- Furthermore, in many parts of the world, girls and young women with disabilities are often entirely excluded from the education system, or otherwise isolated from their communities at home or in institutions, and are without any access to sexuality education. The lack of equal access to inclusive and quality education affects, in particular, girls and young women with disabilities in conflict, post-conflict or other humanitarian situations, especially those who are refugees, internally displaced, migrants or asylum seekers; deprived of their liberty in hospitals, residential institutions, juvenile or correctional facilities; or homeless or living in poverty. Girls and young women in such situations are at heightened risk of being subjected to physical or sexual abuse and contracting sexually transmitted infections.

- Newly arrived migrants could face a variety of challenges in accessing public services, such as health care, education or housing, given their limited command of the local language and their lack of knowledge of the laws and systems of the host country. The enjoyment of such rights by migrants is effectively hampered in the absence of relevant support, such as the provision of language training or free information on relevant laws and regulations. A related concern is the lack of disaggregated indicators on the economic, social and cultural rights of all migrants, which would be useful for adequate policy-making, including on enhancing the accessibility of such services.

States should also develop effective firewalls between educational institutions and immigration authorities and prohibit the sharing of students’ data as well as immigration enforcement operations on or near school premises, as these practices limit or deprive migrant children or children of migrant workers in an irregular situation of their right to education. To respect children’s right to education, States are also encouraged to avoid disruption during migration-related procedures, avoiding children having to move during the school year if possible, as well as supporting them to complete any compulsory and ongoing education courses when they reach the age of majority. While access to upper-level education is not compulsory, the principle of non-discrimination obliges States to provide available services to every child without discrimination on the basis of their migration status or other prohibited grounds.

This means that, where necessary, targeted measures are needed, including additional language education, additional staff and other intercultural support, without discrimination of any kind. States are encouraged to dedicate staff to facilitating access to education for migrant children and to promoting the integration of migrant children into schools. In addition, States should take measures aimed at prohibiting and preventing any kind of educational segregation, to ensure that migrant children learn the new language as a means for effective integration. State efforts should include the provision of early childhood education as well as psychosocial support. States should also provide formal and non-formal learning opportunities, teacher training and life skills classes.

- The right to education is a fundamental human right. It is key for the development of children, but also critical for peacebuilding, economic growth and sustainable development for society as a whole. In times of conflict, infringements of the right to education in the form of targeted attacks on and obstacles to safe access to schools, threats to children and teachers and the military use of schools have a negative impact reaching beyond the education sector alone. Moreover, education is often interrupted due to a general climate of fear and insecurity or because of the displacement of school children, teachers and school personnel. Not only is there a large financial cost to rebuilding schools, repairing infrastructure, replacing equipment and training new teachers, there is a significant individual and societal cost. The loss of educational opportunities owing to war has long-lasting effects on the social and economic development of a country, which in turn increases the likelihood of new cycles of violence and conflict.

- In regard to education, as the Secretary-General noted in his report on addressing large movements of refugees and migrants (A/70/59), with millions of children currently out of school, the promise made by the General Assembly one year ago to leave no one behind in implementing the Sustainable Development Goals risks becoming a meaningless cliché. The Special Representative echoes the Secretary-General's message that primary education should be compulsory and available to all refugee children, and that educational opportunities should be expanded. In that regard, a key achievement of the World Humanitarian Summit was the launch of the Education Cannot Wait Fund. On 23 May 2016, the Special Representative attended an event by the Global Business Coalition for Education during which the private sector announced its intention to mobilize $100 million for the Fund in financial and in-kind contributions. The Special Representative encourages Member States and other partners to further support initiatives aimed at helping displaced children to rebuild their lives.

- Education also provides routine, normality, a protective function, support and information and can be an important step towards community integration in displacement locations. For IDPs, education may be a low priority in the face of survival needs. Children may contribute economically to displaced communities, which can be another barrier to their schooling. Internally displaced parents may exclude children from school in the belief that they will quickly return to their original homes, only for their displacement to become protracted. Parents may also hesitate to send their children to school in conflict zones which may be targeted for forced recruitment of children.

- Access to education continues to be a major obstacle for all Roma. The Government of Argentina has recognized the high levels of illiteracy and school dropout of Roma children. In Brazil, official data on literacy and/or school attendance of Roma children are lacking, but civil society organizations reported that very few Roma children living in camps have ever been to school, and estimate that 90 per cent of the Roma living in camps in Curitiba city are illiterate. Prejudice has also been identified as an obstacle for accessing public schools in Brazil, where Roma children are reportedly not given the chance to enrol on the pretext of a lack of space. A representative of the United Nations Children's Fund (UNICEF) has emphasized that teachers' biased attitudes towards Lyuli children in Central Asia may result in violence at school. The illiteracy rate among Iraqi Roma is very high and many Roma children there are forced to take on irregular jobs or resort to begging. In Lebanon, 68 per cent of school-aged children reportedly do not attend school because of significant obstacles such as discrimination, legal and economic barriers, leading to street labour becoming a significant trend among Dom children.

- On his visit to Côte d'Ivoire in 2012, the Special Rapporteur noted that in some western regions, an estimated 140,000 children had missed out on their education in 2011, due to insecurity and the destruction and pillaging of school buildings. Education was also disrupted in the centre and east of the country, and in Abidjan. He stressed that urgent measures were needed to ensure that children, some of whom had seen their education repeatedly disrupted, were provided with support to resume their education and make up the years of lost schooling.

- The Internet has the potential to compound and magnify existing vulnerabilities of children at risk, and to add to the challenges they face in the offline world. For marginalized children, including those experiencing social exclusion, those out of school, with disabilities, belonging to minorities or affected by migration, who may have no access to the Internet at home or in school, who may lack guidance and advice from caregivers and who explore the cyberspace on their own, the opportunity to become an empowered digital citizen is seriously limited. Those children will be less likely to enjoy the benefits offered by the online environment or to receive information regarding online safety than their peers, and more likely to face bullying, harassment or exploitation online.

- According to article 13 of the International Covenant on Economic, Social and Cultural Rights, the right to education is a universal right. As recognized by Committee on Economic, Social and Cultural Rights in its general comment No. 13, education is the "primary vehicle by which economically and socially marginalized adults and children can lift themselves out of poverty and obtain the means to participate fully in their communities". The Committee on the Elimination of Racial Discrimination, in its general recommendation No. 30, has highlighted the need for States to ensure that all migrant children, irrespective of their status, have access to public educational institutions. The Committee on the Rights of the Child, in its general comment No. 9, endorsed the concept of inclusive education as "a set of values, principles and practices that seeks meaningful, effective, and quality education for all students, that does justice to the diversity of learning conditions and requirements not only of children with disabilities, but for all students".
