- A more recent challenge is the creation of hierarchies of violence against women, especially through political and funding actions. This is particularly evident in the articulation of sexual violence in conflict situations as being different and exceptional, as opposed to its being a continuation of a pattern of discrimination and violence that is exacerbated in times of conflict - as reflected in recent armed conflict situations. The prioritizing of this manifestation of violence has led to numerous concerns, including a shift away from an understanding of violence against women as both gendered and part of a continuum of violence; a shift in resources, in some instances, despite the need to address all manifestations of violence, including at the national level; a shift in focus by some United Nations entities; and the effect of donor-driven priorities in this process. The view of many women's rights defenders is that these shifts have led to focusing on the manifestation of violence against women in conflict situations, to the detriment and ignoring of the low-level "warfare" that women and girls experience in their homes and communities on a daily basis.

- The report, which includes a number of examples of human trafficking and conflict taken from actual conflict and post-conflict situations, has also benefited from the input of Members States during the open debate of the Security Council on "Conflict-related sexual violence: responding to human trafficking in situations of conflict-related sexual violence", held on 2 June 2016, during the presidency of France, at which the Special Rapporteur made an intervention (S/PV.7704). The statements delivered by Member States reflect the urgent need felt by the members of the Council to address the issue of human trafficking for the purpose of sexual exploitation related to conflict. The expert has also been encouraged by the appointment, on 16 September 2016, of Nadia Murad Basee Taha as Goodwill Ambassador for the dignity of survivors of human trafficking, the first time that a survivor of atrocities has been appointed to such a position. Ms. Taha briefed the Council on the atrocities, including trafficking in persons faced by the Yazidi, particularly women and children, at its meeting on 16 December 2015, at which the Council addressed the issue of human trafficking in conflict for the first time.

- However, opportunities for IDW to participate actively in decision-making processes remain particularly limited. For example, IDW have rarely played an active role in developing, implementing and monitoring national action plans on Security Council resolution 1325 (2000), although IDW in a diverse range of contexts have demonstrated their ability and determination to play leading roles in developing and implementing policies and programmes concerning them. Unfortunately, the participatory approaches used to identify protection gaps of concern to IDW often do not extend to ensuring that they have an active say in the development, implementation and evaluation of responses to these gaps. IDW should therefore be given the opportunity to actively participate in peace processes; in negotiating durable solutions and the planning process for returns, reintegration or resettlement; and in post-conflict reconstruction and rebuilding. Participation of women in humanitarian planning should further reflect the diversity of the population and seek to include adolescent girls, youth and those with disabilities.

- With regard to arrests, detentions and criminalization, the majority of these communications were sent to the Russian Federation (10 communications), Belarus (eight communications), and Uzbekistan (eight communications). In this regard, eleven communications were sent to the Russian Federation, 11 to Uzbekistan, and 10 to Belarus. In this context, those most at risk of arrest appear to include women defenders working on human rights issues related to the conflict in the North Caucasus; pro-democracy advocates, particularly in Belarus; women's rights defenders in Belarus and Uzbekistan, those denouncing violations to the European Court of Human Rights, particularly in the Russian Federation, and women journalists in all three countries. In other European countries, smaller numbers of communications concerning allegations of arrests, and detentions were sent to, inter alia, Turkey, the Kyrgyz Republic, Turkmenistan and Spain. Communications regarding other forms of criminalization and judicial harassment were sent to Azerbaijan, France, Greece, Kyrgyzstan, Republic of Moldova, and Turkey.

- Disarmament, demobilization and reintegration are part of the broader security sector reform framework and among the first security initiatives put in place in post-conflict and transition periods. This notwithstanding, disarmament, demobilization and reintegration programmes are rarely developed or implemented in coordination with security sector reform initiatives. This lack of coordination often undermines women's rights, such as when amnesties are granted in order to facilitate the reintegration into security sector positions of ex-combatants who have committed gender-based violations. Women are also excluded from positions within newly formed security sector institutions owing to a lack of planning and coordination in security sector reform and disarmament, demobilization and reintegration initiatives. Inadequate vetting processes further impede gender-sensitive security sector reform, which is key to developing non-discriminatory, gender-responsive security sector institutions that address the security needs of women and girls, including disadvantaged groups.

With the exception of special measures authorized by the present Convention, in particularly by Article 27 and 41 thereof, the situation of protected persons shall continue to be regulated, in principle, by the provisions concerning aliens in time of peace. - Conflict and post-conflict situations often exacerbate an existing environment of discrimination, subordination, violence against women and men's control over their sexuality. Findings of "unimaginable brutality" in the first mandate-holder's report on violence against women during times of armed conflict continue to hold true. Military environments in general, characterized by a hierarchical and command-driven culture, expose women to heightened risks of violence and abuse. As reported following the visit of the Special Rapporteur to the United States, sexual assault and harassment of women in the military has been acknowledged as a pervasive form of violence against women. While most cases of sexual assault in the military go unreported, statistics suggest that women constitute the vast majority of those who report cases. Reflective of a similar tendency of solving domestic violence cases through negotiation and reconciliation, the overwhelming majority of sexual assault cases in the United States military are disposed of through non judicial punishment: only 14 to 18 per cent of cases are prosecuted.

- In her 2010 report (A/HRC/14/22), the Special Rapporteur considered the shortcomings of the due diligence standard in respect of reparations for women who have experienced violence, whether in times of peace, conflict, post-conflict or in authoritarian settings. In her 2013 report (A/HRC/23/49), the Special Rapporteur further deepened the theme of State responsibility to eliminate violence against women and concluded that, while most States accept that violence against women is a pervasive and systemic human rights violation facing countries, this has not led to the adoption of coherent and sustainable solutions. She recommended that State responsibility to act with due diligence be considered as a dual obligation: (a) as a systemic responsibility, whereby States create responsive and effective systems and structures that address the root causes and consequences of violence against women; and (b) as an individual responsibility, whereby States provide victims with effective measures of prevention, protection, punishment and reparation. The Special Rapporteur recommended that accountability of perpetrators, as well as State authorities, for failure to protect from, and prevent, harm should be the norm.

- The first Special Rapporteur recommended that States criminalize and prosecute all manifestations of violence against women, including violence perpetrated under the guise of cultural practices, and called for greater State responsibility for the protection of trafficked women and the prevention of forced or coerced migration. She also called for a more expansive approach that sees violence against women as a "health, legal, economic, developmental and human rights problem", examined the issue of legal protections and remedies for violence against women perpetrated in situations of armed conflict; and called for the inclusion of gendered provisions and processes in the International Criminal Court. In her final report, in January 2003, the first Special Rapporteur stated that the greatest achievements during her mandate had been in "awareness-raising and standard-setting", including with regard to the limitations of the criminal justice framework, and setting new standards for addressing violence as a product of social, political and economic inequality. However, she acknowledged that, despite these successes, very little had changed in the lives of most women during her tenure.

- Most human rights and humanitarian law treaties provide for a right to a remedy. In the context of gross and systematic violations of human rights, the Basic Principles and Guidelines on the Right to Remedy and Reparation for Victims of Gross Violations of International Human Rights Law and serious violations of International Humanitarian Law, adopted by the General Assembly in 2005, start with the premise that "the State is responsible for ensuring that victims of human rights violations enjoy an individual right to reparation". Both the Convention on the Elimination of All Forms of Discrimination against Women and the Declaration on the Elimination of Violence against Women place upon the State the duty to provide compensation for all acts of violence. Yet, the implementation of the due diligence obligation to reparations remains grossly underdeveloped in practice, as discussed in the 2010 report of this mandate. The little attention devoted to gender-specific reparations, both at a substantive and procedural level, contrasts with the fact that women are often the target of both sex-specific and other forms of violence.

- Conflict-related sexual violence takes many forms. Women and girls seeking to survive in conflict zones are often compelled to exchange sexual services and even to "marry" for food, shelter, protection or safe passage. UNHCR has affirmed that women in conflict situations are vulnerable to a range of discriminatory practices that exacerbate their dependence (for example, receiving smaller food rations or not having ration cards or other identity documents in their own name) and are disproportionately exposed to sexual violence. For women and girls abducted into military service, sexual assault is often a feature of their experience. Rape has been used as a tactic of war to humiliate and weaken the morale of the enemy, ethnically cleanse the population, destabilize communities and force civilians to flee. Widespread or systematic sexual assault by government and/or opposition or rebel forces has been documented in multiple modern conflicts, including in the reports of the Secretary-General on conflict-related sexual violence, issued annually since 2009, in which he has identified incidents and patterns of sexual violence in conflict-affected countries employed by parties to armed conflict, primarily against women and girls but also against boys and men (see S/2015/203).

- The breakdown of families, communities and social and institutional structures during conflict and in its aftermath puts children at great risk of being sold, trafficked and sexually exploited. The World Development Report 2011 of the World Bank estimates that approximately 1.5 billion people live in countries affected by repeated cycles of political and criminal violence. The current nature of conflicts, mostly civil wars fought by armed groups rather than the military, disproportionately affects civilians. Children pay a high toll. A child living in a conflict-affected or fragile developing country is nearly three times more likely to be out of school than a child living in a developing country that is unaffected by these factors. Sexual and gender-based violence is a major issue, during and in the aftermath of conflict. Women and children account for close to 80 per cent of refugees and internally displaced persons. As more countries fall into conflict and high levels of political and criminal violence, involving an increasingly complex range of protagonists and ever more violent schemes, children will continue to be exposed to heightened risks.

- Owing to multiple and intersecting forms of discrimination, specific challenges face minority women and girls affected by humanitarian crises. According to the General Recommendation on women in conflict prevention, conflict and post-conflict situations of the Committee for the Elimination of Discrimination against Women (see CEDAW/C/GC/30, para. 36), during and after conflict specific groups of women, including, inter alia, internally displaced and refugee women, women of diverse caste, ethnic, national or religious identities, or of other minorities, are at a particular risk of violence, especially sexual violence. These groups of women "are often attacked as symbolic representatives of their community". The Committee has further noted that stateless women and girls face heightened risk of abuse during conflict, owing to, among other factors, their minority status (ibid, para. 60). Minority women may be particularly at risk of sexual and gender-based violence and other forms of violence, including slavery and trafficking. The Special Rapporteur was deeply troubled and saddened when she listened to the testimonies of Yezidi women in Iraq of sexual and gender-based violence committed against them by Daesh, which acts must be fully investigated and their perpetrators prosecuted.

- The past twenty years have witnessed the formulation of a multitude of tools and standards relevant to gender and forced displacement, which increasingly include IDW. While some standards and practices focus on particular issues such as reproductive health and SGBV, others tackle gender and displacement in a cross-cutting manner. The Guiding Principles formed the first normative framework to detail a number of specific rights of IDW, including non-discrimination and the right of expectant mothers, mothers of young children, and female heads of household, inter alia, to protection and assistance that "takes into account their special needs". The Guiding Principles identify various forms of violence and exploitation against which IDPs should be protected, including SGBV, underline the right of IDW to access all necessary documents, education and training, and call for the active participation of women in decision-making at all stages of displacement. They have informed subsequent instruments and frameworks, which address IDW, such as the Kampala Convention and the Framework on Durable Solutions for Internally Displaced Persons.

- [Millions of people are being newly internally displaced every year as a result of conflict and violence. Disasters displace even more people and the effects of climate change will exacerbate this trend. Development-induced displacement is also on the rise. With international attention focused on camps of internally displaced persons, many other displaced remain invisible, because they stay with host families, are dispersed in urban areas or their existence is officially denied. Some vulnerable groups within the displaced population are also regularly overlooked. Host families and communities are often heavily affected by displacement, but they are often neglected. The Representative urges member States and humanitarian and development actors to expand their scope of action and recommends that they:] Pay greater attention to internally displaced persons with multiple layers of vulnerability and discrimination, especially elderly persons and those with disabilities, women heads of households and their children, and displaced persons belonging to ethnic minorities or indigenous peoples.

Global trends in risks and threats facing human rights defenders 2015, para. 90

- The few observations presented in the present report show that we are dealing with attacks designed to weaken the women and men who are combating injustice and putting themselves in harm's way in order to defend the rights of those who cannot defend themselves. When these defenders are attacked, it is not just them but human rights that are threatened. The defenders we met at these seven consultations run countless risks that leave them distraught and often on their own. The Special Rapporteur is extremely worried about the trends alluded to in this report, especially with regard to the most exposed groups of defenders. He intends to continue exchanging views on certain points that emerged during these consultations in order to exhaust every possible opportunity to provide them with better protection. Positive developments were, nevertheless, reported in the course of these consultations, be it the enactment of domestic laws to protect defenders, certain projects such as the "shelter cities" or the preparation of defenders' kits. The Special Rapporteur will address such initiatives and sound practices in upcoming reports.

- During the 2004-2009 period, the mandate sent some 29 communications regarding threats and death threats against this group of defenders in sub-Saharan African countries. Half of these communications concerned those working in the Democratic Republic of the Congo. In this context, those regularly targeted included members of organizations working on women's rights issues, particularly impunity for sexual and other forms of violence against women in the context of the armed conflict, and their family members, along with wives and other female family members of male human rights defenders. The threats delivered included numerous death threats and often accompanied attacks or break-ins at the home of the defender in question. The sources of such threats were often armed individuals and members of the armed groups party to the conflict in the Democratic Republic of the Congo, including State forces and police. A similar pattern of threats against defenders working on women's rights, albeit less frequently reported, was notable in Zimbabwe, primarily women's rights defenders. Other communications were also sent to the Central African Republic, Kenya and Uganda.

- In the wake of Hurricane Mitch, a combination of factors militated against satisfying the most basic housing needs of the affected Honduran population, much less the full realization of their right to adequate housing. Most analyses of post-Mitch responses conclude that both the country's government and the national emergency management system (as represented by its main agency, COPECO) were not adequately prepared to respond to the need of the victims. On the positive side, Hurricane Mitch led to the arrival of significant human and financial resources. Post-disaster housing response initiatives represented unprecedented opportunities to "build back better". In particular, many women gained access to land and participation through some of these donor-funded responses who insisted that the deeds to all reconstructed houses bear the names of the female spouses (instead of the males), which was justified by the assumption that "women won't sell". Other projects compromised by proposing that post-disaster housing be registered under joint title and then established as family patrimony.
