- The housing sector in the global South has not been subject to extensive financing of homeownership. Only about 17 per cent of the population in Botswana, Kenya, Namibia and Zambia, for example, would be eligible for mortgage finance based on existing criteria. Low-income, informal and indigenous communities have nevertheless experienced, first-hand, the power of financial corporations to appropriate land and real estate and to generate vast disparities in wealth by treating housing and land as commodities. The displacement of Garifuna communities by model cities containing luxury developments for tourists and wealthy residents in Honduras is an example of the kinds of displacements of communities and forced evictions that are occurring in many countries (see A/HRC/33/42/Add.2, para. 56). Many local and national governments looking for capital investment have opted to sell land to major developers at the expense of indigenous and impoverished communities and those living in precarious housing.

It is necessary to develop various socioeconomic indicators and indices to adequately assess possible marginalization of and discrimination against minorities with respect to, inter alia, access to education, employment, health, housing and public services. - The national dimension of the institutional attention to minority issues must be complemented and reinforced by solid regional and international mechanisms tasked to promote domestication of minority rights, as well as the protection and promotion of minority standards regionally and internationally. In this regard, the Special Rapporteur recognizes several existing good practices, such as the High Commissioner on National Minorities of the Organization for Security and Cooperation in Europe and various dedicated mechanisms of the Council of Europe, while also noting the need for further strengthening regional mechanisms. - The Forum on Minority Issues, which replaced the Working Group on Minorities, was established in 2007 by the Human Rights Council in resolution 6/15 and reaffirmed in 2012 by resolution 19/23. It is mandated to provide a platform for promoting dialogue and cooperation on issues pertaining to national or ethnic, religious and linguistic minorities, as well as to provide thematic contributions and expertise to the work of the Special Rapporteur on minority issues. - Finally, independent national human rights institutions have a critical role to play with regard to promoting and monitoring national laws and policies, their harmonization with international human rights standards, including the Declaration, and State compliance. Some independent national human rights institutions have incorporated indigenous members, or sections on indigenous issues, have developed good monitoring practices, and have promoted dialogue on the rights of indigenous peoples in their countries. Countries where independent national human rights institutions have promoted the rights of indigenous peoples include Colombia, Guatemala, Peru, Australia, Indonesia, Malaysia, Nepal, New Zealand, the Philippines, Kenya, Namibia and the United Republic of Tanzania.

- The Declaration contains a set of collective rights that are fundamental for the survival of indigenous peoples as distinct peoples, as underlined by international, regional and national law and jurisprudence. These are their right to self-determination and the related rights over their lands, territories and natural resources, on which the enjoyment of the whole panoply of their human rights depends. The Declaration states the “urgent need” to respect and promote the inherent rights of indigenous peoples, “especially their rights to their lands, territories and resources”. Therefore, it is a serious concern that the most common complaints brought to the attention of the Special Rapporteur are precisely violations of indigenous peoples’ collective rights to their lands, territories and resources.

- As already mentioned, several countries have developed legal instruments and administrative and other measures to recognize indigenous rights to land and resources, including processes of land demarcation, title-clearing, dispute settlement, and others. Yet, even in those countries, implementation of legislation and policies is inadequate and indigenous peoples continue to be dispossessed of their traditional lands and resources and forcibly displaced, including by State-sponsored infrastructure, agribusiness, extractive projects and conservation measures. The consequences of such violations on indigenous peoples, as observed by the mandate holder in a wide range of countries across the world, continue to result in the expropriation of land, forced evictions, and the denial of self-governance, as well as discrimination against traditional livelihoods and loss of culture and spiritual sites.

- Human rights treaty bodies have specifically addressed the need for special measures when referring to indigenous peoples within the context of monitoring compliance with their respective human rights treaties. The Committee on the Elimination of Racial Discrimination has noted that “the situation of indigenous peoples has always been a matter of close attention and concern. In this respect, the Committee has consistently affirmed that discrimination against indigenous peoples falls under the scope of the Convention and that all appropriate means must be taken to combat and eliminate such discrimination.” It has furthermore noted that “States parties should ensure that special measures are designed and implemented on the basis of prior consultation with affected communities and the active participation of such communities”.

- Persons with disabilities belonging to groups that have been historically discriminated against or disadvantaged (such as indigenous peoples, ethnic minorities and persons living with HIV/AIDS) are disproportionately affected in accessing support arrangements and services. This also applies to migrants, persons living in conflict situations, internally displaced persons, refugees, asylum seekers, stateless persons and prisoners with disabilities, as humanitarian responses tend to overlook their support needs. Moreover, there is a strong link between belonging to a racial and cultural minority and experiencing coercion and institutionalization. - Enhanced cooperation with resident coordinators and United Nations agencies and programmes is needed. The Special Rapporteur's interactions with other actors have revealed a lack of visibility and understanding of his mandate and, more generally, a lack of knowledge even within the United Nations about the situation of defenders. He has therefore sought to foster better coordination with institutions such as the United Nations Entity for Gender Equality and the Empowerment of Women (UN-Women), the International Labour Organization (ILO), the United Nations Development Programme (UNDP) and the United Nations Educational, Scientific and Cultural Organization (UNESCO). It would also be useful to develop training and outreach workshops for staff of those institutions and to raise their awareness about the recommendations contained in the Special Rapporteur's reports and the links between them and the issues at the core of those institutions' missions. A noteworthy example would be the recommendations on women defenders or defenders working on development projects or on the protection of ethnic and cultural minorities.

- In her report to the General Assembly, the Special Rapporteur shared her observation that persons belonging to minorities were frequently the victims of violence and atrocities. Violence could take the form of attacks on individuals, their homes, shops or places of worship, or wider acts of aggression against communities with different national, ethnic or religious identities. In the worst cases, violence constituted mass atrocities, crimes against humanity, war crimes, ethnic cleansing and even genocide, often perpetrated with impunity. Sometimes violence was committed by non-State actors, including those belonging to the majority, or by larger, more powerful groups, extremist groups, or even business actors. Sometimes it was perpetrated by State actors.

- She recalled that a primary objective of the United Nations and of most States in the area of peace and stability was to prevent violence before it broke out. The tragic experiences of past violence and atrocities had helped to better understand the causes of violence and the fact that minorities were frequently targets, and to produce indicators to predict violent incidents and provide early warning. However, States too often failed to translate clear early warnings into adequate, appropriate and timely measures to prevent or stop violence. In order to save lives and ensure peaceful societies, a high priority of stakeholders at all levels must be to improve prevention mechanisms and turn early warning into early action. At the national level, good and inclusive governance that included minorities and measures to ensure equality was a key prevention prerequisite. The international community must also improve its ability to engage and assist States in efforts to prevent and resolve violence and to intervene effectively where States failed in their responsibility to protect minorities.

- In view of the current state of affairs, with increasing hate speech, xenophobic rhetoric and incitement to hatred against minorities, coupled with the rise of far-right and extremist political parties worldwide, the Special Rapporteur believes that it is crucial to appoint a high-level official on minority issues within the Secretariat and to establish senior positions within United Nations departments and agencies dedicated solely to issues of minority rights protection, diversity management and safeguarding pluralistic societies. The designation of minority focal points in all United Nations field offices would also be a great step forward.

- The Special Rapporteur also believes that United Nations staff in all offices and entities, particularly in the field, should better reflect the national, ethnic and religious makeup of the societies in which they operate. Staff members from minority groups not only bring expertise on the issues affecting minorities to the work of the United Nations, but also serve as a bridge between United Nations and minority communities. The Special Rapporteur was pleased to identify good practices in this regard. In 2012, the United Nations country team in the Republic of Moldova conducted an internal survey to assess the diversity of its staff and launched an internship programme for persons belonging to the identified underrepresented groups, including persons with disabilities, Afro-descendants and Roma. The Special Rapporteur strongly encourages the replication of this initiative in other United Nations offices.

- Next year also marks the tenth anniversary of the creation of the Forum on Minority Issues. This will provide a unique opportunity to discuss how to strengthen and support the functioning of this unique and global platform to facilitate dialogue and address relevant issues pertaining to minorities. The Forum should be provided with the necessary resources to fully implement its mandate. The Special Rapporteur encourages consideration to be given to raising the Forum's profile at the regional and international levels, following up the implementation of its recommendations, fostering ownership of the Forum's agenda by minorities and promoting a more interactive dialogue and discussions during the Forum's sessions.

- The Constitutional Court used its power to assess implementation of its own judgment, issuing two further orders on the rights of displaced women. In 2008, the Court handed down a decision that was considered a global pioneer in the treatment of sexual violence during internal armed conflict. It identified 10 risks that forcibly displaced women faced, including extreme risk of sexual violence, and 18 gender facets of displacement, including patterns of discrimination and violence. Accordingly, the Court ordered the Government to create and implement 13 programmes with a gender-sensitive approach, including violence prevention, the right to health and education and access to land, justice and reparations. The Court also took an intersectoral approach, highlighting heightened risks faced by girls, indigenous, black and community women leaders, and women with disabilities. The Court ordered the allocation of sufficient resources to guarantee implementation of the programmes, refusing to recognize lack of budget as valid justification for non-compliance.

- The bottom-up approach of the practice, which was developed at the impetus of women’s organizations — while demonstrative of the innovative means used by the community to address the structural reality of the situation of violence and discrimination in which they live — has raised the question as to why grave and well-documented human rights violations have not been addressed on a systematic or institutional level within the federal police and Government. Political will to support, expand and institutionalize this good practice is required for its replication and sustainability. In all post- and ongoing colonial contexts, the disproportionate and intersectional discrimination faced by indigenous women, often aided and abetted by legal systems, must be systematically addressed by State duty holders.

- Discrimination is compounded by other grounds, notably sex, gender, socioeconomic status, race and belonging to ethnic, religious or linguistic minority groups. Indigenous peoples in Canada experience twice the rate of disability as the non-indigenous population and are subjected to intersecting discrimination on the basis of indigeneity, poverty and disability. Criminalization of persons with disabilities, in particular those living in homelessness and those with psychosocial disabilities, is common. A typical pattern for persons with psychosocial disabilities is first to lose their housing, when their needs are not accommodated or when they do not receive adequate financial assistance, then to be criminalized in the context of homelessness and then to be incarcerated. In prison, punitive responses for persons with psychosocial disabilities result in extended isolation, segregation, further deterioration of mental health and an ongoing cycle of homelessness and incarceration.

- In other countries, indigenous peoples are developing their own proposals of autonomy in accordance with the Declaration, such as the Autonomous Territorial Government of the Wampis Nation in Peru. In Bolivia, the first autonomous local government took office in the province of Charagua in January 2017. In addition, new institutions have been created, such as the Sami Parliaments in the Nordic countries, the National Congress of Australia’s First Peoples, and numerous indigenous representative organizations. Nevertheless, challenges still remain for the recognition of indigenous peoples’ own institutions and organizations in many countries, including restrictive legalisation and registration processes.

- The mandate holder has provided numerous recommendations in country reports and in communications on measures and actions to be adopted to realize indigenous peoples’ land and resources rights. These include the development of an adequate legal framework in accordance with international human rights standards; the establishment of accessible, prompt and effective procedures to process land titles; the review of laws on expropriation; adequate mechanisms to resolve land disputes; ensuring effective protection from encroachment, including through early warning systems; and the prohibition of forced evictions. National and regional human rights courts have elaborated jurisprudence that provides a solid basis on the ways to realize indigenous peoples’ rights to their lands and resources, including appropriate remedies when those rights have been violated. The lack of compliance with such court decisions remains a concern.

- Without consideration of these potential barriers, indigenous peoples face violations of due process when they do not understand legal procedures and when courts are inaccessible. Persistent racism, including in the judicial system, is clearly an obstacle to obtaining justice. This is undoubtedly a factor in the concerning overrepresentation of indigenous persons, including women and young people, in jail. Aggressive litigation, particularly by private parties who seek access to indigenous lands and resources, can be used as a way to hinder effective justice or remedy.

- The maintenance of indigenous peoples’ own customary legal institutions and norms is an essential aspect of their right to self-determination. Indigenous jurisdictional functions have been recognized at the national level in several countries. Nevertheless, in spite of increasing recognition of the value of customary law and indigenous justice systems, and certain steps taken towards legal pluralism, implementation of indigenous jurisdiction is still contested. Much more needs to be done in terms of both recognition and harmonization with the national justice systems. An intercultural dialogue and understanding between State and indigenous justice authorities is vital, taking into account indigenous good practices.

- Consultation and free, prior and informed consent are essential safeguards that help to realize the substantive human rights of indigenous peoples. Thus, adequate implementation of the State duty to consult and obtain consent must ensure realization of those fundamental rights. There are different ways in which consultation and consent can be operationalized and this is not just limited to the adoption of specific legislation. In cases when States decide to develop laws to implement this duty, an adequate process has to be established so that indigenous peoples fully participate in the drafting and adoption of such measures. The rights to consultation and consent should not be regarded as stand-alone rights, as these are closely linked to other rights such as the right to self-determination, the right to lands, territories and resources and the right to development.

- The Special Rapporteur is gravely concerned at the limited, or often complete lack, of a minority presence in political and public offices. She has repeatedly stressed throughout her tenure the need to ensure that minorities are included in all decision-making processes, including in municipal and government structures, law enforcement bodies, the judiciary, legislative bodies, criminal justice systems and all authorities, especially when their decisions affect minorities. Without their participation, such bodies are less able to take vital decisions for the benefit of the entire society and may be less trusted by minorities, who may be reluctant to access them, or discouraged from doing so. Moreover, good and inclusive governance, which includes minorities and measures to ensure equality, are key conflict-prevention prerequisites. Good governance includes legal, administrative and territorial arrangements that allow for peaceful and constructive group accommodation on the basis of equality in dignity and rights for all and that allows for the necessary pluralism to enable the persons belonging to the different groups to preserve and develop their identity.

- True reconciliation requires affirmative steps to provide remedy and redress for indigenous peoples. As stated in the Declaration, this is required inter alia for the dispossession of their land, territories and resources, for any form of forced assimilation or integration, for taking cultural, intellectual, religious or spiritual property, for the deprivation of their means of subsistence as well as for the development and for the utilization or exploitation of their mineral, water or other resources. An essential approach for redress in these processes is the consideration of the collective nature of the impact of such violations and therefore the incorporation of adequate collective reparation measures. - Among the gains achieved after the Declaration came into being is the adoption of policies and guidelines on indigenous peoples by several agencies, programmes and funds and other intergovernmental bodies. In 2008, the United Nations Human Settlements Programme (UN-Habitat) adopted its “Policy guide to housing of indigenous peoples in cities”. The United Nations Development Group adopted its “Guidelines on indigenous issues” in 2009, the same year as the International Fund for Agricultural Development adopted its policy of engagement with indigenous peoples. The Food and Agriculture Organization of the United Nations followed suit and adopted its policy on indigenous and tribal peoples in 2010. The United Nations Environment Programme finalized its “Policy guidelines on indigenous peoples” in 2012.

- The International Labour Organization has a particular standing among United Nations agencies with regard to the rights of indigenous peoples, owing to its role in the promotion and implementation of ILO Convention No. 169. The Declaration and ILO Convention No. 169 are complementary international human rights instruments and constitute the minimum human rights standards needed for the dignity, well-being and survival of indigenous peoples. ILO plays an important role, including through technical advice, in the operationalization of the rights of indigenous peoples. Within this context, it is important to recall that, when interpreting human rights standards, a progressive approach is required, so that a human rights instrument can never be used to diminish subsequently recognized standards.

- Development and conservation civil society organizations are also important actors. Their work should adhere to a human rights-based approach, by cooperating with indigenous peoples in achieving the ends of the Declaration and supporting their own self-determined commitments to respect the Declaration. - The only way to move forward is by taking actions in good faith. This entails the holding of intercultural dialogues that are inclusive and carried out with full respect for international human rights standards. This is not to say that there has not been any progress. Many of the gains achieved so far have been outlined in the earlier sections of this report. It has to be recognized that most of these gains have been achieved because of the heightened awareness among indigenous peoples of their rights enshrined in the Declaration. They have actively organized themselves and engaged with Governments to push for the implementation of the Declaration. - While there are some good practices of indigenous-led initiatives supported by States, it remains a serious concern that certain traditional livelihoods and indigenous economic practices are still disregarded and marginalized in many countries, in disregard of article 20 of the Declaration. This is the case with traditional pastoralism in eastern Africa, hunting and gathering, traditional agricultural practices such as shifting cultivation in South-East Asia, small-scale traditional fishing in many coastal areas, or reindeer-herding in the Arctic. Moreover, the contributions of these indigenous livelihoods and economic activities to the general economy are not adequately valuated and taken into account. The right of indigenous peoples to continue practising their traditional livelihoods is often violated in contrast with the protection of the rights and claims of those dominating the national economy.

- The Special Rapporteur wishes to state at the outset that she is of the view that the progress achieved in the last decades in the field of minority rights protection is under threat, and that there is a serious risk that guarantees that have been put in place could be reversed. In recent years, protracted and recent conflicts of various kinds around the globe have led to an unprecedented number of internally displaced persons, migrants and refugees, many of whom belong to minority groups. Increasing hate speech, xenophobic rhetoric and incitement to hatred against minorities have been coupled with the rise of far-right and extremist political parties that are using minorities as scapegoats to divert domestic attention from entrenched and structural problems. Developments in the field of counter-terrorism legislation, discrimination and lack of representation of minorities in governmental structures and within the administration of justice globally have resulted in minorities being increasingly targeted. Widespread attacks against minority individuals and communities, perpetrated with total impunity in different regions, demonstrate the continuing vulnerability faced by minorities around the globe.

- The legal framework may consist of a combination of constitutional recognition and specific legal instruments devoted to the rights of indigenous peoples in general or on different sectoral issues. In some countries, such as Canada, New Zealand and the United States of America, treaties were signed between indigenous peoples and States which provide a legal basis for domestic recognition of indigenous peoples’ rights. There is an ongoing discussion of the possibility of development of a treaty in Australia. There are also different kinds of agreements between indigenous peoples and the State in certain countries. As stated in the Declaration, treaties, agreements and other arrangements between States and indigenous peoples are the basis for a strengthened partnership between indigenous peoples and States and should be honoured and respected.

- There is a continuous need to review policies and align them with the Declaration. The commitment made at the World Conference on Indigenous Peoples by Member States to develop and implement, in cooperation with indigenous peoples, national action plans, strategies and other measures to achieve the ends of the Declaration provides an opportunity to reverse the current situation and develop adequate public policies to comply with this commitment. For some countries, the role of the donor community in this regard is important. Cooperation and aid should explicitly conform to the Declaration as the standard to be applied in the activities supported in relation to indigenous peoples. Several States have developed guidelines and other instruments framing their aid and cooperation activities within the Declaration, such as Australia, Denmark, Germany, Spain and Switzerland.

- The Special Rapporteur is alarmed at the rise of populism, which hampers efforts to include minorities in the national psyche in their respective countries. She is concerned that even the very notion of democracy is being challenged and that there are views that are widely shared, especially on social media, that a democratically elected political leadership has the power to take any decision freely, without, and even against, minorities because minorities - usually being inferior in number - are subject to the will of the majority. The Special Rapporteur stresses that democracy requires good and inclusive governance under which legal, administrative and territorial arrangements are made to allow peaceful and constructive group accommodation on the basis of equality in dignity and rights for all and that allows for the pluralism necessary to enable persons belonging to different groups to preserve and develop their identity (see E/CN.4/Sub.2/AC.5/2005/2, Commentary, para. 13).

- While the Special Rapporteur fully respects the principle of self-identification, she considers that further efforts are necessary to fully convey the meaning, scope and implications of the term "minority" to minority groups themselves, so that the term can be reclaimed and used with the empowering intent it actually holds. She reiterates that the term "minority" does not imply any inferiority or diminished status in any way, but rather the recognition that the principles of equality and non-discrimination are not fulfilled for certain groups. Minority protection entitles persons belonging to minorities to specific rights, imposing concrete obligations on States to ensure the survival and continued development of the cultural, religious and social identity of the minorities.

- The Special Rapporteur has observed challenges to the use of the term "minority" for certain distinct communities, either because they reject being referred as minorities on the basis of a perceived negative connotation, or because they self-identify as minorities but the State refuses to recognize them as such. She considers that further awareness-raising is required to fully convey the meaning, scope and implications of the term "minority", so that it can be reclaimed and used with the empowering intent it actually holds. Moreover, she recalls that the existence of an ethnic, religious or linguistic minority in a given State does not depend upon a decision by the Government but needs to be established by objective criteria. Members of those minorities need not be nationals or citizens, or even permanent residents. Therefore, she encourages States to be as inclusive as possible when designing protection measures for all disadvantaged minorities within their territories, including migrant workers and newly arrived minorities.

- The Special Rapporteur is concerned that minorities are often disproportionately affected by statelessness as a result of discriminatory nationality and citizenship legislation that may deny citizenship for some ethnic, linguistic, racial or religious groups or deprive them of citizenship. Today, at least 10 million people around the world are denied a nationality and, although there are no disaggregated data, estimates indicate that many, if not most, of them belong to minority communities. Therefore, she welcomes current United Nations efforts, including the I Belong campaign to end statelessness of the Office of the United Nations High Commissioner for Refugees, and urges Member States to pledge their full support and cooperation so statelessness can be ended and so that it will not be a further source of stigmatization and discrimination against minorities.

- The Special Rapporteur has often been struck by the general lack of knowledge and understanding about the most disadvantaged minorities and their daily struggles for basic human rights and dignity. This is often compounded by negligence on the part of authorities, owing to non-inclusive governance, lack of channels of communication between minorities and authorities and lack of accessible spaces for safe exchange of the various views, concerns, experiences and aspirations. The Special Rapporteur is concerned that growing inequalities in many parts of the world and the increasing concentration of power in the economic and political spheres as well as in the media will lead to further marginalization of those who are already on the bottom. She believes that communication, trust-building and power-sharing between various groups belonging to different societal strata are prerequisites for sustainable development, peace and stability.

- The Special Rapporteur has been particularly alarmed by the limited, or often complete lack, of minority presence in political and public offices. She has repeatedly stressed throughout her tenure the need to ensure that minorities are included in all decision-making processes, including in municipal and government structures, law enforcement bodies, the judiciary, legislative bodies, criminal justice systems and all authorities, especially when their decisions affect minorities. Without their participation, such bodies are less able to make vital decisions in a way that benefits the entire society, and they will also be less trusted by minorities, who might be reluctant to access them, or discouraged from doing so.

- As the Special Rapporteur has repeatedly stated in her thematic and country visit reports, it is crucial for States to be aware of the composition of their population, including who the minority groups are, in order to obtain an accurate picture of the number, geographical distribution, identity and socioeconomic status of minority groups. Collection and statistical analysis of disaggregated data on minorities are essential tools for designing and monitoring adequate policies and targeted plans for minorities. In the process of collection and analysis of disaggregated data, provisions should be made to safeguard against discrimination, stigmatization and any misuse of sensitive information, in accordance with international standards of personal data protection and privacy.

- In one State in the Western Europe and others group, indigenous women and girls continued to be the target of racially motivated sexual and gender-based violence that began with colonization, as affirmed in a 2015 inquiry report by the Committee on the Elimination of Discrimination against Women, in which the Committee noted grave and systemic violations of indigenous women’s rights, exacerbated by entrenched discrimination that impeded access to justice. In a rural, predominantly indigenous region of the State, a series of high-profile cases, including the acquittal of federal police officers for sexual assault and the death of an indigenous man in police custody, had led to the mobilization of civil society organizations and public outcry, precipitating a government review of the police force in 2010. Local women’s organizations lobbied for inclusion in order to push for an improved response by the justice system to violence against women.

- Certain countries have developed sectoral laws on specific indigenous peoples’ rights, such as in the fields of language, health and education, or established processes for participation or land rights recognition. The elaboration of legislation to operationalize the State duty to consult indigenous peoples is an ongoing process in Latin America. Peru adopted a law to this effect and discussions on potential new legal instruments are taking place, for instance, in Colombia, Costa Rica, Guatemala and Honduras. Legislation addressing indigenous peoples in particular circumstances, such as isolated indigenous peoples and indigenous peoples in recent contact has also been developed in Bolivia, Ecuador and Peru. General sectoral laws in some countries consider specific measures related to indigenous peoples. Dialogue processes for the development of new legislation are taking place in several countries, including transnational instruments as the Nordic Sami Convention.

- The recognition of the pre-existing rights of indigenous peoples in the legal system of a country is generally a constructive step, particularly when it responds to the demands of indigenous peoples and is conducted in cooperation with them and with their full and effective participation. The mandate holder has consistently recalled that such recognition should be accompanied by a necessary review of all domestic legislation to ensure coherence with international human rights standards on the rights of indigenous peoples, particularly the Declaration. In some countries where legislation recognizing the rights of indigenous peoples has been adopted, there are glaring inconsistencies between such legislation and existing regulations concerning investments, extractive activities such as mining, infrastructure development, forestry, agriculture or conservation measures.

- If the Constitution, as the foundational law, recognizes the existence and rights of indigenous peoples, then this reflects a commitment of the whole society within the country. A number of countries recognize the existence and certain rights of indigenous peoples within their Constitution. While most of these recognitions predate the adoption of the Declaration, examples after 2007 include the Constitutions of Ecuador (2008), Bolivia (2009), Kenya (2010), Sweden (2011) and El Salvador (2014). Some countries have amended their Constitutions to at least recognize the multi-ethnic, pluricultural nature of their societies (Costa Rica, 2015).

- Some countries have enacted general laws on the rights of indigenous peoples. Most of the instances also predate the Declaration, and should be reviewed according to its standards, but encouraging new legislation has since been adopted. In October 2007, the Senate of Bolivia sanctioned a bill transposing the Declaration within the Bolivian legal system, making it a law directly applicable by all national courts. Law number 5 of 25 February 2011 on the protection and promotion of the rights of indigenous populations in the Congo constitutes a good practice in this regard within the African region.

- In her report, the Special Rapporteur emphasized that for minorities, language was a central element and expression of their identity and of key importance in the preservation of group identity. Language was often particularly important to non-dominant communities seeking to maintain their distinct group and cultural identity, sometimes under conditions of marginalization, exclusion and discrimination. Minority language rights and language use were frequently a source of tensions, both between and within States. Proponents of linguistic rights had sometimes been associated with secessionist movements or had been seen as a threat to the integrity or unity of a State. The Special Rapporteur pointed out that it was often only when minorities asserted their rights to identity and language that discrimination or persecution started. Fulfilling the rights of minorities, including their language rights, was an essential means to prevent tensions from emerging and was a key element of good governance and conflict prevention. If not appropriately addressed at an early stage, such tensions had led to protracted conflicts and deepening of divisions between linguistic groups. Where conflicts had ceased or peacebuilding initiatives were under way, it was essential that all groups in society should play a full role in discussions, negotiations and decision-making processes.

- The Special Rapporteur dedicated the first Forum on Minority Issues under her leadership, the fourth session, to the topic "Guaranteeing the rights of minority women". The Forum participants recognized that it was particularly important that the voices and views of minority women be heard and that they be consulted and have the opportunity to participate fully in all aspects of life, both within their communities and in the wider society. Barriers to the empowerment of some minority women, including lack of social or economic contacts, networks or minority women's support groups, and scarcity of female minority role models had an important impact on the enjoyment by minority women and girls of their human rights. The Forum considered specific thematic areas in detail, for example, the access of minority women and girls to education; their ability to take part effectively in economic life and to have access to labour markets; and issues relating to their participation in social, cultural and political life. It recommended that Governments should seek and encourage opportunities for women's participation and work together with minority communities as well as minority and women's rights organizations to develop and implement programmes to sensitize minority women about their rights, and men about minority women's rights. - The mandate of the Special Rapporteur thus complements and enhances the work of the Forum, and the Special Rapporteur has fostered the complementary and mutual reinforcement of both mechanisms throughout her tenure. She has guided a total of six sessions of the Forum on the following themes: "Guaranteeing the rights of minority women" (2011), "Implementing the United Nations declaration on minority rights: identifying positive practices and opportunities" (2012), "Guaranteeing the rights of religious minorities" (2013), "Preventing and addressing violence and atrocity crimes targeted against minorities" (2014), "Minorities in the criminal justice system" (2015) and "Minorities in situations of humanitarian crises" (2016). Since 2013, the Special Rapporteur has devoted her annual thematic report to the General Assembly to the same topic as the Forum session, as a means to contribute to and inform the discussions within the Forum. The Special Rapporteur notes that the themes she selected for the annual sessions focused on areas that had emerged as particularly concerning or problematic for minorities and where they believed that minority rights should be better applied and mainstreamed. She believes that the Forum makes a vital contribution to deepening international understanding on these important and topical areas as well as to international standard and norm setting.

- During her tenure, the Special Rapporteur has promoted the work of and the recommendations emanating from the Forum on Minority Issues in other forums. As a regional follow-up activity to the Forum, she travelled to Banjul in April 2013 to attend the fifty-third ordinary session of the African Commission on Human and Peoples' Rights where, among other activities, she organized a public side event with the participation of Commissioner Soyata Maïga, who served as Chair of the fifth session of the Forum. That event provided an opportunity to brief the participants about the mandate and the Forum, and to share information related to minorities with different African human rights mechanisms. In November 2015, the Special Rapporteur organized a side event during the eighth session of the Forum to consider, inter alia, ways to improve the structure and working methods of the Forum, to share best practices on how to better mainstream its recommendations and to discuss how United Nations mechanisms, in particular the Forum, could remain relevant for and accessible to minorities on the ground. In October 2016, on the occasion of the presentation of her report to the General Assembly, she convened a consultative session in New York that served as an opportunity to discuss the draft recommendations of the Forum ahead of its ninth session as well as to raise awareness of the work of the Forum outside Geneva and engage relevant stakeholders in New York.

- In the light of article 19 of the Convention on the Rights of Persons with Disabilities, States must adopt a community-based approach to the provision of support, either directly or through intermediaries. Such an approach enables stakeholders - family, friends, neighbours, peers and others - to play a significant role in supporting persons with disabilities in daily life activities and participating in the community. This allows the provision of culturally sensitive services in the communities where persons with disabilities live, building on existing social networks and community resources. In the case of indigenous peoples, for example, community-based approaches could reduce the risk of assimilation. When services are not made available within the community, there is limited participation by persons with disabilities in their design and provision, and there is an increased risk of segregation and institutionalization. Importantly, by benefiting from local skills and resources, community participation in the provision of support facilitates the optimal and efficient delivery of services, enabling a cost-effective policy response in countries with limited resources.

- Violence and discrimination often appear not as singular events but as part of a prolonged vicious circle. They are multiple and multiplied — inextricably linked emotionally, psychologically, physically and structurally. They intersect in a variety of ways, and most clearly where the victim is not only attacked or discriminated against for having a different sexual orientation and gender identity but also on grounds of race, ethnic origin, age, gender, or membership of a minority or indigenous community. The person might also be a child, a young girl, an intersex person, a refugee, an internally displaced person, a migrant worker, a person with a disability, and more. This intersectionality involves a conglomeration of incidents, actors, perpetrators, and victims — the latter being revictimized an infinite number of times, possibly in different phases of life. The situation becomes aggravated precisely because of the convoluted nature of the phenomenon, where crimes are replicated against the same victims and where impunity prevails subsequently, from the home to the school, to the community, to the nation State and to the international spectrum. In today’s cyber world and social media, incitement to hatred and violence driven by hate speech relating to sexual orientation and gender identity has an exponential reach, spinning the web of violations in real time and into the future.

- [Legislative level] According to articles 2 (b), (c), (e), (f) and (g) and 5 (a), States are required to adopt legislation prohibiting all forms of gender-based violence against women and girls, harmonizing national law with the Convention. In the legislation, women who are victims/survivors of such violence should be considered to be right holders. It should contain age-sensitive and gender-sensitive provisions and effective legal protection, including sanctions on perpetrators and reparations to victims/survivors. The Convention provides that any existing norms of religious, customary, indigenous and community justice systems are to be harmonized with its standards and that all laws that constitute discrimination against women, including those which cause, promote or justify gender-based violence or perpetuate impunity for such acts, are to be repealed. Such norms may be part of statutory, customary, religious, indigenous or common law, constitutional, civil, family, criminal or administrative law or evidentiary and procedural law, such as provisions based on discriminatory or stereotypical attitudes or practices that allow for gender-based violence against women or mitigate sentences in that context;

- States parties should ensure that, where appropriate, the impacts of business activities on indigenous peoples specifically (in particular, actual or potential adverse impacts on indigenous peoples’ rights to land, resources, territories, cultural heritage, traditional knowledge and culture) are incorporated into human rights impact assessments. In exercising human rights due diligence, businesses should consult and cooperate in good faith with the indigenous peoples concerned through indigenous peoples’ own representative institutions in order to obtain their free, prior and informed consent before the commencement of activities. Such consultations should allow for identification of the potentially negative impact of the activities and of the measures to mitigate and compensate for such impact. They should also lead to design mechanisms for sharing the benefits derived from the activities, since companies are bound by their duty to respect indigenous rights to establish mechanisms that ensure that indigenous peoples share in the benefits generated by the activities developed on their traditional territories.

- In his third report to the Human Rights Council (A/HRC/26/29), in which he assessed the threats against groups most at risk when exercising their rights to freedom of peaceful assembly and association, the previous mandate holder focused on the challenges facing groups that were often relegated to the margins of society, both in their daily lives and in the exercise of those rights. In the report, he highlighted the link between the denial of those rights and the marginalization of such groups and how that marginalization exacerbated their inability to effectively exercise their rights. Some of the groups considered to be most at risk were persons with disabilities; youth, including children; women; lesbian, gay, bisexual, transgender and intersex people; members of minority groups; indigenous peoples; internally displaced persons; and non-nationals, including refugees, asylum seekers and migrant workers. For the purpose of the report, the groups most at risk also included groups and individuals who were targeted not because of their identity, but because they actively lobbied for the rights of those most at risk of discrimination and retribution. He noted that human rights defenders, including journalists, trade unionists and environmental activists, faced considerable opposition, harassment, stigmatization and even physical attacks from State and non-State actors in many countries.

- The nature of the allegations received by the mandate holder indicates an increase in violence against indigenous peoples when they defend their basic human rights, including their rights to lands and resources. Within this context, the use of anti-terrorist legislation, the terming of human rights defence as a criminal activity, and impunity when crimes against indigenous peoples are committed remain very serious concerns. In the past 10 years the mandate holder has addressed, often together with other special procedures mandate holders, many cases of violence against indigenous peoples, their leaders and representatives. This has been undertaken through the communications procedure and the release of public statements. The mandate holder has also sought to address these situations by engaging the Governments in constructive dialogues and by undertaking working visits to examine the issues in more depth. The Special Rapporteur intends to develop further research on this issue but would like to emphasize that the underlying reason for the key problems seen in these cases is the lack of observance of indigenous land, natural resources and related rights recognized in the Declaration and other human rights instruments.

- It must be mentioned that the implementation of the Declaration in Asia and Africa, and the work of the mandate holder to promote it, face particular obstacles due to denial by some States of the existence of indigenous peoples within their borders, on the grounds for example that all the population is indigenous to the country. The mandate holder has repeatedly referred to this issue stating that, despite the different terminology employed in many areas, the situation and human rights issues of certain peoples in those regions is a matter of concern for the mandate holder and the provisions of the Declaration apply to them. These populations are distinct peoples, with specific cultures and relation to certain lands and territories, and have been subject to marginalization. The problems they suffer, related to their group identity, are similar to those of peoples all over the world that identify as indigenous, and are the types of problems that the Declaration seeks to resolve as a remedial instrument. The work of the African Commission on Human and Peoples’ Rights, particularly its Working Group on indigenous populations/communities, has been instrumental in advancing a positive dialogue on the recognition of indigenous peoples in the African region.

- Public policies should address the underlying causes of poverty and marginalization that indigenous peoples suffer as a result of the denial of their rights. They should also be considered as elements of the coordinated and systematic action States should develop to ensure that indigenous peoples enjoy their collective and individual human rights, and not as marginal, stand-alone initiatives dependent on available funding. The mandate holder has observed positive examples of public policies to implement indigenous rights on different sectoral issues, such as for example the National Aboriginal and Torres Strait Islander Health Plan 2013-2023 which affirms that it adopts a human rights-based approach informed by the Declaration. Other examples include the Whanau Ora policy in New Zealand; the bilingual intercultural education programme in Panama and the policies for the protection of indigenous peoples in isolation and recent contact in Bolivia and Ecuador. In El Salvador the recently adopted national policy on indigenous peoples considers the Declaration as its framework. Canada is undertaking a review of its policies to ensure coherence with the Declaration, and dialogue processes with indigenous peoples on public policies are ongoing in Costa Rica or Paraguay.

- The establishment of special departments within different Ministries focused on indigenous peoples and parliamentary commissions on indigenous issues can be instrumental in the development of appropriate measures to achieve the ends of the Declaration. Within the justice system, some countries have established specialized Public Prosecutor’s Offices which play an important role in trying to ensure access to justice for indigenous peoples. In several countries joint bodies, such as dialogue round tables, with participation of indigenous peoples and State institutions, have been created: they either deal with specific matters or exist as permanent mechanisms. Provided they comply with the basic requirements of full and effective participation by indigenous peoples in decision-making and respect for indigenous appointment processes, these bodies can play a decisive role in advancing respectful and continuous intercultural dialogue between indigenous peoples and States that may bring about the needed changes. They can also be instrumental in preventing and solving conflict situations.

Witchcraft and the human rights of persons with albinism 2017, para. 15

- Albinism is a relatively rare, non-contagious, genetically inherited condition that affects people worldwide regardless of ethnicity or gender. It results from a significant deficit in the production of melanin and is characterized by the partial or complete absence of pigment in the skin, hair and eyes. Persons with albinism therefore often appear pale in comparison to members of their family and their communities. For a person to be affected by albinism, both parents must carry the gene, and in such cases there is a 25 per cent chance at each pregnancy that a child will be born with albinism. The frequency of albinism varies by region. In Europe and North America, the reported frequency is 1 in 17,000 to 1 in 20,000 births. The frequency in certain parts of the Pacific is reported to be 1 in 700. Among some indigenous peoples in South America, the reported frequency is 1 in 70 to 1 in 125. In sub-Saharan Africa, the reported frequency ranges from 1 in 5,000 to 1 in 15,000, with prevalence rates of 1 in 1,000 to 1 in 1,500 for selected populations. An important caveat is that some studies of the frequency of albinism often lack objectivity in their methodology or are incomplete, rendering estimates as best guesses in most instances.

- Multilateral environmental agreements should also consider the Declaration as the framework when adopting decisions which affect indigenous peoples. Good decisions have emerged from the sessions of the Conferences of the Parties to the Convention on Biological Diversity and the United Nations Framework Convention on Climate Change, and there are positive practices in terms of creating spaces for indigenous peoples within the bodies of these Conventions. For example, under the Convention on Biological Diversity there is a Working Group on article 8 (j) on the traditional knowledge of indigenous peoples and local communities. Since 2007, the Conference of the Parties to the Convention on Biological Diversity has noted the existence of the Declaration in decisions and has adopted guidelines relevant for indigenous peoples. The Conference of the Parties to the Convention on Climate Change, at its twenty-first session, recognized the need to strengthen knowledge, technologies, practices and efforts of local communities and indigenous peoples related to addressing and responding to climate change, and established a platform for the exchange of experiences and sharing of best practices on mitigation and adaptation in a holistic and integrated manner.
