- Some women may experience multiple forms of discrimination on the basis of their sex and other status or identity. Targeting ethnic and racial minorities, women from marginalized communities and women with disabilities for involuntary sterilization because of discriminatory notions that they are "unfit" to bear children is an increasingly global problem. Forced sterilization is an act of violence, a form of social control, and a violation of the right to be free from torture and other cruel, inhuman, or degrading treatment or punishment. The mandate has asserted that "forced abortions or sterilizations carried out by State officials in accordance with coercive family planning laws or policies may amount to torture".

- Persons with disabilities are particularly affected by forced medical interventions, and continue to be exposed to non-consensual medical practices (A/63/175, para. 40). In the case of children in health-care settings, an actual or perceived disability may diminish the weight given to the child's views in determining their best interests, or may be taken as the basis of substitution of determination and decision-making by parents, guardians, carers or public authorities. Women living with disabilities, with psychiatric labels in particular, are at risk of multiple forms of discrimination and abuse in health-care settings. Forced sterilization of girls and women with disabilities has been widely documented. National law in Spain, among other countries, allows for the sterilization of minors who are found to have severe intellectual disabilities. The Egyptian Parliament failed to include a provision banning the use of sterilization as a "treatment" for mental illness in its patient protection law. In the United States, 15 states have laws that fail to protect women with disabilities from involuntary sterilization.

- In accordance with article 17 of the Convention on the Rights of the Child, a child has the right to gain access to appropriate information and material. Gaining access to information is often the first step in the participation process, given that it allows an informed child to voice his or her opinion. In the context of the sale and sexual exploitation of children, this information is often delicate and must therefore take into consideration, and sometimes challenge, cultural and context-specific sensitivities. It is equally important, targeting the children who are most at risk and hard to reach, to ensure the broad geographical and linguistic reach of information tools and mechanisms. Consideration must also be given to the particular communication needs of children with disabilities.

States should take all actions necessary to prevent and to explicitly criminalize such exploitation and to bring perpetrators to justice. Children in street situations may be at risk of developing disabilities owing to the negative impact of aspects of street life, such as violence, exploitation and substance abuse. Intellectual and psychosocial disabilities can render children in street situations particularly vulnerable to exploitation and abuse. States should adopt special protection measures, including identifying and removing barriers that prevent children with disabilities from gaining access to services, including inclusive education.

- Given that nearly 50 per cent of survivors of sexual assault are under 18 years of age, the Special Rapporteur is concerned about the prevailing tendency to overlook the needs of children and youth in this area. Additionally, a stronger focus on prevention is required regarding SGBV within internally displaced households and communities. At present, most SGBV prevention and response programmes focus on "stranger" rape rather than the more prevalent forms of sexual violence experienced within households and communities (e.g. intimate partner violence), and the problematic coping practices that IDW may be compelled to adopt (e.g. early marriages). Moreover, given that women with disabilities in non-displacement settings are more likely to be victims of sexual violence and abuse, the levels of sexual violence against women and girls with disabilities amongst displaced and conflict-affected populations are likely to be even higher.

- Research data is limited, but some evidence indicates that children with disabilities may be up to five times more likely to experience physical, psychological, or sexual violence, less likely to be addressed by prevention programmes or to attract targeted protection services, and less able to challenge or protect themselves from incidents of violence. This explains, inter alia, the special barriers in accessing justice and being accepted as credible witnesses, and the pervasive impunity of abusers. The universal ratification of the Convention on the Rights of Persons with Disabilities will be an essential step to secure the protection of these children from violence.

- In 1989, the Committee on the Elimination of Discrimination against Women explicitly linked gender-based violence and discrimination against women in its general recommendation No. 12 and called on States parties to include in their reports information on violence and on measures introduced to deal with it. Between 1989 and 1992, the Committee issued a series of general recommendations that addressed some rights violations experienced at the intersection of inter- and intra-gender sex discrimination and violence against women. In 1992 it issued general recommendation No. 19 both to define gender-based violence and to make it discrimination on the grounds of sex within the meaning of the Convention. Much of what is set forth in general recommendation No. 19 is reiterated and refined in the Declaration on the Elimination of Violence against Women. CEDAW has also addressed the impact of intersecting forms of discrimination against women and its nexus with gender-based violence. Most recently, in general recommendation No. 27, which deals with the rights of older women, it recognizes that age and sex make older women vulnerable to violence, and that age, sex and disability make older women with disabilities particularly vulnerable.

- States parties have an obligation to draft legislation recognizing and prohibiting violence, including domestic, sexual violence and violence in institutional settings, against older women, including those with disabilities. States parties have an obligation to investigate, prosecute and punish all acts of violence against older women, including those committed as a result of traditional practices and beliefs.

- To date, the approach to violence reduction has been fragmented, compartmentalizing different forms of violence. Importantly, many forms of violence continue to be tolerated within societies and even supported by States. For example, violence against women and children remains accepted in many societies as a cultural norm. The institutional care of young children, a clear act of violence against children, remains widespread in many countries. Around the world, many groups in vulnerable situations, including women, persons with disabilities, migrants and refugees, and lesbian, gay, bisexual, transgender and intersex persons, experience numerous forms of violence. Each example is also a violation of various human rights protected under international law, including the right to health.
