- The Convention on the Rights of the Child stipulates that States parties shall respect and ensure the rights set forth in the Convention to each child within its jurisdiction without discrimination of any kind; this includes discrimination against children on the basis of their or their parents’ migration status. The Committees therefore urge States parties to provide equitable access to economic, social and cultural rights. States are encouraged to expeditiously reform legislation, policies and practices that discriminate against migrant children and their families, including those in an irregular situation, or prevent them from effectively accessing services and benefits, for example social assistance.

- Children may be compelled to work to sustain themselves or provide for their families’ basic needs, especially where parents cannot work legally or simply cannot find work, legally or illegally. Iraqi and Syrian refugee children in Lebanon, for example, work in textile factories, construction or the food service industry, or as agricultural labour or street vendors in conditions amounting to forced labour. According to UNICEF, in Jordan, Lebanon and Turkey, shopkeepers, farmers and manufacturers hire Syrian refugee children because they can pay them a lower wage. Children, especially girls, are seen as less likely to be targeted by the police or prosecuted for illegal work than adults, making families more likely to send them to work. These types of child labour, which often mask other forms of exploitation, such as trafficking for forced labour, have dire consequences on children.

- In Canada, two basic income approaches have been the subject of macroeconomic modelling: a full basic income for all Canadians, and a negative income tax under which the richest receive nothing and the poorest receive the maximum income supplement. Neither payment is adjusted for age. In terms of poverty, the conclusion was that: Cancelling existing income transfer programmes in favour of a single basic income results either in dramatically higher levels of poverty, or ethically and politically unsupportable compromises where seniors are pushed into poverty to lift up adults and children. The more acceptable and feasible approach would be to set up a new basic income on top of the 33 transfers that already exist, thus creating only winners, though the main beneficiaries would be middle-aged Canadians.

- States should take measures to address the structural causes of poverty and income inequalities to reduce pressure on and strengthen precarious families, as a means of offering better protection for children and reducing the likelihood of children ending up in street situations. Such measures include: introducing tax and expenditure policies that reduce economic inequalities; expanding fair-wage employment and other opportunities for income generation; introducing pro-poor policies for rural and urban development; eliminating corruption; introducing child-focused policies and budgeting; strengthening child-centred poverty alleviation programmes in areas known for high levels of migration; and offering adequate social security and social protection. Specific examples include child benefit programmes used in European and North American countries, and cash transfer programmes introduced in Latin American countries and widely applied in Asian and African countries. States should make efforts so that such programmes reach the most marginalized families who may not have bank accounts. Material support should be made available to parents and caregivers and also directly to children in street situations, and such mechanisms and services should be designed and implemented on the basis of a child rights approach. With regard to housing, security of tenure is essential for preventing children from coming into street situations. This includes access to adequate housing that is safe, with access to safe drinking water, sanitation and hygiene facilities. Children, including those living in informal or illegal housing, should not be subject to forced evictions prior to the provision of adequate alternative accommodation: States are required to make appropriate provisions for affected children. Child and human rights impact assessments should be a prerequisite for development and infrastructure projects to minimize the negative impacts of displacement.

- To understand the differences and similarities between cash transfers and basic income, it is helpful to look at the experience in particular countries. Mexico had one of the first conditional cash transfer programmes, PROGRESA, which was introduced in 1997. It was greatly expanded over time and was renamed Oportunidades. It is aimed at combating intergenerational poverty and is targeted only at poor households. The conditions are that children do not miss more than three days of school per month and that household members attend a medical clinic once a month. Mexico also has unconditional cash transfers, such as the Pensión Ciudadana Universal in Mexico City, a monthly electronic transfer to senior citizens of at least half the minimum wage, with no conditionality other than age and residency, and Setenta y Más, another unconditional cash transfer for people over 70 years of age who reside in smaller localities.

- Under the Social Protection Floors Recommendation, 2012 (No. 202), States should establish and maintain social protection floors ensuring that, at a minimum, “over the life cycle, all in need have access to essential health care and to basic income security which together secure effective access to goods and services defined as necessary at the national level”. This comprises essential health care, including maternity care, and basic income security for children, for active-age adults in cases of sickness, unemployment, maternity and disability, and for older persons. These goals may be achieved through any of the following schemes: universal benefit, social insurance, social assistance, negative income tax, public employment and employment support.

- By the time children arrive at their destination, they have acquired debts with exploiters who take away their documents and use threats or violence to subdue them into labour exploitation. For example, Iranian and Afghani children who have crossed the English Channel find themselves pressured to send money to their families, while also repaying substantial debts related to their journeys. This heavy financial burden drives children to accept working conditions that constitute worst forms of child labour, including trafficking. At destination, many are trafficked for forced and exploitative labour in farms and factories and on fishing boats. For example, in France and the United Kingdom, young men are exploited in cannabis farms, while others are allegedly exploited in the agriculture sector in Europe.

- Instruments of the international labour law provide additional protection to children escaping from conflict and humanitarian crises. Indeed, the International Labour Organization Conventions concerning the Prohibition and Immediate Action for the Elimination of the Worst Forms of Child Labour of 1999 (No. 182) and Forced or Compulsory Labour of 1930 (No. 29) call for the prohibition and elimination of, inter alia, trafficking in and other forms of exploitation of children. The Convention concerning Decent Work for Domestic Workers of 2011 (No. 189) is also very relevant, as exploited children on the move regularly end up in such employment.

- In addition, the absolute prohibition of slavery, which is a jus cogens norm under international law, is also relevant in this context. Indeed, the worst forms of child labour, child trafficking, slavery and slavery-like practices can cover similar realities, even though they have their own specificities under international law. Moreover, forced marriage is explicitly prohibited under the Supplementary Convention on the Abolition of Slavery, the Slave Trade, and Institutions and Practices Similar to Slavery, which provides that child and forced marriage can be considered as a form of slavery.

- The mobilization of resources for public spending on child rights should itself be conducted in a manner that adheres to the budget principles set out in section IV. A lack of transparency in resource mobilization systems can lead to inefficiencies, mismanagement of public finances and corruption. This in turn can lead to insufficient resources being available to spend on the rights of the child. The different tax regimes that do not take into account the ability of families to pay can lead to an inequity in resource mobilization. - The Committee recognizes that sustainable debt management by States, on behalf of creditors and lenders, can contribute to mobilizing resources for the rights of the child. Sustainable debt management includes having in place transparent legislation, policies and systems with clear roles and responsibilities for borrowing and lending, as well as managing and monitoring debt. The Committee also recognizes that long-term unsustainable debt can be a barrier to a State's ability to mobilize resources for children's rights, and may lead to taxes and user fees that impact negatively on children. - Trade unions have been critical partners in the prevention of human trafficking and forced labour. The International Trade Union Confederation and the International Union of Food Workers, for example, have played a critical role in curtailing forced labour in the cocoa industry in Côte d'Ivoire by advocating implementation of the Protocol for the Growing and Processing of Cocoa Beans and Their Derivative Products in a Manner that Complies with ILO Convention No. 182 concerning the Prohibition and Immediate Action for the Elimination of the Worst Forms of Child Labour. A partnership between the confederation of workers Rerum Novarum, of Costa Rica, and the Sandinista Workers' Centre and the Confederación de Unificación Sindical, of Nicaragua, led to the creation of the Trade Union Centre for Migrants, which offers free legal and administrative assistance to all migrant workers seeking regularization and aims to combat trafficking in children by partnering with the local taxi drivers' union.

- A review of global estimates of trafficking in human beings makes it possible to highlight a number of common features characterizing the sale of children for the purpose of forced labour. First, the share of children trafficked for the purpose of forced labour is increasing and the share of children involved in forced labour is particularly high. Second, while in Europe and Central Asia children may be sold for the purpose of forced begging and petty crime, in the rest of Asia and in the Americas a high proportion of child victims may be sold for economic exploitation. - The Committee recognizes that children have varying needs at different stages of their growth and development. In their budget decisions, States parties should consider all factors required for children of different ages to survive, grow and develop. States parties should show their commitment to children's rights by making visible the parts of their budgets that affect children in different age groups.
