- Civil society organizations further expressed concern over insufficient support measures available for survivors of violence, such as protection measures and services. Shelters, health care and psychological support remained inaccessible. As highlighted by the Special Rapporteur in document A/HRC/35/30, the lack of systematic data collection on gender-based violence against women and femicide was a serious obstacle to addressing violence against women. Data collection was a crucial step in promoting advocacy at the national level to combat gender-based violence.

- In another landmark ruling, the Supreme Court of Mexico ordered the reopening of the investigation into the suspicious suicide of a women and ordered that it should be reinvestigated "from the perspective" of femicide or the murder of a woman by a man for reasons relating to her gender. The Court declared that it was the "duty of investigative bodies to investigate every violent death of a woman, to determine whether or not this is a case of femicide", thereby affecting countless other cases of unresolved femicides in the country and having implications for all levels of investigation into such crimes.

- The Convention on the Elimination of All Forms of Discrimination against Women and the Declaration on the Elimination of Discrimination against Women established global standards and the obligations of States to prevent violence against women and to provide services for survivors of violence. With regard to services, the Declaration calls upon States to work to ensure, to the maximum feasible extent, in the light of their available resources and, where needed, within the framework of international cooperation, that women subjected to violence and, where appropriate, their children have specialized assistance, such as rehabilitation, assistance in child care and maintenance, treatment, counselling and health and social services, facilities and programmes, and support structures, and should take all other appropriate measures to promote their safety and physical and psychological rehabilitation. In addition, the Declaration states that organs of the United Nations system should promote the formulation of guidelines or manuals relating to violence against women.

- In 2003, the Committee, pursuant to article 8 of the Optional Protocol to the Convention, undertook an inquiry into the abduction, rape and murder of women in and around Ciudad Juarez, State of Chihuahua, Mexico, and recommended that the Government investigate thoroughly and punish the negligence and complicity of public authorities in, the disappearances and murders of women. In 2012, the Committee conducted an inquiry with regard to the Philippines on the implementation of an order issued by the Mayor of the City of Manila on 29 February 2000, on the provision of sexual and reproductive health rights, services and commodities in the City of Manila. The Committee recommended that the State party ensure the immediate implementation of the Reproductive Health Act (adopted on 21 December 2012) and its Implementing Rules and Regulations, including provisions that guaranteed universal access to the full range of reproductive health services and information for women (CEDAW/C/OP.8/PHL/1, para. 51 (b)). In 2013, the Committee conducted an inquiry on Canada, based on allegations of severe of violence, including disappearances and murder, suffered by aboriginal women and girls. The Committee recommended that the State ensure that all cases of missing and murdered women were duly investigated and prosecuted (CEDAW/C/OP.8/CAN/1, para. 217 (a)). These examples show how jurisprudence can be an important tool for transformative change.

- A seminal development is the inclusion in the Protocol of provisions on abortion, the first time such provisions were included in an international or regional human rights instrument. Article 14 (2) (c) addresses the issue of medical abortion, stating that all appropriate measures must be taken to protect the reproductive health of women, including through the authorization of abortions in the following circumstances: sexual assault, rape and incest, and where the continued pregnancy endangers the mental and physical health of the mother. This provision is crucial, considering the high maternal mortality rates linked to the practice of unsafe abortions. However, the cultural, religious and other moral arguments against the termination of pregnancies in many African countries challenge the effective realization of this right.

- The inter-American human rights system was created in 1948 and functions within the framework of the Organization of American States (OAS), with primary areas of focus including democracy, human rights, security and development. Normative developments include the adoption in 1948 of the American Declaration of the Rights and Duties of Man and the Charter of the Organization of American States. The Declaration recognizes a range of civil, political, economic, social and cultural rights, including the right to life (art. I); the right of women, during pregnancy and the nursing period, and children to special protection, care and aid (art. VII); the right to the preservation of one's health and well?being (art. XI); the right to education (art. XII); the right to take part in cultural life and benefit from intellectual progress (art. XIII); the right to work and to fair remuneration (art. XIV); and the right to social security (art. XVI). The Charter refers to human rights in several of its provisions, including article 3 (l) on the fundamental rights of the individual without distinction as to race, nationality, creed or sex. Article 17 provides: "Each State has the right to develop its cultural, political, and economic life freely and naturally. In this free development, the State shall respect the rights of the individual and the principles of universal morality." Article 106 provided for the creation of the Inter-American Commission on Human Rights as a consultative mechanism for the promotion and protection of human rights.

- Violence against women impairs and nullifies the right of women and girls to the enjoyment of the highest attainable standard of physical and mental health. Gender-based violence, such as intimate partner violence, sexual violence, female genital mutilation or other harmful traditional practices, forced and child marriage or cohabitation, gender-related killings, trafficking, infanticide and deliberate neglect of girls, have a severe impact on women's and girls' physical, mental, sexual and reproductive health. As stated by the Committee on the Elimination of Discrimination against Women, violence against women puts women's health and lives at risk. The Committee on Economic, Social and Cultural Rights notes that the right to health includes both freedoms and entitlements, including the right to control one's health and body, inclusive of sexual and reproductive freedom, and the right to be free from interference, such as the right to be free from non-consensual medical treatment and experimentation (E/C.12/2000/4, para. 8).

- Refugees and other non-citizens are often susceptible to violence against women. It is noted that organizational and societal factors, including unhealthy and unsafe housing, unemployment, poverty, restricted access to health care, higher education, participation in civil society and legal protection all contribute to the ill health and vulnerability of migrants and women migrants in particular. Women in these communities are not adequately protected, which can cause them to be more susceptible to violence and less likely to be able to participate adequately in society. - Gender-based violence impedes sustainable development by obstructing women's participation and undermining many of the goals of development. Millennium Development Goal 5 on improving maternal health is one example. When violence against women is manifested in the form of early or forced marriage and childbearing, women are likely to suffer from medical conditions such as haemorrhage, obstructed labour, sepsis and eclampsia, as well as unsafe abortions. Coupled with inadequate access to health services, these conditions may lead to the death of the mother, thus depriving women of their development right to maternal health. Numerous manifestations of violence against women, including forced sterilizations, forced abortions, lack of effective access to safe abortions, lack of informed consent and choice over contraceptive methods, harmful practices such as honour killings, female genital mutilation, early and forced marriage, and sexual violence, contribute to the violation of a number of rights, including the right to participate in and contribute to sustainable development.

- Preventable maternal mortality in turn leads to additional negative development outcomes as it fuels economic and social inequalities. Generally, preventing and combating illness among women and girls leads to a healthier and more productive population, whereas ill-health diminishes people's personal capacity and ability to contribute to their households, resulting in lost incomes and lower productivity. Furthermore, investing in the health of the largest generation ever of young people, particularly adolescent girls, means investing in the future and sustainable development. Gender-based violence, however, impoverishes women and their families, saps public resources and lowers economic productivity. Therefore, when women and girls experience violence, they are denied access to fundamental human rights, such as education and health, which significantly undercuts their capacity to participate meaningfully in the sustainable development of their communities.

- Women with disabilities experience an intersecting confluence of violence which reflects both gender-based and disability-based violence (A/HRC/17/26, para. 28). Many studies note a substantially higher risk of violence among disabled women than among the non-disabled population. For example, disabled women are especially vulnerable to forced sterilization and other coercive birth control methods. In addition, the European Parliament recently published a report stating that almost 80 per cent of disabled women are victims of violence generally, and that disabled women are four times more likely than other women to experience sexual violence.

- In the discharge of the mandate, the Special Rapporteur is required to prepare annual thematic reports and reports on country visits. At the initiative of the previous Special Rapporteur, a 15-year review of the mandate was conducted. The review provides a comprehensive overview and analysis of the functioning of the mandate from 1994 to 2009. As stated in the review, in addition to the issues covered in the thematic reports, the mandate has dealt with several other issues that have been subsumed in the annual reports, country mission reports and communications to governments, including issues relating to health rights, including sexual and reproductive rights; women refugees and asylum seekers; national institutional mechanisms; as well as various aspects of implementation challenges. The mandate holders over that period highlighted in their reports that, despite advances in the creation of tools to enable and enhance compliance, lack of compliance and implementation continues to pose a serious challenge.

Women all too frequently experience violent intrusions of privacy, including through virginity testing and forced sterilization. In assessing State responsibility to act with due diligence to address violence against women, it was suggested by the first Special Rapporteur in 1999 that the following questions needed to be asked:] Is the criminal justice system sensitive to the issues of violence against women? In this regard, what is police practice? How many cases are investigated by the police? How are victims dealt with by the police? How many cases are prosecuted? What types of judgements are given in such cases? Are the health professionals who assist the prosecution sensitive to issues of violence against women?
