The Special Rapporteur's vision of the mandate 2017, para. 45

- The current mandate holder intends to contribute to the development of international standards for the exercise of the rights to freedom of peaceful assembly and of association and to focus on their implementation or lack thereof. To that end, she will strive to ensure that every paragraph in her reports conveys a relevant piece of information for States, civil society organizations and all relevant stakeholders. As mandated by the Human Rights Council in its resolution 15/21 (para. 5 (d)), she will integrate a gender perspective throughout her work.

- Concurrently, the Government maintained a focus on long-term measures to promote gender equality, including the introduction of gender-responsive budgeting, the appointment of gender equality experts within different ministries, the adoption of quotas on the boards of corporations and plans of action for gender equality and violence prevention. The Government also established monitoring mechanisms, such as a gender equality watch and a welfare watch. The welfare watch — which initially operated from 2009 to 2013 under the Ministry of Welfare and a steering committee of experts from Government, labour groups, academia, the financial sector, teachers’ unions, civil society organizations and stakeholders — was in charge of assessing the most pressing welfare issues to be addressed and proposing gender-responsive measures. The model was recognized as innovative and effective.

- One project, aimed at benefiting populations in small towns, supported rehabilitating and expanding piped drinking water systems but built only a handful of public sanitary facilities while training local artisans to produce slabs required for latrines and stimulating a micro savings scheme for residents to purchase those building materials. In that project, support to sanitation was framed through the community-led total sanitation methodology aiming to mobilize communities to completely eliminate open defecation without any external financial input. Thus, it is based on spurring demand creation and behavioural change from users. However, without adequate, continuous guidance and financial assistance, some users may sacrifice essential resources in adopting service levels that are actually unsafe and do not represent a real gain from a human rights perspective.

- In order to institutionalize gender-sensitive teacher training, advocates from civil society organizations convened meetings with government ministries, other such organizations, educators and experts to develop a training module on gender equality and gender violence in partnership with the National Institute of Education, the authority in charge of teacher training. Despite some school directors’ resistance, thousands of social science teachers were trained and the Institute is committed to institutionalizing the training.

- Multi-stakeholder initiatives should map all relevant stakeholders for each specific standard, taking trade unions into special account, and ensure they are actively involved in the determination of criteria and indicators in the standard-setting process and subsequent revisions. They should also ensure that gender considerations are embedded in the standard when specific vulnerabilities based on gender are identified within the industry or workplace affected by the standard. Multi-stakeholder initiatives should consider establishing a capacity-building programme adapted to each audience to equip stakeholders to participate in the standard-setting and standard-revision processes.

- The assurance programme must require that, during auditing exercises or alternative monitoring mechanisms to assess indicators of labour exploitation, sufficient time be allocated for auditors to interview workers, that any necessary interpretation services be provided, that any arrangements necessary to address gender concerns be made, that interviews be held outside the workplace if possible, and that sufficient time be allocated for document review, management interviews, interviews of other relevant stakeholders, such as local trade unions and communities, and report writing.

- Consider ratifying or acceding to, as a matter of particular priority, the Convention on the Elimination of All Forms of Discrimination against Women and the Convention on the Rights of the Child, and the Optional Protocols thereto, limit the extent of any reservations, formulate any such reservations as precisely and as narrowly as possible to ensure that no reservations are incompatible with the object and purpose of the Conventions, review their reservations regularly with a view to withdrawing them, withdraw reservations that are contrary to the object and purpose of the relevant Convention and implement the Conventions fully by, inter alia, putting in place effective national legislation and policies;

- General recommendation No. 35 incorporates the newest developments at the national, regional and international levels and builds upon the growing jurisprudence and work of the Committee, and the work of the Special Rapporteur and other human rights mechanisms. The Special Rapporteur believes that this new instrument will provide in a timely manner additional guidance that is very much needed on steps that should be taken to address gender-based violence in all its forms and to accelerate progress towards its elimination. The mandate holder also welcomes the inclusive participatory process that accompanied the update of general recommendation No. 19.

- The European Union has in place a regulation establishing a financing instrument for democracy and human rights worldwide. The most recent specific policy document on the water and sanitation sector was endorsed in 2002 by the Council of the European Union. It emphasizes the importance of relevant principles and standards related to participation, gender equality, transparency and access to information, financial and environmental sustainability in service provision, affordability, and improving service levels for the poorest populations and rural, urban and peri-urban areas.

- The mandate holder started her tenure on 1 August 2015 and acquired the work carried out by her predecessor on the adequacy of the legal framework on violence against women (A/HRC/26/38, A/69/368 and A/HRC/29/27), in particular, her proposal to “examine the normative gaps within the existing international binding legal frameworks, and address more specifically the legal gaps in protection, prevention and accountability in respect of violence against women”. The current Special Rapporteur presented the report of her predecessor to the General Assembly and decided to continue discussing this question by inviting all stakeholders to send their views and perspectives on the adequacy of the current legal framework on violence against women.

State obligations under the International Covenant on Economic, Social and Cultural Rights in the context of business activities 2017, para. 59

- Following the adoption of the Guiding Principles on Business and Human Rights, many States or regional organizations have adopted action plans on business and human rights. This is a welcome development, particularly if such action plans set specific and concrete targets, allocate responsibilities across actors, and define the time frame and necessary means for their adoption. Action plans on business and human rights should incorporate human rights principles, including effective and meaningful participation, non-discrimination and gender equality, and accountability and transparency. Progress in implementing such action plans should be monitored, and such plans should place equal emphasis on all categories of human rights, including economic, social and cultural rights. As regards the requirement of participation in the design of such plans, the Committee recalls the fundamental role that national human rights institutions and civil society organizations can and should play in achieving the full realization of Covenant rights in the context of business activities.

- The right to health encompasses the underlying determinants of health, including its social and psychosocial determinants. - The successful implementation of climate change policies and projects requires an understanding of the gender-based roles and relationships vis-à-vis natural resources, as well as the gender-differentiated impacts of climate change. The Beijing Declaration in 1995 was the first international declaration to recognize the links between gender equality and climate change. It took a long time for international climate change policy makers to address gender dimensions of climate change. The United Nations Framework Convention on Climate Change (UNFCCC) process referred to gender considerations only in "Reducing Emissions from Deforestation and Forest Degradation" (REDD+) and response measures, with the latter only referring to women as a "vulnerable group". In recent years, progress has been made in integrating gender equality in the COP decisions. It remains uncertain how the gender perspective to climate change policies will be acknowledged in the upcoming document of the climate change agreement.

- The Special Rapporteur notes that UNODC has embarked, as part of its work to build the evidence base, on the strengthening of United Nations data-collection systems, the development of standards for comparative justice statistics and the development of the "global picture" of gender-related killing. She also notes that UNODC has initiated a process to establish a methodological approach to define each crime classification, including interpersonal homicide, and that discussions in that regard already began at the first global meeting of the focal points of the United Nations Survey of Crime Trends, Operations of Criminal Justice Systems and Crime Prevention Strategies, in May 2016.
