- In accordance with her mandate described by the Human Rights Council in its resolution 26/20, the Special Rapporteur aims to respond to the expectations of a broad range of stakeholders of an acceleration in the advances made in the rights of persons with disabilities. She intends to carry out the mandate in a comprehensive and collaborative manner, working closely with States, the United Nations system, academia, persons with disabilities, their representative organizations and other stakeholders towards concrete results. The mandate is comprehensive and presents a great opportunity for change. In order to ensure the effective implementation thereof, and in a spirit of collaboration, the Special Rapporteur calls out for support in her endeavours with a view to ensuring that her work brings about real change in the lives of persons with disabilities and the realization of their human rights without discrimination and on an equal basis with others.

Detention of migrants in an irregular situation 2012, para. 73

- The Special Rapporteur would like to remind Governments that alternatives to detention should not become alternatives to unconditional release, whenever such release is a possibility. Governments should put in place safeguards to ensure that those eligible for release without conditions are not diverted into alternative measures. Alternatives to detention should have a human rights-based approach, be established by law, be non-discriminatory and be subject to judicial review and independent monitoring and evaluation. In designing alternatives to detention, Governments should pay attention to the specific situation of particular groups of migrants, such as children, pregnant women and persons with disabilities, and use the least intrusive measure possible.

- Most States lack a specific and comprehensive law, policy or programme on persons with disabilities in general or on women with disabilities in particular. States that have a disability law do not specifically address the rights of women with disabilities in general, or violence specifically. States may also have a specific law on violence against women that generally provides remedies for all women, within a non-discriminatory framework. Unfortunately, such laws are not effectively implemented in respect of women with disabilities.

- With the adoption of the 2030 Agenda for Sustainable Development, most States will conduct a review of their national policies against the goals and targets of the Sustainable Development Goals. That represents a unique opportunity to include persons with disabilities adequately across all policies and programmes, as well as to ensure policy coherence and intersectoral coordination. Leaving no persons with disabilities behind requires that all States and relevant stakeholders collaborate to design and implement policies and programmes that are inclusive of persons with disabilities.

- Considering the severe mental pain or suffering solitary confinement may cause when used as a punishment, during pretrial detention, indefinitely or for a prolonged period, for juveniles or persons with mental disabilities, it can amount to torture or cruel, inhuman or degrading treatment or punishment. The Special Rapporteur is of the view that where the physical conditions and the prison regime of solitary confinement fail to respect the inherent dignity of the human person and cause severe mental and physical pain or suffering, it amounts to cruel, inhuman or degrading treatment or punishment.

- The Special Rapporteur recommends that States adopt child-friendly administrative and criminal court procedures and train police officers, border guards, detention staff, judges and others who may encounter children deprived of their liberty in child protection principles and a better understanding of the vulnerabilities of children to human rights violations, such as torture and other forms of ill-treatment. Special mention should be made of girls, who are particularly vulnerable, and to special groups of children, such as minorities, disabled children and migrants.

- The Special Rapporteur calls for leadership to confront the global burden of obstacles and embed rights-based mental health innovation in public policy. That includes State champions in international policy efforts, the leadership of professional psychiatry in assessing constructively its approach to the necessity for change, managers of mental health services leading change by example and municipal officials championing grassroots innovation. These champions must work in partnership with their constituents, including persons with intellectual, cognitive and psychosocial disabilities and with autism.

The right to life and the right to adequate housing: the indivisibility and interdependence between these rights 2016, para. 71

- Fifty years after the separation of international human rights into the two covenants, the United Nations is well situated to retrieve a unified and inclusive understanding of human rights and to affirm that the right to life includes the right to a place to live in dignity and security, free of violence. The Human Rights Committee has the opportunity to affirm this integrated understanding of the right to life in the ongoing preparation of its general comment No. 36. The Committee on Economic, Social and Cultural Rights has the opportunity under its Optional Protocol to highlight the connection between the rights to life and adequate housing in lived experience. Other treaty monitoring bodies have the opportunity to ensure that the understanding of the rights to life and adequate housing is informed by the experiences and unique claims of people with disabilities, women, children, migrants, racial minorities and indigenous peoples, among others.
