The existence of relevant information is a vital precondition for devising adequate policy responses for addressing inequalities and for monitoring the effectiveness of measures to overcome discrimination, both within and between countries, as well as for identifying additional gender-based discrimination. In this context, the Special Rapporteur commends the efforts of the Economic Commission on Latin America and the Caribbean (ECLAC) to "democratize information". With the support of a number of United Nations agencies, donor agencies and private funders, the Commission has established a comprehensive database, which provides sociodemographic data on indigenous peoples and Afro-descendants in the region, including data disaggregated by sex and age, as well as data on internal migration, health, youth and the territorial distribution of inequalities. The basis of much of this impressive work is the inclusion by most countries in Latin America of an "indigenous identifier" into their 2000 census round, thus building data through the self-identification of individuals as being a member of an indigenous community.

Without consideration of these potential barriers, indigenous peoples face violations of due process when they do not understand legal procedures and when courts are inaccessible. Persistent racism, including in the judicial system, is clearly an obstacle to obtaining justice. This is undoubtedly a factor in the concerning overrepresentation of indigenous persons, including women and young people, in jail. Aggressive litigation, particularly by private parties who seek access to indigenous lands and resources, can be used as a way to hinder effective justice or remedy.

[Despite the significant constraints facing them, there are many instances where indigenous women having successfully mobilized to fight for their rights. Those successes have led to the development of promising practices in relation to the respect and protection of indigenous women. The following examples of good practice are illustrative and not exhaustive:] As observed by the Special Rapporteur on violence against women, its causes and consequences, the tribal justice system of the Eastern Band of Cherokee Indians in the United States has an effective infrastructure to provide safety of women within their jurisdiction, including dedicated codes to address domestic violence and training for personnel of tribal law enforcement authorities, tribal courts, prosecutors and probation officers. Furthermore, tribal courts have ordered that offenders enrol in re-education programmes and tribes support programmes to encourage boys and young men to respect women;

The Special Rapporteur would like to point out that implementing all of the above-mentioned measures does not necessarily guarantee that true reconciliation will occur. An essential component of the process also involves shifting attitudes on a personal and societal level, which the Special Rapporteur fully acknowledges is not an easy task. She discusses particular concerns in that regard in the following section. It should also be noted that, in 2014, the Expert Mechanism on the Rights of Indigenous Peoples continued its study entitled "Access to justice in the promotion and protection of the rights of indigenous peoples - restorative justice, indigenous juridical systems and access to justice for indigenous women, children and youth, and persons with disabilities" (see A/HRC/EMRIP/2014/3/Rev.1), including a discussion on restorative justice and provides further comments on the issue.

We reaffirm our commitments to the right to education, and in this regard we commit to strengthen international cooperation to achieve universal access to primary education, particularly for developing countries. We recognize that opportunities for decent work for all and job creation can be generated through, inter alia, public and private investments in scientific and technological innovation, public works in restoring, regenerating and conserving natural resources and ecosystems, and social and community services. We are encouraged by government initiatives to create jobs for poor people in restoring and managing natural resources and ecosystems, and we encourage the private sector to contribute to decent work for all and job creation for both women and men, and particularly for young people, including through partnerships with small and medium-sized enterprises and cooperatives. We recognize that workers should have access to education, skills, health care, social security, fundamental rights at work, social and legal protections, including occupational safety and health, and decent work opportunities. Governments, trade unions, workers and employers all have a role to play in promoting decent work for all, and all should help young people to gain access to needed skills and employment opportunities, including in new and emerging sectors. Women and men should have equal access to opportunities to acquire job skills, as well as to worker protections. We recognize the importance of a just transition, including programmes to help workers to adjust to changing labour market conditions.

We commit to promote an integrated approach to planning and building sustainable cities and urban settlements, including by supporting local authorities, increasing public awareness and enhancing participation of urban residents, including the poor, in decision-making. We also commit to promote sustainable development policies that support inclusive housing and social services; a safe and healthy living environment for all, particularly children, youth, women and the elderly and disabled; affordable and sustainable transport and energy; the promotion, protection and restoration of safe and green urban spaces; safe and clean drinking water and sanitation; healthy air quality; the generation of decent jobs; and improved urban planning and slum upgrading. We further support the sustainable management of waste through the application of the 3Rs (reduce, reuse and recycle). We underline the importance of considering disaster risk reduction, resilience and climate risks in urban planning. We recognize the efforts of cities to balance development with rural regions.

We underscore that broad public participation and access to information and judicial and administrative proceedings are essential to the promotion of sustainable development. Sustainable development requires the meaningful involvement and active participation of regional, national and subnational legislatures and judiciaries, and all major groups: women, children and youth, indigenous peoples, non governmental organizations, local authorities, workers and trade unions, business and industry, the scientific and technological community, and farmers, as well as other stakeholders, including local communities, volunteer groups and foundations, migrants and families, as well as older persons and persons with disabilities. The Declaration affirms in its article 3 the right of indigenous peoples to self determination in a way that is deemed compatible with the principle of territorial integrity and political unity of States. On these grounds, the Declaration provides a detailed list of rights that constitute "the minimum standards for the survival, dignity and well-being of indigenous peoples of the world" (art. 43). The Declaration reaffirms basic individual rights to equality and non-discrimination, life and personal integrity and freedom, nationality and access to justice; and it calls for special attention to specific rights and needs of indigenous elders, women, youth, children and persons with disabilities.
