- The principle of non-discrimination must be respected at all stages of a social protection programme cycle, including at the design, implementation and monitoring stages. States must ensure that social protection programmes are designed, implemented and monitored in a way that takes into account the experiences of all men and women with disabilities, from the selection of beneficiaries to the delivery of services and benefits. To that end, social prot ection systems must address the structural barriers that persons with disabilities face to participate in society, including lack of accessibility.

- Redistributing care work involves restructuring the design, funding and delivery of care by households, markets, the State and civil society so that a disproportionate burden of unpaid care does not fall on women. - Export processing zones are delineated industrial estates with special incentives set up to attract foreign business and trade. They are feminized work enclaves in which women make up the majority of workers, up to 100 per cent in some cases. Women workers face particularly harsh employment conditions. Normal labour laws are usually not applied. Whether de jure or de facto, there is a lack of union organization and, typically, women's wages are 20-50 per cent lower than men's. Furthermore, these zones are a health hazard for women, with overextended working hours, rights violations relating to pregnancy protection, maternity leave or childcare, and sexual harassment.

- In some countries, legislative provisions strengthen patriarchal family structures, as well as the concomitant discrimination and violence against women. This is particularly true of provisions allowing rapists to marry their victims in order to escape legal proceedings and laws that exclude marital rape from the prohibition of rape under criminal law. In some contexts, only men are able to transmit their nationality to their foreign spouses and their children. This de jure inequality has considerable effects on women and their children because the State protection granted by citizenship is refused them de facto.

- Substantive equality in the area of health and safety requires differential treatment. Throughout their life cycle from childhood to old age, women have health needs and vulnerabilities that are distinctively different from those of men. Women have specific biological functions, are exposed to health problems that affect only women, are victims of pervasive gender-based violence and, statistically speaking, live longer than men, resulting in their greater need to access health services frequently and into older age. Hence, women and girls experience the negative effects of insufficiencies in health-care services more intensively than men.

- The effort to transplant the Western concept of property rights has created a number of problems, however. Unless it is transparent and carefully monitored, the titling process itself may be appropriated by local elites or foreign investors, with the complicity of corrupt officials. In addition, if it is based on the recognition of formal ownership, rather than on land users' rights, the titling process may confirm the unequal distribution of land, resulting in practice in a counter-agrarian reform. In particular, this will be the case in countries in which a small landed elite owns most of the available land, having benefited from the unequal agrarian structure of the colonial era. There is also a risk that titling will favour men. Any measures aimed at improving security of tenure should instead seek to correct existing imbalances, as the Land Management and Administration Project in Cambodia does.

- Such transformative approach is clearly required under human rights law. The Convention on the Elimination of All Forms of Discrimination against Women affirms that "a change in the traditional role of men as well as the role of women in society and in the family is needed to achieve full equality between men and women" (preamble, 14th para). Accordingly, States Parties shall seek, inter alia, to "modify the social and cultural patterns of conduct of men and women", and to promote the "recognition of the common responsibility of men and women in the upbringing and development of their children" (art. 5 (a). In reference to this provision, the Committee on the Elimination of Discrimination against Women has urged States to combat patriarchal attitudes and stereotypes regarding the roles and responsibilities of women and men within the family and society at large (women being considered as having the primary responsibility for child-rearing and domestic tasks, and men being considered the main breadwinners) and to reject the concept that assigns the role of "head of the household" to men.

- Inheritance is often the main avenue for women's land acquisition, yet women are still less likely to inherit land than men. Inheritance is often determined through marriage practices. Through patri-linearism, which is the most common societal system, sons, rather than daughters, inherit land from their fathers. Even where bilateral inheritance practices exist, communities may favor customary patrilineal practices. This is so in the case of the Mossi community in Burkina Faso "where despite the fact that the majority of families are Muslim, meaning that in theory daughters inherit land, this practice is not observed."

- In chapter II, principle 8, of the Programme of Action of the International Conference on Population and Development confirms that States should take all appropriate measures to ensure, on a basis of equality of men and women, universal access to health-care services, including those related to reproductive health care, which includes family planning and sexual health. It also stresses the need for participation and notes that family planning programmes are most successful when women are fully involved in the design, provision, management and evaluation of services. It further adds that Governments should remove all unnecessary legal, medical, clinical and regulatory barriers to information and to access to family-planning services and methods. In paragraph 96, the Beijing Platform for Action declares that the human rights of women include their right to have control over and decide freely and responsibly on matters related to their sexuality, including sexual and reproductive health, free of coercion, discrimination and violence.

- A growing number of States worldwide have confirmed their commitment to comprehensive sexuality education as an essential priority for achieving national development, health and education goals. In its resolution 70/137, the General Assembly called upon all States to develop and implement educational programmes and teaching materials, as well as teacher education and training programmes for both formal and non-formal education, including comprehensive evidence-based education on human sexuality, based on full and accurate information, for all adolescents and youth; to modify the social and cultural patterns of conduct of men and women of all ages; to eliminate prejudices; and to promote and build decision-making, communication and risk reduction skills for the development of respectful relationships based on gender equality and human rights.

- Specific, targeted schemes should ensure that women are empowered and encouraged to participate in this construction of knowledge. Culturally-sensitive participatory initiatives with female project staff and all-female working groups, and an increase in locally-recruited female agricultural extension staff and village motivators facing fewer cultural and language barriers, should counterbalance the greater access that men have to formal sources of agricultural knowledge. It is a source of concern to the Special Rapporteur that, while women face a number of specific obstacles (poor access to capital and land, the double burden of work in their productive and family roles, and low participation in decision-making), gender issues are incorporated into less than 10 per cent of development assistance in agriculture, and women farmers receive only 5 per cent of agricultural extension services worldwide. In principle, agroecology can benefit women most, because it is they who encounter most difficulties in accessing external inputs or subsidies. But their ability to benefit should not be treated as automatic; it requires that affirmative action directed specifically towards women be taken.

- International human rights law places particular emphasis on the responsibility of States to address discrimination against women and girls and ensure that they enjoy their rights on the basis of equality with men and boys. In the context of early child development, policies and programmes must pay particular attention to redressing discrimination and to equality. - In addition to the rights outlined in the International Covenant on Economic, Social and Cultural Rights, article 13 of the Convention on the Elimination of All Forms of Discrimination against Women guarantees women equal rights to participate in recreational activities, sports and all aspects of cultural life, without discrimination. This is reinforced by the obligation under article 10 of the Convention on the Elimination of All Forms of Discrimination against Women to take all appropriate measures to eliminate discrimination against women in respect of education, ensuring to women the same opportunities as to men to participate actively in sports and physical education. Article 5 of the same Convention also requires States to eliminate stereotyped roles for men and women, which equally applies in the field of sport and physical activity.

- In some countries, civil society organizations have established monitoring programmes that document and verify information on attacks against defenders, identifying patterns of violations and abuses. They maintain databases on defenders, monitoring the risks that they face. They make visible the situation of defenders at risk in particular contexts, pressuring States to be accountable for their protection. Gender analysis should be integrated into human rights monitoring programmes, in particular, from the perspective of intersectionality. This would ensure that the specific experiences of women and transgender persons are, along with those of men, understood and incorporated into the design of protection measures.

- The promotion of gender equality is also a critical aspect to be included in disability-inclusive policies. Men and women with disabilities face different forms of exclusion and discrimination throughout their life cycle and expectations relating to their role within the family, school, workplace and the community also differ greatly and vary widely across countries. - In September 1995, at the Fourth World Conference on Women in Beijing, participating Governments adopted the Beijing Declaration, by which they reaffirmed their fundamental commitment to "the equal rights and inherent human dignity of women and men" (para. 8) and stated unequivocally that "women's rights are human rights" (para. 14). They also adopted the Beijing Platform for Action, in which they pledged to ensure equality and non-discrimination under the law and in practice (strategic objective I.1), and, more specifically, to "revoke any remaining laws that discriminate on the basis of sex and remove gender bias in the administration of justice" (para. 232 (d)). In 2000, during the five-year review and appraisal of the implementation of the Beijing Declaration and Platform for Action by the General Assembly at its twenty-third special session, Governments committed to reviewing legislation with a view to striving to remove discriminatory provisions against women, preferably by 2005.

- Special measures, including quotas for women and other temporary measures, as required under article 4, paragraph 1, of the Convention and general recommendations No. 23 (1997) and No. 25 (2004) of the Committee on the Elimination of Discrimination against Women, are necessary to achieve equality between men and women in political and public life, in order to contend with the underlying structural disadvantaging of women. The most significant increase in the numbers of women in national parliaments over the years has occurred in countries where special measures, such as gender quotas, have been effectively constructed and implemented. The use of quotas to advance women's political representation and participation has increased in the past three decades and produced significant results when properly adapted to specific electoral and political systems.

- The Working Group notes the vital importance of article 5 of the Convention on the Elimination of All Forms of Discrimination against Women, which requires States to modify the social and cultural patterns of conduct of men and women, with a view to achieving the elimination of prejudices and customary practices that are based on the idea of the inferiority or the superiority of either of the sexes or on stereotyped roles for men and women. - [The Working Group recommends that States:] Establish a national legal framework recognizing gender equality in cultural and family life, in accordance with regional and international standards: (iii) Develop national strategies to eradicate cultural practices that discriminate against women and girls, as well as gender stereotypes, through awareness-raising campaigns, educational and informational programmes and stakeholder mobilization. Engage men, as appropriate, in prevention and protection efforts in respect of gender-based discrimination and violence;

- The Convention on the Elimination of All Forms of Discrimination against Women imposes on States the obligation to eliminate discrimination against women in all public and private spheres of their lives, including education. Article 5 of the Convention calls on States parties to take all appropriate measures to modify the patterns of conduct of men and women "with a view to achieving the elimination of prejudices and customary and all other practices that are based on the idea of the inferiority or the superiority of either of the sexes or on stereotyped roles for men and women". Comprehensive sexual education is an indispensable means of achieving that goal. Article 10 (h) of the Convention provides that States should ensure women's "access to specific educational information to help to ensure the health and well-being of families, including information and advice on family planning".

- One of the fundamental challenges to achieving change in people's behaviour and attitudes through education is the need to involve families and communities, avoiding the false dichotomy between the family and the State as guarantor of the right to comprehensive sexual education. Studies indicate that in some countries, one third of young women and one fifth of young men aged 15 to 19 say that they have never discussed sexuality-related issues with their parents.56 Thus, both real life and international law provide ample reason to oppose movements that seek to relieve States of their obligation to provide sexual education in the name of alleged and often non-existent family education.
