Reflections on the six-year tenure of the Special Rapporteur 2017, para. 93

- The Special Rapporteur has observed challenges to the use of the term "minority" for certain distinct communities, either because they reject being referred as minorities on the basis of a perceived negative connotation, or because they self-identify as minorities but the State refuses to recognize them as such. She considers that further awareness-raising is required to fully convey the meaning, scope and implications of the term "minority", so that it can be reclaimed and used with the empowering intent it actually holds. Moreover, she recalls that the existence of an ethnic, religious or linguistic minority in a given State does not depend upon a decision by the Government but needs to be established by objective criteria. Members of those minorities need not be nationals or citizens, or even permanent residents. Therefore, she encourages States to be as inclusive as possible when designing protection measures for all disadvantaged minorities within their territories, including migrant workers and newly arrived minorities.

- As those with primary responsibility, States affected by internal displacement must recognize and better adhere to their commitments under international human rights and humanitarian law and standards, firstly to prevent internal displacement, and to respond better when displacement occurs. Where possible, shifting the focus back towards the primary responsibility of States at all phases of displacement is necessary and will allow international humanitarian partners to more rapidly move on from protracted humanitarian assistance programmes. This will allow them to focus on new, critical displacement situations in which States are unable to respond effectively, as well to undertake more strategic resilience-building and recovery activities alongside development partners.

- The work of the mandate of the Special Rapporteur and her engagement with national governments will be stepped up to assist States and other stakeholders in their efforts to meet their obligations towards internally displaced persons. As the international community brings its attention much more to large-scale movements of people across international borders, through the development of global compacts on safe, orderly and regular migration and on refugees, the Special Rapporteur urges enhanced attention to the situation of internally displaced persons, recognizing that many who have crossed international borders as refugees or undocumented or trafficked migrants have initially been internally displaced in their own countries. Many have not been provided with the necessary protection and support allowing them to remain in their own countries if they so wish.

- States should ensure that bilateral and multilateral agreements on labour migration include mechanisms for oversight of recruitment of migrant workers, are concluded between countries of origin, transit and destination, as relevant, and are implemented effectively. States should also ensure that such agreements are consistent with internationally recognized human rights, including fundamental principles and rights at work, and other relevant international human rights instruments and labour standards. Agreements should also contain specific mechanisms to ensure international coordination and cooperation, including on consular protection, and to close regulatory and enforcement gaps related to recruitment across common labour migration corridors.

- States should make a genuine commitment to the standard of leaving no one behind by collecting disaggregated data. To monitor the implementation of the Sustainable Development Goals, it will be important to improve the availability of, and access to, data and statistics disaggregated by income, gender, age, race, ethnicity, migratory status, disability, geographic location and other characteristics relevant in national contexts to support the monitoring of the implementation of the Goals. The goal indicators should include the use of data from the existing mechanisms for monitoring compliance with human rights standards, especially the universal periodic review mechanism of the Human Rights Council and reviews of compliance with the International Convention on the Elimination of All Forms of Racial Discrimination.

- Living in limbo for long periods owing to delays or inefficiencies in or the absence of regular channels for migration may drive children who have depleted their financial resources to seek alternative ways, whether legal or illegal, to earn money either to survive or to continue their journeys. This situation leads them into the arms of criminals who are able to facilitate their passage to other countries. Moreover, the use of detention for children on the move is contrary to their rights, is especially detrimental to their well-being and should not be resorted to. In addition, while it is fundamental to pursue ongoing efforts to investigate and prosecute smugglers and traffickers, more emphasis must be placed on reducing the vulnerabilities of children on the move.

- The picture of internal displacement and the plight of internally displaced persons globally have offered little positive news in recent years. Massive and ongoing conflicts and displacement crises remain unresolved, and some have worsened or become entrenched. New conflicts have emerged and disasters struck, causing internal displacement numbers to rise relentlessly to record levels, which puts new pressure on an already overstretched international system of humanitarian response. Where conflicts have abated, internally displaced persons often do not achieve durable solutions for years after their displacement, if at all. The protracted nature of some conflicts and internal displacement all too often results in protracted humanitarian responses that fail to progress to recovery phases and towards durable solutions for internally displaced persons. In some cases, donor fatigue results in fewer resources being available to address expanding and complex caseloads of internally displaced persons.

- The Special Rapporteur recommends a consultative process led by the United Nations to further develop goals and targets. Such a process would include the participation of experts, the business community, civil society organizations and migrants themselves. It would build upon the principles and guidelines, supported by practical guidance, on the human rights protection of migrants in vulnerable situations within large and/or mixed movements developed by the Global Migration Group. The guidance could form an important starting point for the development of goals and targets, given that it is derived from existing obligations under international law and is aimed at assisting States and other stakeholders with regard to the refinement, strengthening, implementation and monitoring of measures to protect migrants in vulnerable situations.

- The Special Rapporteur is of the firm view that there is no better deterrent to torture than a strong national will to combat and prevent such abhorrent abuse. - Companies should establish a remediation plan in cooperation with the supplier and local and national authorities when a case of trafficking in persons is detected, in order to ensure that workers have effective access to remedies, including compensation, and to appropriate assistance. Any measure adopted should have a human rights-centred approach and be based on the rights of the trafficked person, whose participation in the determination of a solution for their case should be ensured throughout the process. Companies should ensure that, with regard to access to the grievance mechanism and the remediation plan, they consider the specific barriers faced by, and the vulnerabilities of, migrant workers, contract workers, young people and women.

The repatriation of any child can only be decided when it is evidenced on a case-by-case basis that it is in his or her best interests and after ensuring, by means of a procedure with proper safeguards, that the child, upon return, will be safe and provided with proper care and custody;
