- Article 9 should also be read in conjunction with the obligation to progressively realize the right to adequate housing under article 28. As Gerard Quinn observed, “many of these obligations will require resources and extensive systemic change — all subject to the overall obligation of progressive achievement contained in article 4.2 with respect to socioeconomic rights”. The obligations of States under article 9 can be seen as components of the requirement to immediately implement inclusive rights-based strategies for the realization of the right to housing. Both housing strategies and plans for the implementation of accessibility must establish definite time frames, allocate adequate resources, prescribe the duties of the public authorities, including regional and local authorities, and private actors and ensure participation and consultation with those affected. Ensuring that any new housing is developed in accordance with barrier-free design requirements is an immediate obligation of States. States must also adopt, as quickly as possible, legislation and plans to ensure that barriers in existing housing are removed over time.

- In its general comment No. 15 (2003) on the right to water, the Committee on Economic, Social and Cultural Rights builds on a comprehensive understanding of violations, applying the categories of human rights obligations to respect, protect and fulfil the right to water. While the Committee has not yet adopted a general comment on the right to sanitation, it has issued a formal statement recognizing that similar obligations apply, following an approach taken by the Special Rapporteur in her 2009 report to the Council. The present report applies this framework and develops a typology of common violations of the rights to water and sanitation. In addition to the obligations to respect, protect and fulfil, it puts a particular emphasis on equality and non-discrimination, as well as on participation, and also examines extraterritorial obligations. The latter obligations cut across the "respect, protect, fulfil" framework. This typology is not proposed as a rigid classification, being utilized as a framework for surveying the range of violations which must be addressed, with inevitable overlaps in the categories. What is most important is to ensure that no type of violation is ignored and that no victim is denied access to effective remedies.

- All three branches of government offer potential accountability mechanisms for economic and social rights claims. The legislature is, of course, central in terms of its ability to adopt legislation that mandates attention to such rights or that responds to violations. There have also been important initiatives in terms of establishing parliamentary human rights committees and institutionalizing review of draft legislation to ensure compliance with human rights law. In terms of the executive, government officials can monitor economic and social rights realization and incorporate those rights into policymaking and implementation mechanisms. State agencies are also often a logical locus for complaints mechanisms, although they remain strongly underresearched in the economic and social rights field. While national human rights institutions are potentially relevant, studies indicate that they have played a very minor role, not just in terms of economic and social rights promotion, as noted above, but also in achieving accountability. The main exception in that regard relates to the role of ombuds institutions, which could be much more engaged on matters of economic and social rights than they are, even though their powers generally fall short of being able to provide direct remedies.

- Even when resources are limited, States are legally bound to respect, protect and fulfil international human rights obligations. For State parties to the International Covenant on Economic, Social and Cultural Rights, this means, for example, that they must dedicate the maximum amount of resources available to progressively achieve the full realization of all economic, social and cultural rights. The human rights perspective distinguishes between the inability and the simple unwillingness to act. States cannot use the economic damage caused by the crises to justify actions or omissions that amount to violations of basic human rights obligations. While economic, social and cultural rights are often subject to the principle of "progressive realization" depending on the availability of resources in each State, this principle also prescribes particular modes of conduct that are compulsory for all States, regardless of their level of development. These obligations considerably limit the discretion of States with regard to the implementation of economic, social and cultural rights, and require immediate action.

- [The Special Rapporteur suggests that the way forward requires a shift to take hold so that States ensure that all investment in housing recognizes its social function and States' human rights obligations in that regard. That requires a transformation of the relationship between the State and the financial sector, whereby human rights implementation becomes the overriding goal, not a subsidiary or neglected obligation. The Special Rapporteur believes that can be achieved with more constructive engagement and dialogue between States, human rights actors, international and domestic financial regulatory bodies, private equity firms and major investors. In order to create those new conversations and achieve that shift, the Special Rapporteur recommends the following:] Strategies developed by States and local governments to achieve target 11.1 of the Sustainable Development Goals and the New Urban Agenda should include a full range of taxation, regulatory and planning measures in order to re-establish housing as a social good, promote an inclusive housing system and prevent speculation and excessive accumulation of wealth;

- Over the last 15 years, the "human rights city" has emerged as an important initiative involving mayors, city officials, civic and human rights non-governmental organizations and experts and community-based organizations in cities across the world. The Gwangju Declaration on Human Rights City, adopted in 2011, defined a human rights city as "both a local community and a socio-political process in a local context where human rights play a key role as fundamental values and guiding principles". Accordingly, local government, parliament, civil society, private sector organizations and other stakeholders work together to improve the quality of life for all inhabitants in a spirit of partnership based on human rights standards and norms. The Declaration emphasizes that a legal basis - city ordinances and legal instruments such as human rights charters and legal organizations - should be established. Human rights cities also acknowledge that implementation is more important than policymaking and that effective accountability mechanisms need to be developed to make city government accountable to its commitments.

- [The Special Rapporteur has identified a number of common challenges experienced at the local level with respect to the implementation of the right to adequate housing:] Inadequate resources: The scarcity of financial resources, or the limited ability to tap into other funding sources besides national budget allocations, is a primary concern for local authorities with respect to the implementation of the right to adequate housing. While the responsibility for housing has been put in the hands of local or other subnational governments, resources to meet their housing rights obligations have not similarly flowed. Moreover, funding from national governments for local programmes is often not responsive to changing needs or crisis situations at the local level. Lack of resources can lead subnational governments to make decisions that negatively affect the realization of the right to adequate housing. For example, at the municipal level it is not uncommon for available land or property to be used as an asset for real estate development rather than for the provision of adequate housing.

- The experiences of decentralization in relation to human rights and the right to adequate housing, however, have been mixed. As Paul Lundberg noted, "the issue of human rights has not figured prominently in the ongoing discussion on decentralization". Reference to human rights obligations or the right to adequate housing is conspicuously absent, even from the International Guidelines on Decentralisation and Access to Basic Services for all and the European Charter of Local Self-Government. Decentralization and local governance initiatives from international or regional financial institutions such as the International Monetary Fund and the Inter-American Development Bank, United Nations agencies such as the United Nations Development Programme, as well as from associations of local governments, have focused on economic and political dimensions and participatory rights linked to decentralization. However, they have largely ignored the question of how States' human rights obligations in relation to the right to adequate housing are to be applied to local governments that have taken on key responsibilities for programmes and policies.

Assessing a decade of progress on the right to food 2013, para. 19

- Despite the significant progress made in recent years, some dimensions of the right to food remain underdeveloped. This is especially the case as regards its extraterritorial dimensions. According to the Committee on Economic, Social and Cultural Rights, the duties associated with the right to food extend to all situations, whether located on a State's national territory or abroad, over which a State may exercise influence without infringing on the sovereignty of the territorial State (see E/C.12/2000/4, para. 39, E/C.12/2002/11, para. 31 and E/C.12/2011/1). This is reaffirmed in the Maastricht Principles on the extraterritorial obligations of States in the area of economic, social and cultural rights, adopted by a group of international law experts on 28 September 2011, as well as in the Guiding Principles on Extreme Poverty and Human Rights, endorsed by the Human Rights Council on 27 September 2012 (see A/HRC/21/39, para. 61). Yet, the mechanisms allowing victims of violations of the right to food in extraterritorial situations are often non-existent or hardly accessible in practice. On the whole, however, the examples above show a remarkable progress of the right to food since the Right to Food Guidelines were adopted.

- The reference in article 2, paragraph 2, regarding the objective of special measures to ensure "adequate development and protection" of groups and individuals may be compared with the use of the term "advancement" in article 1, paragraph 4. The terms of the Convention signify that special measures should clearly benefit groups and individuals in their enjoyment of human rights. The naming of fields of action in the paragraph - "social, economic, cultural and other fields" - does not describe a closed list. In principle, special measures can reach into all fields of human rights deprivation, including deprivation of the enjoyment of any human rights expressly or impliedly protected by article 5 of the Convention. In all cases, it is clear that the reference to limitations of "development" relates only to the situation or condition in which groups or individuals find themselves and is not a reflection on any individual or group characteristic.
