- Oxfam researchers found that adaptation projects aimed at women created under Burkina Faso's National Action Programme for Adaptation (NAPA) sought to diversity the ways that women can generate income to offset income lost by harvests damaged by climate change. In order to rectify these consequences, individuals and organizations need to be better educated on the different vulnerabilities that men and women face in disasters, and local women's organizations need to be consulted in order to understand region-specific contexts. Moreover, such attempts could have ancillary positive effects, as developing credit systems to aid families during times of famine, strengthening women's organizations that promote adaptation measures, and addressing larger issues could prevent gender inequality.

- One area of concern is disaster management because climate change is likely to impact the number and severity of extreme weather events. Researches show that in societies where men and women should be impacted indiscriminately in disasters women and girls, as a result of gender based inequalities, are up to 14 times more likely to die in the event of a disaster. This is especially true of elderly women, those with disabilities, pregnant and nursing women, and those with small children, who may have lack of, or limited mobility and resources, and therefore remain most at risk in cases of emergency.

- Due to the depletion of resources, exodus of doctors and health-care personnel and attacks on health-care workers, countries and areas in post-conflict situations may be dependent on international donors and initiatives by non-governmental and intergovernmental organizations for the reconstruction of their health systems. Such health initiatives can be used as a tool for peacebuilding. International aid agencies have used such strategies to break through ethnic divides, thereby increasing the availability and accessibility of health facilities, goods and services and reducing discrimination. To ensure acceptability and accessibility of health services, international aid providers should also be cognizant of the culture of countries and communities. For example, in some countries, provision of health services to pregnant women by male doctors may not be culturally acceptable and may thus impede accessibility.

- Recovery efforts, by overlooking or directly discriminating against some groups, can perpetuate and even reinforce pre-existing patterns of vulnerability and disadvantage. This is often the case with women. In the wake of the 2004 Indian Ocean tsunami, it was reported that the international response on many occasions strengthened "those who were better off and/or more articulate … while marginalizing those who had few assets, notably women". Relief efforts and policies, for instance, excluded women from livelihoods assistance and on occasion directly undermined women's pre-existing rights, such as their rights to housing or land in matrilineal communities. When women also happen to have insecure tenure - as they often do because their access to housing and land frequently hinges on a relationship with a man, or because they face additional hurdles as sole head of a household, they are particularly vulnerable.

- Research conducted by the Active Learning Network for Accountability and Performance (ALNAP) and the ProVention Consortium in the wake of the 2005 South Asia earthquake found "accumulated evidence that people affected by disasters want to participate fully in the response, even if this means a slower implementation process. However, disbursement pressure - the need to get money out of the door - has in the past partly determined response mechanis."While emphasizing the importance of participation, the study also cautions: "When considering communities […] it is important to remember: not to romanticise the coping capacities and resilience of local people and communities - they often face insurmountable difficulties when responding to major disasters; that often 'communities', particularly in areas of high inequality, are made up of different interest groups, and include marginalised groups who may well have difficulty getting their views represented; cultural 'norms' may also, for example, work against women's rights."

- These and other proposals to address housing, land and property rights through the active participation of the affected people, and to build on existing community processes, were not taken up by the transitional authorities or the newly independent Government. In the aftermath of the later wave of violence, destruction and displacement of 2006-7, the need for such involvement became prominently recognised. The five pillars of the National Recovery Strategy included one aimed at building trust within communities and between the people and the Government. This was in the context of urgent attempts to achieve the reintegration and return of IDPs displaced by the violence to their communities, with the incentive of cash compensation from the State with which they could repair their homes or settle in alternative areas in cases where reintegration proved impossible. As part of a Dialogue, Communications and Outreach Programme, dialogue teams were established to manage the necessary conflict resolution, mediation and negotiation processes. This required the participation of local authorities, youth leaders and other groupings. The programme, which was still continuing in some communities in May 2010, incorporated the use of customary dispute resolution practices and peacebuilding ceremonies. It is widely regarded as having been successful and necessary for peacebuilding and the safe return of IDPs. Women reportedly participated far more actively than men in the community dialogue and reconciliation process. This was in contrast to the compensation payment process, which had been male-dominated.

- The poor often stand to lose most in disaster contexts because they often have to settle on fragile and exposed land that is highly susceptible to the effects of disasters. When a disaster strikes, their pre-existing vulnerabilities are exacerbated, with women, children and marginalized groups bearing the brunt of the impact. After the disaster, the poor often also find their attempts to return to their homes officially denied on the grounds that return would be unsafe, and/or not permissible as they did not have official proof of a right to live there in the first place. This can have dramatic consequences for the livelihoods of individuals, families and entire communities. In the case of conflicts, the displacement and dispossession of specific groups are often deliberate strategies of one group or side in the conflict against another. This can result in the total destruction and/or secondary occupation of their lands and homes, and obstruction of their attempts to return and reclaim what was theirs.

- Outside of the Americas, 2009 saw an alarming rise in comparison to previous years in the number of allegations received regarding murders of women human rights defenders and those working on women's rights or gender issues in the Russian Federation: four communications regarding alleged killings were sent in 2009. In this context, those targeted were often working on human rights in Chechnya and the North Caucasus generally, along with journalists. Other killings and attempted killings were reported in communications sent to the Philippines (eight communications), Iraq (two communications), India (two communications), Nepal (one communication), Sri Lanka (two communications), Israel (one communication), and the Congo (one communication), with further attempted killings being reported in communications sent to Pakistan (two communications), Bangladesh (one communication), the United States of America (one communication, concerning Iraq under U.S. Administration), and France (one communication, concerning French Guyana) during the 2004-2009 period.

- In recent years, increased attention has been devoted to rising rates of displacement linked to the effects of climate change and the particularly adverse effects of climate change on potentially vulnerable groups, including women. It is now widely acknowledged that climate change impacts on men and women differently at all stages from preparedness to reconstruction. As recognized by the Intergovernmental Panel on Climate Change (IPCC), inequitable gender roles may exacerbate women's exposure to harm, while at the same time women may make "very significant, active contributions … [to] coping with and adapting to extremes". Women often experience higher rates of mortality than men in natural disasters and may experience particularly deleterious effects on health, exacerbated gender inequality and reduced access to education and livelihood opportunities.

- A 2010 study, using Haiti, Kosovo and Sierra Leone as case studies, demonstrates the link between the introduction of peacekeeping forces into a conflict zone and the subsequent increase in human trafficking as a direct result of an increase in demand for sexual services. The relationship between deployed troops and the demand for trafficked women was also unmistakable in the countries of the former Yugoslavia, where demands for sexual services created by peacekeepers led to an expansion of the sex industry, with many of the women trafficked and sexually exploited forced to work in brothels established expressly to serve United Nations peacekeepers. The past involvement of military, peacekeeping, humanitarian and other international personnel in trafficking and related exploitation during post-conflict periods has been documented in multiple countries, including Angola, Bosnia and Herzegovina, Cambodia, the Democratic Republic of the Congo, East Timor, Kosovo, Liberia, Mozambique, Sierra Leone and Somalia.

- Children trafficked into forced military service perform a variety of combatant and supportive roles. Many children, typically boys, are forcibly recruited or kidnapped for use by armed militias in ongoing conflicts. Children are also used as suicide bombers and human shields. For instance in Iraq, ISIL and other extremist groups traffic boys and young men, including members of the Yazidi minority, into armed conflict, radicalize them to commit terrorist acts using deception, death threats or the offer of money and women as rewards. Others are compelled to work as porters, cooks, guards and messengers or are forced to commit crimes, such as looting and physical and sexual violence. Boys and girls in these situations are often sexually abused and may also be forced to take drugs.

- In addition, the nature and forms of trafficking in persons associated with conflict are highly gendered. For example, abduction into military forces affects males and females differently. Men and boys are typically forced into soldiering while women and girls are generally forced into support roles, and they typically face much greater risk of sexual assault as either a primary purpose or an additional manifestation of their exploitation. As previously noted, sexual enslavement, a practice exacerbated by situations of conflict, is highly gendered in that it disproportionately affects women and girls. Other forms of trafficking-related exploitation particular to or especially prevalent in conflict, including forced and temporary marriage, are highly gendered in their motivation and impact, which underscores the importance of a gender analysis in all trafficking prevention efforts and responses.

- In the aftermath of violent conflict, when "normalcy" is restored, women are subject to new and sometimes higher levels of violence from men whom they know in the family and the community. Internalization of violent mechanisms of conflict resolution, accumulated and unresolved feelings of male impotence and frustration, male anxiety around the empowerment of women who have become politically visible during the conflict or simply the increased vulnerability of women may be some of the reasons that make women the targets of rising levels of violence after official peace or democracy has been declared. Reparations programmes that take place at one given point in time and inevitably look to the past have inherent limitations to address future violations. However, the type of guarantees of non-repetition can ground practical obligations on the part of the State to take into account the foreseeable short- and medium-term legacies of its violent past for women and, more specifically, adopt measures to avoid the exploitation of new forms of vulnerability.

- With this scheme in mind and thinking about women as potential beneficiaries of reparations, the first hurdle relates to the fact that much of the violence that women and girls experience predates the conflict and only continues to aggravate the discrimination to which they are subjected in the post-conflict scenario. Even in non-conflict scenarios, acts of violence against women are part of a larger system of gender hierarchy that can only be fully grasped when seen in the broader structural context. Therefore, adequate reparations for women cannot simply be about returning them to where they were before the individual instance of violence, but instead should strive to have a transformative potential. Reparations should aspire, to the extent possible, to subvert, instead of reinforce, pre-existing structural inequality that may be at the root causes of the violence the women experience before, during and after the conflict.

- The lack of information on monitoring and evaluation processes and outcomes in respect of strategies/plans was the norm in State responses. Concerns by civil society organizations include: the existence of strategies without implementation plans; plans that do not set out the responsibility of different State agencies, benchmarks, timelines and budget allocations; the lack of adequate funding and specialized staffing for the implementation of such strategies and plans; the dependence on donors for funding for the implementation of plans; the lack of public education campaigns to generate information and knowledge about such strategies/plans; the lack of research on the effectiveness of such measures; and the lack of coherence and sustainability. While the Special Rapporteur encountered encouraging examples of joint protocols of action, referral systems and multidisciplinary mobile teams, adequate coordination among State service providers and between them and non-State services continues to be a main challenge. Also, the lack of sensitivity and of a women's rights perspective by these services often results in a lack of substantive protection for women victims.

- The engagement of the Security Council with regard to violence against women is reflected in the seven resolutions on women that it adopted between 2000 and 2013. Security Council resolution 1325 (2000) focuses on the incorporation of a gender perspective in conflict resolution by addressing the special needs of women, ensuring that humanitarian law is used to address women's rights and highlighting the critical role of women in peacebuilding. In this resolution, the Security Council recognized that women and children account for the vast majority of those adversely affected by armed conflict; called for specialized training for all peacekeeping personnel on the protection, special needs and human rights of women and children in conflict situations; and urged the Secretary-General to increase women's representation in conflict-resolution efforts. The Council also emphasized the responsibility of States to prosecute those responsible for sexual violence and highlighted the need for data collection.

- In subsequent resolutions, the Security Council focused on protecting civilians in general, particularly those who have been displaced; stressed the importance of education for preventing sexual exploitation and trafficking in humans; condemned all acts of sexual exploitation, abuse and trafficking of women and children by military, police and civilian personnel involved in United Nations operations; and recommended a policy of zero-tolerance for such violations. The Council also raised concerns about the obstacles to women's participation in the prevention and resolution of conflicts, including violence, intimidation, and discrimination. It requested the Secretary-General to publish a report on situations of armed conflict in which sexual violence has been widely or systematically employed against civilians, including an analysis of trends in sexual violence and benchmarks for measuring progress towards its elimination.

- In humanitarian situations, including in times of conflict or natural disaster, when water and sanitation sources are at a minimum, the specific needs of women and girls are often not taken into account. It is vital to better understand and share experiences about the kinds of responses that can be deployed across the diverse range of emergencies, including the most adequate and effective adaptations and interventions. It further requires an integrated approach and ongoing coordination among all sectors concerned. Lesbian, gay, bisexual, transgender, intersex and gender non-conforming people face additional challenges in areas affected by disaster. A recent United Nations assessment found that, in Europe, women and girls who are refugees are vulnerable to violence and lack services that specifically meet their needs, such as private bathing and sanitation facilities. Some women have reported having stopped eating or drinking to avoid going to the toilet where they felt unsafe. The reaction of Governments and others to these situations is considered inadequate and there is an emphasis on the urgent need to scale up such response efforts.

- While assessment of the impact of such measures was not uniform, and questions remained about whether the gendered analysis and approach to the crisis had deep impacts on the reconstruction of the economy, it can be said that the gender-sensitive response of the Government pre-empted a regression in welfare and women’s rights that had usually accompanied austerity measures. In addition, knowledge of the gendered and intersectional dimensions of crises and the effectiveness of the responses was enhanced through monitoring and data collection. - Conflict and displacement also give rise to increased numbers of persons with disabilities. In Lebanon, the Syrian Arab Republic and the Gaza Strip, for example, conflict has contributed to high numbers of persons with disabilities. At the same time, in each of those places, adequate, accessible housing is extremely scarce, with housing stock having been destroyed and a lack of access or specific policies blocking access to the materials and resources necessary to rebuild homes. - In humanitarian crises, the pre-existing vulnerabilities of girls that are rooted in discriminatory traditions and customs persist and lead to negative coping mechanisms. Children seeking to survive are often compelled to exchange sexual services, and girls are even forced to marry for food, shelter, protection or safe passage. According to the Secretary-General, approximately 90 per cent of women and girls affected by conflict in north-east Nigeria do not have access to basic services. As a result, they are forced to exchange sex for food and other essential supplies, and the child or forced marriages of girls to older men are on the rise, as a supposed protection mechanism and source of income for desperate families.

- According to the information received, the Colombian Constitutional Court has stated that women defenders face extraordinary risks linked to both their condition of women and to their active participation in community and social movements. In this connection, the Constitutional Court has issued orders to overcome the inadequate protection of those women who work as leaders of internally displaced communities and has highlighted the gender-related risks faced by women defenders in the context of the conflict.

- Ongoing efforts in the context of Security Council resolutions 1325 (2000), 1820 (2008 )and 1888 (2009), which seek, inter alia, to strengthen women's participation in decision-making and their agency in conflict prevention, early recovery and governance, as well as in ending conflict related sexual violence and impunity, are important in the context of internal displacement. Equally relevant to the situation of women and girls in internal displacement situations are a number of other instruments, including the International Convention on the Elimination of All Forms of Discrimination against Women, the Convention on the Rights of the Child, and the fundamental guarantees provided for in international humanitarian law. Despite these frameworks, the international community has paid insufficient attention to the particular human rights situation and solutions for women and girls in the specific context of internal displacement. The Special Rapporteur proposes to devote particular attention to exploring the gender dimensions of internal displacement, including by strengthening links with the Committee on the Elimination of Discrimination against Women, the Committee on the Rights of the Child and other relevant bodies and organizations, in order to address the specific human rights violations and discriminatory practices which impact on women and girls at every stage of the displacement process, and by examining alternative solutions and prevention strategies which would be especially effective for them.
