- Multi-stakeholder initiatives should ensure that assurance providers and auditors have demonstrated knowledge and experience in assessing compliance with labour-related standards and in interviewing workers on an ongoing basis. When risk indicators are identified, the initiatives should consider requiring the collaboration of assurance providers and auditors with civil society organizations that are specialized in victim identification and that provide specialized services for trafficked persons. Multi-stakeholder initiatives should ensure that specialized services address gender concerns and that services are offered to both men and women. They should also consider including forced labour and human trafficking experts in oversight bodies.

- The most common providers of children for sexual exploitation are facilitators, who can range from procurers to traffickers and intermediaries, and include financial actors. Such individuals are not always part of criminal networks. Procurers are generally called by their vernacular name, such as "pimp" in English. They are the ones who identify the children and force them into sexual exploitation. Grooming is an essential part of the process. The aim is to entrap the children into a life of sexual servitude and manipulate them at will through extreme methods ranging from physical and psychological abuse to the provision of drugs and alcohol. The demography of procurers is diverse. Though most of them are men, there is a significant presence of women among procurers. There have also been cases of peer driven exploitation. There is also a substantial number of cases of parents and/or family members pushing their children into sexual exploitation in order to provide the family with supplementary income.

- In all of the above-mentioned offender categories, the majority of perpetrators are men; there is only anecdotal evidence of female offenders. Law enforcement data has consistently identified female offenders in the developed world, but without clearly classifying their crime. A 2005 study indicated that women accounted for up to five per cent of all sexual offences against children. The exact traits and motivations of female offenders are still the subject of numerous discussions and further research is required. They have generally been identified in cases of child abuse, and in respect to child sexual exploitation have fulfilled the role of accomplices to male offenders. Female offenders are indeed much more likely to act with a male offender. Comprehensive and updated data at the global level is nonetheless lacking. This is partly owing to pre-existing social constructs that have led to underreporting, since in most societies it has often been considered unimaginable for women to be sex offenders.

- Research on homicide resulting from intimate partner violence makes clear that, almost without exception, women are at greater risk than men and that the majority of women homicide victims are killed by intimate partners who are men. Studies by the United Nations Office on Drugs and Crime (UNODC) also confirm that, in many countries, intimate partner or family-related homicide is the major cause of homicide against women and that their homicide rates are much more likely to be driven by this type of violence than by the organized crime-related homicide typology that disproportionately affects men. In 2012, almost half of all women who were murdered worldwide (47 per cent) were killed by a family member or intimate partner, compared with 6 per cent of homicide victims who were men. As with all forms of intimate partner violence, intimate partner femicide is likely to be significantly undetected and underreported. Prosecutions usually do not integrate a gender perspective. There is a clear need to focus on femicide for the purpose of establishing modalities for a national femicide watch and observatories on violence against women.

- Those data had been gathered from publicly available sources, in particular media articles, and also included details of the perpetrators and the incident, including the date, names, police force jurisdiction, information about children, the recorded motive and the weapon used. Some of the data are verified, emanating from official reports, while other data, from media reports, are unverified. The census records women killed by men under any circumstance, not just intimate partner violence. Data are disaggregated by age, nationality, ethnicity and occupation of both the victim and perpetrator. Information on the health condition of the victim, including whether she was pregnant, and the relationship status with her perpetrator are recorded. This includes whether they were separated and, if so, the time that had elapsed between the actual separation or end of the relationship and the victim's death (from the information analysed, it appears that 53 per cent of intimate partner violence took place within one month of separation), whether the femicide took place in a context of the victim having rejected the perpetrator's advances or was committed in the course of another crime (e.g., high level of killings of older women in the course of burglaries) and any other information that would shed light on the nature of the femicide.

- The femicide census project in the United Kingdom of Great Britain and Northern Ireland began by using social media and blogging and later developed into an advocacy tool for the country to gather statistics in a different manner. It reports on the perpetrators and victims equally and includes a wide range of information about women who have been killed by men. It has relied on support from the private sector for the establishment and maintenance of its website. Information found in the census was gathered initially from a set of names that had been collected since January 2012 and recorded in a blog entitled "Counting dead women". The author of that blog had searched the Internet for news of women who had been killed by men.

- With regard to perpetrators, while the majority of traffickers are men, women constitute 28 per cent of convicted trafficking offenders. It is not uncommon for women victims of trafficking to be convicted for offences connected with, or arising out of, their trafficking situation, as a result of coercion by their perpetrators to undertake criminal activities. In those situations, they often come to the attention of the authorities primarily as offenders, whilst they should rather be identified as victims of trafficking. On the other hand, in some cases women start out as victims of trafficking and, as a means of escaping their own victimization, turn into perpetrators, undertaking the most visible and dangerous criminal tasks. In that regard, the mandate has noted the involvement of women traffickers in areas such as the recruitment and controlling of children for forced labour and domestic servitude, and of women and girls for sexual exploitation (A/HRC/23/48/Add.2 and A/HRC/26/37/Add.4).

- In some countries, legislative provisions strengthen patriarchal family structures, as well as the concomitant discrimination and violence against women. This is particularly true of provisions allowing rapists to marry their victims in order to escape legal proceedings and laws that exclude marital rape from the prohibition of rape under criminal law. In some contexts, only men are able to transmit their nationality to their foreign spouses and their children. This de jure inequality has considerable effects on women and their children because the State protection granted by citizenship is refused them de facto.

Of particular importance is the Protocol to the Forced Labour Convention, 1930 which came into force in 2014, complementing ILO Convention No. 29 and re-enforcing existing international law. The Protocol creates new obligations to prevent forced labour, to protect victims and to provide access to remedy, such as compensation for material and physical harm. It is also supported by a recommendation that provides technical guidance on its implementation.

- Human rights due diligence also requires that investigations and prosecution adopt gender-specific measures that take into account the different assistance and protection needs of women and men, girls and boys and overcome discriminatory barriers to accessing remedies, such as by preventing the introduction of discriminatory evidence in proceedings to determine the victim's right to redress and ensuring that complaint mechanisms and investigations into trafficking in persons incorporate specific positive measures that enable victims to come forward to seek and obtain redress. States should also address other barriers that victims of trafficking in persons often face, including diplomatic immunity when domestic workers are in diplomatic households. Some countries, such as Switzerland and Belgium, have established a specific mediation mechanism to resolve labour conflicts arising between domestic workers and persons enjoying diplomatic privileges and immunities. Trafficked persons, as well as their families and relevant witnesses, should be protected against unlawful interference with their privacy and safety before, during and after relevant proceedings.
