- The Committee on the Elimination of Discrimination against Women and the Committee on the Rights of the Child have noted that harmful practices affecting women and girls are deeply rooted in social attitudes according to which women and girls are regarded as inferior to men and boys based on stereotyped roles. They highlight the gender dimension to violence and indicate that sex- and gender-based attitudes and stereotypes, power imbalances, inequalities and discrimination perpetuate the widespread existence of practices that often involve violence or coercion. They maintain that the nature and prevalence of these practices vary according to region and culture. These practices cause serious harm to every aspect of the lives of the women and girls who fall victim to them and include incest, female genital mutilation, early and/or forced marriage, so-called "honour crimes", dowry-related violence, neglect of girls, extreme dietary restrictions, virginity tests, servitude, stoning, violent initiation rites, widowhood practices and female infanticide. The obligations set out in the Convention on the Elimination of All Forms of Discrimination against Women and the Convention on the Rights of the Child form the basis for the elaboration of a global strategy to eliminate harmful practices, which should be well defined, rights-based, have local relevance and comprise legal, economic and social support measures combined with proportional political engagement and State responsibility at all levels.

- The State must act as an agent of change as regards women's place in cultural and family life, by fostering and creating a culture free of all forms of discrimination against women. A transformative approach to women and girls' status in the family is crucial. There needs to be awareness that, in the past, a patriarchal concept of family pervaded all secular, religious, customary and indigenous laws and institutions and that some States and groups are now trying, in a retrograde manner, to subject women to the most oppressive forms of patriarchy, particularly in the context of religious fanaticism. It should also be understood that the transition towards equality between women and men, and girls and boys, in the culture and in the family is a prerequisite for a decent society.

- Most countries only track enrolment and not completion rates, yet enrolment is an inherently flawed measure of girls' access to education. Attendance is a better measure, as girls' attendance may be cut short due to domestic responsibilities such as cooking, fetching water and firewood, and childcare; lack of adequate sanitation in schools to meet the needs of menstruating girls; early marriage or pregnancy; and gender-based violence and harassment, including in schools. In situations of economic contraction, as households cope with declining household income, girls are more vulnerable to being pulled out of school, with girls experiencing a 29 per cent decrease in primary school completion rates versus 22 per cent for boys.

- In the case of India, international attention has been drawn to the vast divergence in the country's natural gender ratio, with estimates that in 2003 100 million women were "missing" from its population. It is estimated that one million selective female foetal abortions occur annually in India. There is no official statistical data available on female infanticide, but in the state of Kerala, it is estimated that about 25,000 female newborns are killed every year. The preadolescent mortality rate of girls under 5 years old was 21 per cent higher than for boys of the same age in India. Violence, as well as nutritional and deliberate medical neglect by girls' parents, was cited as the main causes of death.

- It is clear from the many concerns that numerous interlocutors have raised with the Special Rapporteur that, even though the shift to the "men and boys" agenda is fraught with difficulty, it appears to have attracted a great deal of funding, recognition and political support. In order to legitimize their mandates, many men's organizations claim that the inclusion of men and boys is a binding obligation called for in numerous international documents and frameworks, including the Rio Declaration of the Global Symposium on Engaging Men and Boys on Achieving Gender Equality, held in Rio de Janeiro, Brazil, from 29 March to 3 April 2009. This Declaration outlines an obligation for States, United Nations agencies and donors to promote the agenda of engaging men and boys, and advocates the allocation of resources to further work in that direction. The Rio Declaration is an NGO declaration and does not have status comparable, in legal terms, with United Nations documents, and it was developed and promoted by the very men's groups that it provides for and strengthens. The distortion of the rationale and the interpretation of international human rights standards and frameworks, particularly as regards gender equality and engaging or partnering with men to transform gender inequality, is thus reinforced by such arguments. Such conflation of United Nations commitments with an NGO declaration has resulted in the mushrooming of independent men's groups and organizations, separate from the women's movement, many of which have redefined engagement with men and boys, in male terms.

- In addition, the Human Rights Council Special Rapporteur on the right to education dedicated his 2007 thematic report to the issue of the right of persons with disabilities to inclusive education (A/HRC/4/29, paras. 8 and 76). He found that literacy rates for women and girls with disabilities were significantly lower than for men and boys, and that women and girls were generally subjected to more discrimination. Similarly, in his 2005 thematic report, the Special Rapporteur on the right of everyone to the enjoyment of the highest attainable standard of physical and mental health, focused on the right to health of persons with mental disabilities (E/CN.4/2005/51, paras. 12 and 49) and found that women with intellectual disabilities were especially vulnerable to forced sterilization and sexual violence. He advocated for measures to protect them from violence and other right to health-related abuses, whether occurring in private health-care or support services. Finally, the Special Rapporteur to monitor the implementation of the Standard Rules on the Equalization of Opportunities for Persons with Disabilities reports annually to the Commission for Social Development and has mainstreamed the issue of women and disabilities in his reports (see E/CN.5/2011/9).
