- A justice system based on the respect of the rights of the child is critical when preventing and addressing incidents of violence against children. Child victims of violence, including as a result of trafficking and exploitation, are, however, still too often criminalized and deprived of the protection that they should enjoy as children. Marginalized children, including those living in poverty, migrants and asylum-seekers face risks of physical, psychological and sexual violence, are denied access to legal assistance, or placed in detention instead of benefiting from adequate care arrangements. Frequently considered the first option rather than a measure of last resort, the deprivation of liberty remains a reality for thousands of children. Violence, including torture and humiliating treatment, is used as a form of control, discipline and punishment; in some countries, sentencing can include caning, flogging, stoning or amputation, as well as capital punishment and life imprisonment.

- Companies should establish a remediation plan in cooperation with the supplier and local and national authorities when a case of trafficking in persons is detected, in order to ensure that workers have effective access to remedies, including compensation, and to appropriate assistance. Any measure adopted should have a human rights-centred approach and be based on the rights of the trafficked person, whose participation in the determination of a solution for their case should be ensured throughout the process. Companies should ensure that, with regard to access to the grievance mechanism and the remediation plan, they consider the specific barriers faced by, and the vulnerabilities of, migrant workers, contract workers, young people and women.

- Existing prevention mechanisms and responses to various forms of exploitation of children in the context of conflict and humanitarian crisis are largely ineffective and lead to precariousness. Indeed, the accurate identification of children who are victims of sale, trafficking and other forms of exploitation is hindered by the inadequate training, or lack thereof, of frontline workers, challenges in age and filiation determination, and a lack of communication and coordination among various actors. In spite of some promising practices, the interim care of and durable solutions for vulnerable children on the move often do not consider the specific needs of children, especially those separated or unaccompanied who live in mixed spaces with adult migrants or refugees in areas or camps that lack basic amenities. The existence of numerous cases of sexual exploitation of children is an additional indication of the failure of a protection system meant to safeguard them.
