- While some refugee and internally displaced persons camps have separate facilities for unaccompanied or separated children, they often lack family-based solutions and have very limited capacity to face the increasing number of unaccompanied or separated children. As a consequence, children share their living space with adults or are held in prolonged detention. In addition, even when children are offered a separated living area, those are often easily accessible to everyone, especially during night-time. Moreover, certain camps fail to provide basic amenities, such as appropriate health-care services or gender-differentiated sanitation. The lack of adequate lightning, the layout of some camps and a shortage of security personnel further increase the vulnerability of children to abuse. Finally, the reluctance of many European countries to provide refugee children with a safe and permanent home continues to aggravate the situation by prolonging the stay of children in the facilities.

- The criminalization of consensual same-sex relations between adults of the same sex violates States’ obligations under international law, including the obligation to protect privacy and to guarantee non-discrimination. Such violations occur even when the law is not enforced. As such, arrests and detentions on the basis of sexual orientation, gender identity or expression are to be considered arbitrary. The imposition of the death penalty for offences related to homosexuality violates the right to life as it does not pass the qualification criteria of “most serious crimes”, as provided for in article 6 of the International Covenant on Civil and Political Rights. Criminalization of same-sex relations also fuels stigma, legitimizes prejudice and exposes people to family and institutional violence and further human rights abuses such as hate crimes, death threats and torture. All such provisions should be repealed.

- Albinism is a rare, non-contagious, genetically inherited condition that affects people worldwide regardless of ethnicity or gender. It results from a significant deficit in the production of melanin and is characterized by the partial or complete absence of pigment in the skin, hair and eyes. In order for a person to be affected by albinism, both parents must carry the gene and, in that case, there is a 25 per cent chance that a child will be born with albinism at each pregnancy. The proportion of persons affected by albinism in the world differs from region to region. For example, in North America and Europe, it is estimated that 1 in 17,000 to 20,000 people are affected by the condition, while in sub-Saharan Africa, 1 in 5,000 to 15,000 could be affected, with specific countries having a much higher tendency, including estimated rates of 1 in 1,400, and about 1 in 20 persons in the general population carrying the gene for albinism. Other studies suggest that in specific groups in Panama or in the Pacific region, the rate of people affected could be as high as 1 in 70 to 1 in 125.

The results of such exclusion include poverty, lack of education and corollary issues of unemployment, poor housing and ill health. These factors render them hyper-vulnerable to abuse and attacks, because perpetrators are aware of their disenfranchisement and their lack of resources and redress in the face of crime committed against them.

- Community support and integration have been identified as key protection measures for persons with albinism. Therefore, excluding and ostracizing persons with albinism have a direct impact on their safety and make them more vulnerable to attacks. Ostracized and physically distanced, those who are in most dire need of protection are rendered more vulnerable. The exclusion of mothers of children with albinism by their family and community throws them into deep poverty. Not only are these women physically distanced from others, they tend to live in insecure homes, which leaves them easy prey to perpetrators of attacks. They are often left exposed to attacks where no one will respond in time, or at all, to their call for help.

- Studies often link the prevalence of skin cancer to factors such as the lack of basic understanding of albinism, particularly by persons with albinism and their families. For example, it is not uncommon for parents to put a newborn with albinism out in the sun for hours. Displaced persons with albinism are exposed to a heightened risk of skin cancer as they are mostly outside of their usual environment and have limited means to address their health needs. Also at particular risk of developing skin cancer are persons with albinism who work outdoors, such as farmers or traders. Such outdoor occupations also emphasize the link between the risk of contracting skin cancer and poverty.

- Challenges to ending impunity may include lack of confidence in the law enforcement or judicial system owing to fear of reprisals or stigmatization, ignorance of their rights or lack of financial resources. Barriers also subsist at the investigations level, where there might be difficulties in finding witnesses owing, inter alia, to stigmatization and discrimination, fear of reprisals (including through witchcraft), lack of comprehensive witness protection programmes, involvement of family members and lack of financial resources. Barriers subsisting at the prosecution stage may include restrictions in the implementation of the right to a fair trial and due process, such as the lack of adequate legal representation. In addition, even when perpetrators are successfully prosecuted, it has been reported that too often the sentence pronounced is not proportionate to the gravity of the crime committed. Such outcomes can undermine the trust of victims in the justice system and lead to a reduction in the number of cases reported. Other barriers to ending impunity can be found at the policy and legislative levels, including the need for a clear and adequate legal framework regarding albinism that covers attacks and the impact of witchcraft on the human rights of persons with albinism.

- On the positive side, the design of housing itself can certainly encourage greater equality vis-à-vis enjoyment and use of domestic space. An example of new ways of thinking about domestic space from a gender perspective can be seen through the development of housing projects which seek to promote non-hierarchical and more flexible uses of the home. For example, creating personal workspaces inside the home can support women who are more likely to engage in home-based income-generating activities. Another interesting development which can be found in certain policies relates to the design of kitchens, a traditionally female space which is often cramped and separated. The design of housing from a gender-sensitive perspective can better promote family integration, as well as a more equitable sharing of household responsibilities between women and men through openness and shared use of spaces.

- Police procedures. Residents of urban settlements and homeless persons face disproportionate levels of police intervention and use of force without due process. In many countries, police enter homes in poor settlements, sometimes in major operations, without a court order, violating residents' rights to protection against arbitrary interference with their privacy, family and home. Homeless persons, who have no choice but to sleep, eat and conduct other life-sustaining activities in publics spaces are commonly harassed, fined and detained for doing so. Police must follow due process and respect human rights in conducting law enforcement activities, including in urban settlements, and ensure that any use of force is strictly necessary and proportional to lawful objectives. States should decriminalize homelessness and ensure full respect by police of human rights of homeless persons.

- Subnational and local governments have also initiated important efforts to address the right to adequate housing of persons with disabilities. Article XIV (1) of the World Charter for the Right to the City provides for universal realization of the right to housing and emphasizes the need for accessible and suitable locations. In article X of the Global Charter-Agenda for Human Rights in the City, it is recommended that cities adopt regulations to ensure the accessibility of housing for persons with disabilities. Some cities have sought to initiate inclusive zoning policies to prevent restrictions on supportive housing. Others have adopted measures to address affordability, such as housing benefits and/or allowances, grants or loans for required adaptations, lower interest rates on housing loans and reduced housing taxes for families with a family member with a disability.

- The segregation within the urban structure of the hosting territory is another dimension of migrant housing conditions: stereotyping, xenophobia and suspicion against migrants and the erection of barriers to keep them away from the local community foster the exclusion of migrants from the urban space. Segregation is also a consequence of insufficient access to social housing and services, which denies migrants access to fully serviced neighbourhoods, confining them to unserviced and unplanned areas with poor conditions and insufficient infrastructure and further fragmenting cities and fostering spatial clustering. Moreover, the need for undocumented migrants to remain invisible to authorities and the desire of all migrants to increase protection among members of each national community and to receive assistance from relatives and friends encourages ghettoized urban spaces.

- Women's right to adequate housing is often denied or ignored within the broader context of family and marriage law. Equality in matters of inheritance is often denied for women and girls on the basis of custom and tradition, whether within the context of the death of a spouse, parent or other relative. This has important ramifications, as inheritance is a primary means by which wealth and resources are transferred within societies, as well as within families. To be excluded from the process of inheritance reinforces women's lack of autonomy and equality, and jeopardizes in a very direct way their right to adequate housing.
