- Persons with disabilities living in poverty in cities commonly live in informal settlements or homeless encampments. The Special Rapporteur has been shocked by the deplorable conditions endured by persons with disabilities in those contexts. Many, including young children and older persons, are left to languish in isolation, sometimes in dark rooms without electricity, hidden from view at the back of the home, without access to community centres, social opportunities or health clinics.

- According to a study by the International Congress on AIDS in Asia and the Pacific (ICAAP), in East Asia most countries had sexual education policies, and many had had them since the early 1990s. Of the cases studied, the policies most widely implemented were those of Papua New Guinea, Mongolia, the Philippines and Thailand. In addition, since 2009, progress has been made in the implementation of public policies and national laws in several countries. However, although some form of sexual education is provided in the region, most young people do not receive comprehensive sexual education.48

- One of the fundamental challenges to achieving change in people's behaviour and attitudes through education is the need to involve families and communities, avoiding the false dichotomy between the family and the State as guarantor of the right to comprehensive sexual education. Studies indicate that in some countries, one third of young women and one fifth of young men aged 15 to 19 say that they have never discussed sexuality-related issues with their parents.56 Thus, both real life and international law provide ample reason to oppose movements that seek to relieve States of their obligation to provide sexual education in the name of alleged and often non-existent family education.

The recent partnership between The Sphere Project and the Inter-Agency Network for Education in Emergencies (INEE) in preparing the companionship agreement guiding the integration of quality education in humanitarian response represents an important step in the promotion of more coherent and dedicated attention to education within the humanitarian community. Traditionally excluded from humanitarian priorities, the restoration of access to education continues to be cited as a priority by families and young people affected by emergencies. Responding to the needs identified by communities affected is an essential component of humanitarian responses, and central to the implementation of the right to education.

- Thus, justiciability of right to education also has its bases in national legal systems which provide “grounds” for the “right of action”, mentioned above. An example is the Constitution of South Africa, which provides in section 38 (Enforcement of rights) that “Anyone listed in this section has the right to approach a competent court, alleging that a right in the Bill of Rights has been infringed or threatened, and the court may grant appropriate relief, including a declaration of rights.” Fundamental rights in India constitute “basic and essential feature” of the Constitution, and any citizen can directly approach the Supreme Court of India in cases of breach or violation. The Brazilian Association of Judges, Prosecutors and Public Defenders for Children and Youth also has a strong commitment to human rights, in particular the right to quality education and its enforcement.

- The Special Rapporteur emphasizes the need for national-level measures in view of the importance assigned to lifelong learning in the 2030 Agenda for Sustainable Development. Sustainable Development Goal 4 in the 2030 Agenda calls upon Member States to "ensure inclusive and equitable quality education and promote lifelong learning opportunities for all". That Goal includes 10 targets, 3 of which call in part for greater lifelong learning options. States are required, by 2030, to "ensure that all youth and a substantial proportion of adults, both men and women, achieve literacy and numeracy". They must also "substantially increase the number of youth and adults who have relevant skills, including technical and vocational skills, for employment, decent jobs and entrepreneurship". Finally, States are called upon to "ensure that all learners acquire the knowledge and skills needed to promote sustainable development".

- The Special Rapporteur believes that criminalization has adverse consequences on the enjoyment of the right to health of those who engage in consensual same-sex conduct, through the creation of the societal perception that they are "abnormal" and criminals. This has a severe deleterious impact on their self-regard, with significant, and sometimes tragic, consequences on their health-seeking behaviour and mental health. Rates of suicide attempts amongst youth who engage in consensual same-sex conduct have been variously reported as between three and seven times higher than for youth who identify as heterosexual; the rates are similar for adults.

- States that implement and enforce criminal or other laws to restrict access to sexual and reproductive health information actively reduce access to information and therefore do not meet their obligation to respect the right to health. As a consequence of such laws and the stigma they generate, third parties, such as teachers, publishers, or booksellers may also deny women and girls access to necessary sexual and reproductive health materials. The obligation of States to fulfil the right to health requires that they develop strategies to ensure that comprehensive sexual and reproductive health education and information is provided to everyone, especially women and young girls.

- Children are also frequently exposed to junk foods in both public and private settings. Food served or sold in institutional settings such as schools may be disproportionately weighted towards junk foods or other foods of limited nutritional value, particularly in school lunch programmes, where funds for healthier foods may be limited. Other places serving children and youth, such as sports centres, may also lack healthy food options. In the private sector, meals designed for children are often high in fat, sugar and salt, and fail to meet children's nutritional needs, especially at fast food establishments. This may be the case even for foods marketed as "healthy" children's meals. Where genuinely nutritious options are available, the default option may still be the unhealthy one.

- Young children's rights to health and development are intrinsically linked in two main ways. First, poor physical or mental health in early childhood is among several interconnected factors that can limit the right to optimal development. About 200 million children fail to reach their developmental potential because of poverty, inequality and discrimination; poor health; poor nutrition, including malnutrition and iodine and iron deficiency; intrauterine growth restriction; a lack of stable, nurturing and responsive environments with learning opportunities; and a lack of safe, supportive physical environments. HIV/AIDS, malaria, violence and maternal depression also cause severe setbacks.

- The benefits of participation in physical activity and sport and the adoption of healthy lifestyles can be especially pronounced for children. Physically active young people have higher levels of cardiorespiratory fitness, better metabolic profiles, improved bone health and fewer symptoms of anxiety and depression. Accordingly, WHO has recommended that children and adolescents should participate in 60 minutes of cumulative physical activity daily. Among adolescents, there is a correlation between participation in organized sport and an increased likelihood of meeting physical activity targets.

- A human rights approach to effective measurement must involve genuine consultation with stakeholders. For some groups, statistical invisibility or being excluded from a census is experienced as marginalization and likely to lead to neglected needs in programmes and legislation. For other groups, however, such as street-connected young people or irregular migrants, being identified by government authorities may be threatening. Homeless people are best placed to ensure that methods of measurement are accurate and inclusive and at the same time sensitive to their circumstances.

- In this regard, the Special Rapporteur is concerned by recent trends in several countries towards passing legislation that prohibits young people, typically below 18 or 21 years of age, from participating in public assemblies. As these tools are extensively used by youth and student defenders, restrictions are likely to create particular obstacles to their human rights work.

- With reference to article 7 of the Declaration on Human Rights Defenders, which states that "everyone has the right, individually and in association with others, to develop and discuss new human rights ideas and principles and to advocate their acceptance", the Special Rapporteur finds the contributions of youth and student defenders of particular importance. The concept of new human rights ideas and principles must be viewed in relation to the local context of human rights. The history of human rights and particularly recent events show that youth and students have a key role to play in putting new human rights ideas and principles on the national and international agenda and advocating for increased respect for human rights without discrimination.

- There were also two cases reported in which violations concerned psychological integrity. Youth and students allegedly targeted by such violations received threats, including death threats; were subject to harassment by police, security forces and non-State actors; and saw, in some cases, such actions target their family members. Two communications raised issues such as raids and searches of the offices of youth and student organizations, confiscation of computers, paper files and other materials from their offices, as well as surveillance of their homes and/or offices.

- Human rights should be an important component of primary and secondary curricula, and be part of "citizenship" training. Human rights "clubs" have been established in some secondary schools to provide a forum for young people to learn about human rights. Post-secondary institutions, including universities, play an important role in human rights education, including in the training of teachers, research and the dissemination of innovative approaches to defending human rights.

- We recognize that opportunities for decent work for all and job creation can be generated through, inter alia, public and private investments in scientific and technological innovation, public works in restoring, regenerating and conserving natural resources and ecosystems, and social and community services. We are encouraged by government initiatives to create jobs for poor people in restoring and managing natural resources and ecosystems, and we encourage the private sector to contribute to decent work for all and job creation for both women and men, and particularly for young people, including through partnerships with small and medium-sized enterprises and cooperatives. In this regard, we acknowledge the importance of efforts to promote the exchange of information and knowledge on decent work for all and job creation, including green jobs initiatives and related skills, and to facilitate the integration of relevant data into national economic and employment policies.

- The Special Rapporteur would like to point out that implementing all of the above-mentioned measures does not necessarily guarantee that true reconciliation will occur. An essential component of the process also involves shifting attitudes on a personal and societal level, which the Special Rapporteur fully acknowledges is not an easy task. She discusses particular concerns in that regard in the following section. It should also be noted that, in 2014, the Expert Mechanism on the Rights of Indigenous Peoples continued its study entitled "Access to justice in the promotion and protection of the rights of indigenous peoples - restorative justice, indigenous juridical systems and access to justice for indigenous women, children and youth, and persons with disabilities" (see A/HRC/EMRIP/2014/3/Rev.1), including a discussion on restorative justice and provides further comments on the issue.

In all aspects of her work as mandate holder, the independent expert will seek to engage with young people from minorities to learn about their views and ideas and to encourage them to take leadership roles and engage in positive activities to promote inter-cultural dialogue.

- While digital media has provided new spaces for minority groups to participate in the public debate, the accessibility, rapidness and relative anonymity provided by the Internet also provide fertile ground for spreading hateful content. Hate speech on the Internet adopts many forms and is disseminated through different digital platforms - from highly organized hate groups which recruit, radicalize and instruct followers to attack targeted groups; the issuing of "hit lists" containing calls for violence against individuals; "cyberbullying", which targets primarily youth and often originates from racial, ethnic or religious bias; dissemination of propaganda, misinformation and hate spam; exchange of information and ideas via social media networks, discussion groups, listservs and communities of interest.
