- The risk of trafficking from situations of armed conflict is a related issue of concern for the protection of girls, including during displacement. The Special Representative welcomes the Human Rights Council's call to Governments in June 2016 to ensure that the prevention of and responses to trafficking in persons continue to take into account the specific needs of women and girls and their participation in and contribution to all phases of preventing and responding to trafficking, especially in addressing specific forms of exploitation, such as sexual exploitation. The Special Representative has also undertaken a number of initiatives to support that aim, including contributing to the report of the Secretary-General on the implementation of measures to counter trafficking in persons and addressing an event on the role of the United Nations in combating modern slavery and human trafficking in conflict, which was hosted in New York in November by the United Nations University.

- [Vulnerabilities and risks faced by children who are internally displaced during armed conflict – addressing their rights]: States and all parties to conflict have obligations under international humanitarian and international human rights law to protect internally displaced children in all phases of displacement. The most fundamental of their rights is the right to life, dignity and physical, mental and moral integrity. Displacement almost inevitably entails severe threats to the right to life. Therefore, the physical safety of the affected population, particularly women and children, in zones of armed conflict should be the highest priority. Protected safe spaces for displaced children should be guaranteed - both for those seeking to escape imminent harm, as well as for those who have reached a place of safety such as an IDP camp but who continue to face security threats, or are at risk of further displacement. Children should also have access to the fullest extent and with the least possible delay to the humanitarian assistance they require, including food, potable water, shelter, health care and psychosocial services.

- In situations of displacement, girls are particularly vulnerable. In addition to discrimination related to race, religion or ethnicity, girls are also often subject to abuses based on their sex, and therefore to multiple forms of discrimination. For example, displaced women and girls face high risks of sexual and gender-based violence, as highlighted in the 2016 report of the Secretary-General to the General Assembly entitled "In safety and dignity: addressing large movements of refugees and migrants" (A/70/59). These specific protection challenges must be recognized in order to mitigate the risks that girls are exposed to in situations of displacement. Member States are therefore urged to ensure that the needs of girls are addressed as part of their response both to refugees and to internally displaced persons. Protection measures should be implemented at all stages of the displacement cycle and girls who have suffered violations should be prioritized in refugee resettlement programmes.

- Women and girls belonging to minority communities, rural and indigenous women, migrant women, refugee women and those seeking asylum, and poor women face discriminatory practices in the implementation of laws on nationality and citizenship. They face prejudicial attitudes as well as structural obstacles which limit access to formal registration of births, marriage, residence and other citizenship documents as well as to relevant information on their rights as citizens. Women who are de facto heads of households, including those who have been abandoned by their husbands, whose divorce is not legally registered, or whose husbands have been forcibly disappeared and do not have death certificates for their husbands , are denied recognition of their status in official documents. Without such access, women from these communities become disproportionately vulnerable in exercising their full and equal rights as citizens.

- Women in the informal economy have, furthermore, been deeply affected by economic crisis. There is an "added worker" effect, whereby women enter the labour force to provide additional income security to the household, often forcing them into precarious work, migrant labour overseas or exposing them to trafficking. According to Women in Informal Employment: Globalizing and Organizing, nearly 40 per cent of street vendors interviewed in developing countries in 2009 had experienced an overall deterioration of employment and income levels, and 84 per cent of own-account home-based workers reported reduced monthly incomes.

- Women migrant workers face exploitation and abuse, often finding themselves in precarious employment without effective legal protections, particularly if they have irregular or undocumented legal status. About half of the world's migrant workers are women, most of them finding work in traditionally female-dominated occupations such as domestic work or in the garment and textile industries. General Recommendation No. 26 of the Committee on the Elimination of Discrimination against Women, on women migrant workers, emphasizes that all categories of women migrants must be protected against discrimination. The ILO Migrant Workers Convention (No. 143) and the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families also provide important protections.

- Furthermore, test results are passed on to employers or recruitment agencies without the migrant worker's consent, breaching the requirement of confidentiality and contrary to international recommendations. Additionally, pre- and post-test counselling protocols may not be followed, even when required by law. A right to health approach, however, requires that counselling, voluntary testing and treatment be treated as a health-care continuum. Migrant workers who test positive for HIV may remain in an irregular situation, making them more vulnerable to abuse by employers and less likely to access medical treatment. In cases of pregnancy, women may resort to risky illegal abortion to avoid deportation. Further, compulsory testing stigmatizes those who are deported based on positive test results.

- International migrants worldwide are estimated to number over 200 million, representing 3.1 per cent of the world population. Ninety million of them are migrant workers. Forty-eight per cent of all international migrants are women. While the larger proportion of migrants moves from low- and middle-income countries to high-income countries, representing a total flow of 80 million persons, it is estimated that South-South migration accounts for 47 per cent of all migration from the South. Migration between developing countries may be even higher if undocumented migration is considered, as official numbers are for the most part unknown, but it is estimated to be around one third of documented migration.

- The e-consultation highlighted a host of issues which continue to impact the ability of women to enjoy their right to adequate housing or which otherwise have a disproportionate gender impact. In all regions, patriarchy and gender discrimination; poverty; and the impact of globalization, neo-liberal economic policies and privatization surfaced as overarching issues of concern which set the stage for violations of women's right to adequate housing. More specifically, the impact of natural and human-induced disasters, conflict and internal displacement, war and occupation, lack of affordable and low-cost housing, forced evictions, homelessness, domestic violence, lack of women's participation in law and policy-making, lack of access to remedies, inadequate and discriminatory laws, and the application of discriminatory customary law, all emerged as relevant barriers to women's right to adequate housing across regions.

Such participation is essential to effectively promoting and protecting human rights, preventing rights violations, achieving durable solutions, and supporting sustainable peace processes, post-conflict reconstruction and development. Ongoing participatory needs assessments and "bottom-up" participatory planning processes are essential to overcoming the "implementation gap" between gender policies and effective practice, and ensuring that nationally and internationally supported protection interventions complement women's self-protection strategies and respond to their evolving needs and concerns.

- The pursuit of durable solutions raises a range of concerns for IDW. Although the choice of a durable solution is, in principle, an individual matter, in practice decisions concerning durable solutions are usually made by families or communities, often marginalizing women's preferences. Yet, in some instances families or other actors may pressure women to return despite these concerns.

- In recent years, increased attention has been devoted to rising rates of displacement linked to the effects of climate change and the particularly adverse effects of climate change on potentially vulnerable groups, including women. It is now widely acknowledged that climate change impacts on men and women differently at all stages from preparedness to reconstruction. As recognized by the Intergovernmental Panel on Climate Change (IPCC), inequitable gender roles may exacerbate women's exposure to harm, while at the same time women may make "very significant, active contributions … [to] coping with and adapting to extremes". Women often experience higher rates of mortality than men in natural disasters and may experience particularly deleterious effects on health, exacerbated gender inequality and reduced access to education and livelihood opportunities.

- The Special Rapporteur would like to remind Governments that alternatives to detention should not become alternatives to unconditional release, whenever such release is a possibility. Governments should put in place safeguards to ensure that those eligible for release without conditions are not diverted into alternative measures. Alternatives to detention should have a human rights-based approach, be established by law, be non-discriminatory and be subject to judicial review and independent monitoring and evaluation. In designing alternatives to detention, Governments should pay attention to the specific situation of particular groups of migrants, such as children, pregnant women and persons with disabilities, and use the least intrusive measure possible.

- However, the Special Rapporteur notes that this focus on migrants who undertake irregular border crossings has significant relevance, as this is where the most egregious human rights abuses appear to take place. Of the utmost concern are the deaths of irregular migrants attempting to cross into the European Union. Other concerns are the mistreatment of migrants at the border, including practices which infringe their liberty and security, and detention regimes on both sides of the border that fail to adequately respect minimum human rights standards. Furthermore, even before crossing the border to the European Union, whether by sea or by land, migrants are often exposed to serious risks of abuse and exploitation en route, including by smugglers. This is particularly true for women and girls who wait in transit countries and who may be exposed to sexually based violence.

- A full picture requires up-to-date disaggregated data, research by national statistical bodies, academia or civil society actors. This should be updated regularly in order to pick up on changes to birth rates, migration flows and patterns of belief. Research should be sophisticated enough to reveal the different situations of women, young people and others who may face particular challenges. It should include beliefs as well as religions. As a basic minimum standard, regular census surveys should include voluntary questions on religion that allow individuals to self-identify and that provide a valuable resource for deeper statistical analysis.

- Some persons belonging to minorities may face particular challenges in learning the national language, including the elderly and those who have not attended education in their country of residence, those with low incomes, the relatively newly arrived, and in some cases women. - Several treaties contain specific references to old age. The Convention on Elimination of All Forms of Discrimination against Women stipulates "the right to social security, particularly in cases of retirement, unemployment, sickness, invalidity and old age and other incapacity to work" (art. 11). It is also understood that the prohibition of discrimination included in major human rights treaties is understood as non-exhaustive; therefore, even if age is not mentioned specifically as a prohibitive ground for discrimination, it should still be accepted under "other status". The International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families specifically identifies age as a prohibited ground for discrimination.

- A number of risk factors increase children's vulnerability and place them at higher risk of being sold and trafficked to meet the demand for sex with children. They include being female, aged between 12 and 18, belonging to an ethnic minority, living in a rural area, lacking education, having a disability, inadequate family protection, living in extreme poverty and having migrated. The general trends and patterns of sale, trafficking and sexual exploitation of children include increased control of trafficking routes and destinations by criminal organizations, which benefit from increased migration movements; the enhanced role of new technologies in marketing children for sexual exploitation, including through new forms of exploitation such as the online streaming of sexual exploitation (A/HRC/28/56, paras. 42-43); the normalization of prostitution as a legitimate business in tourism and entertainment; and the wide-scale migration of women and girls for domestic and entertainment work.

- Nevertheless, Government-run rehabilitation and reintegration efforts are not always effective. In these cases, other stakeholders can offer assistance. Unions and non-governmental organizations (NGOs) in sending and receiving countries have cooperated in order to facilitate the reintegration of victims when return home. In Nepal, where government reintegration services have been limited, two NGOs rehabilitate and reintegrate returned migrant workers. Pouraki Nepal was initiated by women migrant workers, while Pravasi Nepali Coordination Committee advocates for the rights of male migrants. In-country research in Nepal also indicates that a new foundation to aid migrant workers has been established, with a free training centre in Kathmandu that helps rehabilitate and reintegrate returned migrant workers, including a counselling centre for female returnees.

- Thus, a brief analysis of some of the root causes of trafficking shows that there is a wide range of intertwined factors at play. One single factor such as poverty, gender discrimination or lack of employment opportunities per se does not necessarily lead to trafficking; rather, it is the combination of multiple factors that may place certain individuals at a higher risk of being trafficked. Thus, measures aimed at addressing the root causes of trafficking should be based on the recognition that trafficking is caused by a lack of comprehensive protection of such human rights, as freedom from discrimination, the right to work, the right to an adequate standard of living and freedom of movement. As an example, the United Nations Children's Fund (UNICEF) advocates for a comprehensive child protection system rather than measures that focus narrowly on trafficking. In its "system-building" approach, UNICEF promotes shifts towards building and strengthening social welfare, changing social behaviour and improving the legal and justice system for child protection in a holistic manner, based on the principles enshrined in the Convention on the Rights of the Child. This approach can be offered to other groups at high risk of being trafficked, such as women or ethnic minorities, so that prevention measures are designed to protect the human rights of potential victims of trafficking in a comprehensive manner rather than focusing on alleviating one factor. Consistent with this approach, the Special Rapporteur welcomes the recent adoption by the General Assembly of the United Nations Global Plan of Action against Trafficking in Persons (resolution 64/293) in which Member States affirmed their commitment to adopt and implement comprehensive policies and programmes at the national level to prevent trafficking in persons in line with relevant policies and programmes on migration, education, employment, gender equality, empowerment of women and crime prevention.

- Irregular women migrants, women asylum seekers and refugees are particularly vulnerable to violence in the transnational arena. During the country mission to Zambia, the Special Rapporteur was informed that female migrants, especially those engaging in sex work, are often subjected to sexual abuse and at risk of contracting HIV/AIDS due to their inability to negotiate safe sex. Also, their irregular status makes them reluctant to seek health care. Similarly, immigrant women in the United States of America often suffer higher rates of battering as they have less access to legal, social and support services. Testimonies from undocumented immigrant women living with a United States partner reveal hesitation to seek assistance from authorities when facing abuse due to fear of deportation. It was also indicated that abusers may not initiate the process to acquire permanent residence status for their foreign partner or wife as a way to maintain their power and control over these women.

- Migrants face discrimination and exploitation in the workplace and sometimes experience forced labour. They often find themselves in debt bondage as a result of exorbitant recruitment fees. Nevertheless, migrants most often do not seek redress for the violations of human rights and labour standards that they suffer, owing to their limited command of the local language, their lack of knowledge of the laws and systems, cultural barriers and the fear of detection, detention and deportation. This holds especially true for the most precarious migrants, including undocumented migrants, temporary migrant workers in sponsorship programmes and live-in migrant domestic workers, most often women.

Women defenders likewise mentioned the need for them to be included from the outset in the preparation of programmes to protect them, in order to get away from a sometime paternalistic approach that plays down the challenges they face.

- Ongoing efforts in the context of Security Council resolutions 1325 (2000), 1820 (2008 )and 1888 (2009), which seek, inter alia, to strengthen women's participation in decision-making and their agency in conflict prevention, early recovery and governance, as well as in ending conflict related sexual violence and impunity, are important in the context of internal displacement. Equally relevant to the situation of women and girls in internal displacement situations are a number of other instruments, including the International Convention on the Elimination of All Forms of Discrimination against Women, the Convention on the Rights of the Child, and the fundamental guarantees provided for in international humanitarian law. Despite these frameworks, the international community has paid insufficient attention to the particular human rights situation and solutions for women and girls in the specific context of internal displacement. The Special Rapporteur proposes to devote particular attention to exploring the gender dimensions of internal displacement, including by strengthening links with the Committee on the Elimination of Discrimination against Women, the Committee on the Rights of the Child and other relevant bodies and organizations, in order to address the specific human rights violations and discriminatory practices which impact on women and girls at every stage of the displacement process, and by examining alternative solutions and prevention strategies which would be especially effective for them.

- Internally displaced persons in informal urban settlements typically reside in makeshift shelters, where they are barely protected from intruders and are exposed to the risk of sexual and gender-based violence. Urban displacement leads to changes in gender relations, thereby increasing risks of domestic violence, sexual and gender-based violence, survival sex, exploitation and forced labour. Access to protection and assistance for internally displaced women is vital.
