- Internet and telecommunications shutdowns involve measures to intentionally prevent or disrupt access to or dissemination of information online in violation of human rights law (see A/HRC/32/13, para. 10). Governments typically conduct or order shutdowns, often with the assistance of private actors that operate networks or facilitate network traffic. Large-scale attacks on network infrastructure committed by private parties, such as distributed denial-of-service (DDoS) attacks, may also have shutdown effects. While shutdowns are frequently associated with total network outages, they may also arise when access to mobile communications, websites or social media and messaging applications is blocked, throttled or rendered “effectively unusable”. Shutdowns may affect towns or regions within a country, an entire country or even multiple countries and may last for periods ranging from hours to months.

- Shutdowns ordered pursuant to vaguely formulated laws and regulations also fail to satisfy the legality requirement. In Tajikistan, the amended Law on the State of Emergency authorizes the Government to block mobile services and Internet access without a court order following the declaration of a state of emergency. The law fails to define when and for what purposes a state of emergency may be declared. Such ambiguity enables authorities’ unfettered discretion to implement shutdowns. In some countries, authorities rely on antiquated laws to justify shutdowns. Laws and regulations adopted and implemented in secret also violate the legality requirement. In the United States of America, the National Coordinating Center for Telecommunications has largely redacted public release of standard operating procedure 303, an executive regulation that establishes “detailed procedures” on the “disruption of cellular service.” While these procedures have not been publicly invoked, the potential for authorities to evade legal scrutiny and public accountability runs contrary to article 19 of the Covenant.

- The rights to freedom of peaceful assembly and of association are not absolute, meaning that not only can they be temporarily derogated from in a state of emergency, but they can also be exceptionally interfered with under other circumstances. While they are human rights guaranteed to all, their exercise may be subject to certain restrictions. Such restrictions are permitted if they are necessary for a number of public purposes, including the protection of the rights and freedoms of others, as long as they are proportionate and provided for by law. Security and emergency laws, measures aimed at curtailing the financing of international terrorism, anti-money-laundering regulations and other limitations restrictive of civic space in the name of general public purposes, however, do not, as such, justify systematic violations of the freedom of peaceful assembly and of association.

- The Special Rapporteur considers it an absolute priority of the mandate to continue transmitting urgent appeals to States with regard to individuals reported to be at risk of torture, as well as communications on past alleged cases of torture. However, having recently taken up his functions, the Special Rapporteur notes with serious concern that the resources allocated to the mandate are not sufficient to respond to the ever-growing number of urgent requests for intervention on behalf of individuals. The Special Rapporteur therefore appeals to the Human Rights Council, as well as to its members individually, to take every possible measure to allow the Special Rapporteur to carry out the mandate effectively.

- Given their business model, vendors are required to navigate the human rights challenges that their customers face or create. In the area of surveillance, vendors are often bound by “lawful interception” measures, which require the configuration of networks to enable government access to user data. Additionally, vendors may be contracted to establish “administration and mediation systems” that facilitate the sharing of intercepted data between the network operator and the government authority as well as the government systems that process the intercepted data. In arrangements where vendors also manage the networks that they have built, they may also be responsible for handling government requests for user data on the operator’s behalf.

- The human rights obligations of States are classified as obligations to respect, to protect and to fulfil. The obligation to respect requires that States’ regulatory frameworks refrain from interfering directly or indirectly with people’s existing access to water and sanitation. To that end, States must ensure that their regulatory framework prohibits disconnections from water and sanitation services due to users’ inability to pay, as it is a retrogressive measure and violates the human rights to water and sanitation, must ensure, when extending piped networks to informal settlements, that these services are affordable so as not to interfere with people’s access, and must avoid discriminatory or unaffordable increases in the price of water and sanitation services due to inadequate regulation. Furthermore, preparedness for situations of armed conflict, emergency situations, natural disasters and effects of climate change requires that States embrace in their regulatory frameworks the obligations relevant to water and sanitation provision pursuant to international humanitarian law.

- Since taking up her duties on 1 November 2016, the Special Rapporteur has undertaken a series of bilateral consultations with key stakeholders in order to shape her strategic priorities. This process of consultation culminated on 25 January 2017 with a stakeholder meeting in Geneva for the Special Rapporteur to present and receive feedback on her initial strategic priorities and on the main thematic priorities for her work over the next three years. She was honoured to have her predecessors, Chaloka Beyani and Walter Kälin, on the panel, and attendance by over 35 participants from Member States, United Nations agencies and civil society, who provided their perspectives, views and recommendations. Following the event, on 21 February 2017, the Special Rapporteur had occasion to present her strategic and thematic priorities to a broader, online audience of close to 300 persons worldwide through a web course hosted by Professionals in Humanitarian Action and Protection.

- While the lawfulness of specific weapons and other means of warfare has long been regulated in international humanitarian law, it has more recently also become an issue of consideration under human rights law with regard to the wider context of law enforcement. It is increasingly recognized that certain weapons and other means of law enforcement may be inherently cruel, inhuman or degrading by nature or design and, accordingly, that their use, production and trade would be incompatible with the prohibition of torture and other cruel, inhuman or degrading treatment or punishment (General Assembly resolution 66/150, para. 24, and resolution 68/156, para. 30). Ever since the establishment of the mandate of the Special Rapporteur, mandate holders have expressed concern in this respect, starting in the very first report of the Special Rapporteur to the Commission on Human Rights, in 1986 (E/CN.4/1986/15, paras. 120-121), but most notably in a report prepared at the express request of the Commission in 2003 (E/CN.4/2003/69).

The latter trigger the application of article 3 common to the Geneva Conventions relating to the protection of victims of international armed conflicts and the application of the Protocol additional to the Geneva Conventions of 12 August 1949, and relating to the protection of victims of non-international armed conflicts. In that respect, the Special Rapporteur will discuss the principle that international humanitarian law does not apply to the exclusion of fundamental human rights law, but fully complements it;

- The UNDP information disclosure policy provides a good example of how to approach exceptions. Its policy, which notes that the organization operates in contexts of “crisis, conflict or humanitarian disasters” that pose challenges to UNDP operations and Member State interests, identifies several categories of information deemed confidential and “not available to the public”. Not all of the categories of exceptions are entirely appropriate, such as “[c]ommercial information where disclosure would harm either the financial interests of UNDP or those of third parties involved” or “[i]nformation which, if disclosed, in UNDP’s view would seriously undermine the policy dialogue with Member States or implementing partners”. (These exceptions are found in the policies of other intergovernmental organizations as well.) Both categories seem overbroad and subject to undue discretion of the organization. Nonetheless, recognizing this potential for overbreadth and potentially illegitimate non-disclosure in paragraph 12 of its information disclosure policy, UNDP provides that it could disclose even “confidential” information “if it determines that the overall benefits and public interest of such disclosure outweighs the likely harm to the interest(s) protected by the exception(s)”. Such authority rests not only in UNDP itself but in the independent panel created to oversee such decisions.

- [The first thematic report to the Human Rights Council, in 2018, will be focused on the use of force, including less lethal weapons, and the management of assemblies, building upon the joint report on the proper management of assemblies presented in 2016 (see paras. 22 and 41 above), pursuant to Council resolution 25/38. In addition to following up on the compilation of practical recommendations for the proper management of assemblies provided in the joint report, the Special Rapporteur will tackle current and emerging issues, including:] Private security contractors and the managing of assemblies. A restatement of the legal framework is equally needed for guiding both countries and assemblies that engage private sector contractors;
