- Persons with disabilities living in poverty in cities commonly live in informal settlements or homeless encampments. The Special Rapporteur has been shocked by the deplorable conditions endured by persons with disabilities in those contexts. Many, including young children and older persons, are left to languish in isolation, sometimes in dark rooms without electricity, hidden from view at the back of the home, without access to community centres, social opportunities or health clinics.

- The inability to afford adequate housing is frequently the greatest obstacle facing persons with disabilities in realizing their right thereto. They are more likely to live in poverty, and they have higher housing, equipment and health-care costs. Family income is reduced when a family member has to take on the role of support person. Inadequate levels of financial assistance and/or housing subsidies often make it impossible for persons with disabilities to obtain adequate housing and significantly increase the risk of homelessness.

- These tasks are all the more challenging in cases of prolonged, mass displacement. Displacement is a notorious driver of human and particularly housing-rights violations. According to displacement and resettlement experts there are eight major displacement impoverishment risk areas: landlessness, joblessness, homelessness, marginalization, increased morbidity and mortality, food insecurity, loss of access to common property resources, and social/community disarticulation. While the impacts of displacement are devastating for all who are affected, they are most acutely felt by those groups more vulnerable to discrimination, including women, minorities, children and persons with disabilities. If not mitigated through intensive, concerted effort, the consequences are long-term, entrenching patterns of poverty, exclusion, dependency and disempowerment.

- The causes of homelessness vary among particular groups. Street-connected children come from families with a wide range of experiences, including death, dislocation, disease, isolation, poverty, mental illness, domestic violence, child abuse and drug use. Women are forced into homelessness because of violence, unequal access to land and property, unequal wages and other forms of discrimination. Persons with disabilities are made homeless by lack of work, livelihoods and accessible housing. Young people are often denied access to housing and services in cities if they do not have appropriate government-issued documentation or identity cards. Conflict results in massive displacement and migration, as has been evidenced clearly by the waves of refugees from countries such as Afghanistan, Eritrea, Iraq, Somalia and the Syrian Arab Republic escaping from conflict, widespread violence and insecurity.

- Considering the limited length of this report and the mandate's focus on extreme poverty and human rights, no attempt is made to assess the extensive issue of human rights and care holistically. Rather, the report focuses specifically on the human rights of unpaid caregivers, in particular women living in poverty who provide unpaid care. Other relevant human rights implications of unpaid care work - such as tensions between care and unwanted dependency, abuses against persons with disabilities or older persons, and children's right to receive quality care - are not addressed, and only brief recommendations are made on paid domestic work. The Special Rapporteur hopes that this report will nevertheless encourage broader discussion of the human rights implication of care work.

- Simply making information available is not sufficient. The burdens involved in accessing information, such as travel costs, fees, long waiting periods, and interaction with State officials, can act as disincentives for the poorest. States often do not take into account the difficulties, such as financial, geographical, technological or linguistic barriers, that the poor face in accessing information. For example, in many States, information about new statutes is disseminated in a very limited way, or access to copies of enacted laws is conditional upon the payment of a fee. Information may only be available in written format, thus creating obstacles for those with low levels of literacy and persons with disabilities, or may only be published online or in commercial newspapers, or only in one official language.

- In particular, quality and affordable care services for carers and parents can have a major positive impact on the human rights of both caregivers and receivers. Investment in childcare, elder care and disability support should therefore be increased, prioritizing disadvantaged and underserved areas. The services should be affordable, and provided free to those who cannot afford to pay. In particular, all women should have economic and physical access to high-quality, culturally appropriate childcare for children under school age, including children with disabilities. As well as having a major positive impact on women's right to work, quality early childhood education accessible to people living in poverty has many proven benefits for children and society as a whole. Innovative approaches such as mobile crèches should be considered in order to reach communities living in poverty.

The introduction of carer credits into a country's pension or superannuation system can provide a method of explicitly recognizing those years spent providing unpaid care.

- As detailed in the expert's previous reports, social protection is defined as encompassing a wide range of policies designed to address the risks and vulnerabilities of individuals and groups, irrespective of whether they can or cannot work. It seeks to help them cope with, and overcome, situations of poverty, especially when they result from circumstances outside of their control. Social protection systems are generally structured around three important objectives for poverty elimination: (i) facilitating recovery from crises that have led people to become poor; (ii) contributing to the ability of chronically poor people to emerge from poverty; and (iii) supporting the less active poor (such as the elderly, persons with disabilities and children) so that their poverty will not be inherited by the next generation. Governmental entities are the main providers of social protection, but often civil society entities and the private sector also contribute.

- Persons living in poverty, particularly those with disabilities or older persons, may experience additional obstacles in accessing justice when courts and police stations are not appropriately designed, and when court processes are not adaptable. For example, many judicial systems are heavily reliant on paper forms and written submissions, and on the presentation of oral evidence. Often, police stations and courts are not wheelchair accessible. Where measures are not in place to enable judicial bodies to adapt their processes for those in need, including by providing aid to defendants, claimants, witnesses and jurors who require it, such persons are excluded from accessing and benefiting from the justice system.

- Low levels of revenue collection have a disproportionate impact on the poorest segments of the population and constitute a major obstacle to the capacity of the State to finance public services and social programmes. A lack of access to quality services is a constituent element of poverty, and people living in poverty are particularly dependent on public services, being unable to pay for private alternatives. In addition, their specific needs and characteristics make it more likely they will have to interact with State-funded institutions and services on a regular basis. This is particularly the case for people who experience multiple forms of discrimination and disadvantage; for example, persons with disabilities are more likely to come into regular contact with health and social services, while women are more likely to be directly dependent on social protection and health systems for at least some period of their lives because of their sexual and reproductive health and maternity-related needs. Women also serve as unpaid alternative care providers when public services are not adequately funded, increasing their time burden and limiting their opportunities to engage in paid work, education, training or leisure, while also negatively affecting their enjoyment of rights such as health, education, participation and social security.

- Even where legal aid services are available and adequately funded, discrimination in their design and implementation impedes certain individuals and groups from accessing them. For example, some rely on telephone intakes or written applications, failing to take into account the needs and constraints of persons with disabilities, older persons or those with lower levels of literacy. Inadequate or piecemeal support directed towards community-based paralegal programmes also restricts an important and more affordable source of legal assistance. Although all aspects of the legal profession should be regulated, excessive restrictions on the operation of paralegals, or lack of official recognition of their role, can also hamper the support they provide to persons living in poverty.

- According to article 13 of the International Covenant on Economic, Social and Cultural Rights, the right to education is a universal right. As recognized by Committee on Economic, Social and Cultural Rights in its general comment No. 13, education is the "primary vehicle by which economically and socially marginalized adults and children can lift themselves out of poverty and obtain the means to participate fully in their communities". The Committee on the Elimination of Racial Discrimination, in its general recommendation No. 30, has highlighted the need for States to ensure that all migrant children, irrespective of their status, have access to public educational institutions. The Committee on the Rights of the Child, in its general comment No. 9, endorsed the concept of inclusive education as "a set of values, principles and practices that seeks meaningful, effective, and quality education for all students, that does justice to the diversity of learning conditions and requirements not only of children with disabilities, but for all students".

- Much has been learned through questions in household surveys about intrahousehold inequalities related to water collection. Much less is known about such inequalities concerning sanitation and hygiene, and about water, sanitation and hygiene-related household inequalities concerning age and disability. Given that not all households share resources and assets equally among their members and that some may be relatively more privileged than others, commanding more income and accessing greater consumption opportunities, it is imperative to accurately disaggregate intrahousehold data regarding household resources such as water and sanitation. There is evidence that intrahousehold inequality and poverty may disproportionately affect women, persons with disabilities, children and older persons. Targets and indicators should be phrased to require monitoring of intrahousehold inequalities. They should shine a powerful light on areas that need change and ensure that monitoring is in line with the human rights imperative to overcome inequalities wherever they occur.

- Negative examples abound of the failure to achieve the appropriate balance between technical expertise and knowledge gained through experience. For example, there have been cases where providing communities with latrines using subsidies and a standard model design was expected to solve the rural sanitation problem. However, it emerged that the latrines were often not used, or were used as storage facilities or to house livestock. On the other hand, where modifications to water and sanitation facilities are needed to ensure accessibility by disabled persons, specialist knowledge plays a useful role by informing the process of analysing the strengths and weaknesses of each option so that people can make an informed choice in light of their particular needs. Testimony can be extremely powerful and effective for bringing people's experiences to bear. "Poverty truth commissions" can lead to a useful inversion of power dynamics, with those who have become experts through experience testifying and those "in power" hearing the testimony. The process ensures that people experiencing poverty are at the heart of developing solutions.

- Access to public information in relation to the adoption of new laws or amendments to existing legislation is crucial for ensuring justiciability. States are obliged to ensure that this information is made readily available and easily accessible for everyone without discrimination. Particular effort should be made to disseminate information in a format that is user-appropriate, taking into consideration the individual needs of persons with disabilities, and those with low levels of literacy. Migrants and minority groups should not be prevented from accessing information owing to linguistic barriers, and materials should be adapted accordingly. Logistical and financial barriers should also be addressed by taking into consideration the difficulties faced by those living in remote rural areas and those living in poverty.

- Like other programmes, conditional cash transfer programmes must take into account disability-related needs. However, there is growing evidence that the conditionalities attached to these programmes tend to exclude persons with disabilities owing to structural barriers. This includes, for instance, the lack of inclusive education that precludes children with disabilities from attending school or the lack of accessible information that impedes deaf persons from participating in training or meetings with the social services. In response, some conditional cash transfer programmes have opted to exempt persons with disabilities from the conditionalities that they cannot fulfil because of existing external barriers. While such exemptions allow persons with disabilities to fight short-term poverty, they contradict the overall goal of investing in human capabilities to promote social inclusion and active participation, and represent a missed opportunity to address longer-term poverty.

- Furthermore, household poverty rates do not consider the allocation of resources within a household. Evidence shows that persons with disabilities often do not get a share of their household's resources. For instance, if resources are tight, parents may pay for the education of their non-disabled children but not for those with a disability. Studies using multidimensional indices of poverty therefore show a greater poverty gap between persons with and without disabilities. - Support must be affordable for all persons with disabilities. Support services represent a significant cost for persons with disabilities, preventing them from climbing out of poverty. States must ensure that support is available at nominal or no cost to the maximum extent of their available resources, and take into account the gender disparity in income and access to financial resources. Social protection systems can constitute a powerful strategy to facilitate access to support services for persons with disabilities (see A/70/297, para. 9). Qualifying conditions for accessing support must be reasonable, proportionate and transparent, and should not be limited to those persons protected by social insurance schemes. Additionally, States should include the provision of essential assistive devices and technologies in the coverage of national health insurance and/or social protection schemes, on the basis of the World Health Organization priority assistive products list (ibid.). States should also consider waiving import duties and taxes on assistive devices and technologies that are not produced domestically (ibid., para. 48).
