- Continual evaluation is therefore a crucial component of effective measures. The Committee has consistently recommended that States parties provide data disaggregated by age, gender and other key factors in their reports to enable the Committee to adequately evaluate the implementation of the Convention. Disaggregated data permits the States parties and the Committee to identify, compare and take steps to remedy discriminatory treatment that may otherwise go unnoticed and unaddressed. States parties are requested to describe, as far as possible, factors affecting the incidence and prevention of torture or ill-treatment, as well as the difficulties experienced in preventing torture or ill-treatment against specific relevant sectors of the population, such as minorities, victims of torture, children and women, taking into account the general and particular forms that such torture and ill-treatment may take.

- Certain forms of racial discrimination may be directed towards women specifically because of their gender, such as sexual violence committed against women members of particular racial or ethnic groups in detention or during armed conflict; the coerced sterilization of indigenous women; abuse of women workers in the informal sector or domestic workers employed abroad by their employers. Racial discrimination may have consequences that affect primarily or only women, such as pregnancy resulting from racial bias motivated rape; in some societies women victims of such rape may also be ostracized. Women may also be further hindered by a lack of access to remedies and complaint mechanisms for racial discrimination because of gender related impediments, such as gender bias in the legal system and discrimination against women in private spheres of life.

- Women with disabilities are not a homogenous group. They include: indigenous women; refugee, migrant, asylum seeker and internally displaced women; women in detention (hospitals, residential institutions, juvenile or correctional facilities and prisons); women living in poverty; women from different ethnic, religious and racial backgrounds; women with multiple disabilities and high levels of support; women with albinism; and lesbian, bi-sexual, transgender women, and intersex persons. The diversity of women with disabilities also includes all types of impairments which is understood as physical, psychosocial, intellectual or sensory conditions which may or may not come with functional limitations. Disability is understood as the social effect of the interaction between individual impairment and the social and material environment, as described in article 1.

Consistent with article 39 of the Convention, States parties shall take all appropriate measures to promote physical and psychological recovery and social reintegration of a child victim of any form of exploitation, abuse, torture or any other form of cruel, inhuman or degrading treatment or punishment or armed conflicts. - Article 38 of the Convention obliges States parties to ensure respect for the rules of humanitarian law, to protect the civilian population and to take care of children who are affected by armed conflict. States parties should pay particular attention to the risks indigenous children face in hostilities and take maximum preventive measures in consultation with the communities concerned. Military activities on indigenous territories should be avoided to the extent possible, the Committee recalls article 30 of the United Nations Declaration on the Rights of Indigenous Peoples in this regard. States parties should not require military conscription of indigenous children under the age of 18 years. States parties are encouraged to ratify and implement the Optional Protocol on the Involvement of Children in Armed Conflict.

Health services should to the extent possible be community based and planned and administered in cooperation with the peoples concerned. Particular attention should be given to ensuring access to health care for indigenous peoples who reside in rural and remote areas or in areas of armed conflict or who are migrant workers, refugees or displaced. - In Honduras, in the wake of Hurricane Mitch in 1998, the groups disproportionately affected included poor women, peasants and indigenous groups, many of whom had been living under insecure tenure conditions and in vulnerable areas exposed to strong winds, flooding and landslides (see A/HRC/16/42, para. 32). In Colombia, the floods throughout 2010 and into 2011 were said to have disproportionately affected those already displaced by conflict, particularly indigenous and Afro-Colombians, who tended to live in remote areas subject to violence from armed groups.

- While improved statistical data will be important to guide public policy and to hold governments accountable, adjustments will need to be made for the inevitable limitations, omissions and possible distortions in available data. Challenges associated with measuring homelessness should not be allowed to encourage policies that respond only to the visible and more easily measured forms of homelessness. Homelessness among single men living on the streets or using emergency shelters is more easily measured. It is more difficult to measure homelessness among women, children and young people living temporarily with family or friends, or among those most marginalized and precariously housed within informal settlements, who may be altogether left out of census or data collection. It is equally difficult to identify and measure homelessness among indigenous households or communities displaced from ancestral lands. Members of ethnic minorities may not wish to be identified by authorities. In Kenya, for instance, many of the people who become homeless because of ethnic violence did not want to be identified for fear of reprisal. Policy responses and assessments of progress in eliminating homelessness must make allowances for less visible dimensions of homelessness that may not have been measured.

- At the same time, ambitious plans for "redevelopment" and luxury tourism emerged, including for those coastal areas closed off to residents for safety reasons. One tourism board announced at the time that the tsunami offered an opportunity to make of its country a "world class tourism destination". It was reported that while displaced persons were prohibited from returning to their homes, the same prohibition did not apply to hotel complexes. In some places, land developers simply used the opportunity to grab land, especially from the most vulnerable communities. Luxury hotels sprang up in many coastal areas. Communities and civil society organizations complained that the creation of zones was used to arbitrarily evict poor coastal dwellers and indigenous communities to the benefit of businesses and new tourism facilities.

- While people from all economic groups suffered from the effects of the hurricane, the damage disproportionately affected the most marginalized sectors of the population - poor women, peasants, indigenous groups. Significantly, many of these had been living under insecure tenure conditions in irregular settlements and inadequate housing, located in vulnerable areas exposed to strong winds, flooding and landslides. Although evacuation orders were issued, many refused to leave their homes for fear of losing their belongings, with disastrous and often fatal consequences. Vulnerability and in particular tenure insecurity was both the cause and effect of the disaster for such families. In the absence of officially recognized tenure rights, people ended up living on the fringes in dangerous areas, which due to their location were often worst affected by the hurricane. Any post-disaster response measures intended to form the basis for longer-term recovery would therefore have needed to address pre-existing insecurity, in order to provide a basis for the full realization of the right to adequate housing.

Because of ingrained discrimination and structural disadvantage, vulnerable groups have restricted access to services and social protection, which help to cushion the effects of crises, and they are thus exposed to increased risk during times of economic shock.

- In its work in the field the United Nations has developed some excellent practice with regard to minority issues. However, there is no mechanism for or consistent practice of ensuring that minority issues are mainstreamed across the in-country work of entities in the United Nations system, in accordance with article 9 of the Declaration, even in countries where those issues are at the core of local conflicts. At the Headquarters level, in the Department of Political Affairs and in the UNDP Bureau for Crisis Prevention and Recovery, know-how on minority rights could be enhanced to facilitate the development of policies and practices sensitive to minorities. Appropriate training programmes and resources are required for staff throughout the United Nations system, to assist in the early identification by decision makers at the highest level of tensions involving minorities.

- Minorities are often the targets, rather than the perpetrators, of violence. When minority rights are violated, members of minorities may be at a greater risk of being subjected to systematic violence, even when they are bystanders to a conflict involving other parties. Such incidents can happen as a result of minorities' poverty and exclusion from political decision-making processes, or because their often remote communities, poorly served by State infrastructure, can become targets for occupation for strategic purposes or for exploitation of natural resources. Furthermore, owing to the suspicion and prejudice with which they are often viewed by both members of the majority and security forces, minorities may be targeted with impunity.

- Respecting the right of minorities to political participation at times of peace contributes to harmonious societies and opens non-violent avenues for the grievances of minorities to be addressed. When violent conflict does occur in diverse societies, applying a minority rights-based approach to consultations regarding peace agreements will require that all communities affected by the conflict, including those that are not active parties to it, be able to participate in the settlement process. That approach should counteract a tendency common in many conflict situations, whereby Governments, and the international community, focus predominately on addressing the demands of communities that are linked to armed movements, which may result in peace agreements that guarantee rights for some communities at the expense of others.

- According to a statistical assessment carried out by Minority Rights Group International, over 55 per cent of violent conflicts of a significant intensity between 2007 and 2009 had at their core violations of minority rights or tensions between communities. In a further 22 per cent of conflicts, minority issues had emerged or receded in the course of the evolution of the conflict. Those figures indicate that Governments, donors and intergovernmental organizations need to allocate significant attention and resources to minority issues as sources of conflict. However, the current picture in this regard is mixed.

- Caught between warring factions, minorities in Iraq have been the targets of violence for more than a decade. In 2014, the targeting of minorities has continued and intensified under the so-called Islamic State which took control of much of the country. The Special Rapporteur, along with another United Nations expert, issued a press release in July 2014, in which she expressed her grave concern about the physical safety of several minority groups in Iraq, including Christians, Shia, Shabaks, Turkmen and Yazidis, who were being persecuted on the grounds of their religion and ethnicity. She urged the Iraqi Government and the international community to do their utmost to protect vulnerable civilians and minorities.

The Special Rapporteur on extrajudicial, summary or arbitrary executions found that indigenous and Afro-Colombian communities had been victimized by all parties to Colombia's conflicts and that, historically, paramilitaries, sometimes in collusion with State forces, had appropriated land and committed massacres to intimidate local populations (A/HRC/14/24/Add.2, para. 76). Resource exploitation, agriculture and mega-projects have created new motivations for violence.

- The huge impact of conflict and instability on minorities in Iraq has been documented, including for Muslim minorities, Baha'is, Christians, Armenians, Chaldo-Assyrians, Faili Kurds, Palestinians, Jews, Sabian Mandaeans, Yazidis and others. Minority Rights Group states that: "Minorities in Iraq have continued to be targeted on the grounds of their religion or ethnicity since the US-led invasion and fall of Saddam Hussein in 2003. They have suffered from killings, kidnappings, torture, harassment, forced conversions and the destruction of homes and property." Persecution, human rights violations and targeted attacks have led to vast numbers of internally displaced persons and a mass exodus of minority communities to neighbouring countries, where they continue to experience severe challenges and poverty. Equally, in Egypt and the Syrian Arab Republic, the full extent of unrest and conflict on minorities is becoming evident and has far-reaching implications for their rights and security.
