- The right to comprehensive sexual education is also confirmed by recommendations and declarations of international bodies, as well as by documents reflecting the global consensus among States. For example, the Programme of Action adopted by the International Conference on Population and Development recognizes that sexual and reproductive health education must begin in primary school and continue through all levels of formal and non-formal education.3 The Joint United Nations Programme on HIV/AIDS (UNAIDS) has found that sexual education is more effective if given prior to first intercourse. The World Health Organization (WHO) believes that it is crucial for sexual education to start early, especially in developing countries. The Organization has also provided specific guidance on how to incorporate sexual education into school curricula and recommends that sexual education should constitute a separate subject, rather than being incorporated into other subjects. In addition, comprehensive sexual education is a basic tool for achieving many of the Millennium Development Goals (MDGs), such as promoting gender equality and empowering women (Goal 3), reducing child mortality (Goal 4), improving maternal health (Goal 5) and combating HIV/AIDS (Goal 6).

- [Children as victims and witnesses]: With the establishment of the International Criminal Court, it is likely that more children will participate as witnesses in legal proceedings against the violators of their rights. The Rome Statute establishing the Court requires that it “take appropriate measures to protect the safety, physical and psychological well-being, dignity and privacy of victims and witnesses”, and “have regard to all relevant factors, including age, gender [...] and health, and the nature of the crime, in particular, but not limited to, where the crime involves sexual or gender-based violence against children.” Victims and witnesses units in charge of short- and long-term protective measures and security arrangements, as well as medical and psychological support, have become an established practice in international and national courts. Special protection measures can be requested to assist a child giving evidence. However, it is not always in the best interest of child witnesses of serious violations of human rights or international humanitarian law to give evidence in a court. In some cases, it may result in grave psychological trauma and illness or renewal of despair, depression or even suicidal tendencies.

- While some refugee and internally displaced persons camps have separate facilities for unaccompanied or separated children, they often lack family-based solutions and have very limited capacity to face the increasing number of unaccompanied or separated children. As a consequence, children share their living space with adults or are held in prolonged detention. In addition, even when children are offered a separated living area, those are often easily accessible to everyone, especially during night-time. Moreover, certain camps fail to provide basic amenities, such as appropriate health-care services or gender-differentiated sanitation. The lack of adequate lightning, the layout of some camps and a shortage of security personnel further increase the vulnerability of children to abuse. Finally, the reluctance of many European countries to provide refugee children with a safe and permanent home continues to aggravate the situation by prolonging the stay of children in the facilities.

- The breakdown of families, communities and social and institutional structures during conflict and in its aftermath puts children at great risk of being sold, trafficked and sexually exploited. The World Development Report 2011 of the World Bank estimates that approximately 1.5 billion people live in countries affected by repeated cycles of political and criminal violence. The current nature of conflicts, mostly civil wars fought by armed groups rather than the military, disproportionately affects civilians. Children pay a high toll. A child living in a conflict-affected or fragile developing country is nearly three times more likely to be out of school than a child living in a developing country that is unaffected by these factors. Sexual and gender-based violence is a major issue, during and in the aftermath of conflict. Women and children account for close to 80 per cent of refugees and internally displaced persons. As more countries fall into conflict and high levels of political and criminal violence, involving an increasingly complex range of protagonists and ever more violent schemes, children will continue to be exposed to heightened risks.

- Over the years, classifications of different profiles have been made to facilitate the development of appropriate interventions. A distinction was therefore made between "situational" and "preferential" child sex tourists. The situational sex tourist was described as not travelling with the intention of being a sex tourist, who is tempted by an opportunity to have sex with children in a country, not usually having a preference for children, abusing children who are pre-pubescent or not, driven by the search for new experiences and justifying their acts on the basis of cultural or economic grounds. The preferential sex tourist travels specifically with the aim of abusing children, can experience sexual attraction for adults, but tends to search for pubescent or adolescent children. In addition, the paedophile, usually considered as someone suffering from a clinical disorder, with an exclusive inclination for pre-pubescent children, who may not show any preference for the gender of the child and may not view sexual contact with children as harmful. In contrast to the situational offender, they are notorious reoffenders, seeking out vulnerable children.

- In the United Kingdom, a prevention programme on sexual exploitation, administered by Nia (an organization that works towards the prevention of violence against children and the protection of victims of gender-based violence) in partnership with the Children's Society, developed and ran a train-the-trainers programme in which young people were trained to deliver training to professionals and other young people. The aim was to equip young people with information on sexual exploitation and to develop creative ways to engage participants in the learning process. The young people co-facilitated training sessions for professionals, in addition to giving presentations and workshops at various conferences and youth centres. The response from the trainers was unanimously positive; all felt that the experience had boosted their self-esteem, increased their own awareness of sexual exploitation and given them presentation skills. While the young people reportedly experienced rudeness and haughty behaviour from some professionals, they found the majority open and genuinely interested in hearing their viewpoint. The project benefited both the participants and the professionals by showing them another perspective and the unique knowledge of young people.

The importance of social protection measures in achieving Millennium Development Goals (MDGs) 2010, para. 65

- In order to ensure that women's rights are fully respected, social protection programmes must be accompanied by gender-sensitive social services, including sexual and reproductive health care. This requires investment in public services, without which social protection programmes will not be effective. Women and girls, for example, may be prevented from meeting conditionalities imposed by a programme if social services are far away and transportation costs are too high, or if they fear being sexually assaulted while making the trip required. Girls may not attend school if there are no separate sanitation facilities for them or if they are harassed by teachers or other students. Mothers may not bring their children to the hospital owing to discriminatory practices on the part of health-care providers (for example, requesting the consent of the husband) or communication difficulties (for example, women might be expected to demonstrate some form of literacy or might not be able to communicate in their minority language). In the same vein, women may choose not to use clinics for child delivery because of a lack of skilled birth attendants or culturally appropriate birthing methods.
