- Development-induced displacement is an increasingly widespread phenomenon with devastating impact. An estimated 15 million people each year are forced to relocate and resettle as a result of such interventions. Despite some of the more recent efforts to highlight land dispossession, as yet global institutions have been unable to discourage the practices and processes that undermine land rights, prevent equitable access and establish the context for large and small-scale displacements. The expanding mining sector has contributed to strong economic growth in some countries, with mining and oil concessions dramatically increasing in countries. The industry has however also generated social conflict in many States, particularly in rural areas, with mining activities coming into direct competition with small-scale agriculture. Indigenous peoples are particularly vulnerable as they are often forced to leave their land and sources of livelihood. A lack of engagement and opportunities for participation in decisions that affect their lives has left many communities in situations of dire poverty and without access to adequate food and nutrition.

- Persons with disabilities belonging to groups that have been historically discriminated against or disadvantaged (such as indigenous peoples, ethnic minorities and persons living with HIV/AIDS) are disproportionately affected in accessing support arrangements and services. This also applies to migrants, persons living in conflict situations, internally displaced persons, refugees, asylum seekers, stateless persons and prisoners with disabilities, as humanitarian responses tend to overlook their support needs. Moreover, there is a strong link between belonging to a racial and cultural minority and experiencing coercion and institutionalization. Policies and programmes to ensure access to support must seek to overcome the impact of the multiple and aggravated forms of discrimination faced by persons with disabilities belonging to these groups in accessing support.

- International investment agreements that have facilitated and protected investments in indigenous territories are often accompanied by the deployment of military and private security services. The effects of this are a major concern in many jurisdictions, in particular those with histories of low-intensity conflict. As a result, under international human rights law, and as reflected in article 30 of the United Nations Declaration on the Rights of Indigenous Peoples, military activities should not take place in the lands or territories of indigenous peoples, unless justified by a relevant public interest or otherwise freely agreed to or requested by the indigenous peoples concerned. However, such security presences are effectively mandated under certain existing interpretations of the provisions of such agreements on full protection and security, leading to a direct conflict between international investment law and international human rights law.

- Moreover, the assemblies of religious, ethnic and cultural minorities have been selectively targeted. In Rakhine State, Myanmar, for example, Emergency Act 144 was applied in June 2012 to prevent groups of five or more people from gathering in public areas. The Act was imposed following severe riots between Rohingya Muslims, a predominantly stateless ethnic group in western Rakhine State, and Buddhists in the area. The ban on public gatherings, however, has reportedly only been enforced against Rohingya. The ban has been extended numerous times, and was still in effect at the time of the drafting of the present report. The ban has also prevented Rohingya from gathering in local mosques to pray and celebrate religious festivals; Buddhists religious gatherings have reportedly not been disrupted.

- Surveillance tactics ostensibly designed to prevent criminal activity are also often used selectively to target certain groups who plan to stage peaceful public assemblies. In Canada, for example, the Government formed a special police unit to produce intelligence updates on potential protests by indigenous peoples, primarily those fighting outside development on their ancestral land. Similarly, disproportionate force (including armed police, snipers and roadblocks) is often deployed at disfavoured protests as an intimidation tactic. Such practices should be vigorously discouraged. As the Special Rapporteur has previously noted, public assemblies should be presumed to be peaceful and lawful, until proven otherwise (A/HRC/20/27, para. 25) Surveillance tactics and disproportionate shows of force attest that authorities in some Member States often presume the opposite, and have a chilling effect on peaceful protestors, such as in the United Kingdom of Great Britain and Northern Ireland (A/HRC/23/39/Add.1, para. 32).

- The Constitutional Court used its power to assess implementation of its own judgment, issuing two further orders on the rights of displaced women. In 2008, the Court handed down a decision that was considered a global pioneer in the treatment of sexual violence during internal armed conflict. It identified 10 risks that forcibly displaced women faced, including extreme risk of sexual violence, and 18 gender facets of displacement, including patterns of discrimination and violence. Accordingly, the Court ordered the Government to create and implement 13 programmes with a gender-sensitive approach, including violence prevention, the right to health and education and access to land, justice and reparations. The Court also took an intersectoral approach, highlighting heightened risks faced by girls, indigenous, black and community women leaders, and women with disabilities. The Court ordered the allocation of sufficient resources to guarantee implementation of the programmes, refusing to recognize lack of budget as valid justification for non-compliance.

- The huge impact of conflict and instability on minorities in Iraq has been documented, including for Muslim minorities, Baha'is, Christians, Armenians, Chaldo-Assyrians, Faili Kurds, Palestinians, Jews, Sabian Mandaeans, Yazidis and others. Minority Rights Group states that: "Minorities in Iraq have continued to be targeted on the grounds of their religion or ethnicity since the US-led invasion and fall of Saddam Hussein in 2003. They have suffered from killings, kidnappings, torture, harassment, forced conversions and the destruction of homes and property." Persecution, human rights violations and targeted attacks have led to vast numbers of internally displaced persons and a mass exodus of minority communities to neighbouring countries, where they continue to experience severe challenges and poverty. Equally, in Egypt and the Syrian Arab Republic, the full extent of unrest and conflict on minorities is becoming evident and has far-reaching implications for their rights and security.

- According to the report of the United Nations System Task Team on the Post-2015 United Nations Development Agenda: "Deepening resilience among vulnerable populations and reducing risks of disasters and other shocks must be central to limiting the social and economic costs of disasters, in terms of death, hunger, malnutrition, displacement and forced migration." Equally, Claus H. Sorensen, Director-General of the European Commission Directorate General for Humanitarian Aid and Civil Protection stated: Those who are most vulnerable and marginalised need primary attention when a disaster strikes, both because the impact of the disaster is likely to be higher on them than others, and because of the likelihood that they find themselves excluded from response and recovery efforts. By systematically addressing in each action the inclusion of those who are marginalised (in particular, persons affected by caste discrimination, minorities, as well as persons with disabilities, women, and the elderly), lives have been saved, the suffering of those in need has been alleviated, and their dignity protected.

- Population dynamics may be deeply affected by discrimination and social exclusion exercised by one population group against another. The dynamics between and across different population groups should therefore also be given greater attention. For example, conflict between communities and enforced population movement due to conflict results in internal displacement that may affect minorities disproportionately and have a greater and longer-term impact on their rights, their access to livelihood, income and basic services. Globally, millions of people are affected by displacement and they are often minorities who are numerically fewer, politically and militarily non-dominant and the most vulnerable to social and political unrest and the impact of conflict. A fundamental message of the Independent Expert is that protection of minority rights and the creation of a culture of minority rights within wider society promotes conditions of stability under which human rights and development crises and setbacks, and huge population impacts, are less likely to occur.

- Certain forms of racial discrimination may be directed towards women specifically because of their gender, such as sexual violence committed against women members of particular racial or ethnic groups in detention or during armed conflict; the coerced sterilization of indigenous women; abuse of women workers in the informal sector or domestic workers employed abroad by their employers. Racial discrimination may have consequences that affect primarily or only women, such as pregnancy resulting from racial bias motivated rape; in some societies women victims of such rape may also be ostracized. Women may also be further hindered by a lack of access to remedies and complaint mechanisms for racial discrimination because of gender related impediments, such as gender bias in the legal system and discrimination against women in private spheres of life.

Gender-related killings of women 2012, para. 63

- In Guatemala, the current experience of massive and violent killings of indigenous women has a legacy stemming back to colonial times, further increasing during the 36-year armed conflict. Indigenous Maya women constituted 88 per cent of victims of sexual and systematic attacks, with such attacks being publicly and intentionally perpetrated, mainly by military and paramilitary personnel. After the 1996 Peace Accord, no efforts were made to seek justice for and provide reparations to the victims and their families. In fact, article 200 of the Penal Code (repealed in 2006) afforded immunity to perpetrators of sexual violence and kidnapping of women and girls over 12 years old, where the perpetrator subsequently married the victim. Thus a State-endorsed impunity was established, condoning all forms of violence, particularly against indigenous women.

- During each regional consultation, discussions were held about the threats and challenges faced by certain specific groups of defenders. As requested on several occasions by the Human Rights Council (in its resolutions 13/3, 22/6 and 24/24), strategies and actions for providing them with better protection were also examined. Some defenders face threats purely because of their identity (for example, women, lesbian, gay, bisexual, transgender or intersex persons, members of indigenous peoples, or defenders of persons suffering from albinism), others because of the issues they address (combating corruption, protecting the environment), or due to a particularly sensitive context (defenders working in conflict or post-conflict areas).

- Some activists face greater and more specific risks than others (see A/HRC/16/44, A/HRC/19/55 and A/70/217, paras. 61-77). Defenders who challenge social and cultural norms, do not fit stereotypes and prescribed roles, or who challenge power structures in society - such as defenders of sexual orientation and gender identity rights, women defenders, and defenders working on the rights of minorities and indigenous people - are often stigmatized and subjected to threats and attacks from members of society because of who they are or what they do. Defenders in conflict zones and in occupied territories are also more vulnerable to continuous insecurity and threats. Protection practices must therefore be gender-sensitive and suited to the specific needs and situations of such defenders at risk.

- One approach taken in building local support for defenders is to expand membership of the support community, beyond defenders and other "usual" allies. The leadership of local communities constitutes not only government officials but also informal community leaders, indigenous chiefs, religious figures, businesspersons and other figures of local authority. Working in partnership with local leaders can insulate defenders from threats and attacks and assist in holding the State to account for failures in protection.

- According to the Guiding Principles, "all authorities and international actors shall respect and ensure respect for their obligations under international law, including human rights and humanitarian law, in all circumstances, so as to prevent and avoid conditions that might lead to displacement of persons" (principle 5). Furthermore, "States are under a particular obligation to protect against the displacement of indigenous peoples, minorities, peasants, pastoralists and other groups with a special dependency on and attachment to their lands" (principle 9). These principles underline States' obligations to take preventive measures to avoid displacement. However, States often lack adequate governance structures to prevent, prepare for and mitigate the consequences of internal displacement before the onset of a displacement crisis.

- While improved statistical data will be important to guide public policy and to hold governments accountable, adjustments will need to be made for the inevitable limitations, omissions and possible distortions in available data. Challenges associated with measuring homelessness should not be allowed to encourage policies that respond only to the visible and more easily measured forms of homelessness. Homelessness among single men living on the streets or using emergency shelters is more easily measured. It is more difficult to measure homelessness among women, children and young people living temporarily with family or friends, or among those most marginalized and precariously housed within informal settlements, who may be altogether left out of census or data collection. It is equally difficult to identify and measure homelessness among indigenous households or communities displaced from ancestral lands. Members of ethnic minorities may not wish to be identified by authorities. In Kenya, for instance, many of the people who become homeless because of ethnic violence did not want to be identified for fear of reprisal. Policy responses and assessments of progress in eliminating homelessness must make allowances for less visible dimensions of homelessness that may not have been measured.

Considering that gender inequality is a cause of and a factor that perpetuates poverty, effective recovery policies must take into account State obligations regarding gender equality and the protection of women's full range of rights.

- These are alarming numbers. What these figures do not show, however, is that those who are enduring the gravest effects of the crises are the most vulnerable and disadvantaged in society, including women, children, older persons, persons with disabilities, indigenous peoples, ethnic minorities and migrants. Because of ingrained discrimination and structural disadvantage, vulnerable groups have restricted access to services and social protection, which help to cushion the effects of crises, and they are thus exposed to increased risk during times of economic shock.

- The synthesis report recognizes increasingly negative displacement trends. In the section on "dignity" it states that no society can reach its full potential if whole segments of that society are excluded from participating in, contributing to, and benefiting from development. It notes that the agenda "must not exclude migrants, refugees, displaced persons, or persons affected by conflict and occupation". The chapter entitled "A synthesis" states that particular attention should be given to countries in situations of fragility and conflict and the specific conditions of each country should be addressed. There is a consistent call to "leave no one behind" and ensure equality, non-discrimination, equity and inclusion. The report states: "We must pay special attention to the people, groups and countries most in need. We need to include the poor, children, adolescents, youth and the aged, as well as the unemployed, rural populations, slum dwellers, persons with disabilities, indigenous peoples, migrants, refugees and displaced persons, vulnerable groups and minorities. These also include those affected by climate change."

- During his joint visit to the Central African Republic in February 2015, the Special Rapporteur deplored the living conditions of nearly 500 members of the Peulh minority group, trapped in an enclave in Yaloke. According to reports, the food being distributed in Yaloke does not meet the cultural and nutritional needs of the Peulh minority group. The Peulh, living largely on a diet of beef and milk from cattle, are not used to the rice and beans that humanitarian agencies distribute. As of December 2014, over 40 Peulh had died from malnutrition and other diseases, the majority of them children.

- IDPs frequently belong to national, ethnic or religious minorities who, due to historical, geopolitical, social and other factors, may face varying degrees of discrimination, social and economic marginalization and sometimes violence on the basis of their identity. They may be excluded or marginalized in national development programmes, even during periods of peace. During times of instability and conflict, they are vulnerable to violence and displacement by larger population groups, members of which may dominate the government, the police and military forces and other public bodies, including those with responsibility for national development goals.

- Continual evaluation is therefore a crucial component of effective measures. The Committee has consistently recommended that States parties provide data disaggregated by age, gender and other key factors in their reports to enable the Committee to adequately evaluate the implementation of the Convention. Disaggregated data permits the States parties and the Committee to identify, compare and take steps to remedy discriminatory treatment that may otherwise go unnoticed and unaddressed. States parties are requested to describe, as far as possible, factors affecting the incidence and prevention of torture or ill-treatment, as well as the difficulties experienced in preventing torture or ill-treatment against specific relevant sectors of the population, such as minorities, victims of torture, children and women, taking into account the general and particular forms that such torture and ill-treatment may take.

- The establishment of special departments within different Ministries focused on indigenous peoples and parliamentary commissions on indigenous issues can be instrumental in the development of appropriate measures to achieve the ends of the Declaration. Within the justice system, some countries have established specialized Public Prosecutor’s Offices which play an important role in trying to ensure access to justice for indigenous peoples. In several countries joint bodies, such as dialogue round tables, with participation of indigenous peoples and State institutions, have been created: they either deal with specific matters or exist as permanent mechanisms. Provided they comply with the basic requirements of full and effective participation by indigenous peoples in decision-making and respect for indigenous appointment processes, these bodies can play a decisive role in advancing respectful and continuous intercultural dialogue between indigenous peoples and States that may bring about the needed changes. They can also be instrumental in preventing and solving conflict situations.

- States parties should take the necessary steps to ensure ease of access to health-care services for indigenous children. Health services should to the extent possible be community based and planned and administered in cooperation with the peoples concerned. Special consideration should be given to ensure that health-care services are culturally sensitive and that information about these is available in indigenous languages. Particular attention should be given to ensuring access to health care for indigenous peoples who reside in rural and remote areas or in areas of armed conflict or who are migrant workers, refugees or displaced. States parties should furthermore pay special attention to the needs of indigenous children with disabilities and ensure that relevant programmes and policies are culturally sensitive.

- Through its periodic reviews of States parties' reports, the Committee has concluded that indigenous children are particularly vulnerable in situations of armed conflict or in situations of internal unrest. Indigenous communities often reside in areas which are coveted for their natural resources or that, because of remoteness, serve as a base for non-State armed groups. In other situations, indigenous communities reside in the vicinity of borders or frontiers which are disputed by States.
