- The Special Rapporteur considers the global compact for safe, orderly and regular migration, which is to be presented for adoption in 2018, as the beginning of a long-term, 15-year agenda, complementary to the 2030 Agenda for Sustainable Development and aimed primarily at implementing targets 10.7 and 8.8 of the Sustainable Development Goals. The objective is to provide States with short-, medium- and long-term achievable goals and targets aimed at facilitating migration and mobility and protecting the human and labour rights of migrants, as requested in the 2030 Agenda.

- States should make a genuine commitment to the standard of leaving no one behind by collecting disaggregated data. To monitor the implementation of the Sustainable Development Goals, it will be important to improve the availability of, and access to, data and statistics disaggregated by income, gender, age, race, ethnicity, migratory status, disability, geographic location and other characteristics relevant in national contexts to support the monitoring of the implementation of the Goals. The goal indicators should include the use of data from the existing mechanisms for monitoring compliance with human rights standards, especially the universal periodic review mechanism of the Human Rights Council and reviews of compliance with the International Convention on the Elimination of All Forms of Racial Discrimination.

- Confronted by the reality of record numbers of internally displaced persons, it is vital for the international community to maintain and intensify its generous efforts to meet the needs and protect the rights of internally displaced persons and to begin to reverse the global trends. The vision laid out at the World Humanitarian Summit for new approaches to humanitarian action is welcome and provides a positive direction of travel that stakeholders should adopt. The focus on internally displaced persons is necessary and timely, and a global target to reduce internal displacement by 50 per cent by 2030 in a safe and dignified manner provides an ambitious yet necessary stimulus. Moving from principles to action will be a difficult task ahead in order to meet this goal. This must be achieved in compliance with human rights law and through the implementation of international standards for the protection of internally displaced persons and the achievement of durable solutions.

- The Special Rapporteur will continue to address the most critical situations regarding the internal displacement of persons, in all regions, and to promote durable solutions and advocate for the adoption of regional and national normative frameworks. In addition, she will bring new attention to other important internal displacement issues, including: strengthening the participation of internally displaced persons in responses to internal displacement; ensuring the inclusion of internally displaced persons in transitional justice processes; improving the protection of internally displaced children; enhancing the role of national human rights institutions in the protection of internally displaced persons; and providing increased attention to neglected drivers of internal displacement, including development-induced displacement and displacement as a result of generalized violence.

- The long-term strategy would start in 2020, which could be designated as the “International year for safe, orderly and regular migration for all”. The strategy could be called the “2035 agenda for facilitating human mobility”. The Special Rapporteur recommends the adoption of eight practical and achievable goals, with appropriate targets and indicators, as his contribution to the 2035 agenda. He acknowledges that these goals and targets could be further refined and must be developed in full recognition of the challenges that States are facing in their endeavour to establish a global framework for rights-based global migration governance.

- Migration is here to stay. The inclusion of migration in the Sustainable Development Goals demonstrated the importance of migration today and the commitment of States to addressing it. The unprecedented number of undocumented cross-border movements has resulted in increased deaths, violence and suffering at borders and at every stage of the migratory process over the past few years. Such events have clearly shown that the status quo in the approaches of States to border control and migration is not sustainable if the objective is to reduce suffering and deaths. They have also underlined the increasing importance of migration. In the high-level plenary meeting on addressing large movements of refugees and migrants and its outcome document, the New York Declaration, migration was firmly established as a priority issue within the United Nations system, and the need of States to commit to the protection of the human rights of migrants and improved global migration governance was acknowledged.

- The Special Rapporteur is of the firm view that there is no better deterrent to torture than a strong national will to combat and prevent such abhorrent abuse. In addition to visiting places of detention, therefore, the Special Rapporteur will use the opportunity of fact-finding visits to encourage States to take effective legislative, administrative and judicial measures to prevent torture. - Multi-stakeholder initiatives should define indicators to assess the risk level of clients and determine the intensity and frequency of audits. Such indicators should take into account elements such as State ratification and enforcement of relevant international conventions on human rights and labour standards; the existence of regulatory regimes that regulate recruitment activities in accordance with international standards and guidelines; the level of informality within the economic sector in which the client operates; the percentage of vulnerable groups in the client’s workforce, including the number of migrant, temporary, seasonal, contractual or home-based workers; the level of complexity of the client’s labour supply chains; and client’s previous record on these issues.

- Companies should establish a remediation plan in cooperation with the supplier and local and national authorities when a case of trafficking in persons is detected, in order to ensure that workers have effective access to remedies, including compensation, and to appropriate assistance. Any measure adopted should have a human rights-centred approach and be based on the rights of the trafficked person, whose participation in the determination of a solution for their case should be ensured throughout the process. Companies should ensure that, with regard to access to the grievance mechanism and the remediation plan, they consider the specific barriers faced by, and the vulnerabilities of, migrant workers, contract workers, young people and women.

- The work of the mandate of the Special Rapporteur and her engagement with national governments will be stepped up to assist States and other stakeholders in their efforts to meet their obligations towards internally displaced persons. As the international community brings its attention much more to large-scale movements of people across international borders, through the development of global compacts on safe, orderly and regular migration and on refugees, the Special Rapporteur urges enhanced attention to the situation of internally displaced persons, recognizing that many who have crossed international borders as refugees or undocumented or trafficked migrants have initially been internally displaced in their own countries. Many have not been provided with the necessary protection and support allowing them to remain in their own countries if they so wish.

- The Special Rapporteur recommends a consultative process led by the United Nations to further develop goals and targets. Such a process would include the participation of experts, the business community, civil society organizations and migrants themselves. It would build upon the principles and guidelines, supported by practical guidance, on the human rights protection of migrants in vulnerable situations within large and/or mixed movements developed by the Global Migration Group. The guidance could form an important starting point for the development of goals and targets, given that it is derived from existing obligations under international law and is aimed at assisting States and other stakeholders with regard to the refinement, strengthening, implementation and monitoring of measures to protect migrants in vulnerable situations.

- As those with primary responsibility, States affected by internal displacement must recognize and better adhere to their commitments under international human rights and humanitarian law and standards, firstly to prevent internal displacement, and to respond better when displacement occurs. Where possible, shifting the focus back towards the primary responsibility of States at all phases of displacement is necessary and will allow international humanitarian partners to more rapidly move on from protracted humanitarian assistance programmes. This will allow them to focus on new, critical displacement situations in which States are unable to respond effectively, as well to undertake more strategic resilience-building and recovery activities alongside development partners.

- Indeed, the numbers of internally displaced persons globally are in fact likely to be significantly higher than those publicly stated by the United Nations and other international organizations, which only take into account the available data on conflict-induced and disaster-induced displacement. It is estimated that millions more are displaced annually by other causes and drivers of displacement, including development projects and generalized violence. It must also be recognized that there is a need for greater research and more data on internal displacement as a result of slow-onset disasters and climate change, in order to reveal the current and future internal displacement trends and to better meet these challenges. The Special Rapporteur will continue to raise awareness of these neglected areas of internal displacement concern, as well as to advocate for national and international action to protect the human rights of persons who have been internally displaced as a result of all causes of displacement.

- The picture of internal displacement and the plight of internally displaced persons globally have offered little positive news in recent years. Massive and ongoing conflicts and displacement crises remain unresolved, and some have worsened or become entrenched. New conflicts have emerged and disasters struck, causing internal displacement numbers to rise relentlessly to record levels, which puts new pressure on an already overstretched international system of humanitarian response. Where conflicts have abated, internally displaced persons often do not achieve durable solutions for years after their displacement, if at all. The protracted nature of some conflicts and internal displacement all too often results in protracted humanitarian responses that fail to progress to recovery phases and towards durable solutions for internally displaced persons. In some cases, donor fatigue results in fewer resources being available to address expanding and complex caseloads of internally displaced persons.

- [Criteria and indicators should be strengthened in accordance with the benchmarks and indicators for ensuring trafficking-free supply chains proposed by the Special Rapporteur (A/HRC/23/48/Add.4, appendix I) and should include at a minimum the following indicators:] Withholding or confiscating passports, other identity documents or work permits is prohibited; in cases where such documents are withheld by employers or labour recruiters as per legal requirement, simple procedures are in place to allow the workers direct and immediate access to the documents at any time;
