- In a similar vein, combating violence against women and girls in the indigenous context must be achieved holistically; it cannot be addressed in isolation from the range of rights recognized for indigenous peoples in general. In this regard, violence against indigenous women and girls, which is distressingly all too common across the globe, cannot be seen as separate from the history of discrimination and marginalization that has been suffered invariably by indigenous peoples. This history manifests itself in continued troubling structural factors, such as conditions of poverty, lack of access to land and resources or other means of subsistence, or poor access to education and health services, which are all factors that bear on indigenous peoples with particular consequences for indigenous women. The history of discrimination against indigenous peoples has also resulted in the deterioration of indigenous social structures and cultural traditions, and in the undermining or breakdown of indigenous governance and judicial systems, impairing in many cases the ability of indigenous peoples to respond effectively to problems of violence against women and girls within their communities.

- Programmes to promote development implemented by Governments and external donors often fail to take into account the inequalities between communities, the unique circumstances of minorities or the possible need for special measures to ensure that minority communities also benefit. Minorities may be adversely affected through displacement by large-scale projects such as dams and natural resource extraction, or as a result of the negative environmental impact. As noted in the 2007 annual report of the independent expert, conflict prevention is one reason why monitoring poverty alleviation among minorities is crucial: if strategies are successful for some groups but not for minorities, inequalities will increase and so too may tension. Inclusive participation strategies for poverty reduction are proven and effective conflict prevention measures (see A/HRC/4/9, para. 43).

- Economic exclusion is a cause, a manifestation and a consequence of discrimination against minorities, both in the developed and in the developing world. Minorities are often discriminated against when they seek employment and are often poorly represented even in public sector employment and despite legislation that bans discrimination in both public and private sectors. They may face barriers in accessing credit or loans to begin small businesses and may live in the poorest regions or remote areas that offer limited prospects for their economic development. Equally, large-scale economic development projects or commercial activities carried out on the lands and territories where minorities live, without their prior consultation, have had negative impacts, including displacement, the perpetuation of poverty and, in some cases, violence.

- In his landmark report to the Millennium Assembly of the United Nations in 2000, the Secretary-General stated that in many countries at war, the condition of poverty was coupled with sharp ethnic or religious cleavages, and that almost invariably, the rights of subordinate groups were insufficiently respected, the institutions of Government were insufficiently inclusive and the allocation of society's resources favoured the dominant faction over others. He added that the solution was clear: to promote human rights, to protect minority rights and to institute political arrangements in which all groups were represented, and that every group needed to become convinced that the State belonged to all people (A/54/2000, paras. 202-203).

- In States in which minority populations are significant, where inter-community relations are complex, where long-term challenges persist, or where ethnic or religious tensions or conflict exist or have previously occurred, institutional attention may be particularly appropriate. In the European context, for example, it is acknowledged that the Roma require dedicated national attention so as to promote their inclusion in all fields of life, address disproportionate poverty and improve living conditions and health indicators. Discrimination and exclusion are key factors contributing to their disadvantaged situation. Solutions must take account not only of their unique circumstances and target community challenges and the impact of discrimination against Roma, but also of the causes and manifestations of discrimination in the wider society.

- International civil society groups should mobilize effectively and in coalition with groups in other sectors to advocate and promote the Social Protection Floor Initiative. While the Center for Economic and Social Rights joined with a range of other groups, including Amnesty International, to call for a commitment to social protection floors in the sustainable development goals, the great majority of international human rights groups have said little and done less on the issue. It is essential to acknowledge that extreme poverty, which continues to afflict hundreds of millions of people, is a negation of all human rights. International civil society groups in the human rights field fight valiantly to eliminate torture, to reduce and expose extrajudicial executions, to reduce violence against women, to outlaw discrimination and the oppression of minorities and so on, but if the elimination of extreme poverty is not a central part of the collective human rights vision, it is a highly selective battle that is being fought.

- What emerges from the above is a pattern of neglect of the needs of the most vulnerable and marginalized groups in society across planning, institutional responsibilities and resource allocation. Disadvantaged groups can often be identified along ethnic, geographic, and socioeconomic divides (see, for example, A/HRC/18/33/Add.4, para. 79). Indigenous peoples, Dalits and Roma are among such groups facing discrimination with whom the Special Rapporteur has met during the course of her mandate. Moreover, there are vast gender inequalities - in many poor communities, the task of collecting water overwhelmingly falls to women and girls (see, for example, A/HRC/15/31/Add.3 and Corr.1, para. 22). Persons with disabilities are also disproportionately represented among those lacking access to water and sanitation (A/HRC/15/55, para. 21). Neglect can occur for a variety of reasons: groups and individuals may experience stigmatization, they may live in remote areas making serving them costly, or politicians may be indifferent to their needs.

- In line with general recommendation No. 28, States parties should recognize that rural women are not a homogenous group and often face intersecting discrimination. Many indigenous and Afro-descendent women live in rural settings and experience discrimination based on their ethnicity, language and traditional way of life. Rural women who belong to other ethnic minorities or to religious minorities, as well as female heads of household, may also experience higher rates of poverty and other forms of social exclusion. Women working in rural areas, including peasants, pastoralists, migrants, fisherfolk and landless women, also suffer disproportionately from intersecting forms of discrimination. As recognized in general recommendation No. 18 (1991) on disabled women, while women with disabilities face unique challenges in all areas of life, this is particularly the case of those living in rural areas. Discrimination may be compounded in rural areas by a lack of appropriate access to, inter alia, water, sanitation, electricity, health care, child and older person care, and inclusive and culturally appropriate education. As recognized in general recommendation No. 27 (2010) on older women and protection of their human rights, older women and widows may also suffer stigmatization and isolation in rural areas, which expose them to greater risks of ill treatment. In addition, rural women, including heads of household, living in conflict-affected areas face security concerns and further obstacles in enjoying their rights.

- An emerging issue is that of access to online information. Relatively little Internet content is available in some minority languages, and those who are not proficient in national languages, those in rural and remote localities and those in poverty may be at a disadvantage in terms of their access. - Neo-liberalism is an economic paradigm that champions the power of market forces and argues that, if left unregulated, markets will deliver global development. Neo-liberalism grew in dominance in the latter part of the twentieth century and infiltrated development policy. The entry of foreign direct investments in indigenous territories to exploit mineral resources and establish mega-infrastructure projects without the free, informed and prior consent of the citizens impacted by market liberalization and deregulation has led to systematic violations of indigenous land rights and self-determination. The global dominance of neo-liberalism has led to development that is measured by overall growth figures, but which gives little weight to whether such development leads to a reduction in inequality or poverty alleviation therefore significantly disadvantaging vulnerable groups, such as indigenous peoples and women.

- Indigenous peoples account for 5 per cent of the world's population, while representing 15 per cent of those living in poverty. As many as 33 per cent of all people living in extreme rural poverty globally are from indigenous communities. Those figures are particularly alarming given the wealth of natural resources that are located within indigenous territories. That level of poverty is a violation of indigenous people's rights to development, as well as their economic and social rights to an adequate standard of living, housing, food, water, health and education. Such poverty is deeply interrelated with abuses of land and self-determination. The denial of self-determination in relation to development pathways and control over natural resources is also a central causal factor in the prevalence of poverty among indigenous communities. It is related to and mutually reinforced by the exclusion of indigenous people's perspective and agency from dominant development paradigms.

- In general, disadvantages do not exist in isolation and there are numerous examples that demonstrate how poverty and gender discrimination contribute to exacerbating educational deprivation among indigenous peoples throughout the world. The UNESCO report identifies the following measures to overcome marginalization in education, all of which are valid options for addressing the problems encountered by indigenous peoples: setting national equity-based targets, which focus on marginalized sections of the population; gathering disaggregated data to identify marginalized groups and monitor their progress; identifying the drivers of marginalization for specific groups; adopting an integrated policy approach that addresses interlocking causes of disadvantage, within education and beyond, including by improving affordability and accessibility, strengthening the learning environment; and honouring and expanding entitlements and opportunities.

- Another concern consistently raised by indigenous peoples in developed countries is that they generally have limited access to financial and technical assistance from international cooperation. Such cooperation is guaranteed in article 39 of the Declaration on the Rights of Indigenous Peoples, which states that indigenous peoples "have the right to have access to financial and technical assistance … through international cooperation". However, given the rules for eligibility of official development assistance, which is largely based on gross national income, indigenous peoples living in developed countries are often denied such support. One commendable example of how to overcome this limitation is presented in the Strategy for Danish Support to Indigenous Peoples, which stipulates that the general eligibility criteria for development aid recipients is waved in the context of indigenous peoples, as they often live in "poverty pockets," even in countries that are not among the poorest.

- In spite of such progress, the Special Rapporteur notes that there is still a considerable implementation gap with regard to the effective realization of these rights. The long history of colonization and attempts at assimilation of indigenous peoples has continuing effects today. In nearly all of the countries in which they live, indigenous peoples fare worse than non-indigenous sectors of the population in terms of their development, including levels of poverty, education, health, unemployment, housing conditions, clean water and sanitation. Furthermore, in a number of States, indigenous peoples' development strategies and aspirations are still met with negative stereotyping and their contributions in terms of biodiversity conservation, ecosystem services and sustainable food production, for example, are often not well understood.
