- The work of WHO, particularly in the area of sexual health, has already been referred to above, as has the work of UNHCR on refugees, asylum seekers and stateless persons, particularly in relation to the intersectionality issue. UNHCR has been facing new challenges in regard to recent outflows from the war-related situations in Middle East to Europe and other regions, and it has done key work to raise the profile of sexual orientation and gender identity issues. Meanwhile, UN-Women has been highlighting the rights of lesbians and bisexual, transgender and intersex women and girls; thus has included the mapping of country situations and support for follow-up to the recommendations of human rights treaty bodies and the universal periodic review. For instance, there is an awareness-raising programme on action to end violence against women in Malawi, which includes references to lesbian, bisexual and transgender women. Complementing this, the International Labour Organization is infusing the lesbian, gay, bisexual and transgender issue strongly into its decent work programme, while the World Bank has helped to examine the cost of homophobia as well as to generate data on lesbian, gay, bisexual and transgender exclusion. The World Bank has now a focal point on sexual orientation and gender identity and this provides an important opportunity to address violence and discrimination on the basis of sexual orientation and gender identity, especially with low-income countries. A range of other United Nations agencies and programmes, enhanced by United Nations country teams, are progressively integrating the issue of sexual orientation and gender identity into country programming.

- Water points and sanitation facilities must be made available and accessible to women, ensuring women's rights to water and sanitation, as well as to health. In order to ensure that women's needs are adequately reflected in housing law, policy, and programming, a human rights-based approach requires that women be able to participate in all stages of policy and programme development, so that they are able to give input into the kinds of resources most needed by them within their specific social and cultural context. For example, the recent Inter-Agency Standing Committee guidelines on addressing gender issues in the aftermath of Haiti's earthquake of January 2010 highlighted that "it is essential that water and sanitation actors consult women and girls on the location of sanitation facilities to ensure that the route is safe; that latrines be well lit, lockable from the inside, and offer privacy."

- Domestic bonded labour can be linked to gender-discriminatory cultural practices. Among certain ethnic groups in Ghana and neighbouring countries, for instance, girls as young as 6-10 years old are forced into bonded labour, serving as so-called trokosi or vudusi in the household of priests at local fetish shrines. They are given by their parents to the shrine to pay the shrine for erasing a moral failing or curse attached to the parents. In addition to performing domestic chores and ritual duties at the shrine, a trokosi is usually also expected to work long hours on farmland belonging to the shrine. From puberty, she is expected to endure sexual relations with the fetish priest. Although the Government of Ghana has criminalized the practice, it has not yet been eradicated.

- It is important to note the distinction between servile marriage and arranged marriage. The Working Group on Contemporary Forms of Slavery was established by the Economic and Social Council in its decision 16 (LVI) to monitor the existence of slavery and the slave trade in all their practices and manifestations, including slavery-like practices such as servile marriage. The Working Group believed that it was important to highlight the distinction between forced marriage and arranged marriage. Arranged marriages, which exist in many parts of the world, are based on the consent of both parties, whereas forced marriages do not involve the consent of the parties or, at any rate, both of the parties. Any duress in a marriage is a violation of internationally recognized human rights standards and cannot be justified on religious or cultural grounds. The Working Group asserted that the perpetuation of forced and early marriages was a result of gender inequality and lack of both a culture of education for girls and of self-esteem.

Families will often give preference to boys to continue their education, while girls are forced to drop out of school to help earn money for the family. In some cultural contexts, there is a widespread belief that domestic work provides better training for becoming a wife and mother than formal education.

- Domestic work also draws in many women and girls with irregular migration status, because it is less visible, usually provides cash payment and, in many cases, a place to stay. Women in such situations usually fear reporting exploitation to the authorities, especially where criminal investigations and the enforcement of labour standards are linked to immigration control. Domestic workers without papers include women who should qualify for asylum or other protected status, but face deportation because States fail to respect their international obligations not to subject to refoulement persons who would face persecution or torture upon their return. Victims of gender-based persecution - e.g. women at risk of "honour" killings - are also prone to becoming undocumented migrants vulnerable to exploitation, because national authorities fail to recognize such persecution or unrealistically assume that the victim has "internal flight alternatives" in her country of origin.

- Gender inequality also contributes to servile marriage through its impact on formal legal systems. Although a woman's right to choose if, when and whom to marry is recognized in international human rights law, and although the Committee on the Elimination of All Forms of Discrimination against Women and the Committee on the Rights of the Child and other treaty bodies state that the minimum age of marriage should be 18 years, several countries with high rates of early marriage also have unequal laws of consent for boys and girls. Such laws reinforce and legalize the idea that marriage is suitable for girls earlier than for boys. Patriarchal laws and practices give women and girls less negotiating power around marriage and sexual and reproductive health and rights.

- In 1995, the Beijing Declaration and Platform for Action highlighted the importance of tackling the unequal distribution of paid and unpaid work between men and women, as an essential step towards achieving gender equality. Unfortunately, very little progress has been made since that time. The neglect of unpaid care in policy persists, at great cost to caregivers themselves. Across the world, millions of women still find that poverty is their reward for a lifetime spent caring, and unpaid care provision by women and girls is still treated as an infinite, cost-free resource that fills the gaps when public services are not available or accessible. This report calls for a fundamental shift in this status quo, as part of States' fundamental human rights obligations. Without further delay, public policies should position care as a social and collective responsibility and treat unpaid caregivers and those they care for as rights holders.

- Although many forms of discrimination are inherently unjust, the correlation between gender-based discrimination and economic inequalities deserves special mention since it potentially affects half of the world's population. While both men and women may experience myriad inequalities, based on factors such as their race, ethnicity, sexual orientation or disability, gender-based discrimination is too often seen to be almost exclusively a women's problem. In its World Development Report 2012, the World Bank describes the forms of discrimination that still exist in many countries and that directly affect economic inequality between men and women. According to the World Bank, men and women still have different ownership rights in at least nine countries, and in many countries, women and girls still have fewer inheritance rights than men and boys. In addition, women continue to fare badly in the labour market generally. A stocktaking by the United Nations Entity for Gender Equality and the Empowerment of Women (UN-Women) shows that almost 80 countries maintain restrictions on the types of work that women are permitted to undertake. Also according to UN-Women, at the global level, women's labour force participation rates have stagnated since the 1990s. Currently, only half of women are in the labour force compared to more than three quarters of men. Despite considerable regional variations, nowhere has this gender gap been eliminated: globally, women earn on average 24 per cent less than men. In one study of four countries, lifetime income gaps between women and men were estimated to be between 31 and 75 per cent.

Gender-based discrimination limits women's opportunities to gain access to education, decent work, land ownership, credit, inheritance and other economic resources, thus increasing their likelihood of living in extreme poverty. Accordingly, it is widely accepted that improving the situation of women is essential for sustainable development. - Nonetheless, social protection programmes have limits. Many countries pride themselves on having achieved quantifiable improvements in gender equality, especially regarding girls' access to education. For example, the Female Secondary School Assistance Project in Bangladesh, which provides girls with a stipend so that they can attend school, has been recognized as successful in raising enrolment rates for girls. However, States must take care not to limit their efforts to promote gender equality to improving parity between girls' and boys' enrolment rates. While stipends promoting girls' enrolment are important, they must be accompanied by broader measures addressing other concerns of particular importance to women, such as gender-based violence, including harmful traditional practices (for example, female genital mutilation and child marriage). Several countries have expressed frustration at the narrowness of some of the indicators for Millennium Development Goal 3 (promote gender equality and empower women) and have chosen to focus their energies on their own indicators related to gender equality, such as formal workforce participation, wage gaps, political participation and domestic violence. The independent expert believes States should adopt or revise national targets and indicators for all Millennium Development Goals in line with their obligations under human rights law, in order to accelerate their progress in achieving the Goals.

- In order to ensure that women's rights are fully respected, social protection programmes must be accompanied by gender-sensitive social services, including sexual and reproductive health care. This requires investment in public services, without which social protection programmes will not be effective. Women and girls, for example, may be prevented from meeting conditionalities imposed by a programme if social services are far away and transportation costs are too high, or if they fear being sexually assaulted while making the trip required. Girls may not attend school if there are no separate sanitation facilities for them or if they are harassed by teachers or other students. Mothers may not bring their children to the hospital owing to discriminatory practices on the part of health-care providers (for example, requesting the consent of the husband) or communication difficulties (for example, women might be expected to demonstrate some form of literacy or might not be able to communicate in their minority language). In the same vein, women may choose not to use clinics for child delivery because of a lack of skilled birth attendants or culturally appropriate birthing methods.

- In 2009, of the world's 101 million children out of school, an estimated 50-70 per cent were from minorities or indigenous peoples. In Central Africa, the great majority of Batwa and Baka have not had access even to primary education. Only 13 per cent of children in sub-Saharan Africa have access to primary education in their mother tongue. In South Asia, Dalit girls are prevented from pursuing their education not only because of poverty, but through discrimination and sexual violence. Literacy levels are commonly much lower among Dalit girls. For example, in the Mushahar Dalit community in India, barely 9 per cent of women are literate. In Latin America, millions of indigenous and African descendant children work in fields, plantations or mines instead of being in school.
