- The Special Rapporteur further notes that child migrants and refugees, often in search of education and work opportunities, are particularly vulnerable to forced, compulsory and exploitative labour and sexual abuse. International instruments, such as the ILO Minimum Age Convention No. 138 and the European Social Charter (revised) (art. 7.2), establish 15 as the minimum age for both the completion of compulsory schooling and entry into employment. Consequently, the increased reduction of the right to education in elementary schooling undermines the protection of child migrants and refugees from hazardous work. This is related to the understanding that education can, and should, serve as an important tool to protect children from sexual and gender-based violence, HIV/AIDS, military recruitment, crime and drugs, inter alia.

- In agriculture, contemporary forms of slavery have reportedly occurred in many countries, involving crops such as sugar cane, cut flowers, fruit and vegetables, tropical nuts and commodities, for example, palm oil, cotton, cocoa, tobacco and beef. Production in the sector often relies on temporary or migrant labour and is characterized by complex contracting and subcontracting chains, as well as smallholder farming in some cases. Much of the work on remote farms and plantations is typified by excessive working hours, lack of compliance with labour laws, weak or non-existent labour inspections and corruption. Competition to produce at the lowest cost enhances the risk of contemporary forms of slavery being involved in agriculture, especially debt bondage in impoverished rural communities and among vulnerable categories of workers, such as indigenous people, minorities, migrants, women and children.

- The gravity and the scale of the practice of disappearances by the regimes that were in power in Latin America from the 1960s, and the subsequent struggle of family members and society in general to establish the fate of the victims and to ensure investigation into the facts and punishment of the perpetrators, was initially at the centre of the development of the right to truth. During those regimes, the justice systems of the countries in which such acts occurred were completely ineffective in carrying out investigations into the facts. Moreover, many of the countries concerned adopted amnesty laws that not only ensured impunity for the perpetrators but, in effect, also impeded investigations by the justice systems.

- These and other proposals to address housing, land and property rights through the active participation of the affected people, and to build on existing community processes, were not taken up by the transitional authorities or the newly independent Government. In the aftermath of the later wave of violence, destruction and displacement of 2006-7, the need for such involvement became prominently recognised. The five pillars of the National Recovery Strategy included one aimed at building trust within communities and between the people and the Government. This was in the context of urgent attempts to achieve the reintegration and return of IDPs displaced by the violence to their communities, with the incentive of cash compensation from the State with which they could repair their homes or settle in alternative areas in cases where reintegration proved impossible. As part of a Dialogue, Communications and Outreach Programme, dialogue teams were established to manage the necessary conflict resolution, mediation and negotiation processes. This required the participation of local authorities, youth leaders and other groupings. The programme, which was still continuing in some communities in May 2010, incorporated the use of customary dispute resolution practices and peacebuilding ceremonies. It is widely regarded as having been successful and necessary for peacebuilding and the safe return of IDPs. Women reportedly participated far more actively than men in the community dialogue and reconciliation process. This was in contrast to the compensation payment process, which had been male-dominated.

- Many regions are affected by generalized violence resulting in internal displacement. For example, Central America, including the Northern Triangle countries of El Salvador, Guatemala and Honduras, is deeply affected by generalized and gang-related violence. The Special Rapporteur visited Honduras in November 2015 and found that displacement as a result of gang-related (maras) and generalized violence is widespread and there is an "invisible epidemic" affecting whole communities and neighbourhoods. For many, the only option to escape threats, extortion and violence by the maras is to leave their homes and, often, their country. The Special Rapporteur commended the Government of Honduras for being the first in the region to publicly acknowledge the problem and to undertake an in-depth profiling to gain a better understanding of the situation. He urged it to put in place overdue protection measures for internally displaced persons.

- However, the Special Rapporteur notes that this focus on migrants who undertake irregular border crossings has significant relevance, as this is where the most egregious human rights abuses appear to take place. Of the utmost concern are the deaths of irregular migrants attempting to cross into the European Union. Other concerns are the mistreatment of migrants at the border, including practices which infringe their liberty and security, and detention regimes on both sides of the border that fail to adequately respect minimum human rights standards. Furthermore, even before crossing the border to the European Union, whether by sea or by land, migrants are often exposed to serious risks of abuse and exploitation en route, including by smugglers. This is particularly true for women and girls who wait in transit countries and who may be exposed to sexually based violence.

- Trade unions have been critical partners in the prevention of human trafficking and forced labour. The International Trade Union Confederation and the International Union of Food Workers, for example, have played a critical role in curtailing forced labour in the cocoa industry in Côte d'Ivoire by advocating implementation of the Protocol for the Growing and Processing of Cocoa Beans and Their Derivative Products in a Manner that Complies with ILO Convention No. 182 concerning the Prohibition and Immediate Action for the Elimination of the Worst Forms of Child Labour. A partnership between the confederation of workers Rerum Novarum, of Costa Rica, and the Sandinista Workers' Centre and the Confederación de Unificación Sindical, of Nicaragua, led to the creation of the Trade Union Centre for Migrants, which offers free legal and administrative assistance to all migrant workers seeking regularization and aims to combat trafficking in children by partnering with the local taxi drivers' union.

The partnership agreement between the members of the African, Caribbean and Pacific States and the European Union, also known as the Cotonou Agreement, provided for the creation of cooperative education programmes towards the elimination of child labour.

- The huge impact of conflict and instability on minorities in Iraq has been documented, including for Muslim minorities, Baha'is, Christians, Armenians, Chaldo-Assyrians, Faili Kurds, Palestinians, Jews, Sabian Mandaeans, Yazidis and others. Minority Rights Group states that: "Minorities in Iraq have continued to be targeted on the grounds of their religion or ethnicity since the US-led invasion and fall of Saddam Hussein in 2003. They have suffered from killings, kidnappings, torture, harassment, forced conversions and the destruction of homes and property." Persecution, human rights violations and targeted attacks have led to vast numbers of internally displaced persons and a mass exodus of minority communities to neighbouring countries, where they continue to experience severe challenges and poverty. Equally, in Egypt and the Syrian Arab Republic, the full extent of unrest and conflict on minorities is becoming evident and has far-reaching implications for their rights and security.

- In Europe, in 2008, the Fundamental Rights Agency conducted a survey of 23,500 respondents from ethnic minority and immigrant groups to assess how many had been victims of assault, threat or serious harassment with a perceived racist motive. The survey found that between 16 per cent and 32 per cent of Roma, and between 19 per cent and 32 per cent of persons of African origin reported being victims of racial discrimination. Another survey of 5,900 respondents in nine European Union Member States found that up to one third of Jewish people had experienced verbal abuse or physical anti-semitic violence. The Special Rapporteur considers that many incidents could be prevented with timely and appropriate responses to hateful messages, including through better representation and inclusion of minorities in mainstream communication platforms.

- In Canada, in order to reduce discriminatory policing behaviours, in 2011-2012, training on Roma culture was delivered, as part of the Hate Can Kill project, to Ontario police, including information about the Roma Holocaust, the racially motivated violence experienced by Roma and the lack of trust in police authorities among Roma communities. In parallel, Roma families and young people were also educated on what constitutes a hate crime, on relevant legal instruments and on the importance of reporting hate crimes to the police. Following that training, in 2012 both the Toronto Police Force and the Hamilton Police Force recorded hate crimes reported by people of Roma identity.

- Various countries emerging from conflict or an authoritarian regime have been confronted with allegations of systematic illegal adoptions as part of past large-scale abuses. Few countries have responded to victims' calls for truth, justice, reparation and guarantees of non-recurrence, however, and none have done so in a comprehensive manner. Argentina has pioneered such responses, in particular in relation to enforced disappearances, through truth-seeking and accountability. Genetic tracing and the establishment of a national genetic database have played a key role in identifying disappeared children who were subjected to illegal adoption and in efforts to seek judicial accountability. Moreover, the "disappeared" children, now adults, are stepping forward to uncover their biological origins and some are playing a role in the prosecution of their adoptive parents.

- The definition of debt bondage in the Supplementary Convention on the Abolition of Slavery, the Slave Trade and Institutions and Practices Similar to Slavery is sufficiently broad to cover the situation of workers trapped in debt bondage in systemic, archaic, feudal systems of slave-labour exploitation, as well as that of migrant workers from developing countries who leave their countries accruing debt to cover the costs associated with recruitment. Debt bondage is closely related to a number of forms of exploitation, including forced labour, the abuse of migrant workers, trafficking, and the worst forms of child labour. It has been observed that debt bondage is an area in which the relationship between trafficking and forced labour practices is particularly strong. Debt is considered to be a key source of vulnerability to trafficking and is one of the mechanisms used to force victims to work in exploitative or abusive conditions.

- Due diligence on preventing trafficking also requires action to address the wider, more systemic processes or root causes that contribute to trafficking in persons, such as inequality, restrictive immigration policies, and unfair labour conditions, particularly for migrant workers. As such, the present mandate holder has previously emphasized that international law "requires that States act with due diligence to prevent trafficking and the human rights violations with which it is associated," including to address demand, such that due diligence "on the part of States should require action on these wider processes, all of which foster demand for, and vulnerability to, trafficking." Additionally, Rantsev v. Cyprus and Russia, has clarified that as part of the positive obligation to address trafficking "a State's immigration rules must address relevant concerns relating to encouragement, facilitation or tolerance of trafficking." Often, however, States adopt immigration policies in the name of preventing trafficking that in practice deter movement; instead of being preventative, these policies make transborder movement more perilous and foster situations that lead to trafficking.

- The Special Rapporteur intends to work in collaboration with other special procedures mechanisms which examine issues relating to trafficking, including but not limited to: the Special Rapporteur on the human rights of migrants; the Special Rapporteur on contemporary forms of slavery, including its causes and consequences; the Special Rapporteur on the sale of children, child prostitution and child pornography; and the Working Group on the issue of human rights and transnational corporations and other business enterprises. The Special Rapporteur will continue to strengthen the work of the trafficking mandate while delineating its intersections with related mandates. In this regard, she will try to identify possible joint initiatives that can complement each other's work, such as joint communications on allegations of human rights violations and the issuance of joint press statements.

- The private sector is another actor that could play a positive role in preventing trafficking in persons for labour exploitation and other labour abuses of persons fleeing conflict. In this regard, private sector initiatives have developed guidance to help companies that operate in areas with presence of refugees to understand and identify indicators of risk with regard to labour exploitation and to assist them in implementing due diligence measures to prevent and mitigate labour abuses within their supply chains. One such initiative is the recently published guidance on "Syrian refugees working in Turkey" issued by the Business Social Compliance Initiative and the Foreign Trade Association.

Continuum of violence against women from the home to the transnational sphere: the challenges of effective redress 2011, para. 46

- Irregular women migrants, women asylum seekers and refugees are particularly vulnerable to violence in the transnational arena. During the country mission to Zambia, the Special Rapporteur was informed that female migrants, especially those engaging in sex work, are often subjected to sexual abuse and at risk of contracting HIV/AIDS due to their inability to negotiate safe sex. Also, their irregular status makes them reluctant to seek health care. Similarly, immigrant women in the United States of America often suffer higher rates of battering as they have less access to legal, social and support services. Testimonies from undocumented immigrant women living with a United States partner reveal hesitation to seek assistance from authorities when facing abuse due to fear of deportation. It was also indicated that abusers may not initiate the process to acquire permanent residence status for their foreign partner or wife as a way to maintain their power and control over these women.
