- The Committee on the Elimination of Discrimination against Women has had the opportunity to consider in its jurisprudence the obligation of States parties to address threats to women linked to lack of housing. In Ms. A.T. v. Hungary, the Committee considered the circumstances of a woman with two children who was viciously beaten by her husband and who feared for her life. She was unable to move to a shelter because there were no spaces available to accommodate her child, who had a disability. The domestic courts refused to grant A.T. possession of her home, in consideration of the property rights of her husband. The Committee held that women's human rights to life and to physical and mental integrity could not be superseded by other rights, including the right to property and the right to privacy. The Committee recommended that Hungary take positive measures to remedy the situation of A.T., to ensure better protection for women more generally and to ensure that A.T. was given a safe home in which to live with her children, as well as child support, legal assistance and reparation for the violations of her rights.

- Similarly, in Jasin v. Denmark (see CCPR/C/114/D/2360/2014) the Committee considered the effects of homelessness in the context of a single mother facing deportation to Italy. Osman Jasin had fled for her life from a violent husband in Somalia and was rescued by the Italian Coastguard while crossing the Mediterranean. In Italy, she tried without success to find housing, lived in the street with her one-year-old daughter, sleeping in railway stations and marketplaces. Ms. Jasin and her daughter left Italy to seek asylum in the Netherlands, but were returned to Italy, where she again lived in the street with her two-year-old daughter, sleeping in railway stations during a pregnancy. She was denied medical assistance during the birth of her second child because she had no address. When she was unable to pay to renew her Italian residency permit, she travelled to Denmark. The Committee found that returning her and her children to Italy would constitute cruel and inhuman treatment because they would likely become homeless again.

- In the case of East Timor discussed earlier, the importance and value of direct participation of the affected population in re-establishing a system of housing, land and property rights in the aftermath of the 1999 referendum was emphasized from an early stage. A 2000 report to the United Nations indicated that the majority of Timorese interviewed during a fact-finding study had confirmed the importance of involvement of customary local dispute resolution structures in future land dispute resolution and adjudication mechanisms, on the grounds of their persisting legitimacy in spite of decades of conflict and dispossession and also their role as a valuable source of "information, including details of boundaries, levels of rights and history of acquisition and loss ". On the basis of these submissions from a broad range of Timorese, the report recommended that where feasible, existing local dispute resolution structures should be used as a crucial first step in dealing with land, housing and property disputes. This mediation could commence "at any of a number of levels, right down to the level of family meetings".

- In the context of article 17 of the International Covenant on Civil and Political Rights, prohibiting arbitrary or unlawful interference with privacy, family, home or correspondence, the Committee has recognized certain components of the right to adequate housing under the Covenant. It has found that a termination of tenancy rights due to an absence from the country is arbitrary and therefore contrary to article 17 (see CCPR/C/112/D/2068/2011) and that housing constructed without formal permission on municipal property should be recognized as a "home" and protected from unlawful interference (see CCPR/C/106/D/2073/2011). The Committee has also acknowledged the devastating consequences of eviction on families and communities and has stipulated that it should not be permitted if it will result in homelessness (ibid.). In a concurring opinion in the Georgopoulos case, a member of the Human Rights Committee, Fabián Salvioli, noted that the Committee's decision in that case recognized the principle of the interdependence and indivisibility of rights and was consistent with "the trend in contemporary international human rights law away from the fictitious and artificial division of rights into 'categories'" (CCPR/C/99/D/1799/2008, para. 3).

- The recognition that women's housing security is vital to their ability to leave a violent relationship is spreading, and efforts have been made at national level, resulting in the promulgation of new domestic laws. For instance, in Serbia, according to article 198(2) of the Family Law adopted in 2005, courts can issue an order for the removal of the perpetrator from family housing, and they can also order that victims of domestic violence be allowed to stay in family housing, in both cases regardless of the ownership of housing. In Brazil, what has become popularly known as the "Maria da Penha Law" (2006) allows for the removal of the abuser from the home. Additionally, the Indian Protection of Women from Domestic Violence Act (2005) explicitly recognizes the right of women victims of domestic violence to reside in a shared household, and provides that "every woman in a domestic relationship shall have the right to reside in the shared household, whether or not she has any right, title or beneficial interest in the same." In addition, the Act guarantees that a person suffering domestic violence "shall not be evicted or excluded from the shared household or any part of it by the respondent [i.e. the abuser] save in accordance with the procedure established by law."

- Article 9 of the International Convention on the Protection of the Rights of Migrant Workers and Members of Their Families affirms that the right to life of migrant workers and members of their families shall be protected by law. The Committee on the Rights of Migrant Workers drew attention to violations of the right to life in the context of forced evictions of migrants from a public park in Buenos Aires which resulted in two deaths (see CMW/C/ARG/CO/1, para. 19).

- Concerns have also been expressed over what has been called "the business of reconstruction", whereby the planning, financing and implementation of reconstruction are outsourced to private companies. In some cases, outsourcing reconstruction without putting adequate safeguards in place has been associated with negative impacts on the adequacy and affordability of reconstruction as well as on people's ability to participate in and benefit from reconstruction efforts. In Chile, following the earthquake and subsequent tsunami of February 2010, the private sector reportedly played a central role in the reconstruction of urban centres and coastal areas. Following one of the main principles of the national reconstruction plan, families have the choice to decide whether to rebuild their homes on the same sites of the collapsed buildings or to acquire a previously existing or a newly built house. However, as housing reconstruction was supported mainly by subsidies attached to individual property, private constructors preferred to rebuild housing in new areas on the outskirts of towns, rather than the central areas from which many people had been displaced, where land and housing prices were much higher. Real estate companies were also said to pressure families to sell land and housing at very low prices in a moment where they were very vulnerable, in order to make way for private redevelopment. This shows that if left only to the market, new housing for the poorest will likely be in the peripheries.

- Many expected that the global financial crisis and its impact on the human rights of millions of households would act as an alarm bell, forcing States and international financial institutions to reassess the value of unbridled financialization and introduce reforms to ensure that the financial system addressed rather than exploited the housing needs of low-income households. Unfortunately, it seemed to have the opposite effect. Individuals and families who were affected by the crisis were often blamed for taking on too much debt and new rules and regulations were put in place to restrict their access to mortgages. Austerity measures cut programmes on which they had relied for access to housing options, and the march towards the financialization of housing continued. The States that were the most severely affected by the crisis assumed responsibility for billions of dollars' worth of distressed debt (high-risk mortgages) and arranged for them to be sold off to private equity funds, thereby increasing rather than decreasing the role and power of corporate finance in national housing systems.

- States should take measures to protect the tenure security and promote inheritance rights of women and girls in the case of the death of a spouse, father, brother, son or other male household member so that they are able to continue residing in the family home. States should also take measures to address the vulnerability of women and children to tenure insecurity due to a breakdown of spousal relations, including as a result of domestic violence. Women and children's security of tenure should be prioritized in these circumstances. Many legal systems authorize the victim of domestic violence to stay in the family home, and order the removal of the perpetrator. For example, in Serbia, the Family Law authorizes the courts to issue an order for the removal of the perpetrator of domestic violence from the family home, allowing the victim to remain in the home, regardless of ownership (art. 198 (2)). When remaining in the family home is not feasible, States should ensure victims have access to alternative adequate housing with secure tenure.

- Police procedures. Residents of urban settlements and homeless persons face disproportionate levels of police intervention and use of force without due process. In many countries, police enter homes in poor settlements, sometimes in major operations, without a court order, violating residents' rights to protection against arbitrary interference with their privacy, family and home. Homeless persons, who have no choice but to sleep, eat and conduct other life-sustaining activities in publics spaces are commonly harassed, fined and detained for doing so. Police must follow due process and respect human rights in conducting law enforcement activities, including in urban settlements, and ensure that any use of force is strictly necessary and proportional to lawful objectives. States should decriminalize homelessness and ensure full respect by police of human rights of homeless persons.

- Regulatory safeguards should be put in place to protect households facing default and foreclosure, including prohibiting eviction until the household has access to alternative adequate housing. In England and Wales, a pre-action protocol for possession claims obliges lenders and borrowers to follow procedures aimed at ensuring that repossession is a last resort after all reasonable attempts to resolve the situation have failed. In Richmond, California, the municipality voted to use its powers of eminent domain to seize mortgages of households that have defaulted or are at risk of default, when the investor refuses to sell. Under the scheme, the City pays the investor the current market value for the mortgage, often considerably less than the amount owing, and then supports affordable refinancing options for the homeowner. A decree-law in Andalucía, Spain, currently under appeal, allows the local Government to expropriate empty residences that have been repossessed by banks and developers in order to house families who have lost their homes.

- Housing cooperatives are established by a group of persons who form a legal entity to develop and maintain a housing project for the collective benefit of members. In countries like the Philippines, Sweden and Uruguay, government programmes help communities to acquire, develop and manage land for cooperative housing. Since 1968, Uruguay has had legislative regulation of cooperatives, and approximately 600 cooperatives currently house some 20,000 families. Cooperatives' success as a provider of low-income housing has been largely due to the existence of the Federation of Mutual Aid Housing Cooperatives, which supports democratic participation, self-management and the joint effort of families in the construction of homes. In Argentina, the Buenos Aires municipality has established a credit programme for housing cooperatives.

- Civil society organizations have brought new and diverse housing issues before the Committee on Economic, Social and Cultural Rights, and also before the Human Rights Committee, the Committee on the Elimination of Racial Discrimination, the Committee on the Rights of the Child, the Committee on the Elimination of Discrimination against Women, the Committee on the Rights of Persons with Disabilities and the Committee on the Protection of the Rights of All Migrant Workers and Members of Their Families. By doing so, they have encouraged various treaty monitoring bodies to consider State obligations with respect to the right to housing in diverse circumstances and to clarify the links between the right to housing and other human rights. These dynamic interactions between national experiences and international human rights mechanisms benefit and strengthen both.

- In the Uruguayan model, security of tenure is ensured by a contract between the cooperative and the member ("contrato de uso y goce" of the Federation of Mutual Aid Housing Cooperatives), which is not time bound. Each family enjoys usufruct rights that can be inherited or sold back to the cooperative. The value of the member's share is paid back to him by the cooperative in two instalments over a period of three years and comprises the value of labour hours; maintenance of the common areas; the repaid amount of the loan; and the repaid interest. This prevents a high member turnover and protects the cooperative from gentrification processes.

- The Uruguayan mutual aid cooperatives promote affordable housing through a collective process involving the future occupiers. Ownership, as well as responsibility for the mortgage and maintenance of the property is collective and indivisible. Under the Federation of Mutual Aid Housing Cooperatives model, families can get access to collective housing loans without previous savings (particularly suitable for low-income households); the time they spend building the houses is considered to be down payment (15 per cent of public bank mortgage). Members pay a monthly share of the collective mortgage, an additional fee to the Cooperative Fund for the maintenance of common spaces and services, and an assistance fund for members that are temporarily unable to pay to the cooperative due to various reasons (such as accident, loss of employment or death of bread winner).

- In Latin America, a successful example of housing cooperatives on a national scale is the mutual aid cooperatives in Uruguay, which are promoted by the Federation of Mutual Aid Housing Cooperatives. The Uruguayan legislation recognizes collective tenure, and the regulation of the housing cooperatives is encompassed in the 1992 General Cooperative Law. Since 1965, around 600 Federation cooperatives have been consolidated in Uruguay, and around 20,000 families are living in houses and apartments built through mutual aid. Mutual aid cooperatives have been introduced and adapted in 14 Latin American and Caribbean countries over the past 20 years through various initiatives.

- Common property is a regime that allocates a package of property rights to a group. Such rights may include ownership, management, use, exchange and access of shared resources. The term "common property regime" refers to a set of institutions, regulations and management practices subject to collective decision-making. Such regimes are distinct from communal tenure, which refers more broadly to community-based tenure systems, in which some form of collective authority (for example, an extended family, clan or other social grouping) holds allocation rights. - In applying the law, the courts also have a critical role to play. In Kenya, recent judicial decisions referencing the Convention on the Elimination of All Forms of Discrimination against Women have put to rest the persistent conflict between customary legal systems which deny women inheritance of family property on the one hand, and the guarantee of gender equality under the Kenyan Constitution on the other. In the Ntutu case (2008), for example, the Kenyan High Court heard arguments by the sons of the deceased that "Masai customary law of succession … does not recognize the rights of the daughters to inherit the estate of their fathers." Here, the Court applied international human rights law, international covenants and treaties which have been ratified by Kenya, and noted the previous decision of Rono vs. Rono. The Court found "the customary law which shall abrogate the right of daughters to inherit the estate of a father cannot be applicable as it shall be repugnant to justice and morality," and upheld the right of the daughters to inherit equally from the assets of the estate.

- Some community funds, such as Baan Mankong in Thailand and the Community Mortgage Programme in the Philippines, have demonstrated a great capacity to expand their coverage and to execute complex housing and infrastructure projects that involve national and local Governments, landowners and several communities. The Baan Mankong programme, introduced in 2003 by the Government of Thailand and implemented by an independent Government agency, the Community Organizations Development Institute, aimed to improve living conditions for 300,000 families by 2008. Its strategy for delivering low-income housing is to channel funds to community-based organizations that plan and carry out projects themselves. The programme became an exemplar for community-supported slum upgrading, although it has been implemented on a smaller scale than originally envisaged.

- Until the 1980s, slum dwellers and the urban poor had not been a market for financial services. As previously mentioned, the reasons were the inability of low- and even middle-income households to afford housing finance debt; the incompatibility of formal finance loan requirements (such as complex collateral and extended repayment capabilities) with the characteristics of low-income households (low level and irregularity of income and lack of security of tenure); and the fact that financial institutions perceived few incentives to lend to the poor, who usually "consume" small loan amounts and entail high transaction costs. As a result, low- and even middle-income households adopted "informal" finance strategies based on individual savings, family loans and remittances, or moneylenders or pawnbrokers.

Unlike in the case of housing markets for higher-income families, in which suppliers have to be sensitive to demand requirements and therefore to the trilogy of product-price-location as they operate in a competitive context, operators that supply social housing have a captive demand, particularly when it is fully subsidized. In a context of housing deficit, beneficiaries of housing subsidies will simply "buy" what is available at the moment. Suppliers of social housing can therefore be not very sensitive to, or simply ignore, demand preferences, as there is no competition.

- In some cases, local governments have established programmes to assist low-income migrant families in paying their rents, obtaining a house or doing maintenance work on their residences and to give both documented and undocumented migrants access to social policies. As a result, migrant families have equal opportunities to enjoy adequate housing and living conditions. Since migrants often represent a significant proportion of the poor, non-restrictive policies addressed to the entire low-income population can have a real impact on the living conditions of migrants. In Spain, the municipalities of Salamanca and Valladolid provide financial assistance to low-income populations, including migrants, to rent their homes. Similarly, in Catalonia, the provincial immigration office, the Fundación Caixa Catalunya and a network of non-governmental organizations assist in the provision of housing for documented and undocumented migrants, as well as for asylum-seekers.

- When children do not have documents they face triple discrimination: as children, as migrants and as being undocumented, and thus they constitute one of the most vulnerable groups. Their right to adequate housing, as well as other economic, social and cultural rights, are often severely affected in those circumstances. Among undocumented children, a particularly difficult situation is that of unaccompanied migrant children, who, because their parents are unable to work or they have no parents to look after them, are forced into poverty and exclusion. Often living on the streets, in parks and in front of shops, these children are excluded from child protection services and are denied adequate housing. In certain countries, unaccompanied children are detained for living on the streets and are institutionalized in prison-like conditions or deported to countries where they have no family to care for them (see A/HRC/14/30, paras. 58 and 59).

- In its concluding observations of 25 May 2007 on Egypt (CMW/C/EGY/CO/1), the Committee on the Protection of the Rights of All Migrant Workers and Members of Their Families expressed its concern about reports that some migrant workers suffer from discrimination, inter alia, in the area of housing, and encouraged the State to ensure that the rights provided for in the Convention are enjoyed without discrimination. The Committee expresses similar concerns with regard to non-Arab migrants in the Syrian Arab Republic in its concluding observations of 2 May 2008 (CMW/C/SYR/CO/1).

- At the regional level, article 13 of the European Convention on the Legal Status of Migrant Workers, requires States to accord to migrant workers treatment not less favourable than that accorded to its own nationals with regard to access to housing and rents; to ensure that standards of fitness of accommodation are kept up for migrant workers as for its own nationals; to protect migrant workers against exploitation in respect of rents; and to ensure that the housing of migrant workers is suitable. In addition, article 19 (4) (c) of the European Social Charter requires States to secure documented migrant workers and their families treatment not less favourable than that of their own nationals regarding accommodation.

- Article 6 of the International Labour Organization (ILO) Migration for Employment Convention (Revised) of 1949 requires parties to the Convention to apply, without discrimination in respect of nationality, race, religion or sex, to immigrants lawfully within its territory, treatment no less favourable than that which it applies to its own nationals in respect of accommodation. Similarly, the ILO Workers' Housing Recommendation of 1961 calls upon the competent authorities to pay particular attention to the particular problem of housing of migrant workers and their families and to ensure as rapidly as possible equality of treatment between migrant workers and national workers in that respect.
