The right to social security (Art. 9) 2007, para. 28 | Aug 19, 2019 | Paragraph | The right to social security plays an important role in supporting the realization of many of the rights in the Covenant, but other measures are necessary to complement the right to social security. For example, States parties should provide social services for rehabilitation of the injured and persons with disabilities in accordance with article 6 of the Covenant, provide child care and welfare, advice and assistance with family planning and the provision of special facilities for persons with disabilities and older persons (article 10); take measures to combat poverty and social exclusion and provide supporting social services (article 11); and adopt measures to prevent disease and improve health facilities, goods and services (article 12). States parties should also consider schemes that provide social protection to individuals belonging to disadvantaged and marginalized groups, for example crop or natural disaster insurance for small farmers or livelihood protection for self-employed persons in the informal economy. However, the adoption of measures to realize other rights in the Covenant will not in itself act as a substitute for the creation of social security schemes. | Committee on Social, Economic and Cultural Rights | General Comment / Recommendation |

Older women and protection of their human rights 2010, para. 44 | Aug 19, 2019 | Paragraph | States parties should provide adequate non-contributory pensions, on an equal basis with men, to all women who have no other pension or insufficient income security, and State-funded allowances should be made available and accessible to older women, particularly those living in remote or rural areas. | Committee on the Elimination of Discrimination against Women | General Comment / Recommendation |

The economic, social and cultural rights of older persons 1995, para. 16 | Aug 19, 2019 | Paragraph | Older persons as a group are as heterogeneous and varied as the rest of the population and their situation depends on a country's economic and social situation, on demographic, environmental, cultural and employment factors and, at the individual level, on the family situation, the level of education, the urban or rural environment, and the occupation of workers and retirees. | Committee on Social, Economic and Cultural Rights | General Comment / Recommendation |

Older women and protection of their human rights 2010, para. 26 | Aug 19, 2019 | Paragraph | Under some statutory and customary laws, women do not have the right to inherit and administer marital property on the death of their spouse. Some legal systems justify this by providing widows with other means of economic security, such as support payments from the deceased's estate. However, in reality, such provisions are seldom enforced, and widows are often left destitute. Some laws particularly discriminate against older widows, and some widows are victims of "property grabbing." | Committee on the Elimination of Discrimination against Women | General Comment / Recommendation |

Equality in marriage and family relations 1994, para. 32 | Aug 19, 2019 | Paragraph | In some countries, on division of marital property, greater emphasis is placed on financial contributions to property acquired during a marriage, and other contributions, such as raising children, caring for elderly relatives and discharging household duties are diminished. Often, such contributions of a non-financial nature by the wife enable the husband to earn an income and increase the assets. Financial and non-financial contributions should be accorded the same weight. | Committee on the Elimination of Discrimination against Women | General Comment / Recommendation |

The right to work (Art. 6) 2005, para. 16 | Aug 19, 2019 | Paragraph | The Committee recalls its general comment No. 6 (1995) on the economic, social and cultural rights of older persons and in particular the need to take measures to prevent discrimination on grounds of age in employment and occupation. | Committee on Social, Economic and Cultural Rights | General Comment / Recommendation |

Non-discrimination in economic, social and cultural rights (Art. 2, para. 2) 2009, para. 29 | Aug 19, 2019 | Paragraph | Age is a prohibited ground of discrimination in several contexts. The Committee has highlighted the need to address discrimination against unemployed older persons in finding work, or accessing professional training or retraining, and against older persons living in poverty with unequal access to universal old-age pensions due to their place of residence. In relation to young persons, unequal access by adolescents to sexual and reproductive health information and services amounts to discrimination. | Committee on Social, Economic and Cultural Rights | General Comment / Recommendation |

Older women and protection of their human rights 2010, para. 42 | Aug 19, 2019 | Paragraph | States parties have an obligation to ensure that the retirement age in both the public and private sectors do not discriminate against women. Consequently, States parties have an obligation to ensure that pension policies are not discriminatory in any manner, even when women opt to retire early, and that all older women who have been active have access to adequate pensions. States parties should adopt all appropriate measures, including, where necessary, temporary special measures, to guarantee such pensions. | Committee on the Elimination of Discrimination against Women | General Comment / Recommendation |

Older women and protection of their human rights 2010, para. 21 | Aug 19, 2019 | Paragraph | Older women's right to self-determination and consent with regard to health care are not always respected. Social services, including long-term care, for older women might be disproportionately reduced when public expenditure is cut. Post-menopausal, post- reproductive and other age-related and gender-specific physical and mental health conditions and diseases tend to be overlooked by research, academic studies, public policy and service provision. Information on sexual health and HIV/AIDS is rarely provided in a form that is acceptable, accessible and appropriate for older women. Many older women do not have private health insurance, or are excluded from State-funded schemes because they did not contribute to a scheme during their working life in the informal sector or providing unpaid care. | Committee on the Elimination of Discrimination against Women | General Comment / Recommendation |

The economic, social and cultural rights of older persons 1995, para. 30 | Aug 19, 2019 | Paragraph | Furthermore, as already observed in paragraphs 20 and 21 above, in order fully to implement the provisions of article 9 of the Covenant, States parties should, within the limits of available resources, provide non-contributory old-age benefits and other assistance for all older persons who, when reaching the age prescribed in national legislation, have not completed a qualifying period of contribution and are not entitled to an old-age pension or other social security benefits or assistance and have no other source of income. | Committee on Social, Economic and Cultural Rights | General Comment / Recommendation |

The economic, social and cultural rights of older persons 1995, para. 24 | Aug 19, 2019 | Paragraph | In the years preceding retirement, retirement-preparation programmes should be implemented, with the participation of representative organizations of employers and workers and other bodies concerned, to prepare older workers to cope with their new situation. Such programmes should, in particular, provide older workers with information about their rights and obligations as pensioners; the opportunities and conditions for continuing an occupational activity or undertaking voluntary work; means of combating detrimental effects of ageing; facilities for adult education and cultural activities; and the use of leisure time. | Committee on Social, Economic and Cultural Rights | General Comment / Recommendation |

The economic, social and cultural rights of older persons 1995, para. 20 | Aug 19, 2019 | Paragraph | In accordance with article 3 of the Covenant, by which States parties undertake "to ensure the equal right of men and women to the enjoyment of all economic, social and cultural rights", the Committee considers that States parties should pay particular attention to older women who, because they have spent all or part of their lives caring for their families without engaging in a remunerated activity entitling them to an old-age pension, and who are also not entitled to a widow's pension, are often in critical situations. | Committee on Social, Economic and Cultural Rights | General Comment / Recommendation |

The economic, social and cultural rights of older persons 1995, para. 17 | Aug 19, 2019 | Paragraph | Side by side with older persons who are in good health and whose financial situation is acceptable, there are many who do not have adequate means of support, even in developed countries, and who feature prominently among the most vulnerable, marginal and unprotected groups. In times of recession and of restructuring of the economy, older persons are particularly at risk. As the Committee has previously stressed (General Comment No. 3 (1990), para. 12), even in times of severe resource constraints, States parties have the duty to protect the vulnerable members of society. | Committee on Social, Economic and Cultural Rights | General Comment / Recommendation |

The economic, social and cultural rights of older persons 1995, para. 13 | Aug 19, 2019 | Paragraph | Accordingly, the Committee on Economic, Social and Cultural Rights is of the view that States parties to the Covenant are obligated to pay particular attention to promoting and protecting the economic, social and cultural rights of older persons. The Committee's own role in this regard is rendered all the more important by the fact that, unlike the case of other population groups such as women and children, no comprehensive international convention yet exists in relation to the rights of older persons and no binding supervisory arrangements attach to the various sets of United Nations principles in this area. | Committee on Social, Economic and Cultural Rights | General Comment / Recommendation |
