- Similarly, on 24 November 2015, Mozambique adopted an action plan to respond to attacks, with concrete, time-bound measures. The action plan is based on a preliminary socio-anthropological study on albinism conducted by the Institute of Social-Cultural Research. The main areas of the action plan are promoting education on albinism, public education and awareness-raising on the issue among families and communities; guaranteeing protection and social assistance to persons with albinism; ensuring prevention of attacks, legal assistance and procedural celerity; sharing and publication of judicial decisions as a means of deterrence; and conducting further research to improve measures identified in the plan and to support evidence-based policymaking.

- Support is usually delivered by a mixture of providers, including State agencies, private organizations, non-profit organizations, charities and families. In high- and middle-income countries, States have traditionally been the main source of formal support, either through their centralized health-care or social protection systems or through local authorities. In many cases, States fund and contract non-profit organizations and private organizations to carry out these interventions. In low-income countries, charities and international non-governmental organizations are the main providers of formal support, often with limited sustainability and low standards of quality. Regardless of the type of service delivery arrangement, States have an obligation to ensure that persons with disabilities have access to and receive quality services and adequate support, including when service provision is delegated to non-profit organizations and private actors. In such cases, States must adopt a comprehensive regulatory and monitoring framework that involves a due diligence obligation.

The right of women to equality in the family was established in the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights and elaborated in articles 2 and 16 of the Convention.

- Reform of family laws provides a firm basis to overcome structural and cultural impediments to women's equal and full participation in political and public life. Family laws have been the focus of reform throughout history, as part of whole movements of States and societies towards modernity. In most cases, religious hermeneutic projects, particularly when initiated as part of broader reforms during times of political transition, have been an integral part of making these changes possible, with a prominent role played by women's rights movements, as in the case of Morocco, which achieved significant reform on many fronts in the family code (Moudawana), and by reform-minded religious institutions. The political will for these reforms, in State-sponsored modernization projects and social engineering agendas, has existed in diverse contexts of colonial power, the post-colonial State and communist regimes.

- In some countries, legislative provisions strengthen patriarchal family structures, as well as the concomitant discrimination and violence against women. This is particularly true of provisions allowing rapists to marry their victims in order to escape legal proceedings and laws that exclude marital rape from the prohibition of rape under criminal law. In some contexts, only men are able to transmit their nationality to their foreign spouses and their children. This de jure inequality has considerable effects on women and their children because the State protection granted by citizenship is refused them de facto.

- National constitutions are generally the supreme law in most States and form the foundation of the State's institutional and legal structures. They also provide the framework for the elimination of discrimination against women. An explicit constitutional guarantee of gender equality is fundamental to combating discrimination against women and girls in law and in practice. Many countries have already recognized and enshrined this principle of equality in their constitutional laws, and it is essential that it apply in all areas of law, including family law.

- The second process is the transition from patriarchal religious family law to a secular family law system that provides for gender equality in the family. Several States where family law was based on patriarchal religious codes have introduced equality for women in the family by revoking religious laws and regulating family affairs under secular codes. In many European countries, family law was based on religious, primarily Christian, laws, and all marriages were thus placed under religious jurisdiction. At the end of the nineteenth century, all matters relating to family were placed under the secular jurisdiction of the State, thereby removing the religious hegemony in this area.

Procedures to bring claims must be simplified for unrepresented claimants, and kept as informal as possible for quasi-judicial institutions. Rules with respect to legal standing to bring a claim should allow not just a child and their parents, but also third parties to bring a claim based on the alleged violation, in order to ensure that cultural constraints, or threats against the victims, do not prevent cases from emerging.

Violations of the right to education may be voiced in the media, but they must also be subject to effective adjudication. For this reason, legal standing should be given the broadest possible interpretation, to allow not just affected children, but also their parents and other education stakeholders to bring complaints before judicial and quasi-judicial bodies. Poor and disadvantaged persons may be unwilling to pursue their rights, out of fear of reprisals, lack of financial resources, or unwillingness to challenge State authorities. Quasi-judicial institutions should be empowered to initiate investigations suo moto, and third parties, including non-governmental actors, should be able to initiate cases before courts and human rights institutions where the available evidence supports them.

- The World Bank and the International Finance Corporation have been key proponents of public-private partnerships and have been particularly instrumental in facilitating the replication of what they consider to be successful pilots or experiments in partnerships between Governments and the private sector. A small cluster of large, powerful, global management firms have taken large interests in such public-private partnerships. Outsourcing education activities to profit-making corporations opens the space for them not only to make a profit, but also to steer education agendas in ways that may not be in the best interest of students, parents and teachers and thus societies as a whole.

- Public-private partnerships in education may take many forms and arrangements, such as contractual arrangements with the private sector for public school infrastructure or school management, to operate public schools or manage certain aspects of public school operations. Public-private partnerships can also involve government purchases of education services delivered by private schools or private entities. Capacity-building initiatives, the training of public school teachers and curriculum enhancement programmes delivered by the private sector are other forms of public-private partnerships. Voucher systems, which provide government grants for students from low-income families to enrol in private schools, also amount to public-private partnerships. Another modality of public-private partnerships is the provision of cash and in-kind resources by private sector partners to complement government funding of public schools or "adopt a school" programmes.

The experience of Chile demonstrates the negative consequences of a voucher system in creating social stratification. Education service contracting in the Philippines, providing a public subsidy for each student opting to enrol in eligible private schools, is fraught with similar consequences, exacerbating inequities and social segregation. The Punjab Education Foundation in Pakistan, which sources funds from donors and financial institutions (in mixed loans and grants) and allocates vouchers to selected private schools, allows private individuals to manage government-created foundations as public-private partnerships, which is detrimental to public investment in education.

- The pricing mechanisms should be clear and transparent and show how prices incorporate production costs, risks and returns. While a variety of price models exist (e.g. spot market-based pricing, split pricing, fixed prices and flexible price model), in the view of the Special Rapporteur, the ideal pricing mechanism is one replicating the formula used in fair trade schemes. The producer should be guaranteed a fixed minimum price based on the need to meet production costs and to ensure a living wage for all the workers concerned (including family members, where applicable) (see A/HRC/13/33, paras. 14-17), but the prices paid by the buyer should be higher if market prices increase. This is the price-setting mechanism used, for instance, by MBSA for the acquisition of jatropha produced by smallholders in Mali. The farmers, represented by a union of cooperatives, are guaranteed a minimum price, which may increase relative to the price of diesel at the pump. This eliminates the temptation for the producer to sell goods outside the terms of the contract, and thus the need for the buyer to closely monitor the producer's operations. It therefore guarantees a stable supply for the buyer, while simultaneously reducing transaction costs linked with the contracting of a large number of small-scale suppliers. Pricing mechanisms should be subject to an independent arbitration mechanism, and farmers should be provided with the market prices of internationally traded commodities to reduce the risks associated with the asymmetry of information between the parties.

- However, partly because of concerns with the fiscal sustainability of unconditional cash transfer programs, and partly in order to encourage poor families to invest more in their children and thus reduce the inter-generational transmission of poverty, conditional cash transfers (CCTs) have been expanding in recent years. Such CCTs generally target certain poor regions and, within those regions, poor households. They generally provide cash or sometimes nutritional supplements, usually to the mother or primary caregiver, provided certain conditions are met. These conditions relate most often to children's school enrolment and attendance level, and attendance at pre- and postnatal health-care appointments to ensure that children receive appropriate vaccinations and to check their growth. In previous mission reports, the Special Rapporteur discussed the well-known CCTs that have been launched in Mexico (Progresa/Oportunidades) and in Brazil (Bolsa Familia) (A/HRC/13/33/Add.6 and A/HRC/19/59/Add.2). An early example is Bangladesh's Female Secondary School Assistance Project (FSSAP) launched in 1993 (see para. 16 above), which was complemented, in July 2002, by the Primary Education Stipend Project (PESP). The PESP aimed to increase the educational participation (enrolment, continued attendance and educational performance) of primary school children from poor families throughout Bangladesh (initially estimated at more than 5 million pupils) by providing cash payments to targeted households. Despite significant targeting problems during its initial phase, the programme is credited for improving educational attainments.

- Brazil's agroecology policies have already experienced success. Approximately 100,000 family farms have adopted agroecological farming practices. These farms have had average yield increases of 100-300 per cent and demonstrated greater resilience to irregular weather patterns. Brazil has also developed programmes that provide access to low-interest credit for family farmers and also offered technical support for 2.3 million families in 2010. It has stimulated agroecological systems by providing technical support for crop diversification techniques and irrigation systems.

The programme in Brazil has grown from covering 3.6 million families in 2003 to 13.8 million in 2012, while a solidarity-based pension system in Chile went from 560,000 beneficiaries in 2008 to 1.1 million in 2012. In China, the Di bao reforms aim to create social insurance and assistance programmes to protect the entire population against economic insecurity and physical infirmity. Overall, there has, as the World Bank observes, been "an exponential growth in social safety nets, especially cash-based programs".

- It must also be acknowledged that even within the United Nations family, there are significant differences in approach. A recent report on social protection floors by the United Nations Development Group explicitly acknowledged such differences and sought to downplay the consequences. It began by acknowledging that social protection occupies different positions within United Nations organizations' mandates and agendas, resulting in "different working definitions and components" being used. But it went on to note, reassuringly and in terms similar to those used by the World Bank, that United Nations organizations nevertheless "have much in common in terms of the desired objectives, principles, and approaches to social protection".

- Another key area of focus of the mandate of the Special Rapporteur on contemporary forms of slavery, including its causes and consequences, is child and forced marriage. The Supplementary Convention on the Abolition of Slavery, the Slave Trade, and Institutions and Practices Similar to Slavery obligates Member States to take all "practicable and necessary legislative and other measures to bring about progressively and as soon as possible the complete abolition or abandonment" of, inter alia, any institution or practice which amounts to forced marriage, such as when a woman, without the right to refuse, is promised or given in marriage on payment to her parents, guardians, family or another person or group; when a husband, his family or his clan transfers his wife to another person for value received or for any other reason; or the inheriting by another person of a woman on the death of her husband (see art. 1). Early and forced marriage can, under certain circumstances, constitute servile marriage or result in domestic servitude or other forms of slavery. The previous mandate holder drew links between child marriage and slavery, and pointed out that Member States were obliged to prohibit and eliminate slavery as a non-derogable and fundamental principle of international law. Child marriage is linked to the thematic issues of trafficking for forced labour, commercial sexual exploitation, migration and contemporary forms of slavery, which reinforces the need for cooperation among the respective mandate holders as part of a comprehensive multi-agency and multi-stakeholder effort to eradicate those practices from society, as women and girls in child and forced marriages may experience conditions within the marriage that meet "international legal definitions of slavery and slavery-like practices", including forced labour. Furthermore, "a potentially high proportion of child marriage cases appear to constitute the worst forms of child labour under the 1999 ILO Convention No. 182."

- Studies suggest that up to 80 per cent of women in prison are mothers. Many female prisoners are single mothers or primary caregivers, and imprisonment can result in considerable hardship for their children. Contact between detained mothers and their children is often difficult due to the remote location of female prisons. Concern about their children is a primary factor leading to the high incidence of mental health problems and self-harm among female detainees. The Bangkok Rules require that parental and child-caring responsibilities be taken into account in the allocation and sentence-planning processes. The best interests of the child, including the need to maintain direct contact with the mother, must be carefully and independently considered by competent professionals and taken into account in all decisions pertaining to detention, including pretrial detention, sentencing and the placement of the child (CRC/C/THA/CO/2).
