- Low levels of revenue collection have a disproportionate impact on the poorest segments of the population and constitute a major obstacle to the capacity of the State to finance public services and social programmes. A lack of access to quality services is a constituent element of poverty, and people living in poverty are particularly dependent on public services, being unable to pay for private alternatives. In addition, their specific needs and characteristics make it more likely they will have to interact with State-funded institutions and services on a regular basis. This is particularly the case for people who experience multiple forms of discrimination and disadvantage; for example, persons with disabilities are more likely to come into regular contact with health and social services, while women are more likely to be directly dependent on social protection and health systems for at least some period of their lives because of their sexual and reproductive health and maternity-related needs. Women also serve as unpaid alternative care providers when public services are not adequately funded, increasing their time burden and limiting their opportunities to engage in paid work, education, training or leisure, while also negatively affecting their enjoyment of rights such as health, education, participation and social security.

- Basic income is intended as a cash grant; not as in-kind support such as food, vouchers or shelter. This means that individuals must have a means by which to receive the income, such as a bank account, or a cell phone capable of managing electronic payments. This might be problematic where neither banking infrastructure nor cell phone coverage are strong, and will also be difficult for groups such as the homeless, people fleeing domestic violence, and persons with psychosocial disabilities.

- Ensuring the enjoyment of rights of other members of the population - such as older persons, children and persons with disabilities - will also prove beneficial to their caregivers, by alleviating and redistributing intensive care needs. In this regard, inter alia, States are required to provide physical as well as psychological rehabilitative measures aimed at maintaining the functionality and autonomy of older persons; and attention and care for chronically and terminally ill persons.

- Such factors often act as a persuasive deterrent against seeking redress from judicial or adjudicatory mechanisms, or may indeed represent an insurmountable obstacle for the poorest and most marginalized. This is especially so for those who have limited mobility, such as older persons or persons with disabilities, or those for whom travel is more difficult or dangerous, including women and children.

- In the World Report on Disability, jointly published by the Bank and the World Health Organization, the leaders of the two organizations stated that the report aimed to "provide the evidence for innovative policies and programmes that can improve the lives of people with disabilities, and facilitate implementation of the United Nations Convention on the Rights of Persons with Disabilities … This landmark international treaty reinforced our understanding of disability as a human rights and development priority." The report itself is full of practical guidance about how international human rights law is relevant to dealing with disability issues in development.

- In particular, quality and affordable care services for carers and parents can have a major positive impact on the human rights of both caregivers and receivers. Investment in childcare, elder care and disability support should therefore be increased, prioritizing disadvantaged and underserved areas. The services should be affordable, and provided free to those who cannot afford to pay. In particular, all women should have economic and physical access to high-quality, culturally appropriate childcare for children under school age, including children with disabilities. As well as having a major positive impact on women's right to work, quality early childhood education accessible to people living in poverty has many proven benefits for children and society as a whole. Innovative approaches such as mobile crèches should be considered in order to reach communities living in poverty.

- The African Charter on Human and Peoples' Rights stipulates that "the aged and the disabled shall also have the right to special measures of protection in keeping with their physical or moral needs" (art. 18). The Protocol to the African Charter on Human and Peoples' Rights on the Rights of Women in Africa (Maputo Protocol) recognizes the particular vulnerability of older women and requests States to take a number of measures "commensurate with their physical, economic and social needs as well as their access to employment and professional training" and "ensure the right of elderly women to freedom from violence, including sexual abuse" (art. 22).

- Accepting these principles entails both carefully screening policy choices to prevent the unfair exclusion of disadvantaged and disempowered groups - in particular, persons with disabilities, older persons, indigenous peoples, minorities and persons with HIV/AIDS - and actively seeking out ways to ensure that they are reached. In this regard, social protection programmes must be physically and culturally accessible. This means, for example, that benefits must be distributed within a safe physical distance and that transportation or opportunity costs must be taken into account. Outreach and information regarding programmes must be specifically designed to reach groups that are particularly vulnerable or excluded; examples include radio announcements and community plays aimed at overcoming illiteracy. Information about programmes must be available in the languages of minorities, indigenous peoples and immigrant populations.

- States must comply with the international human rights legal framework when designing, implementing, monitoring and evaluating social protection programmes. To be sure, human rights standards do not provide answers to all the challenges faced by policymakers when designing social protection programmes. They do, however, impose legally binding obligations governing the discretion of States. Those obligations not only require States to put social protection systems in place, but also determine the manner in which they do so (obligations related to the process) and the intended results of such systems (obligations related to the outcome). Moreover, rights-based social protection measures help States to fulfil several human rights obligations, including ensuring the enjoyment of the right to the highest attainable standard of physical and mental health; the right to education, the protection of the family and maternity benefits; the right to fair and equal remuneration for work; and the specific rights of vulnerable groups such as children, older persons and persons with disabilities.
