- Conflict and displacement also give rise to increased numbers of persons with disabilities. In Lebanon, the Syrian Arab Republic and the Gaza Strip, for example, conflict has contributed to high numbers of persons with disabilities. At the same time, in each of those places, adequate, accessible housing is extremely scarce, with housing stock having been destroyed and a lack of access or specific policies blocking access to the materials and resources necessary to rebuild homes. In refugee camps, poorly lit and remotely located latrines can lead to difficult access and experiences of sexual violence for women with disabilities, while crowded, narrow walkways can result in persons with visual impairments falling into open sewers.

- In addition to the more obvious requirements, within the framework of human rights, to ensure that housing developers exercise due diligence, comply with safety standards and adopt policies of non-discrimination, for example, States may also be required to ensure that investment in housing complies with a rights-based housing strategy and with the target of ensuring adequate housing for all by 2030. Private actors may be required to take particular steps to ensure access to credit for disadvantaged households and to address the needs of residents of informal settlements, women, migrants and people with disabilities. The obligation of States to facilitate the realization of the right to housing by establishing a coherent strategy at both the national and international levels with clearly allocated roles and responsibilities is central to the commitments made by States in the 2030 Agenda for Sustainable Development and the New Urban Agenda.

- The dominant impact of wealth and private investment has also created and perpetuated spatial segregation and inequality in cities. In South Africa, for example, the impact of private investment in the urban core of cities has sustained the discriminatory patterns of the apartheid area, with wealthier, predominantly white households occupying areas close to the centre and poorer black South Africans living on the peripheries of cities. That "spatial mismatch", relegating poor black households to homeownership in peri-urban areas where employment opportunities are scarce, rather than rentals in the urban core, for example, has entrenched their poverty and cemented inequality. Similar patterns of racial displacement from urban centres and segregation in evidence in large cities in the United States have led to more severe impacts of financialization and the mortgage crisis being experienced by African-American households. Financialization also creates gender segregation. In Australia, analysis has shown that average-income single female workers can afford to live in only one suburb of Melbourne and cannot afford to live anywhere in Sydney.

- For women and children victims of domestic violence the home ceases to be the safe haven it is meant to be and becomes the most dangerous place, in some cases leading to their death. Factors such as overcrowded residences, poor habitability and lack of accessible services (water, electricity and sanitation) increase the incidence of domestic violence. Many women in such situations are unable to remove the perpetrator from the house, owing to a lack of family, community and State supports. Further, many women are prevented from leaving violent situations because alternative housing and financial supports are unavailable. Those who do manage to leave home become vulnerable to homelessness and consequently may suffer further violence.

- The humiliation homeless people suffer in their daily lives cannot be underestimated. Take for example, the experience of women who lack adequate sanitation facilities, especially during menstrual cycles, or of families who are treated like "human waste", forced to establish their households on or next to a garbage dump. Homeless people have told the Special Rapporteur, often through tears, that more than any material security, what they yearn for is to be "seen", to be recognized and treated by society as human beings with inherent dignity and respect.

- The ongoing legacy of discriminatory customary and statutory laws on divorce, inheritance and matrimonial property - as well as social practices that attribute housing to male heads of households and the resultant poverty - deprive women of security of tenure and render them particularly vulnerable to homelessness. When women are widowed, separated or divorced, need to leave violent households or flee situations of armed conflict or natural disasters, or are evicted from their homes, they face significant risks of becoming homeless. Divorced and widowed women in Bangladesh and Lebanon, for example, are reported to be living in dilapidated shacks in dangerous informal settlements and women fleeing violence in Kyrgyzstan and Papua New Guinea are left with few housing options.

- The Committee on the Rights of Persons with Disabilities has only started to grapple with communications addressing issues of grossly inadequate housing, lack of support for community living, institutionalization and lack of accessible housing which characterize the housing circumstances of millions of people with disabilities. In its periodic reviews, however, the Committee has emphasized the importance of States' obligations to take positive steps to implement inclusive, effective strategies to realize the right to housing and social protection and to address the particular issues affecting women, migrants and young people with disabilities.

- For anyone who is homeless or street involved, living in security and dignity is near impossible. The death rate among homeless people ranges from two to ten times higher than for those who are not homeless. In eight states in India, between 2010 and 2016, approximately 24,000 homeless people died as a result of their living conditions, such as from infectious diseases, road accidents, and exposure to the elements. The interim findings of a study undertaken in the United Kingdom of Great Britain and Northern Ireland, for example, showed that homeless women can expect to live for just 43 years, compared to 80 years for women in the general population.

- Many societal changes without adequate State responses contribute to homelessness. For example, the break-up of traditional family structures is a prevalent cause of homelessness. Men who move to cities for economic reasons often forgo shelter in order to save money to send back to their families in rural areas. In many States, long traditions of extended family support and kinship responsibility at the community level have been eroded. Illness, including the HIV/AIDS pandemic, is both a major cause and effect of homelessness.

- The causes of homelessness vary among particular groups. Street-connected children come from families with a wide range of experiences, including death, dislocation, disease, isolation, poverty, mental illness, domestic violence, child abuse and drug use. Women are forced into homelessness because of violence, unequal access to land and property, unequal wages and other forms of discrimination. Persons with disabilities are made homeless by lack of work, livelihoods and accessible housing. Young people are often denied access to housing and services in cities if they do not have appropriate government-issued documentation or identity cards. Conflict results in massive displacement and migration, as has been evidenced clearly by the waves of refugees from countries such as Afghanistan, Eritrea, Iraq, Somalia and the Syrian Arab Republic escaping from conflict, widespread violence and insecurity.

- Homeless people are subject to constant intimidation, discrimination and harassment; they are denied access to places to shower, urinate, defecate or eat; they are rounded up and forced out of cities and relocated to remote locations where no one wants to live; and they are subject to extreme forms of violence (A/HRC/31/54, para. 21). Homeless women often have their children taken away from them by government officials on the basis that they cannot provide them with a life of security and dignity.

- While improved statistical data will be important to guide public policy and to hold governments accountable, adjustments will need to be made for the inevitable limitations, omissions and possible distortions in available data. Challenges associated with measuring homelessness should not be allowed to encourage policies that respond only to the visible and more easily measured forms of homelessness. Homelessness among single men living on the streets or using emergency shelters is more easily measured. It is more difficult to measure homelessness among women, children and young people living temporarily with family or friends, or among those most marginalized and precariously housed within informal settlements, who may be altogether left out of census or data collection. It is equally difficult to identify and measure homelessness among indigenous households or communities displaced from ancestral lands. Members of ethnic minorities may not wish to be identified by authorities. In Kenya, for instance, many of the people who become homeless because of ethnic violence did not want to be identified for fear of reprisal. Policy responses and assessments of progress in eliminating homelessness must make allowances for less visible dimensions of homelessness that may not have been measured.

- The Committee's recognition in these cases that deportation into homelessness may constitute cruel and inhuman treatment or punishment, and that victims of homelessness in this context are entitled to a remedy, is significant. It is equally important, however, to ensure access to adjudication and remedy for those who experience the same deprivations of homelessness resulting from inaction or neglect within a State's own borders. In A.H.G and Jasin, the Committee considered the effects of widespread and systemic violations of the right to security and dignity. However, this consideration remained within the negative rights framework of prohibited "treatment" or "punishment". That framework is not conducive to hearing the substantive claim to a life of dignity, security and inclusion advanced by people with disabilities or women escaping violence, who do not see the fulfilment of their human rights merely as freedom from treatment or punishment but more fundamentally as a right to a place to live in dignity and security.

- Fifty years after the separation of international human rights into the two covenants, the United Nations is well situated to retrieve a unified and inclusive understanding of human rights and to affirm that the right to life includes the right to a place to live in dignity and security, free of violence. The Human Rights Committee has the opportunity to affirm this integrated understanding of the right to life in the ongoing preparation of its general comment No. 36. The Committee on Economic, Social and Cultural Rights has the opportunity under its Optional Protocol to highlight the connection between the rights to life and adequate housing in lived experience. Other treaty monitoring bodies have the opportunity to ensure that the understanding of the rights to life and adequate housing is informed by the experiences and unique claims of people with disabilities, women, children, migrants, racial minorities and indigenous peoples, among others.

- The Committee on the Elimination of Discrimination against Women has had the opportunity to consider in its jurisprudence the obligation of States parties to address threats to women linked to lack of housing. In Ms. A.T. v. Hungary, the Committee considered the circumstances of a woman with two children who was viciously beaten by her husband and who feared for her life. She was unable to move to a shelter because there were no spaces available to accommodate her child, who had a disability. The domestic courts refused to grant A.T. possession of her home, in consideration of the property rights of her husband. The Committee held that women's human rights to life and to physical and mental integrity could not be superseded by other rights, including the right to property and the right to privacy. The Committee recommended that Hungary take positive measures to remedy the situation of A.T., to ensure better protection for women more generally and to ensure that A.T. was given a safe home in which to live with her children, as well as child support, legal assistance and reparation for the violations of her rights.

- Homelessness disproportionately affects particular groups, including women, young people, children, indigenous peoples, people with disabilities, migrants and refugees, the working poor, and lesbian, gay, bisexual and transgender people, each in different ways, but with common structural causes. These include: (a) the retreat by all levels of government from social protection and social housing and the privatization of services, infrastructure, housing and public space; (b) the abandonment of the social function of land and housing; (c) the failure to address growing inequalities in income, wealth and access to land and property; (d) the adoption of fiscal and development policies that support deregulation and real estate speculation and prevent the development of affordable housing options; and (e), in the face of urbanization, the marginalization and mistreatment of those who are most precariously housed in informal settlements, living in temporary overcrowded structures, without access to water, sanitation or other basic services and living under the constant threat of eviction.

- In some situations, children and youth, including lesbian, gay, bisexual, transgender and intersex youth, and women can be vulnerable to violence, requiring access to safe housing and basic services if they are to thrive in the urban context. These groups are often forced into homelessness by sexual and other violence, socioeconomic deprivation, and religious and cultural intolerance within their homes or communities. A sound housing structure does not guarantee safety within housing for these vulnerable groups. When women, children and youth leave their homes, they require both short- and long-term support to secure adequate housing, as they often lack the means to secure housing themselves. In this regard, diverse, culturally appropriate options must be made available.

- The Special Rapporteur is mindful that the present report is prepared on the eve of the adoption of the post-2015 development agenda. The content of the sustainable development goals appears to have taken on board some of the lessons learned from the experience of the Millennium Development Goals. As it stands, the final draft of the outcome document articulates a renewed commitment to fostering inclusive societies, combating inequality, ensuring equal access to justice and respect for all human rights. In particular, the document refers to the right to development, the right of self-determination, women's equal rights to economic resources, reproductive and labour rights and the right to an adequate standard of living, including food and water. Nowhere, however, does the document refer to the right to adequate housing.

- Under international human rights law, policies and programmes must be designed in ways that take into account the experiences and realities of marginalized groups so that their disadvantage is addressed in real terms. This is because equality is understood "substantively" and not just "formally". Even where laws and policies appear to be "fair" by treating everyone the same, the experience or effect of laws and policies can be discriminatory owing, for example, to a person's socioeconomic status, housing status or gender. States and subnational governments are obliged to address the needs of those in the most desperate housing situations as a matter of priority and urgency. Positive measures must be taken to reduce stigmatization and address the needs of homeless women and men, residents of informal settlements, low-income households and other groups lacking access to adequate housing.

- Urbanization has created new patterns of discrimination and inequality based on spatial and socioeconomic marginalization. Exclusionary patterns of governance and citizenship have given disproportionate power and influence to property owners and investors while depriving those without land or property of a meaningful say in decisions that will have significant impact on their lives and on their ability to obtain housing. Refugees, migrants, persons with disabilities, children and youth, indigenous peoples, women and minorities are most likely to find themselves homeless or relegated to the most marginal and unsafe places in cities, treated as non-citizens or outsiders.

- Those who are affluent and own land, homes or other property in cities have dramatically increased their wealth because of speculation and inflation of values. Those who cannot afford ownership face increasing housing costs and are driven to the outskirts of cities or to informal settlements, dislocated from their sources of livelihood and lacking security of tenure. Inequality in access to land and property, affecting marginalized groups including women, migrants and all those living in poverty, has become embedded in housing inequality and spatial segregation, dividing cities between those who own land and property and have access to basic services and infrastructure and those who do not.

- In the United Kingdom of Great Britain and Northern Ireland, there are no constitutional protections through which the right to housing can be claimed. However, statutory provisions requiring local authorities to provide housing for those who are homeless are enforceable in courts. In addition, the European Convention for the Protection of Human Rights and Fundamental Freedoms is enforceable by domestic courts in the United Kingdom. In R. v. Enfield London Borough Council, ex parte Bernard, for example, when a woman with a disability was not provided with the accessible housing to which she was entitled under the Housing Act, she challenged the local authority's actions as a violation of her right to the protection of home and family life under article 8 of the European Convention. The court held that accessible accommodation was important because it would facilitate family life and would secure her "physical and psychological integrity". The court ruled that "it would have restored her dignity as a human being".

- The Committee on the Elimination of Discrimination against Women has also dealt with housing cases that engage subnational level governments. In Kell v. Canada (CEDAW/C/51/D/19/2008), an indigenous woman alleged that in the context of domestic violence, she had been dispossessed of her housing as a result of decisions taken by the local housing authorities. The Committee deemed the Northwest Territories Housing Corporation and the local housing authority to be agents of the State party, referring to them as such, and concluded that, as a result of the actions of the local housing authority, the State party had violated articles 2, paragraphs (d) and (e), and article 16, paragraph 1 (h), read in conjunction with article 1 of the Convention, which protect against discrimination by public authorities and the equal rights of spouses with respect to property.
