- Concerns also emerged which were more regionally specific. In Africa, urbanization, climate change, low levels of financial literacy amongst women, and the rising number of female headed households all emerged as key issues affecting the status of women's right to adequate housing in the African continent today. In Asia, as well as in Africa, the consultation revealed how women are negatively affected by the impact of the agrarian crisis, as well as by "land grabbing", further limiting women's already precarious access to, and control over, land and other natural resources. The e-consultation in Eastern and Central Europe highlighted the importance of recognizing intersectional discrimination as it affects certain groups of women, in particular vis-à-vis the segregation of Roma communities. In the Middle East and North Africa, lack of law enforcement; conflict and occupation; and discrimination against minorities all negatively impact women's right to adequate housing. In Western Europe and North America, key issues highlighted included inadequate supply of public housing and lack of government assistance for housing; lack of affordable housing; domestic violence; and discrimination against women on public assistance, women with disabilities, and women belonging to racial/ethnic minorities, including Indigenous women. And in Latin America, where the e-consultation highlighted many of the issues already mentioned - including discrimination in matters related to housing against indigenous and Afro-descendant women, lack of access to justice, and domestic violence - participants also highlighted the need for better statistical information related to women and housing, as well as the urgent need to close the implementation gap between policy and practice.

- Caste-based discrimination, found in various cultural contexts, and domestic servitude are linked. In South Asia, so-called "untouchables" (dalits) and certain indigenous communities make up the vast majority of people in domestic bonded labour, which is a form of domestic servitude. Moreover, specific types of degrading domestic chores are specifically associated with lower castes and linked to exploitative conditions. In certain States in India, despite a long-standing Government campaign to eradicate the practice, many dalit women reportedly still have to engage in "manual scavenging": because of their caste they are expected to take care of scraping human excrement from dry toilets in private households or public places.

- The obligations of non-discrimination and equality oblige States to ensure that employment creation policies benefit all sectors of society equally. Policies that increase the employability (for example, through demand-driven skills development and vocational training) of groups that face specific barriers in their access to employment, such as women, persons with disabilities, young people and indigenous populations, will assist States in fulfilling their human rights obligations. To remove obstacles to employment for women, States should ensure the availability of care services (from the State, the community and the market), the redistribution of paid and unpaid work from a gender perspective and the elimination of all forms of gender discrimination. States are not only obliged to undertake effective legislation to this end, but also to take measures to modify social and cultural patterns of conduct of men and women.

- Economic exclusion and denial of access to quality education bring about a sense of despair, destroy hopes of upward mobility and are often a central grievance and a source of tensions. International standards on non-discrimination place an obligation on States to institute affirmative action policies to correct historical patterns of exclusion and enable members of minorities to achieve equality. Many States have recognized the corrosive nature of inequalities and have implemented such measures. Affirmative action programmes can, however, be a point of contention for majority communities, in particular when poorer members of majority communities perceive that they are losing out. It is important that Governments exercise leadership in educating the larger public, demonstrating that such programmes are based on the principles of justice and equal opportunity and result in fairer and more stable society.

- The theme of the third session of the Forum was minorities and effective participation in economic life. Minority women are often excluded from the labour market or are at greater risk of unemployment. Barriers to minority women's access to labour markets include lack of professional education and formal qualifications, limited knowledge of the official language, low awareness of job opportunities, geographical location of jobs distant from their place of residence, lack of public infrastructure for child care, and financial difficulties. Cultural traditions and gendered societal roles may further discourage the involvement of minority women in employment or severely limit their options in this regard.

- Multiple forms of discrimination which may further curtail access to justice can also arise from within the minority community. Minority women may face multiple stigmas in relation to their ethnic or religious background, their sex, and the nature of the crime of which they were the victim. In India, for instance, Dalit women subjected to violence reportedly face unnecessary delays and pressure to drop charges, which are linked to a combination of their gender and minority status. In some countries of Eastern and Central Europe and Central Asia, parental attitudes can limit minority children's access to justice: girls in particular are expected to remain silent about problematic family situations.

- Customary law used by minorities, as well as laws in general, may disadvantage minority women, and entrenched gender roles may leave them highly vulnerable, particularly with regard to ownership of land or property, inheritance rights and access to credit, technology or markets. - Two side-events on issues related to the rights of minority women and girls were organized in the margins of the fourth session of the Forum. - Comprehensive national action plans and budgets to combat discrimination based on caste and analogous systems should be urgently developed and implemented in caste-affected countries. Plans should have clear objectives and measures in a wide range of areas, including poverty reduction strategies, employment, health, housing, education and access to basic services, including water and sanitation. They should include specific attention to the issues of caste-affected women, be developed in coordination with affected groups and local organizations working with them and be provided with sufficient funding. Their progress should be regularly monitored.

- Besides its National Human Rights Commission, Nepal also has a National Dalit Commission, which was established in 2002 in recognition of the fact that caste discrimination and untouchability practices continue. It promotes implementation of national and international law and advocated for the Caste-based Discrimination and Untouchability Act, adopted in May 2011, which criminalized such discrimination in private and public spheres. Among its activities was the organization of a 100-day campaign against caste discrimination, in collaboration with the office of the United Nations High Commissioner for Human Rights in Nepal, launched in September 2011 by the President and the High Commissioner.

- In South Asia, violence against Dalits is reported to be widespread and driven by the effects of the caste system and the lack of justice for victims. Although official data are scarce, information from some States indicates that the number of reported crimes against Dalits is rising. For instance, data from the National Crime Records Bureau in India reveal that reported crimes against individuals from scheduled castes increased 19 per cent in 2014 from the previous year. In Nepal, Amnesty International reported that in 2014 victims of discrimination on the grounds of caste were subject to torture and other ill treatment, including sexual violence.

- In 2009, of the world's 101 million children out of school, an estimated 50-70 per cent were from minorities or indigenous peoples. In Central Africa, the great majority of Batwa and Baka have not had access even to primary education. Only 13 per cent of children in sub-Saharan Africa have access to primary education in their mother tongue. In South Asia, Dalit girls are prevented from pursuing their education not only because of poverty, but through discrimination and sexual violence. Literacy levels are commonly much lower among Dalit girls. For example, in the Mushahar Dalit community in India, barely 9 per cent of women are literate. In Latin America, millions of indigenous and African descendant children work in fields, plantations or mines instead of being in school.

- The issues and concerns of minority women frequently receive a lower priority than the efforts made to ensure minority rights for the group in general. Women belonging to minority groups often struggle within their communities to advocate for their rights, which can be set aside as a result of the prioritization of the general concerns of the group. Barriers to the empowerment of some minority women, including lack of social or economic contact, networks or minority women's support groups, and scarcity of female minority role models have an important impact on the enjoyment by minority women and girls of their human rights. Minority women may hesitate to voice their gender-specific grievances even within their groups, let alone outside them. Minority women's rights could also benefit from increased attention by the broader movement for women's rights. In turn, the women's rights movement would also benefit from the specific experiences of minority women in their overall struggle for equality.

- The International Federation of the Red Cross has also developed a Strategic Framework on Gender and Diversity for 2013-2020 which includes some important points regarding the inclusion of minorities in humanitarian relief work. - At its first session, the Forum focused on minorities and the right to education. Access to education for minority girls may present particular challenges, especially in highly patriarchal family and community structures where gendered societal roles persist. Lack of education represents an absolute barrier to their progress and empowerment in every region of the world. In some cases, where barriers to access are compounded for girls, sometimes owing to the prioritization given to the education of boys, this results in a vicious circle leading to severe educational exclusion and diminished opportunities for girls to take part fully in economic, social, cultural and political life. As a consequence, some minority girls and women excluded from education suffer from high illiteracy levels.

- Compounded gender stereotypes can have a disproportionately negative impact, in particular on the enjoyment of the human rights to water and sanitation, on certain groups of women, such as women with disabilities, women from minority or indigenous groups, women from lower caste groups and women of lower economic status. They may moreover become further compounded when they intersect with other forms of stigma or taboos, like those linked to menstruation and perimenopause, incontinence or childbirth-related complications, such as obstetric fistula. The power of stereotypes, stigmas, taboos and gender-assigned roles is such that persons sometimes do not claim their legal rights for fear or because of the pressure placed on them to conform to societal expectations. These deeply entrenched issues call for approaches that go beyond formal protection in the law.

- In its concluding observations, the Committee on Economic, Social and Cultural Rights has called for the provision of education on sexual and reproductive health and has specifically recommended sexual education as a means of ensuring the right of women to health, particularly reproductive health, as well as full access to sexual education for all girls and young women, including in rural areas and indigenous communities. The Committee has also recommended the development of training programmes and counselling services on reproductive health and has expressed the view that sexual education and awareness campaigns are appropriate means of reducing maternal and infant mortality. The Committee has associated the lack of education with the practice of abortion as a primary means of family planning and has advocated education programmes aimed at eliminating female genital mutilation.

- A successful strategy for strengthening the rights of women in support of the realization of the right to food requires a whole-of-government approach, coordinated across various ministries, including those responsible for health, education, employment, social affairs and agriculture. For instance, for the multiplier effects of school-feeding programmes to be maximized, coordinated action between departments responsible for agriculture, education and employment is required. Such a strategy should include targets, defined through a participatory process, and independent monitoring of their achievement within specified time frames. The outcomes to be achieved should be defined through indicators based on the normative components of the right to food, and disaggregated by ethnicity, age and gender in order to ensure that a gender-sensitive approach will be adopted in all sectors, and that multiple forms of discrimination, such as that experienced by older women and indigenous women, is tracked and addressed effectively. The systematic collection of gender-disaggregated data is key to this objective.

- Although traditionally the role of women has been a part of the agenda on the right to food, the Special Rapporteur believes that the empowerment of women and the protection of their rights should be placed at the centre of the policymaking process on the right to food. Specific programmes and policies should be developed to empower women as agents of change. That means ensuring that they are granted equal access to resources, such as land ownership or tenure, water and seeds, and financial and technological assistance. The empowerment of women should not be limited to rural areas, but should also be extended to urban women, women from indigenous communities, those living in refugee camps and undocumented migrants. In the agricultural sector, policies tend to be "gender blind or gender sensitive in mild ways", failing to address some of the main obstacles women face. Moving towards gender transformative policies will require major additional efforts on the part of States.

- National strategies grounded in the right to food should be conceived as participatory processes, co-designed by all relevant stakeholders, including in particular the groups most affected by hunger and malnutrition - smallholder producers, fisherfolk, pastoralists, indigenous people, the urban poor, migrants and agricultural workers. Interministerial bodies should be provided with recommendations that can support local initiatives that support the transition to sustainable food systems (A/68/288, paras. 42-46). The strategies should set out objectives that are specific, measurable, attainable, relevant and time-bound. Their rights-based dimensions require that they identify which actor is responsible for which action, and that implementation be supported by independent monitoring in the hands of national human rights institutions or, perhaps preferably, food security and nutrition councils. Because gender-based discrimination violates the right to food of women and girls, the empowerment of women and gender equality, as well as the adoption of social protection schemes that are transformative of gender roles, should be a priority of such strategies. Enhancing the role of women in decision-making at all levels, including within the household, moreover, improves nutritional and health outcomes. And women must be better supported as economic agents in the food systems (A/HRC/22/50).

- The Special Rapporteur draws attention to the precarious situation of the numerous indigenous women, particularly from Latin America and Asia, who serve as domestic workers, either in their home countries or as migrant workers. According to ILO estimates, there are a minimum of 53 million adult domestic workers in the world; 83 per cent of whom are women. It is unknown what percentage indigenous women constitute, but the sparse data available indicates that in some countries and regions they may actually constitute the majority. These women often face deplorable working conditions, labour exploitation and human rights abuses, frequently without legal recourse to remedy. In this context, the Special Rapporteur notes that the Domestic Workers Convention (ILO Convention No. 189) entered into force in September 2013. The Convention aims at extending basic labour rights to domestic workers around the globe and can be a potentially important instrument for indigenous women.

- To contribute to addressing any continuing gaps in monitoring and implementing the Declaration on the Rights of Indigenous Issues, the Special Rapporteur dedicates the present report to the issue of indigenous women and girl's rights. While recognizing the great diversity in the experiences of indigenous women, she will take a global approach, focusing on common themes and patterns experienced by indigenous women across regions. The Special Rapporteur will highlight examples of specific rights violations and issues from different countries, which are illustrative but not exhaustive. In analysing the situation of indigenous women, she will consider both the gendered forms of violations against indigenous women and the gendered effects of human rights abuses that target indigenous communities as a whole. In that way, the Special Rapporteur hopes that the forms of oppression, discrimination and violence that indigenous women face -because they are women and because they are indigenous - can be better understood.
