(a) To ensure full respect for the rights to freedom of assembly, opinion and expression and for the right to take part in the conduct of public affairs, in accordance with its obligations under the International Covenant on Civil and Political Rights, and, in particular, to end the harassment, intimidation and persecution of political opponents and human rights defenders, including by releasing persons imprisoned arbitrarily or on the basis of their political views; and to increase actions to promote and facilitate human rights education at all levels and to ensure that all those responsible for training lawyers, law enforcement officers, the personnel of the armed forces and public officials include appropriate elements of human rights teaching in their training programme;

In April 2014, the International Federation of Journalists adopted the "Brussels Declaration" to combat incitement to hate and violence through media. The Declaration made recommendations to journalists and their unions aimed at upholding the principles and ethics of responsible journalism, including denouncing incitement to hatred whenever identified, ensuring knowledge of codes and guidelines by media workers, promoting education and training of journalists as well as encouraging diversity in media outlets.

In all educational sectors, successful human rights education bridges the gap between the knowing and the doing. Innovative pedagogies, such as role-based simulations, mock report writing and field placements, help to fill this gap and to equip future defenders with the knowledge and skills that their future practice will require. Successful education and training are often rooted in cooperation between educational institutions on the one hand and defenders on the other. Bringing defenders "into the classroom" can be a rewarding experience for both.

Human rights education is a long-standing tactic of the human rights movement and should be directed at various audiences, including State officials, professional groups, students and the general public. Rights education can lead not only to a better understanding of a State's human rights obligations, but can also serve as a vehicle for understanding "the relationships that undergird the discourses and actions of human rights violators, human rights protectors, and human rights victims." It can also provide other concrete dividends; for example, training medical staff in human rights could facilitate the collection and presentation of forensic evidence in the prosecution of perpetrators of violence against defenders.

Environmental education is, laudably, becoming widespread, as expressed both in formal curricula in educational institutions and in public education campaigns. Such education initiatives should recognize the crucial role played by environmental human rights defenders in environmental protection. Building public support for defenders through education serves important preventive and protective functions. Human rights education must also be available for government officials, journalists and others working on environmental and development issues. The Special Rapporteur encourages initiatives such as the Global Action Programme on Education for Sustainable Development of the United Nations Educational, Scientific and Cultural Organization and supports the call by UNESCO for inclusive, empowering education about the environment, engaging civil society and local communities as active participants.

Nevertheless, in very many countries, defending and promoting human rights remain an extraordinarily dangerous activity. Nevertheless, that activity is a universally recognized right that all actors are duty-bound to protect as a routine fact of life. The consultations showed the importance of a human rights education for ensuring that society as a whole recognizes the role and contribution of actions undertaken by teachers, lawyers, journalists, employees of nongovernmental organizations, and ordinary citizens. We need not just to recall the commitment of all the actors involved, but also ensure that such decisions are followed by concrete steps to enable defenders, with peace of mind, to go about promoting and protecting the human rights and freedoms that every society needs.

The Special Rapporteur concurs with the view that, in countries where human rights are specifically recognized and protected in domestic law, those rights are more likely to be respected and realized in practice. Beyond their normative value, she further believes that human rights laws can have an important educational role in that such laws signal the values for which a particular society stands. The adoption of laws that explicitly guarantee the rights contained in the Declaration on Human Rights Defenders is crucial in that it could contribute to building an enabling environment and give these rights legitimacy. Furthermore, such laws could contribute to building wider societal support for the demand of fulfilling these rights.

In addition to, and as a complement to, ensuring a conducive normative and administrative framework, States should disseminate the Declaration widely. In line with article 13 of the Declaration, human rights educational programmes, especially those addressed to law enforcement and public officials, should include modules based on the text that reaffirm the basic right to defend human rights and the role that human rights defenders play in society. Enabling human rights defenders' work also involves periodically recognizing and informing populations about the rights and responsibilities of all individuals to promote and protect human rights.

In her report to the General Assembly in 2007 (A/62/225), the former Special Representative addressed the situation of student activists in the context of the right to freedom of assembly. She noted a trend of acts of repression and retaliation against student activists engaged in protests and expressed particular concern about the brutality of the violations against this group, which in many cases amounted to torture. The young age of the students adds to the severity of the violations suffered and leaves them particularly vulnerable. Noting the high educational value of student protests as a first experience of public participation and defence of human rights, the Special Representative argued that "ensuring a conducive environment for student protests is a social investment in addition to a legal obligation" (paras. 70 and 101 (b)).

The role of human rights defenders in disseminating information about sexual and reproductive rights, whether as part of State institutions set up for this purpose, through non-governmental organizations or through the formal education system, needs to be clearly defined in legislation relating to public morals to ensure that such activities are not criminalized. Defenders who provide evidence-based sexual and reproductive health information and education should in no circumstances face criminal sanctions, in line with article 6 (b) of the Declaration on Human Rights Defenders (see also A/66/254, para. 65).

In the Republic of Korea, high school students have promoted a major social mobilization against authoritarian practices within the education system. As a result of the public debate generated by the students, in January 2012, the Seoul Metropolitan Council adopted a students' rights ordinance ensuring, inter alia, the right of students to protest, a ban on corporal punishment, the elimination of mandatory participation in religious activities and the protection of lesbian, gay, bisexual and transgender students and pregnant students against discrimination. Action for Youth Rights of Korea, an association established by Korean students in the context of this mobilization, continues to promote student activism.
