- The Special Rapporteur has received many allegations of excessive violence, during apprehension of a suspect and during demonstrations or public turmoil, including in pre-election and election periods. In many of those cases, people have been peacefully exercising their right to assembly when police or security officers violently dispersed the demonstration by beatings, the use of pepper and tear gas, sound bombs, water cannons, rubber bullets or firearms indiscriminately used on the masses. This all too often has led to persons being injured or killed. Of particular concern are reports of police brutality against vulnerable, disadvantaged groups and minorities. The Special Rapporteur has therefore repeatedly stated that the use of force must be exercised with restraint and only once non-violent means have been exhausted. Law enforcement bodies shall refrain from the use of firearms, except in self-defence or defence of others from an imminent threat of death or serious injury. In this regard, strict rules on the use of force for police and security forces should be applied. Furthermore ways to improve the recording and monitoring of arrests and the control of demonstrations should be explored.

- Owing to multiple and intersecting forms of discrimination, specific challenges face minority women and girls affected by humanitarian crises. According to the General Recommendation on women in conflict prevention, conflict and post-conflict situations of the Committee for the Elimination of Discrimination against Women (see CEDAW/C/GC/30, para. 36), during and after conflict specific groups of women, including, inter alia, internally displaced and refugee women, women of diverse caste, ethnic, national or religious identities, or of other minorities, are at a particular risk of violence, especially sexual violence. These groups of women "are often attacked as symbolic representatives of their community". The Committee has further noted that stateless women and girls face heightened risk of abuse during conflict, owing to, among other factors, their minority status (ibid, para. 60). Minority women may be particularly at risk of sexual and gender-based violence and other forms of violence, including slavery and trafficking. The Special Rapporteur was deeply troubled and saddened when she listened to the testimonies of Yezidi women in Iraq of sexual and gender-based violence committed against them by Daesh, which acts must be fully investigated and their perpetrators prosecuted.

- The synthesis report recognizes increasingly negative displacement trends. In the section on "dignity" it states that no society can reach its full potential if whole segments of that society are excluded from participating in, contributing to, and benefiting from development. It notes that the agenda "must not exclude migrants, refugees, displaced persons, or persons affected by conflict and occupation". The chapter entitled "A synthesis" states that particular attention should be given to countries in situations of fragility and conflict and the specific conditions of each country should be addressed. There is a consistent call to "leave no one behind" and ensure equality, non-discrimination, equity and inclusion. The report states: "We must pay special attention to the people, groups and countries most in need. We need to include the poor, children, adolescents, youth and the aged, as well as the unemployed, rural populations, slum dwellers, persons with disabilities, indigenous peoples, migrants, refugees and displaced persons, vulnerable groups and minorities. These also include those affected by climate change."

- [Millions of people are being newly internally displaced every year as a result of conflict and violence. Disasters displace even more people and the effects of climate change will exacerbate this trend. Development-induced displacement is also on the rise. With international attention focused on camps of internally displaced persons, many other displaced remain invisible, because they stay with host families, are dispersed in urban areas or their existence is officially denied. Some vulnerable groups within the displaced population are also regularly overlooked. Host families and communities are often heavily affected by displacement, but they are often neglected. The Representative urges member States and humanitarian and development actors to expand their scope of action and recommends that they:] Pay greater attention to internally displaced persons with multiple layers of vulnerability and discrimination, especially elderly persons and those with disabilities, women heads of households and their children, and displaced persons belonging to ethnic minorities or indigenous peoples.

- While people from all economic groups suffered from the effects of the hurricane, the damage disproportionately affected the most marginalized sectors of the population - poor women, peasants, indigenous groups. Significantly, many of these had been living under insecure tenure conditions in irregular settlements and inadequate housing, located in vulnerable areas exposed to strong winds, flooding and landslides. Although evacuation orders were issued, many refused to leave their homes for fear of losing their belongings, with disastrous and often fatal consequences. Vulnerability and in particular tenure insecurity was both the cause and effect of the disaster for such families. In the absence of officially recognized tenure rights, people ended up living on the fringes in dangerous areas, which due to their location were often worst affected by the hurricane. Any post-disaster response measures intended to form the basis for longer-term recovery would therefore have needed to address pre-existing insecurity, in order to provide a basis for the full realization of the right to adequate housing.

- Surveillance tactics ostensibly designed to prevent criminal activity are also often used selectively to target certain groups who plan to stage peaceful public assemblies. In Canada, for example, the Government formed a special police unit to produce intelligence updates on potential protests by indigenous peoples, primarily those fighting outside development on their ancestral land. Similarly, disproportionate force (including armed police, snipers and roadblocks) is often deployed at disfavoured protests as an intimidation tactic. Such practices should be vigorously discouraged. As the Special Rapporteur has previously noted, public assemblies should be presumed to be peaceful and lawful, until proven otherwise (A/HRC/20/27, para. 25) Surveillance tactics and disproportionate shows of force attest that authorities in some Member States often presume the opposite, and have a chilling effect on peaceful protestors, such as in the United Kingdom of Great Britain and Northern Ireland (A/HRC/23/39/Add.1, para. 32).

- The establishment of special departments within different Ministries focused on indigenous peoples and parliamentary commissions on indigenous issues can be instrumental in the development of appropriate measures to achieve the ends of the Declaration. Within the justice system, some countries have established specialized Public Prosecutor’s Offices which play an important role in trying to ensure access to justice for indigenous peoples. In several countries joint bodies, such as dialogue round tables, with participation of indigenous peoples and State institutions, have been created: they either deal with specific matters or exist as permanent mechanisms. Provided they comply with the basic requirements of full and effective participation by indigenous peoples in decision-making and respect for indigenous appointment processes, these bodies can play a decisive role in advancing respectful and continuous intercultural dialogue between indigenous peoples and States that may bring about the needed changes. They can also be instrumental in preventing and solving conflict situations.

- Building on the Vienna Declaration and its framework, both the Fourth World Conference on Women in Beijing (1995) and the Third World Conference against Racism, Racial Discrimination, Xenophobia and Related Intolerance in Durban (2001) addressed the multiple and intersecting forms of discrimination that cause intra-gender and intra-racial inequalities respectively. The Fourth World Conference on Women recognized the particular vulnerability to violence of "women belonging to minority groups, indigenous women, refugee women, women migrants, including women migrant workers, women in poverty living in rural or remote communities, destitute women, women in institutions or in detention, female children, women with disabilities, elderly women, displaced women, repatriated women, women living in poverty and women in situations of armed conflict, foreign occupation, wars of aggression, civil wars, terrorism, including hostage-taking." The World Conference against Racism included gender and racial discrimination among its five areas of focus. The Durban Declaration expressed the view "that racism, racial discrimination, xenophobia and related intolerance reveal themselves in a differentiated manner for women and girls, and can be among the factors leading to a deterioration in their living conditions, poverty, violence, multiple forms of discrimination, and the limitation or denial of their human rights."

- The mandate of the Special Rapporteur thus complements and enhances the work of the Forum, and the Special Rapporteur has fostered the complementary and mutual reinforcement of both mechanisms throughout her tenure. She has guided a total of six sessions of the Forum on the following themes: "Guaranteeing the rights of minority women" (2011), "Implementing the United Nations declaration on minority rights: identifying positive practices and opportunities" (2012), "Guaranteeing the rights of religious minorities" (2013), "Preventing and addressing violence and atrocity crimes targeted against minorities" (2014), "Minorities in the criminal justice system" (2015) and "Minorities in situations of humanitarian crises" (2016). Since 2013, the Special Rapporteur has devoted her annual thematic report to the General Assembly to the same topic as the Forum session, as a means to contribute to and inform the discussions within the Forum. The Special Rapporteur notes that the themes she selected for the annual sessions focused on areas that had emerged as particularly concerning or problematic for minorities and where they believed that minority rights should be better applied and mainstreamed. She believes that the Forum makes a vital contribution to deepening international understanding on these important and topical areas as well as to international standard and norm setting.

- While recognizing the great diversity in the experiences of minorities affected by humanitarian crises, the Special Rapporteur has adopted a global approach, focusing on common themes and patterns experienced by displaced minorities across regions. The Special Rapporteur also refers to particular examples to highlight specific challenges facing minorities. These cases are intended to be illustrative and are in no way exhaustive.
