- However, opportunities for IDW to participate actively in decision-making processes remain particularly limited. For example, IDW have rarely played an active role in developing, implementing and monitoring national action plans on Security Council resolution 1325 (2000), although IDW in a diverse range of contexts have demonstrated their ability and determination to play leading roles in developing and implementing policies and programmes concerning them. Unfortunately, the participatory approaches used to identify protection gaps of concern to IDW often do not extend to ensuring that they have an active say in the development, implementation and evaluation of responses to these gaps. IDW should therefore be given the opportunity to actively participate in peace processes; in negotiating durable solutions and the planning process for returns, reintegration or resettlement; and in post-conflict reconstruction and rebuilding. Participation of women in humanitarian planning should further reflect the diversity of the population and seek to include adolescent girls, youth and those with disabilities.

- General Comment No. 14 places emphasis on access to information because it is a critical component of the right to health (ibid; footnote 8), and particularly guarantees access to sexual and reproductive health information. States are additionally required to provide adequate resources and refrain "from censoring, withholding or intentionally misrepresenting health-related information, including sexual education and information (see E/C.12/2000/14, para. 14)". The Committee on the Elimination of Discrimination against Women has recommended that a comprehensive understanding of the content of sexual and reproductive education encompass the topics of reproductive rights, responsible sexual behaviour, sexual and reproductive health, prevention of sexually transmitted infections including HIV/AIDS, prevention of teenage pregnancies, and family planning, and stressed that education campaigns are urgently needed to combat harmful practices such as female genital mutilation. Comprehensive education and information on sexual and reproductive health is also useful in reducing knowledge gaps between men and women on these issues.

- Over the years, classifications of different profiles have been made to facilitate the development of appropriate interventions. A distinction was therefore made between "situational" and "preferential" child sex tourists. The situational sex tourist was described as not travelling with the intention of being a sex tourist, who is tempted by an opportunity to have sex with children in a country, not usually having a preference for children, abusing children who are pre-pubescent or not, driven by the search for new experiences and justifying their acts on the basis of cultural or economic grounds. The preferential sex tourist travels specifically with the aim of abusing children, can experience sexual attraction for adults, but tends to search for pubescent or adolescent children. In addition, the paedophile, usually considered as someone suffering from a clinical disorder, with an exclusive inclination for pre-pubescent children, who may not show any preference for the gender of the child and may not view sexual contact with children as harmful. In contrast to the situational offender, they are notorious reoffenders, seeking out vulnerable children.

- The first step is to ensure that legislation properly reflects the definitions formulated in international standards, including their child-specific aspects. The legal framework must incorporate all relevant provisions under civil, criminal and administrative law in order to guarantee that offenders are punished and victims adequately protected. Provisions in relation to the age of the victim need to ensure that children, including adolescents, enjoy appropriate protection. International instruments provide crucial guidance on the legislative measures to be adopted to address the sale and exploitation of children. The Optional Protocol on the sale of children, child prostitution and child pornography obliges States parties to ensure that, as a minimum, the list of offences contained in the Protocol are fully covered under domestic criminal law. The Optional Protocol also requires extraterritorial jurisdiction to address such crimes. It further requires the prohibition of the production and dissemination of material advertising the offences. It provides for the rights of victims to assistance, redress and compensation.

- The synthesis report recognizes increasingly negative displacement trends. In the section on "dignity" it states that no society can reach its full potential if whole segments of that society are excluded from participating in, contributing to, and benefiting from development. It notes that the agenda "must not exclude migrants, refugees, displaced persons, or persons affected by conflict and occupation". The chapter entitled "A synthesis" states that particular attention should be given to countries in situations of fragility and conflict and the specific conditions of each country should be addressed. There is a consistent call to "leave no one behind" and ensure equality, non-discrimination, equity and inclusion. The report states: "We must pay special attention to the people, groups and countries most in need. We need to include the poor, children, adolescents, youth and the aged, as well as the unemployed, rural populations, slum dwellers, persons with disabilities, indigenous peoples, migrants, refugees and displaced persons, vulnerable groups and minorities. These also include those affected by climate change."

- Other laws restricting access to family planning and contraception include a city-wide de facto ban on so-called "artificial" contraception in one jurisdiction, which created significant difficulty for women in accessing reliable forms of birth control (see A/HRC/14/20/Add.1). A total of 70 per cent of the affected population, a majority of whom were poor and marginalized, depended on Government providers for services including female sterilization, oral pills, intrauterine devices and injectables (ibid.). The ban resulted in the absolute deprivation of access to family planning services and contraception for many women and men. In other instances, States require women to obtain their husband's consent and adolescents to obtain parental consent before acquiring various forms of contraception. Other jurisdictions allow pharmacists, and in some cases pharmacies, to refuse to dispense emergency contraception, which is otherwise legally available. These laws directly infringe upon the right of women and girls to make free and informed choices about their sexual and reproductive health and reflect discriminatory notions of women's roles in the family and society.

- In addition, it is reported that initiatives to intercept potential victims of trafficking at borders are often misguided and abusive, amounting to a violation of their freedom of movement and stigmatization of the intercepted persons in some cases. For example, girls who were intercepted at the border between Nepal and India were stigmatized upon their return to their communities because the organizations carrying out the interception were known to be involved in anti prostitution work and the girls were thus suspected of having been involved in prostitution. By the same token, some communities have established a community-level vigilance or surveillance committee to prevent trafficking in persons, particularly children. However, evidence suggests that the committees often failed to distinguish between trafficked children and other children leaving their homes to earn money elsewhere, with the result that even adolescents were stopped from migrating from extremely poor villages to seek work in other towns. Destination countries also exercise restrictive immigration control purportedly to prevent potential cases of trafficking. For example, it has been reported that many Brazilian women have been repeatedly denied entry to European Union member States because they looked like prostitutes and thus were suspected to be victims of trafficking.

- In all his endeavours, the Special Rapporteur will promote adherence to, and ratification of, core relevant human rights treaties. At the same time, the Special Rapporteur will also promote so-called soft-law standards such as, but not limited to, the Nelson Mandela Rules, the Body of Principles for the Protection of all Persons under Any Form of Detention or Imprisonment, the Bangkok Rules, the United Nations Standard Minimum Rules for the Administration of Juvenile Justice (Beijing Rules), the United Nations Rules for the Protection of Juveniles Deprived of their Liberty, the Code of Conduct for Law Enforcement Officials, the Basic Principles on the Use of Force and Firearms by Law Enforcement Officials and other relevant instruments. Ultimately, the Special Rapporteur will prioritize results-based pragmatism rather than formalism without, however, compromising on applicable norms, terms and standards. Therefore, the primary focus of the Special Rapporteur will not necessarily be to achieve universal ratification of relevant treaties, but rather to advocate for the implementation, in actual practice, of norms, procedures and mechanisms for the effective prevention of torture or other cruel, inhuman or degrading treatment or punishment.

- The death penalty cannot be applied for crimes committed by persons under 18 years of age. In Michael Domingues v. United States (2002), the Inter-American Commission canvassed international legal and political developments and State practice concerning the execution of juveniles and reached the conclusion that the state of international law had evolved so as to prohibit, as a jus cogens norm, the execution of persons who were under 18 years of age at the time of committal of their crimes. This is in line with the jurisprudence of the Human Rights Committee. In Roper v. Simmons (2005), the United States Supreme Court held that under the evolving standards of decency test, it was cruel and unusual punishment to execute a person who was under the age of 18 years at the time of the murder. Remarkably, in January 2012, the Government of the Islamic Republic of Iran, one of the most persistent retentionist countries, adopted the Islamic Penal Code which established new measures to limit the sentencing to death of juveniles (A/HRC/21/29 and Corr.1, para. 8). The abolition of the death penalty for juveniles is based on the fact that their limited capacity has a direct impact on their effectively benefiting from the right to a fair trial and that it is inherently cruel to execute children and would therefore amount to a violation of the prohibition of torture and cruel, inhuman and degrading treatment.

- With respect to juveniles, the Declaration of the Rights of the Child and the Preamble of the Convention on the Rights of the Child state that, given their physical and mental immaturity, juveniles need special safeguards and care, including appropriate legal protection. Article 19 of the Convention on the Rights of the Child (General Assembly resolution 44/25) requires States Parties to "take all appropriate legislative, administrative, social and educational measures to protect the child from all forms of physical or mental violence …" In its General Comment No. 8, the Committee on the Rights of the Child indicated that "There is no ambiguity: 'all forms of physical or mental violence' does not leave room for any level of legalized violence against children" (CRC/C/GC/8, para. 18). Paragraph 67 of the United Nations Rules for the Protection of Juveniles Deprived of their Liberty, adopted by the General Assembly in resolution 45/113 of 14 December 1990, states that "All disciplinary measures constituting cruel, inhuman or degrading treatment shall be strictly prohibited, including ... solitary confinement or any other punishment that may compromise the physical or mental health of the juvenile concerned" (see also CRC/C/GC/10, para. 89). Thus the Special Rapporteur holds the view that the imposition of solitary confinement, of any duration, on juveniles is cruel, inhuman or degrading treatment and violates article 7 of the International Covenant on Civil and Political Rights and article 16 of the Convention against Torture.

Provisions such as residency restrictions are particular controversial and have not proved to prevent offending. - Prevention is widely recognized as a priority concern and critical dimension of the fight against the sale of children, child prostitution and child pornography. In the child rights framework, prevention lies at the core of child protection. Articles 34 and 35 of the Convention on the Rights of the Child expressly concentrate on the obligation of States to take preventive measures to protect children from sexual abuse and exploitation, and from the sale of and trafficking in children. The Optional Protocol to the Convention on the Rights of the Child on the sale of children, child prostitution and child pornography contains a set of detailed measures State parties are required to adopt for prevention. In his 2006 report (A/61/299), the independent expert for the United Nations study on violence against children emphasized that all violence is preventable and called for prioritizing prevention. The 2008 Rio de Janeiro Declaration and Call for Action to Prevent and Stop Sexual Exploitation of Children and Adolescents also underscores the importance of prevention. - Important international and regional human rights standards provide a sound framework for the development of strong, safe and effective counselling, reporting and complaint mechanisms to address incidents of violence against children. As agreed upon at the Third World Congress against Sexual Exploitation of Children and Adolescents, these mechanisms should be set up in all countries by 2013.

- In some counties, legislation recognizes a broad general right of children to lodge complaints before public authorities. The effectiveness of such legislation is closely associated with children's access to information on their right to access justice and to complain before a judicial or non-judicial mechanism. The Costa Rican Children's and Adolescents' Code, for example, provides that: "Persons under the age of majority shall have the right to seek shelter, help and advice when a threat to their rights entails a serious risk to their physical or spiritual health; and to receive timely assistance and protection from the competent authorities." The Paraguayan Children's and Adolescents' Code recognizes the right of children to personally request any public body or official to take action that is within their mandate or competence, and to receive a timely reply. In Romania, Law No. 272/2004 on the protection and promotion of the rights of the child recognizes the child's right to personally make complaints regarding violations of his or her fundamental rights. In Spain, the law recognizes children's right to receive from the public authorities adequate assistance in guaranteeing respect for their rights, including the right to request protection or support from any public institution and to make complaints regarding violations of their rights to the public prosecutor or the Ombudsman.

- Around the world, adolescent substance abuse is a growing and alarming phenomenon. The rising - and disturbing - number of adolescents addicted to all types of drugs (including solvents, psychotropic substances, cannabis, heroin, cocaine, crack, Methylenedioxymethamphetamine (MDMA or ecstasy)) and/or to alcohol, forces a large number of them to turn to prostitution to obtain the money to supply their habits.
