- [At the outset, the Committee wishes to underscore that CRC requires States parties to develop and implement a comprehensive juvenile justice policy. This comprehensive approach should not be limited to the implementation of the specific provisions contained in articles 37 and 40 of CRC, but should also take into account the general principles enshrined in articles 2, 3, 6 and 12, and in all other relevant articles of CRC, such as articles 4 and 39. Therefore, the objectives of this general comment are:] To promote the integration, in a national and comprehensive juvenile justice policy, of other international standards, in particular, the United Nations Standard Minimum Rules for the Administration of Juvenile Justice (the "Beijing Rules"), the United Nations Rules for the Protection of Juveniles Deprived of their Liberty (the "Havana Rules"), and the United Nations Guidelines for the Prevention of Juvenile Delinquency (the "Riyadh Guidelines").

- Article 20 (2) provides for restrictions with respect to hateful advocacy that amounts to incitement to hostility, discrimination or violence; it does not permit restrictions merely on the basis of "incompatibility" with a particular faith's values, nor does it (or article 19) permit restrictions that amount to blasphemy as such. Nonetheless, Maldives enacted a law in 2016 that criminalizes speech not expressed in accordance with social norms, national security and Islam. Singapore noted that a teenager was convicted under national legislation "for posting a video containing remarks against Christianity with deliberate intent to wound the religious feelings of Christians". While "wounding religious feelings" may involve real emotional costs, such charges have no basis under international human rights law and limit without justification the sharing of information and ideas pertaining to religion and belief.

- Adequate measures to address HIV/AIDS can be undertaken only if the rights of children and adolescents are fully respected. The most relevant rights in this regard, in addition to those enumerated in paragraph 5 above, are the following: the right to access information and material aimed at the promotion of their social, spiritual and moral well being and physical and mental health (art. 17); the right to preventive health care, sex education and family planning education and services (art. 24 (f)); the right to an appropriate standard of living (art. 27); the right to privacy (art. 16); the right not to be separated from parents (art. 9); the right to be protected from violence (art. 19); the right to special protection and assistance by the State (art. 20); the rights of children with disabilities (art. 23); the right to health (art. 24); the right to social security, including social insurance (art. 26); the right to education and leisure (arts. 28 and 31); the right to be protected from economic and sexual exploitation and abuse, and from illicit use of narcotic drugs (arts. 32, 33, 34 and 36); the right to be protected from abduction, sale and trafficking as well as torture or other cruel, inhuman or degrading treatment or punishment (arts. 35 and 37); and the right to physical and psychological recovery and social reintegration (art. 39). Children are confronted with serious challenges to the above-mentioned rights as a result of the epidemic. The Convention, and in particular the four general principles with their comprehensive approach, provide a powerful framework for efforts to reduce the negative impact of the pandemic on the lives of children. The holistic rights-based approach required to implement the Convention is the optimal tool for addressing the broader range of issues that relate to prevention, treatment and care efforts.

- Children have the right not to have their lives arbitrarily taken, as well as to benefit from economic and social policies that will allow them to survive into adulthood and develop in the broadest sense of the word. State obligation to realize the right to life, survival and development also highlights the need to give careful attention to sexuality as well as to the behaviours and lifestyles of children, even if they do not conform with what society determines to be acceptable under prevailing cultural norms for a particular age group. In this regard, the female child is often subject to harmful traditional practices, such as early and/or forced marriage, which violate her rights and make her more vulnerable to HIV infection, including because such practices often interrupt access to education and information. Effective prevention programmes are only those that acknowledge the realities of the lives of adolescents, while addressing sexuality by ensuring equal access to appropriate information, life skills, and to preventive measures.

- In some counties, legislation recognizes a broad general right of children to lodge complaints before public authorities. The effectiveness of such legislation is closely associated with children's access to information on their right to access justice and to complain before a judicial or non-judicial mechanism. The Costa Rican Children's and Adolescents' Code, for example, provides that: "Persons under the age of majority shall have the right to seek shelter, help and advice when a threat to their rights entails a serious risk to their physical or spiritual health; and to receive timely assistance and protection from the competent authorities." The Paraguayan Children's and Adolescents' Code recognizes the right of children to personally request any public body or official to take action that is within their mandate or competence, and to receive a timely reply. In Romania, Law No. 272/2004 on the protection and promotion of the rights of the child recognizes the child's right to personally make complaints regarding violations of his or her fundamental rights. In Spain, the law recognizes children's right to receive from the public authorities adequate assistance in guaranteeing respect for their rights, including the right to request protection or support from any public institution and to make complaints regarding violations of their rights to the public prosecutor or the Ombudsman.

- Similarly, the International Covenant on Economic, Social and Cultural Rights also provides for a broader range of rights, including the right to strike, the right to freely enter marriage, the right to maternity protection, the right to special protection of children and adolescents, the right to an adequate standard of living including adequate food and clothing, and certain cultural rights. The Convention does not provide for such rights only in relation to migrant workers in a regular situation. In addition, the Covenant recognizes the rights to work, to vocational guidance and training, to form trade unions, to protection of the family, to housing, and to participate in cultural life. The Convention recognizes these rights in relation to migrant workers in a regular situation and members of their families. In addition, most of the economic, social and cultural rights in Part III of the Convention have a narrower scope than their counterparts in the Covenant.

- In its general comment No. 4, the Committee on the Rights of the Child strongly urges States parties to develop and implement legislation aimed at changing prevailing attitudes, and address gender roles and stereotypes that contribute to harmful traditional practices. It also calls upon States parties to protect adolescents from all harmful traditional practices, such as early marriage, and recommends that they review and, where necessary, reform their legislation and practice to increase the minimum age for marriage with and without parental consent to 18 years, for both girls and boys.

- The situation of those children remains hidden and surrounded by stigma, and is seldom envisaged as a priority in the policy agenda. There is scarce information on the numbers of children deprived of liberty and on the reasons that lead to their placement in justice and care institutions; independent monitoring mechanisms are rarely available to safeguard their rights and address their complaints; and sensationalistic information, combined with ill perception of growing juvenile delinquency, fuel social pressure for the criminalization of children and adolescents, and for the introduction of increasingly lower ages of criminal responsibility and longer measures of deprivation of liberty. This is a pattern that helps to create a culture of tolerance of violence against children, and which often contributes to the stigmatization of children belonging to poor and disadvantaged groups.

- Research on gangs in Honduras has shed some light on factors that lead adolescents to join or leave a gang. Joining a gang is more likely for a young person whose parents are absent for economic reasons, including as a result of migration, and for whom no other authority figure has stepped in. In one group studied, gang members who had lost their parents saw the gang as a replacement family. In another group, gang members were far more driven by financial reasons, regarding the leader as the boss of the business. Overall, the most common reasons for leaving the gang were the birth of a first child, concern about damage being caused to family members, the opportunity to move to a different neighbourhood, commitment to the community and having a spiritual experience.

- The right of the child to have his or her best interests taken into account as a primary consideration is a substantive right, an interpretative legal principle and a rule of procedure, and it applies to children both as individuals and as a group. All measures of implementation of the Convention, including legislation, policies, economic and social planning, decision-making and budgetary decisions, should follow procedures that ensure that the best interests of the child, including adolescents, are taken as a primary consideration in all actions concerning them. In the light of its general comment No. 14 (2013) on the right of the child to have his or her best interests taken as a primary consideration, the Committee stresses that, when determining best interests, the child's views should be taken into account, consistent with their evolving capacities and taking into consideration the child's characteristics. States parties need to ensure that appropriate weight is afforded to the views of adolescents as they acquire understanding and maturity.

- [In accordance with general comments No. 5 (2003) on general measures of implementation of the Convention (arts. 4, 42 and 44, para. 6) and No. 19 (2016) on public budgeting for the realization of children's rights (art. 4), the Committee draws attention to States parties' obligations to implement the following measures to establish the framework for the realization of the rights of children during adolescence. The experience and perspectives of adolescents themselves should be fully recognized and taken seriously in the development of all such measures, including:] Monitoring implementation to ensure that the rights of adolescents are respected in legislation, policy and services;
