- The process of incorporating the human rights to water and sanitation in development cooperation has not been a straightforward, consensual or expeditious process. International events have provided opportunities for governmental bodies to make various human rights-related commitments. One clear example of this is the Accra Agenda for Action of 2008, agreed to by developed and developing countries, in which it was indicated that developing countries and donors would ensure that their respective development policies and programmes were designed and implemented in ways consistent with their agreed international commitments on gender equality, human rights, disability and environmental sustainability. More recently, the Ministerial Declaration of the Sixth World Water Forum (2012), adopted by representatives of 145 countries, demonstrated a true international consensus on the right to water and sanitation and the commitment by Governments to accelerating access to safe and clean drinking water and sanitation in line with United Nations resolutions. In the Ministerial Declaration of the Seventh World Water Forum (2015), signatories indicated their engagement to translate commitments into national policies, plans and actions and to intensify joint efforts to advance water-related cooperation on a global scale, as well as their commitments to the human right to safe drinking water and sanitation and to ensuring progressive access to water and sanitation for all.

- One project, aimed at benefiting populations in small towns, supported rehabilitating and expanding piped drinking water systems but built only a handful of public sanitary facilities while training local artisans to produce slabs required for latrines and stimulating a micro savings scheme for residents to purchase those building materials. In that project, support to sanitation was framed through the community-led total sanitation methodology aiming to mobilize communities to completely eliminate open defecation without any external financial input. Thus, it is based on spurring demand creation and behavioural change from users. However, without adequate, continuous guidance and financial assistance, some users may sacrifice essential resources in adopting service levels that are actually unsafe and do not represent a real gain from a human rights perspective.

- It is of crucial importance to monitor, in a rights- and gender-sensitive manner, progress towards achieving the Sustainable Development Goals, and to make sure that national and local mechanisms track compliance with and progress made to realize the rights to water and sanitation, including in terms of gender equality. Gender equality is central to the Goals (see Goal 5) and is reflected in several targets, including target 6.2. Gender equality in access to water, sanitation and hygiene will have a positive impact on other goals and targets, including those on ending poverty (Goal 1), on promoting decent work and economic growth (Goal 8), on reducing inequality (Goal 10) and on making cities and human settlements inclusive and sustainable (Goal 11). Since gender inequalities are so profound in water and sanitation and, at the same time, manifest themselves in all human rights and throughout the entire development agenda, a comprehensive approach would allow for using similar indicators and information collected through the monitoring of different human rights and development targets.

- Human rights-based monitoring can be built on a framework of structural, process and outcome indicators that serve to monitor not only the commitments made by a State but also the State's ongoing efforts and whether progress is being made to achieve targets on gender equality. Useful examples of indicators to monitor gender equality in access to water, sanitation and hygiene can be found in the OHCHR framework on indicators and by the World Health Organization-United Nations Children's Fund Joint Monitoring Programme Task Force on monitoring inequalities. Indicators on menstrual hygiene facilities, for example, could be used to track gender equality and help to break related taboos.

- Donors increasingly advocate for comprehensive systems for monitoring the sustainability of water and sanitation interventions. Some seek to include a sustainability clause in their contracts with implementers as a means to verify whether sustainability criteria are being met. Similarly, the United Nations Children's Fund (UNICEF) has developed sustainability checks aimed at auditing the water supply and open-defecation-free status of communities after the project has ended. These checks examine several institutional, social, technical and financial indicators to measure sustainability. From a human rights perspective, it is crucial to complement such tools with equality criteria to ensure that all in society benefit. Moreover, such sustainability checks must not be perceived as a donor-driven initiative applied on a project level, but must be incorporated more broadly in the sector.

- Equality is relevant to all fields of development and must be applied to all future goals and targets, including those concerning water, sanitation and hygiene. Integrating non-discrimination and equality into all future goals and targets requires including incentives to reduce inequalities. However, to underscore the intrinsic value of equality as an overriding objective, it should also be a stand-alone goal. Having a stand-alone goal on the reduction of inequality is essential to bring it to light and to give it a centre stage in the development agenda. While some argue that a separate equality goal will lead to an insular treatment of equality, the Special Rapporteur is of the opposite view: including equality as an overarching, cross-cutting concern at the goal level will ensure that the reduction of inequalities will be addressed under all the substantive targets, while she acknowledges that this will depend on the way the goal is crafted.

- The target on water and sanitation, for example, has encouraged Governments to allocate resources towards improving access to water. In recent years, there is more attention to access to sanitation, in part owing to its notorious status as one of the ''most off track'' of the targets. Monitoring of issues such as open defecation has moved policymakers to recognize significant issues relating to dignity, health and human rights. Some Governments have initiated campaigns to eradicate open defecation practices. As such, in her country missions, the Special Rapporteur has observed that the monitoring of access to water and sanitation services has provided decisive information to encourage and convince Governments, policymakers and donors to revisit their policies and to engage more effectively with the water and sanitation sector, in order to ensure the provision of services.

- To ensure coordination, Governments may wish to appoint a focal point or create a steering committee or task force. The Colombo Declaration, adopted at the fourth South Asian Conference on Sanitation in April 2011, explicitly calls on countries "to establish one national body with responsibility for coordinating sanitation and hygiene, involving all stakeholders including, but not limited to, those responsible for finance, health, public health, environment, water, education, gender and local government at national, subnational and local levels". Such a coordination body needs backing from the highest political level as well as a clear mandate. To avoid a disjuncture between the different phases of planning, it is essential that the same institutions are involved throughout the entire planning cycle.

- The global targets and indicators are generally formulated in terms of aggregate attainments. While the United Nations guidance on monitoring recommends gender as well as urban/rural disaggregation for all Millennium Development Goal indicators as far as possible, in practice the data are only disaggregated to a very limited extent. The indicators on water and sanitation are a notable exception. But even this is no panacea, as the distinction is often more administrative than real, particularly in peri-urban areas, and studies have found that in national surveys many urban slums are treated as rural areas. In other instances, the population of informal settlements does not appear at all in the statistics. The situation in urban slums, in particular, can therefore be assumed to be much bleaker than the official figures suggest.

- Accountability begins with reliable, relevant and adequate data. It is critical to supplement the data sources used by the Joint Monitoring Programme with additional data sets that relate specifically to human rights standards. Indicators should reflect the human rights criteria of availability, safety, acceptability, accessibility (including reliability) and affordability. Generating such additional data sets might be viewed as a considerable opportunity cost, to the extent that these funds could otherwise be dedicated to water or sanitation programmes directly. But in the view of the independent expert, the "opportunity" far outweighs the "cost", not only in terms of focusing interventions on key bottlenecks and informing policymaking in the water and sanitation sectors, but also the very substantial multiplier effects this would bring for health, education, gender equality, education, nutrition and related human rights and Millennium Development Goals.
