- The regulatory framework must provide a contextual meaning of the social and cultural acceptability of water and sanitation facilities. This cannot be done in a meaningful way without the genuine participation of those who use the services. While water should be of an acceptable colour, odour and taste for each personal or domestic use, these are highly subjective parameters, and perceptions of these characteristics depend on local culture, education and experience. Personal sanitation is a highly sensitive issue across regions and cultures, and differing perspectives about which sanitation solutions are acceptable must be taken into account when designing, positioning, and setting conditions for the use of sanitation facilities (see A/70/203, para. 13). Regulations should stipulate that facilities need to allow for acceptable hygiene practices in specific cultures, such as anal and genital cleansing, and menstrual hygiene (see A/HRC/12/24, para. 80). Acceptability often requires separate facilities for women and men in public spaces, and for girls and boys in schools, which should be reflected in regulatory frameworks. Regulation should play an essential role in ensuring that toilets are constructed in a way that safeguards privacy and dignity.

- Nonetheless, social protection programmes have limits. Many countries pride themselves on having achieved quantifiable improvements in gender equality, especially regarding girls' access to education. For example, the Female Secondary School Assistance Project in Bangladesh, which provides girls with a stipend so that they can attend school, has been recognized as successful in raising enrolment rates for girls. However, States must take care not to limit their efforts to promote gender equality to improving parity between girls' and boys' enrolment rates. While stipends promoting girls' enrolment are important, they must be accompanied by broader measures addressing other concerns of particular importance to women, such as gender-based violence, including harmful traditional practices (for example, female genital mutilation and child marriage). Several countries have expressed frustration at the narrowness of some of the indicators for Millennium Development Goal 3 (promote gender equality and empower women) and have chosen to focus their energies on their own indicators related to gender equality, such as formal workforce participation, wage gaps, political participation and domestic violence. The independent expert believes States should adopt or revise national targets and indicators for all Millennium Development Goals in line with their obligations under human rights law, in order to accelerate their progress in achieving the Goals.

- The Committee on the Elimination of Discrimination against Women and the Committee on the Rights of the Child have noted that harmful practices affecting women and girls are deeply rooted in social attitudes according to which women and girls are regarded as inferior to men and boys based on stereotyped roles. They highlight the gender dimension to violence and indicate that sex- and gender-based attitudes and stereotypes, power imbalances, inequalities and discrimination perpetuate the widespread existence of practices that often involve violence or coercion. They maintain that the nature and prevalence of these practices vary according to region and culture. These practices cause serious harm to every aspect of the lives of the women and girls who fall victim to them and include incest, female genital mutilation, early and/or forced marriage, so-called "honour crimes", dowry-related violence, neglect of girls, extreme dietary restrictions, virginity tests, servitude, stoning, violent initiation rites, widowhood practices and female infanticide. The obligations set out in the Convention on the Elimination of All Forms of Discrimination against Women and the Convention on the Rights of the Child form the basis for the elaboration of a global strategy to eliminate harmful practices, which should be well defined, rights-based, have local relevance and comprise legal, economic and social support measures combined with proportional political engagement and State responsibility at all levels.

In addition, many women and children increasingly undergo medical treatment and/or plastic surgery to comply with social norms of the body, rather than for medical or health reasons, and many are also pressured to be fashionably thin, which has resulted in an epidemic of eating and health disorders.

Facilities should accommodate hygiene practices in specific cultures, such as anal and genital cleansing, and women's toilets must accommodate menstruation hygiene management needs, particularly with respect to privacy. Menstruation is taboo in many countries, which makes menstrual hygiene a major concern for the health and well-being of women, and particularly of girls, who may not have sufficient knowledge about managing menstruation to be able to develop good practices. Education is necessary at schools, for boys as well as girls, to start to address the social taboos associated with menstruation and menstrual hygiene.

There needs to be awareness that, in the past, a patriarchal concept of family pervaded all secular, religious, customary and indigenous laws and institutions and that some States and groups are now trying, in a retrograde manner, to subject women to the most oppressive forms of patriarchy, particularly in the context of religious fanaticism. It should also be understood that the transition towards equality between women and men, and girls and boys, in the culture and in the family is a prerequisite for a decent society.

These include the imposition of harmful initiation rites, exposure to violence, gangs, coercion into militia, extremist groups and trafficking. The denial of their vulnerability to physical and sexual abuse and exploitation also poses pervasive and significant barriers to boys gaining access to sexual and reproductive health information, goods and services, and a consequent lack of protective services.

Explicit measures are needed in all laws, policies and programmes to guarantee the rights of girls on an equal basis with boys.
