- Gender equality is central to human rights. Equality is a fundamental human rights principle that is inherently relative and context specific. Ensuring the human rights of women requires, firstly, a comprehensive understanding of the social structures and power relations that frame laws and policies as well as the economy, social dynamics, family and community life, and cultural beliefs. Gender stereotypes can also limit women's capacity to develop their personal abilities, pursue their professional careers and make choices about their lives and life plans. Both hostile/negative or seemingly benign stereotypes can be harmful. There is a recognized need to address harmful gender stereotypes in order to promote gender equality . The Convention equally enshrines an obligation to combat stereotypes, prejudices and harmful practices relating to persons with disabilities, including those based on sex and age, in all areas of life .

In the interim, it is therefore important to develop strategies and time -bound action plans to make public and private facilities and services accessible for persons with disabilities. Whereas retrofitting all structures in the short term may not be feasible, requiring that all new constructions and renovations follow accessibility and universal design standards has limited cost implications. Estimates indicate that it would only add about 1 per cent to construction costs.

- Domestic workers caring for children, the disabled and ageing people, are a highly vulnerable category of employees, often in the informal sector. About 83 per cent are women or girls, and many are migrant workers. Domestic workers often encounter deplorable working conditions; labour exploitation; extortionate recruitment fees resulting in debt; confiscation of passports; long, unregulated hours of work; lack of privacy; exposure to physical and sexual abuse; and separation from their own families and children. The ILO Domestic Workers Convention (No. 189) calls for States to guarantee decent work for domestic workers, and thus several countries have introduced new protections.

- The holistic approach to women's rights, by situating violence against women on a continuum from the home to the transnational sphere, has been further developed by the Special Rapporteur in her reports to the General Assembly, such as her 2011 report (A/66/215). In that report, she recommended that States engage in transformative remedies to confront the root causes of violence against women, in order to achieve individual, institutional and structural change. In her 2012 and 2013 reports to the General Assembly, the Special Rapporteur dealt with two issues that had not been specifically addressed in previous thematic reports, namely, violence against women with disabilities and violence with respect to the incarceration of women. Both reports provide a clear illustration of how violence against women intersects with other factors, including different forms of inequality and identity status, such as poverty, health, race, ethnicity, sexual orientation, religion and language.

- The Commission recognizes that women and girls undertake a disproportionate share of unpaid care and domestic work, including caring for children, older persons, persons with disabilities and persons living with HIV and AIDS, and that such uneven distribution of responsibilities is a significant constraint on women's and girls' completion of or progress in education, on women's entry and re-entry and advancement in the paid labour market and on their economic opportunities and entrepreneurial activities, and can result in gaps in both social protection and pensions. The Commission stresses the need to recognize, reduce and redistribute the disproportionate share of unpaid care and domestic work by promoting the equal sharing of responsibilities between women and men and by prioritizing, inter alia, social protection policies and infrastructure development.

- Girls and young women with disabilities are disproportionately affected by different forms of gender-based violence, including physical, sexual, psychological and emotional abuse; bullying; coercion; arbitrary deprivation of liberty; institutionalization; female infanticide; trafficking; neglect; domestic violence; and harmful practices such as child and forced marriage, female genital mutilation, forced sterilization and invasive and irreversible involuntary treatments (see A/HRC/20/5, paras. 12-27). Many of those forms of violence are a consequence of the intersection between disability and gender, and might happen while a girl or young woman with disabilities performs daily hygiene, receives treatment or is overmedicated. Gender-based violence occurs at home, in institutions, in schools, in health centres and in other public and private facilities, and perpetrators are frequently relatives, caregivers and professionals on whom the girl or young woman may depend.

Multiple and intersecting forms of discrimination and violence against women 2011, para. 13

- In 1993, the Vienna Conference on Human Rights adopted a declaration and a programme of action, which took into account both discrimination and violence against women. The Conference addressed specific human rights violations suffered by identifiable groups of individuals, including persons belonging to national, racial, ethnic, religious and linguistic minorities, indigenous peoples, women, children and persons with disabilities. It also recognized violence against women as a particular human rights violation which required the attention and resources of the United Nations.

- By the time the Special Rapporteur presents this report, the General Assembly will have already adopted the Sustainable Development Goals. The draft final outcome document and the Addis Ababa Action Agenda, adopted in July 2015, include important references to persons with disabilities. This reflects a growing consensus among States and successful advocacy by the disability community regarding a critical message: one of the reasons why the Millennium Development Goals have fallen short of reaching the set milestones is that persons with disabilities were completely absent from that framework.

- Social protection is a fundamental tool for achieving the proposed targets and goals, as mentioned in proposed goal 1 (End poverty in all its forms everywhere), 5 (Achieve gender equality and empower all women and girls) and 10 (Reduce inequality within and among countries). In relation to persons with disabilities, goal 1 should be addressed in the short term by mainstreaming disability in all social protection and poverty reduction programmes - a task that remains a global challenge. Social protection should further be used as an important instrument for pursuing other proposed goals in the context of disability, including those of ensuring healthy lives and well-being, guaranteeing inclusive, equitable quality education, promoting lifelong learning and opportunities for all, and promoting full and productive employment and decent work for all. The Addis Ababa Action Agenda highlights the importance of financing sustainable and nationally appropriate social protection systems with a focus on persons with disabilities, among others.

- Persons with disabilities constitute 15 per cent of the world population, approximately one billion people. Many of them require different forms of support, including for basic day-to-day activities such as getting up, bathing, dressing and eating. The sustained ageing of the global population, particularly in high-income countries, has also had a substantial impact on the demand for disability-related support, as older persons tend to be overrepresented in the disability community. - Funding restrictions, including restrictions on foreign funding, may disproportionately affect associations that promote issues that do not enjoy popularity or the support of the State or the majority of the population, including those that relate to the advancement of the rights of marginalized groups. This is evidenced by the dichotomy that some States impose regarding association funding sources: certain types of activities or organizations are permitted to receive foreign funding while others only receive domestic funding. For instance, to be considered an Ethiopian charity or society, organizations cannot receive more than 10 per cent of their funding from foreign sources. Only Ethiopian charities or societies may engage in promoting human rights work, gender equality and religious equality, the rights of persons with disabilities, children's rights, conflict resolution or reconciliation and the efficiency of the justice and law enforcement services. Foreign associations or those that receive more than 10 per cent of their funding from foreign sources may not engage in such activities. In the Russian Federation, an organization working on "political activities" and receiving foreign funding must register itself as a "foreign agent", which in Russian is synonymous with "foreign spy". The law broadly defines political activities as attempts to influence official decision-making or to shape public opinion to exert a similar influence, and thus can include work in areas such as human rights, governance and accountability issues.

- The Special Rapporteur notes that while the Rules recognize and address specific needs of different categories of prisoners (such as women, juveniles, persons with disabilities and foreign nationals), it fails to require the extension of special protection measures to other disadvantaged groups of detainees or prisoners. It is essential that the Rules adopt special measures aimed at protecting the rights of other disadvantaged groups of prisoners, in accordance with well-established international standards and norms (see UNODC/CCPCJ/EG.6/2012/2, p. 21). Special care must be taken to ensure that segregating members of these groups does not further marginalize them from the rest of the community or expose them to further risk of torture or ill-treatment (see, for example, the Yogyakarta Principles on the Application of International Human Rights Law in relation to Sexual Orientation and Gender Identity, principle 9 (a)).

- Women with disabilities make up a significant part of the world's population. According to the 2011 World Report on Disability of the World Health Organization and World Bank, it is estimated that approximately 15 per cent of the world's population lives with some form of disability. The disability level threshold indicates that the male disability prevalence rate is 12 and the female 19.2. Based on such figures, it is clear that women with disabilities constitute a significant portion of the global population. Despite the evolution of normative frameworks concerning both the human rights of women and of persons with disabilities, the impact of the combined effects of both gender and disability have not gained sufficient attention, and violence against women with disabilities remains largely unaddressed.

- Article 16 of the Convention on the Rights of Persons with Disabilities, on freedom from exploitation, violence and abuse, specifically addresses the problem of gender-based offences. It provides for the protection of that freedom; educational support for persons with disabilities and their families; monitoring of facilities and programmes to serve persons with disabilities; prevention strategies; recovery programmes; and prosecution of crimes involving exploitation, violence and abuse against such persons. Additionally, it includes provisions regarding the establishment of gender and age-specific supports. Article 25 is also relevant to the issue of violence against women, in recognizing that persons with disabilities have the right to the enjoyment of the highest attainable standard of health, without discrimination on the basis of disability. This includes access to gender-sensitive health services and health-related rehabilitation, sexual and reproductive health and population-based public health programmes, all of which should be provided as close as possible to the individual's community.

- Violence against women is too often discussed in a theoretical vacuum that focuses only on interpersonal and structural inequalities between men and women, thereby excluding analysis on intra-gender inequalities. It is important to recognize the obstacles faced by women who experience multiple and intersecting forms of discrimination, for example women with disabilities, women who belong to ethnic or cultural minorities, women who live in poverty, women who live in rural areas, women who lack citizenship status and older women, among others. This increases the risk that some women will experience targeted, compounded or structural discrimination, in addition to gender-based violence (A/HRC/17/26, para. 17).

- For women with disabilities, disability inclusion and gender equality cannot be achieved without addressing their sexual and reproductive health and rights. In particular, girls and young women with disabilities are able to develop their own identities and realize their full potential when their sexual and reproductive health needs and rights are met. That contributes to ensuring their health and well-being, reducing the existing gaps in their access to education and employment and achieving their empowerment. When those needs and rights are not met, they are exposed to unintended pregnancies, sexually transmitted diseases, gender-based violence and sexual abuse, child marriage and other harmful practices that hamper their participation.

- States must ensure that all information and communication pertaining to sexual and reproductive health and rights are accessible to persons with disabilities, including through sign language, Braille, accessible electronic formats, alternative script, easy-to-read formats, and augmentative and alternative modes, means and formats of communication.64 For instance, call centres to report cases of gender-based violence must be accessible to deaf and hard-of-hearing girls and women through text messaging or other alternative methods. For example, Illinois Imagines has developed guides and other materials for rape crisis centres, disability service agencies and self-advocates that include guidance for prevention education programmes and picture guides about sexual assault exams and the rights of sexual violence survivors. The University of Tartu in Estonia has provided training for teachers on how to deliver comprehensive sexuality education in plain language so that children with intellectual disabilities can benefit equally from the lessons.

- Evidence on sexual and gender-based violence against girls and young women with disabilities is robust. Studies from across the globe show that they are at increased risk of violence, abuse and exploitation compared with those without disabilities, and with boys and young men with disabilities. Overall, children with disabilities are almost four times more likely to experience violence than children without disabilities. However, the risk is consistently higher in the case of deaf, blind and autistic girls, girls with psychosocial and intellectual disabilities and girls with multiple impairments. Belonging to a racial, religious or sexual minority, or being poor, also increases the risk factor for sexual abuse for girls and young women with disabilities. Humanitarian crises and conflict and post-conflict settings generate additional risks of sexual violence and trafficking that affect girls with disabilities.

- The Commission further reaffirms the commitments to gender equality and the empowerment of women made at the Millennium Summit of the United Nations, the 2005 World Summit, the High-level Plenary Meeting of the General Assembly on the Millennium Development Goals, held in 2010, and the special event to follow up efforts made towards achieving the Millennium Development Goals, held in 2013. It also reaffirms the outcome document of the high-level meeting of the General Assembly on the realization of the Millennium Development Goals and other internationally agreed development goals for persons with disabilities: the way forward, a disability-inclusive development agenda towards 2015 and beyond.
