Cultural rights and the protection of cultural heritage
The Human Rights Council,
Guided by the purposes and principles of the Charter of the United Nations,
Recalling the Universal Declaration of Human Rights, the Vienna Declaration and
Programme of Action, the Declaration on the Right to Development and all relevant
international human rights treaties, including the International Covenant on Economic, Social
and Cultural Rights and the International Covenant on Civil and Political Rights, and
reaffirming the human rights and fundamental freedoms enshrined therein,
Recalling also General Assembly resolution 60/251 of 15 March 2006, by which the
Assembly established the Human Rights Council and in which it stated that all human rights
are universal, indivisible, interrelated, interdependent and mutually reinforcing, and must be
treated in a fair and equal manner, on the same footing and with the same emphasis,
Recalling further previous Human Rights Council resolutions on cultural rights and
the protection of cultural heritage, inter alia, Council resolution 49/7 of 31 March 2022,
Recalling General Assembly resolution 79/133 of 6 December 2024 on the return or
restitution of cultural property to the countries of origin,
Recalling also the adoption of General Assembly resolution 79/1 of 22 September
2024, entitled “The Pact for the Future”, in particular action 11 contained therein,
Recalling further the Universal Declaration on Cultural Diversity of the United
Nations Educational, Scientific and Cultural Organization adopted on 2 November 2001,
promoting, among other things, intercultural dialogue as a tool for guaranteeing peace,
Recalling the declaration adopted at the World Conference of the United Nations
Educational, Scientific and Cultural Organization on Cultural Policies and Sustainable
Development (MONDIACULT 2022), which, among other things, called upon the SecretaryGeneral to firmly anchor culture as a global public good, and which also contained a
commitment to fostering an enabling environment conducive to the respect and exercise of
all human rights, in particular cultural rights, and underlined both the opportunities and the
risks that digital transformation brings to culture and heritage,
