- Indeed, the numbers of internally displaced persons globally are in fact likely to be significantly higher than those publicly stated by the United Nations and other international organizations, which only take into account the available data on conflict-induced and disaster-induced displacement. It is estimated that millions more are displaced annually by other causes and drivers of displacement, including development projects and generalized violence. It must also be recognized that there is a need for greater research and more data on internal displacement as a result of slow-onset disasters and climate change, in order to reveal the current and future internal displacement trends and to better meet these challenges. The Special Rapporteur will continue to raise awareness of these neglected areas of internal displacement concern, as well as to advocate for national and international action to protect the human rights of persons who have been internally displaced as a result of all causes of displacement.

- As already mentioned, several countries have developed legal instruments and administrative and other measures to recognize indigenous rights to land and resources, including processes of land demarcation, title-clearing, dispute settlement, and others. Yet, even in those countries, implementation of legislation and policies is inadequate and indigenous peoples continue to be dispossessed of their traditional lands and resources and forcibly displaced, including by State-sponsored infrastructure, agribusiness, extractive projects and conservation measures. The consequences of such violations on indigenous peoples, as observed by the mandate holder in a wide range of countries across the world, continue to result in the expropriation of land, forced evictions, and the denial of self-governance, as well as discrimination against traditional livelihoods and loss of culture and spiritual sites.

- In order to facilitate the implementation of the agenda by States, the Special Rapporteur also supports the proposal made in the report of the Special Representative of the Secretary-General on Migration (A/71/728) with regard to financing through a collective fund. As stated in paragraph 34 of the present report, similar long-term strategies exist for the environment, trade and energy. Similarly, as outlined in the report of the Special Representative, a dedicated financing facility would be needed to support capacity development for the implementation of migration-related international commitments. The Special Rapporteur welcomes the opening of the Sustainable Development Goals Financing Lab, which is aimed at mobilizing the resources needed to support the world’s long-term sustainable development objectives, including in relation to migration.

- Despite this extraordinary protection framework, implementation has faced challenges. Women victims of sexual violence still faced barriers to filing reports and receiving adequate care and protection, particularly in remote areas. There was still heightened violence against displaced women linked to the illegal exploitation of mining resources or on the basis of their sexual orientation. Continued efforts were needed to ensure ongoing progress in a complex and dynamic context.

Strengthening voluntary standards for businesses on preventing and combating trafficking in persons and labour exploitation, especially in supply chains 2017, para. 40

- The evaluation of the competence of the auditors is also a key concern. The level of understanding of the complexities of detecting trafficking in persons, forced labour and other types of labour exploitation varies among those in the industry. The skills required to, among other things, interview workers, and an auditor’s comprehensive understanding of the specific vulnerabilities of categories of workers, such as migrant or contract workers, are indispensable to ensuring adequate evaluations of a company’s performance on indicators related to trafficking in persons. Unfortunately, one single team of auditors is often charged with the evaluation of the complete set of indicators, including those on other issues, such as deforestation or corruption. It is unlikely that auditors with expertise in environmental concerns would have also the same level of experience in evaluating corporate practices that represent risk indicators of trafficking in persons or forced labour, especially considering the subtle ways in which such practices may be concealed and the fact that workers themselves may be unaware of the wrongfulness of corporate practices that are perceived as common businesses practices, such as compulsory overtime or the payment of recruitment fees.

- Seasonal and migrant workers are also more vulnerable, as they may work temporarily at various agricultural sites, multiplying their exposure risk to pesticides. Language barriers may further prevent these workers from understanding labels and safety warnings, they may experience poor working conditions without access to adequate safety equipment and they may have difficulty accessing medical care and compensation for pesticide-related diseases. Workers may also have little control over the types of pesticides used.

- The right to freedom of opinion and expression must be respected "without distinction of any kind" (see article 2 (1) of the Covenant). Members of some groups, however, often face particular discrimination when it comes to the implementation of restrictions on expression. The Special Rapporteurs on the rights to freedom of peaceful assembly and of association, on the situation of human rights defenders and on the independence of judges and lawyers address issues pertaining to human rights defenders and non-governmental organizations (NGOs), often in collaboration with the Special Rapporteur on the promotion and protection of the right to freedom of opinion and expression. Given their focus and detailed reporting, I will not highlight here our shared concerns about restrictions imposed against NGOs, human rights defenders environmental activists, refugees and lawyers. Instead I will highlight several other groups whose expression is particularly subject to repression.

- Many migrants move voluntarily in a safe and regular manner and live and work in conditions in which their labour and human rights are respected. In some circumstances, families are reunified. Others are forced to migrate as a result of push factors, including poverty, discrimination, violence, conflict, political upheaval and poor governance, and pull factors, including official or unacknowledged labour needs, as explained above, or for family reunification. Children are disproportionately represented among those forcibly displaced. In the context of natural disasters and climate change, migration is increasingly seen as an adaptation measure ensuring resilience through planned mobility. In the process of migration, many face exploitation, discrimination, abuse and other human rights violations.

- Delivering better means learning the lessons and continuing to do what is done well while improving on it. It means being more strategic and collaborative, and working differently towards shared goals. Transcending the humanitarian-development divide will allow integrated action that invests in building self-reliance and resilience from the outset. To reduce displacement as a result of climate change, sudden and slow-onset disasters and conflict, we must act now and establish effective safeguards and benchmarks that will avoid future lost generations of displaced. No one should be left behind and the World Humanitarian Summit has taken important steps, but its commitments and promise must be realized in practice.

- Finally, while internal displacements due to disasters have traditionally been for short periods, their increased frequency and severity, including owing to climate change, point to more chronic situations likely to involve new, more prolonged or definitive displacements - and requiring more comprehensive displacement responses, in particular taking into account the needs of minorities. Moreover, recurrent disasters, such as more frequent flooding for example, can significantly impact the resilience of the people living in disaster-prone areas, including owing to destruction of livelihoods and destruction of homes and basic infrastructure.

- The current global humanitarian context is alarming. Ongoing and protracted conflicts are leading to massive displacement crises: there are unprecedented numbers of refugees and internally displaced persons, and inter-ethnic and interracial tensions and conflict are erupting in nearly every region of the world. Many conflicts threaten to further deteriorate, and new conflicts are emerging. These conflicts are often rooted in power struggles, identity politics, competition for resources, rising income disparities and socioeconomic inequalities, and increasing polarization of societies, making national, ethnic, religious and linguistic minorities particularly vulnerable; indeed many of the persons who flee their countries for fear of persecution are members of minority groups targeted precisely because of their minority identity. Furthermore, with the impact of climate change, disasters are becoming all too frequent and widespread, further affecting minorities.

- In India, Adivasis and tribal peoples have been evicted from tiger reserves for decades, often without any form of reparation. This continues to occur despite the Forest Rights Act of 2006, which only allows displacement from "critical wildlife habitats" if scientifically determined that the habitat is being damaged irreversibly and that co-existence is not possible. The Forest Rights Act stipulates that even then, displacement can only be carried out after obtaining free, prior and informed consent. In practice, however, displacement from protected areas continues across India through a combination of misinterpretation, coercion, and inducement. Reportedly, tribal peoples have faced prosecution for "offences" in protected areas, such as the traditional practice of collecting honey.

- The 2007 Basic principles and guidelines on development-based evictions and displacement provide valuable guidance in addressing the human rights implications of development-linked evictions and related displacement. They provide practical guidance to States on measures and procedures to be taken in order to ensure that development-based evictions are not undertaken in contravention of existing international human rights standards and do not thus constitute "forced evictions". The guidelines also focus on effective remedies for those whose human rights have been violated, should prevention measures fail. Independent human rights and environmental impact assessments of development and business activities likely to cause displacement should be conducted at the earliest opportunity, with their findings informing a legal project approval process and resettlement and rehabilitation programmes.

Outcomes and commitments on internal displacement of the World Humanitarian Summit 2016, para. 85

- This means increasing international focus and cooperation on risk reduction and resilience based on the 2015 Sendai Framework and the 2015 Paris Agreement on climate change. The Summit addressed displacement in the context of disasters and climate change and participants called for the development of an international mechanism and legal framework for the protection of those displaced by the adverse impacts of climate change. The 2010 Cancun Agreements recognized climate-induced displacement, and the Special Rapporteur examined this in his report to the General Assembly in 2011 (A/66/285). Disaster-related internal displacement is closely linked with disaster-related cross-border displacement. He welcomes the Agenda for the Protection of Cross-Border Displaced Persons in the Context of Disasters and Climate Change endorsed by 110 countries in 2015 under the Nansen Initiative.

- Without assembly and association rights, workers have little leverage to change the conditions that entrench poverty, fuel inequality and limit democracy. The need to maintain paid work is all-consuming; so many workers toil long hours for low wages in unsafe and unhealthy environments, risking disease, injury and death. They work without basic social protections such as health care, education, pensions or, in the case of trafficked workers, the right to choose or leave employment. The impact of the lack of assembly and association rights is compounded for migrant workers by harsh immigration laws, unscrupulous labour recruitment organizations, militarized labour systems and rights-restricted structures in export processing zones. Migrant domestic and agricultural workers, often excluded from labour law protection both at home and abroad, are doubly exploited and marginalized.

- Since 2008, an average of 26.4 million people each year have been displaced by natural disasters, including mudslides, earthquakes, floods, typhoons and tsunamis. The likelihood of being displaced by a disaster today is 60 per cent higher than it was four decades ago. Not surprisingly, a key factor of vulnerability is rapid, unplanned and poorly governed urbanization. The poorest and most precariously housed are disproportionately affected by natural disasters, often experiencing tragic consequences; they are also the least able to recover.

- Incorporating the Guiding Principles into regional human rights frameworks remains much needed. African States and the African Union have shown leadership, while much work remains to ensure that the Kampala Convention is ratified by all African States and implemented, including by establishing a conference of States parties. Creating such a mechanism will galvanize action and promote implementation of the Convention. It could develop tools, programmes and resources to allow it to be a regional authority on internal displacement that is able to provide practical assistance to States and foster regional solidarity to confront the challenges, including conflicts, disasters and climate change.

- The Kampala Convention calls upon States Parties to "endeavour to protect communities with special attachment to, and dependency, on land due to their particular culture and spiritual values from being displaced from such lands, except for compelling and overriding public interests". It requires States to "ensure the accountability of non-State actors concerned, including multinational companies and private military or security companies, for acts of arbitrary displacement or complicity in such acts" and to "ensure the accountability of non-State actors involved in the exploration and exploitation of economic and natural resources leading to displacement". International standards relating to the operations of business enterprises, including the 2011 Guiding Principles on Business and Human Rights, require States and businesses to comply with all applicable laws and to respect human rights.

- Development and business-related activities can create or exacerbate complex displacement scenarios. The rights of some communities, including indigenous or minority communities, such as their rights to the land on which their identity rests, can prove inconvenient in the face of development or economic interests. Militarization of areas allocated for resource development has been evident, with some companies using private military or security companies to enforce their encroachment onto some territories. Tactics to divide communities or bypass and undermine local leadership structures have been employed and may involve corrupt practices or payments that lead to breakdown of the social fabric of communities.
