- In 2013, Parliament passed a law on the equal rights and equal opportunities of women and men. The law reiterated the constitutional guarantee of gender equality, defined gender discrimination and contained provisions against direct and indirect discrimination. However, the law generated a great deal of social controversy and backlash because of the perception that it represented an attack on “family values”. Women’s civil society organizations became targets of harassment and protests erupted, with demonstrators calling the law “national treason”.

- Inheritance is often the main avenue for women's land acquisition, yet women are still less likely to inherit land than men. Inheritance is often determined through marriage practices. Through patri-linearism, which is the most common societal system, sons, rather than daughters, inherit land from their fathers. Even where bilateral inheritance practices exist, communities may favor customary patrilineal practices. This is so in the case of the Mossi community in Burkina Faso "where despite the fact that the majority of families are Muslim, meaning that in theory daughters inherit land, this practice is not observed."

- The ability to claim rights in front of the courts is important for changing social and cultural attitudes. The courts play a role in condemning practices that reinforce gender stereotypes and can require the State or third parties to adopt measures to address them. Recently, a group of students asked the Supreme Court of India whether menstruation could be a criterion for denying women of a certain age the right to enter a temple and worship in it. The Supreme Court addressed the following questions to the administration of the Sabarimala temple: "If men can go till a point (near the temple) without undertaking austere activities, why can't women go? … Are you associating menstruation with impurity? You are making a classification. Can a biological phenomenon be a reason for discrimination? All practices are acceptable till there is no distinction between genders."

- Sociocultural norms, notions of "female modesty" and masculinity and stereotypes concerning gender-assigned roles, including of women as caretakers, translate into unequal opportunities, unequal power and control over finances and resources, as well as unequal household responsibilities. Where legislation and policies reflect stigmatizing attitudes, thereby institutionalizing and formalizing stigma, they must be repealed. States may design and implement, in collaboration with civil society, awareness-raising programmes to enhance positive and non-stereotypical portrayals of women. Initiatives should aim to reveal "invisible" social norms and power relations through a context-specific gender analysis. WaterAid, for example, has undertaken qualitative research to explore how the provision of water, sanitation and hygiene services has led to positive changes in gender roles and social relations among men and women .

- In addition to risking physical violence, women and girls may also experience sanitation-related psychosocial stress, including fear of sexual violence. Women and girls who have limited access to sanitation facilities experience environmental barriers when they engage in water, sanitation and hygiene practices, including carrying water, managing menstruation, defecating and bathing, that contribute to that kind of stress. Examples include the fear of encountering snakes and mosquitos when walking to a defecation site, or the stress caused by social norms that view the fact of being seen by men while bathing as negative, among other issues. A better understanding of the range of causes of stress and adaptive behaviours is needed to inform context-specific, gender-sensitive water and sanitation interventions.

- A gender stereotype is defined as "a generalized view or preconception about attributes or characteristics that are ought to be possessed by, or the roles that are or should be performed by women and men". A gender stereotype is harmful when it limits women's and men's capacity to develop their personal abilities, pursue their careers and make choices about their lives. Gender stereotyping is wrongful when it results in violations of human rights and fundamental freedoms. States cannot dismiss stereotyping and stigma as a social phenomenon over which States have no influence; instead, they must actively combat practices that are based on harmful stereotypes of men and women, including in the private sphere.

- Parallel justice systems apply religious, customary or indigenous laws, which, as shown above, are patriarchal. These systems are mostly dominated by men and therefore tend to perpetuate inequalities and patriarchal interpretations of culture, resulting in discrimination against women. Regardless of whether the law is religious or customary, its provisions are often interpreted differently for men and women. The rulings and procedures of these legal mechanisms generally discriminate against women. Moreover, gender-based violence is seldom punished and is sometimes downplayed by religious or customary law courts.

- Culture is a broad concept encompassing all forms of conduct, organization and human behaviour within society, including family, language, religion, philosophy, law, government, art and sport. Cultural diversity occurs when culture is expressed and develops in different contexts in society. Culture is not a static or unchanging concept, although some States tend to present it as such in order to justify inequality between men and women. This living, dynamic and evolving process permeates all human activities and institutions, including legal systems, in all societies across the world. Viewing culture and beliefs as immutable hinders the realization and development of all human rights, including those of women.

- In some communities, women are unable to approach justice systems without the assistance of a male relative, and social norms hinder their ability to exercise autonomy outside the household. Article 15 of the Convention provides that women and men are to be equal before the law and that States parties must accord to women a legal capacity in civil matters identical to that of men and the same opportunities to exercise that capacity. The civil law procedures and remedies to which women are to have access include those in the fields of contracts, private employment, personal injury, consumer protection, inheritance, land and property rights.

- Under international human rights law, policies and programmes must be designed in ways that take into account the experiences and realities of marginalized groups so that their disadvantage is addressed in real terms. This is because equality is understood "substantively" and not just "formally". Even where laws and policies appear to be "fair" by treating everyone the same, the experience or effect of laws and policies can be discriminatory owing, for example, to a person's socioeconomic status, housing status or gender. States and subnational governments are obliged to address the needs of those in the most desperate housing situations as a matter of priority and urgency. Positive measures must be taken to reduce stigmatization and address the needs of homeless women and men, residents of informal settlements, low-income households and other groups lacking access to adequate housing.

- Article 2 of the Protocol requires States to take positive action to address inequalities between women and men in State efforts to ensure that women enjoy their rights. Other articles set out obligations with respect to, among other things, the right to dignity; the right to life, integrity and security of the person; protection from harmful practices; rights in marriage, which include entitlement to property and the custody and guardianship of children; protection from early and forced marriages; the right of access to justice and equal protection of the law; the right to participate in political and decision-making processes; the right to peace; the rights to adequate housing, food security, education and equality in access to employment; reproductive and health rights, including control of one's fertility; and the right to be protected against HIV infection. The Protocol also includes specific provisions on the protection of rights of women with disabilities. All promotional and protective provisions in the African Charter on Human and Peoples' Rights and other human rights instruments are equally applicable in the interpretation of the Protocol.
