- Culture is a broad concept encompassing all forms of conduct, organization and human behaviour within society, including family, language, religion, philosophy, law, government, art and sport. Cultural diversity occurs when culture is expressed and develops in different contexts in society. Culture is not a static or unchanging concept, although some States tend to present it as such in order to justify inequality between men and women. This living, dynamic and evolving process permeates all human activities and institutions, including legal systems, in all societies across the world. Viewing culture and beliefs as immutable hinders the realization and development of all human rights, including those of women.

- The construction of gender is deeply embedded in culture. In its general recommendation No. 28, the Committee on the Elimination of Discrimination against Women indicates that "the term 'gender' refers to socially constructed identities, attributes and roles for women and men and society's social and cultural meaning for these biological differences resulting in hierarchical relationships between women and men and in the distribution of power and rights favouring men and disadvantaging women. This social positioning of women and men is affected by political, economic, cultural, social, religious, ideological and environmental factors and can be changed by culture, society and community."

- The Working Group notes the vital importance of article 5 of the Convention on the Elimination of All Forms of Discrimination against Women, which requires States to modify the social and cultural patterns of conduct of men and women, with a view to achieving the elimination of prejudices and customary practices that are based on the idea of the inferiority or the superiority of either of the sexes or on stereotyped roles for men and women. This provision establishes a legal basis for the primacy of women's right to equality over discriminatory cultural patterns of conduct, including those stemming from religious edicts.

- Parallel justice systems apply religious, customary or indigenous laws, which, as shown above, are patriarchal. These systems are mostly dominated by men and therefore tend to perpetuate inequalities and patriarchal interpretations of culture, resulting in discrimination against women. Regardless of whether the law is religious or customary, its provisions are often interpreted differently for men and women. The rulings and procedures of these legal mechanisms generally discriminate against women. Moreover, gender-based violence is seldom punished and is sometimes downplayed by religious or customary law courts.

- The effort to transplant the Western concept of property rights has created a number of problems, however. Unless it is transparent and carefully monitored, the titling process itself may be appropriated by local elites or foreign investors, with the complicity of corrupt officials. In addition, if it is based on the recognition of formal ownership, rather than on land users' rights, the titling process may confirm the unequal distribution of land, resulting in practice in a counter-agrarian reform. In particular, this will be the case in countries in which a small landed elite owns most of the available land, having benefited from the unequal agrarian structure of the colonial era. There is also a risk that titling will favour men. Any measures aimed at improving security of tenure should instead seek to correct existing imbalances, as the Land Management and Administration Project in Cambodia does.

- Such transformative approach is clearly required under human rights law. The Convention on the Elimination of All Forms of Discrimination against Women affirms that "a change in the traditional role of men as well as the role of women in society and in the family is needed to achieve full equality between men and women" (preamble, 14th para). Accordingly, States Parties shall seek, inter alia, to "modify the social and cultural patterns of conduct of men and women", and to promote the "recognition of the common responsibility of men and women in the upbringing and development of their children" (art. 5 (a). In reference to this provision, the Committee on the Elimination of Discrimination against Women has urged States to combat patriarchal attitudes and stereotypes regarding the roles and responsibilities of women and men within the family and society at large (women being considered as having the primary responsibility for child-rearing and domestic tasks, and men being considered the main breadwinners) and to reject the concept that assigns the role of "head of the household" to men.

- Inheritance is often the main avenue for women's land acquisition, yet women are still less likely to inherit land than men. Inheritance is often determined through marriage practices. Through patri-linearism, which is the most common societal system, sons, rather than daughters, inherit land from their fathers. Even where bilateral inheritance practices exist, communities may favor customary patrilineal practices. This is so in the case of the Mossi community in Burkina Faso "where despite the fact that the majority of families are Muslim, meaning that in theory daughters inherit land, this practice is not observed."

- On the positive side, the design of housing itself can certainly encourage greater equality vis-à-vis enjoyment and use of domestic space. An example of new ways of thinking about domestic space from a gender perspective can be seen through the development of housing projects which seek to promote non-hierarchical and more flexible uses of the home. For example, creating personal workspaces inside the home can support women who are more likely to engage in home-based income-generating activities. Another interesting development which can be found in certain policies relates to the design of kitchens, a traditionally female space which is often cramped and separated. The design of housing from a gender-sensitive perspective can better promote family integration, as well as a more equitable sharing of household responsibilities between women and men through openness and shared use of spaces.

- Under international human rights law, policies and programmes must be designed in ways that take into account the experiences and realities of marginalized groups so that their disadvantage is addressed in real terms. This is because equality is understood "substantively" and not just "formally". Even where laws and policies appear to be "fair" by treating everyone the same, the experience or effect of laws and policies can be discriminatory owing, for example, to a person's socioeconomic status, housing status or gender. States and subnational governments are obliged to address the needs of those in the most desperate housing situations as a matter of priority and urgency. Positive measures must be taken to reduce stigmatization and address the needs of homeless women and men, residents of informal settlements, low-income households and other groups lacking access to adequate housing.

- Compliance with those principles is particularly important in the implementation of social protection systems. This stems from the International Covenant on Economic Social and Cultural Rights, which prohibits any form of discrimination in the fulfilment of all economic, social and cultural rights, including the right to social security, and ensures the equal rights of men and women. The Convention on the Elimination of All Forms of Discrimination against Women, inter alia, obliges States parties to eliminate or amend policies and practices resulting in unequal access for women to public services such as health care and family benefits. It also highlights the unique challenges faced by working women during pregnancy and maternity and it encourages States to ensure that women have access to various social services that support them as they balance their work and family obligations.

- Economic shocks affect women and men differently. Owing to discrimination and gender inequality, women are disproportionately represented in the informal economy and thus have less access than men to many social insurance benefits, such as pensions and unemployment and sickness benefits. Moreover, an interrupted work history as a result of care responsibilities, in particular child-rearing, and a longer life expectancy worldwide reduce the ability of women to contribute to social protection schemes and further disadvantage them in old age.

- Family status depends on honour. In patriarchal and patrilineal societies, maintaining the honour of the family is a woman's responsibility. The concept of women as commodities and not as human beings endowed with dignity and rights equal to those of men is deeply embedded in these societies. Women are seen as the property of men and must be obedient and passive, rather than assertive and active. Any assertive behaviour is considered to be an element that would result in an imbalance of power relations within the parameters of the family unit (E/CN.4/2002/83, para. 27). UNICEF reports that in some countries, early marriages are regarded by families as a means of protecting girls from premarital sex that would undermine their honour and that of their families.

- Institutional and structural violence is any form of structural inequality or institutional discrimination that maintains a woman in a subordinate position, whether physical or ideological, to other people within her family, household or community. In many contexts, there are discriminatory measures in place that maintain gender stratification that privileges male power and control, and which disadvantages some women in particular ways. Gender ideologies that dictate that men should control women or allow for men to physically control their partners or children are forms of gender-based structural violence. Therefore, when a woman is abused by a husband because he believes he has the right to physically assault her, the woman is experiencing interpersonal and structural violence simultaneously.

- The inter-gender hierarchy between men and women inherent to patriarchy, together with the intra-gender hierarchy according to which women are constructed and valued, gives rise to the competing impulses of protecting valued women and attacking devalued women. In many cases, a cultural belief of, and value attached to, patriarchal authority, contributes to the gender stratification that exacerbates forms of violence against women. Many traditions promote the notion that the man is the natural head of the household, and when violence occurs in such contexts it can be very difficult for a woman to recognize her abuse as a violation of her rights. Even in cases where she suspects that she has a right not to be abused, there may be little or no community support for her to leave a household where violence is occurring.

- In 2000, the Human Rights Committee adopted general comment 28 on the equality of rights between men and women, in which it stated that honour crimes which remained unpunished constituted a serious violation of the International Covenant on Civil and Political Rights. Moreover, laws which imposed more severe penalties on women than on men for adultery or other offences also violated the requirement of equal treatment. In 2004, the General Assembly passed a resolution on the elimination of crimes against women and girls committed in the name of honour. It stressed the need to treat such crimes as criminal offences punishable by law. It emphasized that such crimes are incompatible with all religious and cultural values, and called upon all States to continue to intensify efforts to prevent and eliminate crimes against women and girls committed in the name of honour, by using legislative, administrative and programmatic measures.

In that context, article 5 (a) of the Convention on the Elimination of All Forms of Discrimination against Women requires States parties to take all appropriate measures "to modify the social and cultural patterns of conduct of men and women, with a view to achieving the elimination of prejudices and customary and all other practices which are based on the idea of the inferiority or the superiority of either of the sexes or on stereotyped roles for men and women". Similar provisions requiring States to combat stereotypes and prejudices are included in article 8, paragraph 1 (b) of the Convention on the Rights of Persons with Disabilities and article 7 of the International Convention on the Elimination of All Forms of Racial Discrimination. The rationale of these provisions can be transferred to stigmatized groups in general, since prejudices and ideas of inferiority and superiority are central to the formation of stigma.

- The ability to claim rights in front of the courts is important for changing social and cultural attitudes. The courts play a role in condemning practices that reinforce gender stereotypes and can require the State or third parties to adopt measures to address them. Recently, a group of students asked the Supreme Court of India whether menstruation could be a criterion for denying women of a certain age the right to enter a temple and worship in it. The Supreme Court addressed the following questions to the administration of the Sabarimala temple: "If men can go till a point (near the temple) without undertaking austere activities, why can't women go? … Are you associating menstruation with impurity? You are making a classification. Can a biological phenomenon be a reason for discrimination? All practices are acceptable till there is no distinction between genders."

- Inequalities based on gender exist in every country and in all aspects of social life, and are echoed in the vast divides between men and women in their ability to access, manage and benefit from water, sanitation and hygiene. A large and growing body of studies suggests that women and men often have differentiated access, use, experiences and knowledge of water, sanitation and hygiene. Cultural, social, economic and biological differences between women and men consistently lead to unequal opportunities for women in the enjoyment of the human rights to water and sanitation, with devastating consequences for the enjoyment of other human rights and gender equality more generally.
