- [The Special Rapporteur also makes the following recommendations to the international community:] Establish adequate governance instruments to operationalize the commitments set out in the Final Declaration of the International Conference on Agrarian Reform and Rural Development. The Voluntary Guidelines on Responsible Governance of Tenure of Land and other Natural Resources could make a significant contribution, provided that they: Provide for the systematic and comprehensive interpretation of existing provisions of international human rights and environmental law that protect the rights of land users in all categories, whether indigenous peoples or other rural groups such as peasants, pastoralists and fisherfolk. The international recognition of the rights of these groups is scattered among various instruments and lacks systematic interpretation. The FAO Committee on World Food Security could also play an important role by: a. Establishing a mechanism for follow-up to the Conference commitments; b. Commissioning an independent review by the Committee's High-level Panel of Experts on Food Security and Nutrition of best practices in agrarian reform;

- National strategies grounded in the right to food should be conceived as participatory processes, co-designed by all relevant stakeholders, including in particular the groups most affected by hunger and malnutrition - smallholder producers, fisherfolk, pastoralists, indigenous people, the urban poor, migrants and agricultural workers. Interministerial bodies should be provided with recommendations that can support local initiatives that support the transition to sustainable food systems (A/68/288, paras. 42-46). The strategies should set out objectives that are specific, measurable, attainable, relevant and time-bound. Their rights-based dimensions require that they identify which actor is responsible for which action, and that implementation be supported by independent monitoring in the hands of national human rights institutions or, perhaps preferably, food security and nutrition councils. Because gender-based discrimination violates the right to food of women and girls, the empowerment of women and gender equality, as well as the adoption of social protection schemes that are transformative of gender roles, should be a priority of such strategies. Enhancing the role of women in decision-making at all levels, including within the household, moreover, improves nutritional and health outcomes. And women must be better supported as economic agents in the food systems (A/HRC/22/50).

- We reaffirm our commitment in the Johannesburg Plan of Implementation to eliminate subsidies that contribute to illegal, unreported and unregulated fishing and overcapacity, taking into account the importance of this sector to developing countries, and we reiterate our commitment to conclude multilateral disciplines on fisheries subsidies that will give effect to the mandates of the World Trade Organization Doha Development Agenda and the Hong Kong Ministerial Declaration to strengthen disciplines on subsidies in the fisheries sector, including through the prohibition of certain forms of fisheries subsidies that contribute to overcapacity and overfishing, recognizing that appropriate and effective special and differential treatment for developing and least developed countries should be an integral part of World Trade Organization fisheries subsidies negotiation, taking into account the importance of the sector to development priorities, poverty reduction and livelihood and food security concerns. We encourage States to further improve the transparency and reporting of existing fisheries subsidies programmes through the World Trade Organization. Given the state of fisheries resources, and without prejudicing the Doha and Hong Kong ministerial mandates on fisheries subsidies or the need to conclude these negotiations, we encourage States to eliminate subsidies that contribute to overcapacity and overfishing, and to refrain from introducing new such subsidies or from extending or enhancing existing ones.

- Traditional food sources of indigenous peoples are regularly found to contain high levels of pesticides. This is also true in the Arctic, because chemicals travel northward through long-range environmental transport in wind and water, bioaccumulating and biomagnifying in traditional foods such as marine mammals and fish. Indigenous peoples in the Arctic are found to have hazardous pesticides in their bodies that were never used near their communities, and suffer from above average rates of cancer and other diseases.

- Directly linked to health concerns, minorities are frequently in a vulnerable situation in regard to hunger, food security and nutrition. High levels of poverty and extreme poverty, lack of access to employment or secure forms of income, land or land tenure all impact on their food security. In India, for example, child malnutrition is some 14-20 per cent higher for Scheduled Castes and Scheduled Tribes and has been declining at a slower rate than for the rest of the populations over the period of the MDGs. In country visits by the mandate holders to Rwanda (2011) and Cameroon (2013), food security and nutrition was a major concern of Batwa and Pygmy communities, many of whom are displaced from traditional forest habitats and can no longer maintain their hunter/gather lifestyles and access forest-based food sources.

- During his joint visit to the Central African Republic in February 2015, the Special Rapporteur deplored the living conditions of nearly 500 members of the Peulh minority group, trapped in an enclave in Yaloke. According to reports, the food being distributed in Yaloke does not meet the cultural and nutritional needs of the Peulh minority group. The Peulh, living largely on a diet of beef and milk from cattle, are not used to the rice and beans that humanitarian agencies distribute. As of December 2014, over 40 Peulh had died from malnutrition and other diseases, the majority of them children.

- Food insecurity is not well-managed or understood within indigenous peoples due to a severe lack of relevant data. However it is widely recognized that indigenous people experience significant food insecurity and therefore suffer with widespread violations of their right to food. A range of interconnected and mutually reinforcing factors contributes to significant levels of food insecurity. As identified by the Food and Agriculture Organization of the United Nations, loss of a culture, land and insecure access to lands, territories and natural resource have been key drivers of this phenomenon amongst indigenous communities. Like poverty, violations of the right to food affect indigenous women directly and also have a disproportionate impact on them because of their roles as food and water providers, caregivers and managers of resources.

The need to harmonize activities affecting indigenous peoples within the United Nations system 2012, para. 44

- Such was the issue raised this year in relation to the Voluntary Guidelines on the Responsible Governance of Tenure of Land, Fisheries and Forests in the Context of National Food Security developed by the Food and Agriculture Organization of the United Nations (FAO) and adopted by the Committee on World Food Security on 11 May 2012. The development of the Guidelines was initiated in 2009 and included some 10 consultations with Governments, civil society, the private sector, academia and United Nations agencies, among others. The Guidelines are expressly voluntary (guideline 2.1) but at the same time have potentially far-reaching implications, as they may be used by all countries and regions at all stages of economic development and for the governance of all forms of tenure (guideline 2.4).

- Noting the diversity of agricultural conditions and systems, we resolve to increase sustainable agricultural production and productivity globally, including by improving the functioning of markets and trading systems and strengthening international cooperation, particularly for developing countries, by increasing public and private investment in sustainable agriculture, land management and rural development. - General comments do not establish legal obligations, but elaborate on the practical implications of those obligations. The treaty bodies, however, have legally binding powers. In February 2013, the Committee of the Rights of the Child adopted general comment No. 16 (2013) on State obligations regarding the impact of the business sector on children's rights to elaborate on the practical implications of those obligations. The Committee also noted that the existing instruments and guidance did not sufficiently address the particular situation and needs of children. The treaty bodies have also contributed to the protection of the rights of groups such as indigenous people and small-scale farmers, whose rights are routinely disregarded by foreign States and private actors based in third countries. Moreover, in recent years a number special procedure mandate holders have sent various communications to States concerning the application of extraterritorial obligations, especially in cases involving allegations of corporate abuse of human rights in host States.
