- The Centre on Housing Rights and Evictions (COHRE), a non-governmental organization, estimates that 1.6 million people were forcibly evicted in 2007 and 2008 - in many cases without consultation, adequate alternatives or compensation and therefore contrary to the Guiding Principles. Colombia's law on internally displaced persons specifically recognizes the rights of the displaced to assistance and a corresponding right of the international community to provide humanitarian assistance.

- Flexibility, multi-stakeholder dialogue and willingness to come to pragmatic compromises can significantly help to address tensions. For example, some months after the earthquake of 12 January 2010, the Government of Haiti asked to phase out the blanket distribution of free food aid, fearing that it might exacerbate recipient dependency and undermine local markets. Accordingly, the United Nations and other major providers of humanitarian assistance agreed to adapt their approach, including by providing recipient rights-holders with cash or food in exchange for community work (for example, rubble removal), while still maintaining targeted free food aid programmes for the most vulnerable.

- Increasing constraints on humanitarian access have the effect of excluding internally displaced persons and others affected by conflict and disasters from their entitlements to assistance. Administrative and technical barriers regularly impede the provision of humanitarian action. Humanitarian actors find it increasingly difficult to defend the impartiality, neutrality and independence that form the basis of their work, as individual States and State coalitions seek to align humanitarian action with their own political and military agendas, a trend considered responsible, in part, for the increasing violence against humanitarian workers. This increase in politically motivated attacks on humanitarian personnel and other patterns of insecurity that interrupt humanitarian operations have a profound impact on both the extent and methods for providing humanitarian assistance, with recipient rights-holders as the ultimate victims.

- Host communities and host families often end up assuming considerable burdens due to the influx of displaced persons, which may create social tensions and further protection concerns. In this respect a concept of "displacement-affected communities" is helpful in recognizing that not only displaced communities but also communities which host or (re)integrate them are affected by internal displacement. The Representative has consistently encouraged donors and humanitarians to expand their focus and extend protection and assistance to a broader spectrum of beneficiaries. Such activities should go beyond delivering humanitarian aid and include development interventions to strengthen basic infrastructure such as water and sanitation and basic services such as health and education, and increase food security and the availability of shelter. Such interventions may be less costly in the long run and would not only help to address the needs of the displaced but, at the same time, contribute to the development of areas and communities receiving them.

- Cluster responsibilities at the global and national level have brought more predictability and helped to close gaps in the humanitarian response to internally displaced persons. In particular, UNHCR, as the cluster lead for the protection of internally displaced persons in conflict settings, emergency shelter, and camp management has taken on considerable responsibilities, including the role of "provider of last resort". In order to live up to these new commitments, UNHCR has increased its operational engagement and provided for institutional and budgetary amendments. However, the capacities of UNHCR, as well as those of its partners, in particular as regards training and adequate staff numbers, as well as the capacity to provide guidance in the area of protection, are still very limited compared to the overall needs of the displaced. A more robust and decisive engagement will be required.

- General insecurity in crisis-affected States suffering from a breakdown of law and order is on the rise. Virtually all modern armed conflicts involve non-State armed groups and many of them operate more like unscrupulous criminal gangs than armed political movements with a sense of respect for humanitarian principles. - While the General Assembly has noted that humanitarian assistance "should be provided with the consent of the affected country", this does not imply that States are entitled to withhold their consent in all circumstances. As seen above, article 2, paragraph 1, of the International Covenant on Economic, Social and Cultural Rights specifically requires States parties to take steps towards realizing human rights also "through international assistance and cooperation". There is growing acceptance that the obligation to respect, protect and fulfil human rights includes an obligation to invite, accept and facilitate international humanitarian assistance, in particular if the State is unable or unwilling to effectively address all humanitarian needs.

- The nature of the mandate - situated at the heart of the United Nations system - and its access to many different agencies and offices, in particular all levels of the Inter-Agency Standing Committee, have been key features that have contributed to its effectiveness. - Measures to address these vulnerabilities and meet the challenges related to climate change-induced displacement should be informed and supported by a human rights-based approach which is applied at all phases of displacement and disaster response. - Some climate change-induced displacement however, such as movements triggered by slow-onset disasters, may require more emphasis on the positive obligations of States, with the support of regional bodies and the international community, to anticipate, plan ahead and take measures to prevent or mitigate conditions likely to bring about displacement and threaten human rights. - Plans to relocate individuals or communities need to ensure effective participation by the affected population in all decisions, including with regard to the new relocation site and the timing and modalities of the relocation. Key and often difficult issues in relocations frequently include access to land, livelihood opportunities and compensation for the displaced. Relocation plans need to be sensitive to other factors as well, such as issues of community, ethnic and cultural identity and possible (often pre-existing) incompatibilities or tensions with the receiving community. Measures which are sensitive to the needs and concerns of the receiving community, including with regard to absorption capacity (additional pressures placed on natural and other resources, community services, etc.), and which promote integration, and mediation where necessary, will often be necessary. These require working with all parties in order to foster trust and provide the necessary support for the relocation to both the displaced and the receiving communities.

- The majority of such displacements over the past four years have been due to a small number of large and megadisasters. Although megadisasters are relatively rare they have a great impact on internal displacement figures. In terms of the number of internally displaced persons, in 2011 the top 10 disasters continued to be in Asia, including multiple events in China, the Philippines, Sri Lanka and Japan. In contrast to the visibility of large and megadisasters, many smaller disasters go relatively underreported. Yet, their impact on low-income households and communities, especially if they are recurrent, has the effect of undermining resilience and aggravating vulnerabilities or creating new ones. As such, they are an issue deserving of further attention by humanitarian and development actors alike.

- The Guiding Principles on Internal Displacement were drafted and subject to a broad-based consultation process from 1996 to 1998, and finalized at a conference of 50 international experts in Vienna, hosted by the Government of Austria. - Following the Secretary-General's report on the system-wide review (E/CN.4/1992/23), a number of significant measures were taken to strengthen the coordination of humanitarian emergency assistance of the United Nations, including the designation of an emergency relief coordinator and the establishment of the Inter-Agency Standing Committee, to be chaired by the Emergency Relief Coordinator (see General Assembly resolution 46/182, annex, paras. 34 and 38). The Inter-Agency Standing Committee includes all United Nations operational agencies, this mandate, intergovernmental organizations, such as the International Committee of the Red Cross (ICRC) and IOM, and non-governmental organizations, either by standing invitation or on an ad hoc basis. The Inter-Agency Standing Committee therefore became the primary mechanism for inter-agency coordination and the development of policy for ensuring a coherent and timely response to humanitarian emergencies (see General Assembly resolution 48/57, para. 6).

- In recognition of the primary responsibility of the State for protection and assistance to internally displaced persons, the General Assembly, the Human Rights Council and its predecessor, the Commission on Human Rights, have over the years repeatedly encouraged Governments to develop domestic legal and policy frameworks based on the Guiding Principles. It is estimated that, at present, over 20 countries have adopted or issued policies, laws or decrees relating specifically to internal displacement. A number of other countries, including Afghanistan, the Central African Republic, Kenya, Nigeria and Yemen, are currently in the process of developing, or have already announced, draft national policies or legislation, a process which this mandate has routinely supported. Of note also is the adoption of the first state- or provincial-level law on internally displaced persons, in Mexico, where the State of Chiapas adopted a law on displacement in February 2012 which incorporates the Guiding Principles.

- In particular, there is increasing interest in and research on internal displacement caused by violence linked to organized crime in situations which do not reach the threshold of armed conflict. An example is the debate around responses relating to internal displacement in situations of violence stemming from the activities of drug cartels or fighting between the police, the military and drug gangs. - While urban environments can often provide a conducive setting for internally displaced persons to rebuild their lives, they also present important protection and other challenges. This is especially the case since internally displaced persons, who usually live within host communities rather than in defined camp settings, can be difficult to identify and assist in urban contexts. While precise estimates, including of future displacement, are not available, internal displacement, including secondary displacements, connected to the global trend of largely unplanned rapid urbanization, stands out as an issue meriting much more attention and data collection. Situations of unplanned migration or displacement to urban areas are more likely to result in a lack of security of housing or land tenure and in settlement in hazard prone areas, often by marginalized or vulnerable populations, such as internally displaced persons. In turn, this is likely to lead to more forced internal displacements due to the threat of or actual natural disasters, for example flooding or mudslides, in those areas; mass evictions for development projects or other reasons as cities try to modernize and enforce urban planning and decongestion; or urban violence. More work on internal displacement in urban contexts will continue to be required, including from the perspective of urban planning, in relation to emergencies and natural disasters in urban areas, humanitarian and development assistance and guidelines in cases of mass eviction, and from the point of view of local integration as a durable solution in urban areas (see A/HRC/19/54 for recommendations).

- Refugee and IDW often face similar assistance and protection concerns, such as increased risk of sexual and gender-based violence (SGBV), and could benefit in some instances from analogous gender-sensitive interventions to address these problems. However, the diversity within these groups, the particular challenges they may face, and the legal, social and other implications of the very context of their displacement (i.e. internal versus external displacement) must be acknowledged and integrated into responses to their needs. For example, the lower levels of international assistance provided, on average, to IDPs compared to refugees are associated with comparatively poorer reproductive health outcomes for IDW. Conversely, as residents or citizens of their country, IDW generally do not face the same type (or extent) of legal and administrative barriers in the exercise of their rights to freedom of movement and to work.

In Kenya, a number of workshops and bilateral meetings were held and attended by the Parliamentary Select Committee, representatives of government ministries, the Special Rapporteur and the staff supporting his mandate. The Truth, Justice and Reconciliation Commission was also consulted. The Parliamentary Select Committee carried out 26 public hearings and field visits around the country from March to October 2011 to gain further insights into the plight of internally displaced persons in Kenya.

- With regard to cash-grant mechanisms, which include grants for the reconstruction and repair of houses and rental subsidy schemes, they attempt to strengthen tenure security for internally displaced renters, while ensuring that those internally displaced persons move into properties that meet minimum safety standards. For example, in Haiti, two years after the earthquake, the Government addressed some displacement-related housing, land and property issues in the context of its "16/6" project. The project, first launched in August 2011, envisaged the reconstruction of 16 earthquake-affected neighbourhoods and the closure of six major related camps by providing grants to the internally displaced persons living in those camps to rent housing, to construct a new house or to repair their own houses that were damaged by the earthquake. With regard to the rental subsidy mechanism, it also attempted to raise awareness of renters' rights and required the signing of a formal lease.

- The Special Rapporteur also encourages initiatives aimed at including existing informal settlements in comprehensive urban planning schemes, thereby increasing security of tenure and adequate living conditions, including in terms of access to services. In the case of Somalia, national and local authorities, United Nations agencies and international non-governmental organizations worked together to devise a comprehensive urban development plan to address the precarious living conditions of internally displaced persons in Boosaaso. Of the inhabitants of Boosaaso, 1 in 4 is internally displaced, with most residing in cramped and unsanitary squatter camps on the peripheries of the city. The private owners of the land on which displaced persons were living forced them to pay high rents, offered no protection from fires that frequently destroyed large sections of the settlements and forbade the construction of any sanitary infrastructure such as wells or latrines.

- There is therefore a pressing need for a more preventative approach to these challenges. In this regard, the Protocol on the Prevention and Suppression of Sexual Violence against Women and Children (2006) of the Great Lakes region and the model law annexed thereto, the 2011 Council of Europe Convention on preventing and combating violence against women and domestic violence and the Inter-American Convention on the Prevention, Punishment, and Eradication of Violence against Women (Convention of Belém do Pará) provide some important entry points and examples in terms of legal frameworks. Fuel strategies and livelihood initiatives targeting displaced women and girls, and those at risk of displacement, are further practical measures which can be central to reducing exposure to sexual violence. Reducing vulnerability to sexual violence also entails ensuring that survivors have access to appropriate support, including reproductive and psychosocial services and that adequate resources are devoted to gender-sensitive site planning.

- Finally, the implementation and monitoring phase is an essential and often ongoing one. As implementation will be achieved gradually, it can be helpful to prioritize implementation activities, ensuring that emergency needs are addressed while longer-term needs and concerns are not overlooked. Implementation may also require capacity-building at various levels of government. Dissemination and awareness-raising among government officials at all levels, as well as among internally displaced persons and other displacement-affected communities, in relevant languages and through appropriate channels in order to ensure the most vulnerable populations are reached, are also critical steps to ensure effective implementation. It is also important that obstacles and gaps in implementation are promptly identified and addressed. Monitoring and evaluation should be carried out regularly by an entity with monitoring expertise and experience, and the national institutional focal point should convene to take stock of the implementation process.

- In Kenya, the Ministry of State for Special Programmes was designated as the institutional focal point responsible for internal displacement issues, including the resettlement of internally displaced persons and the coordination of disaster risk reduction programmes during the 2007/08 post-election violence. - There is a danger of camps and their populations becoming "invisible" or an inconvenience that national authorities seek to remove by closure or demolition of facilities. Regrettably, some governments have taken the view that the closure of camps and/or the provision of cash grants to IDPs without linking the grants to livelihood and other sustainable strategies, constitute a solution to displacement that absolves them of further responsibilities. Such measures may be forced upon IDPs or accepted by them, since they are frequently unaware of their rights under international law.

- For many children in displacement situations, exclusion from education can be a long-term problem. Particularly in less developed countries, lack of resources, buildings, teachers and education materials may all create barriers to education. Lack of documentation, including birth certificates, may be a factor in States in which students must demonstrate their citizenship or residence in a region to have access to services. Discrimination may also be a factor, with schools and local authorities being reluctant to accept displaced children from different ethnic, linguistic or religious groups.

- Despite the explicit commitments made in the United Nations Millennium Declaration to protect the vulnerable and "to help all refugees and displaced persons to return voluntarily to their homes, in safety and dignity and to be smoothly reintegrated into their societies", millions of IDPs globally are amongst those who were left behind as others were brought out of poverty. All durable solutions, not just return, but also local integration or settlement elsewhere within the country, must be considered as options available to IDPs. - In December 2014, the synthesis report of the Secretary-General on the post-2015 sustainable development agenda highlighted "gap issues", and included explicit references to internal displacement. It calls for a transformative shift away from business as usual and proposes six "essential elements": (a) dignity: to end poverty and fight inequalities; (b) people: to ensure healthy lives, knowledge and the inclusion of women and children; (c) prosperity: to grow a strong, inclusive, and transformative economy; (d) planet: to protect our ecosystems for all societies and our children; (e) justice: to promote safe and peaceful societies and strong institutions; (f) partnership: to catalyse global solidarity for sustainable development.

- While national governments have the primary responsibility towards IDPs, their responses are often ad hoc, uncoordinated and, therefore, ineffective. National laws, policies or strategies on internal displacement can assist national authorities in addressing the challenges of displacement in a planned manner, and improve short-term and long-term responses. Such national instruments may serve to clarify who is an IDP and what such a person's corollary rights are, establish budgets directed towards them and create administrative and response structures and responsibilities, as well as creating confidence amongst regional and international development partners.

- Development projects, including dams, irrigation projects, pipelines, highways, urbanization, mining, and conservation of nature, can all create displacement. The Brookings Institution report, "Risks and rights: the causes, consequences, and challenges of development-induced displacement", states that it is "problematic at best, even when a State has the best interests of the entire population at heart. The effects can be catastrophic when such displacement occurs in the midst of conflict and human rights abuse, or when a State deliberately or arbitrarily targets some of its people to bear a disproportionate share of the costs of development and denies them a proper share of the benefits".

- Historically, development projects have been a major cause of displacement. Important questions relating to their impact must always be asked and the principles of informed consultation, participation and consent respected. For example, while proposed sustainable development goal 7 calls for States to ensure access to affordable, reliable, sustainable and modern energy services for all, the impact in terms of displacement of communities to make way for hydroelectric and other development projects must be taken into account. The sustainable development goals must not be achieved at the cost of forced displacement.

- As the Special Rapporteur pointed out in the joint note to the Secretary-General in October 2014 with Valerie Amos, António Guterres and William Lacy Swing: The displaced are often excluded from longer-term development and institutional planning. If left unaddressed, protracted displacement generates further marginalization, inequality, fragility, vulnerability and erodes people's resilience. This poses a serious impediment to all present pillars of sustainable development both for the displaced persons and host communities. Development actors need to increase their engagement from the onset of a crisis to ensure that the development dimensions of displacement are addressed. The post-2015 development agenda therefore needs to address protracted displacement by ensuring effective support for durable solutions.

- While humanitarian aid staples often consist of rice, beans, oil and tinned produce, as well as products to meet the nutritional needs of children, there is frequently a shortage of higher value or perishable foodstuffs, such as meat, fish and vegetables. A restricted diet over any significant period can result in inadequate nutrition and malnutrition, with a lasting effect on the health of individuals and their susceptibility to illness. In this respect, the Special Rapporteur stresses the importance of taking into account the specific needs of children, breastfeeding mothers and groups with specific dietary habits, such as nomadic peoples. Systematically implementing an approach to hunger and food security that recognizes the need for availability, accessibility, acceptability and quality, means also including IDPs.

- The massive displacement figures alone do little to reveal the devastating impact of conflict on civilians, particularly where international humanitarian law and human rights law are violated. Prevention and resolution of conflict are primarily the responsibility of national authorities. While, as recent experience of conflicts demonstrates, not all can be prevented or easily resolved, some conflict and violence can be prevented. It requires political will and leadership, but also concerted and timely action, strategic planning, institutional and governance structures and dedicated resources. With these in place, States can take effective steps in the area of prevention of conflict and internal displacement.

- A deeper understanding of the causes of conflict and displacement is required. - Improved political leadership must be reflected in the recognition of national challenges, including internal displacement, and a political resolve to address them comprehensively. Consequently, legal and policy safeguards and protection and assistance measures are absent and some States avoid their primary responsibility for protecting and assisting internally displaced persons. - The relationship between humanitarian and development actors has been the subject of perennial discussion. - Positive developments relating to durable solutions exist and should be developed, among them the Secretary-General's Policy Committee decision on durable solutions for internally displaced persons and returning refugees (2011), which recognized the enormous gap in response for these groups in the aftermath of conflict. Some States such as Côte d'Ivoire and Mali have developed durable solution strategies. The Solutions Alliance (see www.solutionsalliance.org) was established in 2014 and brings Governments and humanitarian and development partners together to solve concrete problems. The work of JIPS helps to develop a nationally owned evidence-base for operational decision-making and IDMC enhances relevant analysis at the global level, while the United Nations Development Programme (UNDP), the World Bank and multiple donors have committed to address internal displacement as a development issue, and not just a humanitarian one.

- The primary responsibility of the State to protect and assist internally displaced persons extends to funding. While some States are among the poorest and require significant international support, others are middle income and must allocate appropriate resources from national budgets to meet their needs. - The projects included emergency employment, restoration and stabilization of disrupted livelihoods, emergency support to vulnerable groups, capacity development, advocacy and technical assistance. Vocational training was provided through entrepreneurship promotion activities, with a special focus on vulnerable groups, including female-headed households, persons with disabilities and young people. - In some situations of generalized violence, persecution or human rights violations, for example, the internal displacement of individuals, families or targeted communities may be slower, small-scale, dispersed and less obvious than in some conflict situations. There are those who flee their homes but do not identify themselves as internally displaced persons owing to a lack of understanding about their rights or out of fear or a desire to remain anonymous. Equally, State authorities can fail to identify those persons as internally displaced owing to a lack of understanding or neglect of their pertinent obligations to assist and protect those displaced by generalized violence. The challenge exists to ensure that those who are unlawfully forced or coerced to leave their homes are identified as internally displaced persons and receive necessary assistance and protection.

- It is essential to establish national legal and policy frameworks relating to development, land and non-State actors that intersect with and complement legal provisions relating to internal displacement and the rights of internally displaced persons, and conform to international standards. For example, the International Labour Organization Indigenous and Tribal Peoples Convention, 1989 (No. 169) relates to the rights of indigenous and tribal peoples and incorporates the right to free, prior and informed consent for indigenous peoples. Articles 6, 7 and 9 of the Convention establish that consent must be acquired before indigenous communities are relocated or before development is undertaken on their land. Where displacement is approved or agreed to following an appropriate and rigorous consultation and participatory process, internally displaced persons must be provided with appropriate compensation, support and durable solutions in line with international standards.

- Consultation, participation and information provision activities must engage widely with internally displaced persons, including women and female heads of households, young people, older persons and persons with disabilities. In-depth assessments, profiling and consultations help to reveal vulnerabilities, capacities and obstacles, essential to providing appropriate responses and durable solutions. Gathering data on those outside of camps has also proven extremely difficult, and there is a need to find creative solutions to ensure that they do not fall through protection and support nets. The Special Rapporteur's report on the issue to the Human Rights Council in 2012 notably focuses on addressing the causes of neglect of internally displaced persons outside camps through data collection.

- Disaster risk reduction and action to address climate change and its adverse effects in terms of internal displacement and other human rights issues must remain high on the international agenda. The Paris Agreement, reached after the twenty-first Conference of the Parties to the United Nations Framework Convention on Climate Change, is an essential step in the right direction that explicitly recognizes the need for individual and collective State action. - During his visit to the Syrian Arab Republic in May 2015, the Special Rapporteur witnessed initiatives to assist local integration and build resilience, early recovery and livelihoods for internally displaced persons and host communities. In total, the United Nations Development Programme (UNDP) and local partners supported more than 100 livelihood-related projects that targeted the affected governorates as well as host communities, recognizing the heavy burden on them of hosting internally displaced persons. - Essential to national responses are legislative, policy and institutional frameworks that explicitly guarantee protection and assistance to internally displaced persons. Governments must be active in ensuring implementation and exhaustive in their activities to identify such persons who are victims of general or criminal violence and reach them with relevant information, documentation, protection and assistance linked to durable solutions. Where no protection measures exist, internally displaced persons often find protection in anonymity and become dispersed and "invisible", often within poor urban communities. - Lack of information, of consultation and of meaningful participation, or tokenistic participation, means that recovery efforts are more likely to fail and may not meet the needs or expectations of the internally displaced communities affected. - Truth commissions and criminal prosecution of perpetrators also form key elements of transitional justice. The experience of forced displacement often encompasses massive human rights abuses, prior to, during and in the aftermath of the displacement, the legacy of which continues while persons remain in displacement and even after they have achieved physical return, resettlement or integration elsewhere. Internally displaced persons must be included in community reconciliation and social cohesion projects, which form important elements of peacebuilding initiatives and from which they are frequently excluded. The understanding that internally displaced persons have the right to participate fully in transitional justice mechanisms and peacebuilding processes must be reinforced, as must the responsibility of governments to guarantee their participation and to ensure that transitional justice is achieved for them in practice.

- Ongoing efforts in the context of Security Council resolutions 1325 (2000), 1820 (2008 )and 1888 (2009), which seek, inter alia, to strengthen women's participation in decision-making and their agency in conflict prevention, early recovery and governance, as well as in ending conflict related sexual violence and impunity, are important in the context of internal displacement. Equally relevant to the situation of women and girls in internal displacement situations are a number of other instruments, including the International Convention on the Elimination of All Forms of Discrimination against Women, the Convention on the Rights of the Child, and the fundamental guarantees provided for in international humanitarian law. Despite these frameworks, the international community has paid insufficient attention to the particular human rights situation and solutions for women and girls in the specific context of internal displacement. The Special Rapporteur proposes to devote particular attention to exploring the gender dimensions of internal displacement, including by strengthening links with the Committee on the Elimination of Discrimination against Women, the Committee on the Rights of the Child and other relevant bodies and organizations, in order to address the specific human rights violations and discriminatory practices which impact on women and girls at every stage of the displacement process, and by examining alternative solutions and prevention strategies which would be especially effective for them.

- In the 1980s, international efforts to bridge the gap between relief and development assistance included the UNHCR refugee aid and development approach, applied through the International Conference on Assistance to Refugees in Africa, in 1981, and the Second International Conference on Assistance to Refugees in Africa, in 1984. It was followed by the International Conference on Central American Refugees process, launched in 1989 with the aim of supporting durable solutions for Central American refugees and internally displaced persons. According to UNDP, UNHCR and the World Bank, the conferences "demonstrated and to large extent created awareness and recognition that displacement has development challenges which can only be addressed by linking relief and development".6 The Development Programme for Displaced Persons, Refugees and Returnees in Central America complemented the Central American process and was seen as a "successful programme with UNDP playing a prominent role in engaging development actors".6 Although the longer-term success of the International Conference on Central American Refugees and the Development Programme for Displaced Persons, Refugees and Returnees in Central America processes has been questioned, the latter model was subsequently adjusted and replicated in numerous countries.

- After visiting a number of countries affected by disaster-induced displacement, the Representative found that too often insufficient attention is paid to the multiple human rights challenges they face in these situations. The rights of persons displaced by natural disasters often suffer not only because of weaknesses in the disaster response but also because disaster preparedness and disaster mitigation measures were not adequately put into effect. Disaster induced displacement often exacerbates pre-existing patterns of discrimination, putting already marginalized and vulnerable groups at increased risk of human rights abuse. The result can be insufficient or inappropriate protection from threats caused by the effects of disaster; unequal access to humanitarian assistance, in particular for displaced women; discrimination in the provision of assistance; sexual and gender-based violence, particularly in collective shelters or camps; infringements of the right to education; non-replacement of lost, confiscated or destroyed documents; economic and sexual exploitation of children in the absence of sufficient assistance; unsafe or involuntary returns or forced relocations to other parts of the country; or failure to restore property and reconstruct houses or provide compensation.

- At times, domestic authorities and other actors may wish to ensure assistance to their own constituencies, while "punishing" or neglecting others, such as populations perceived as being associated with political or military opponents or religious or ethnic minorities. In Nepal, only those displaced by the Maoists could register as internally displaced persons during the internal armed conflict (see E/CN.4/2006/71/Add.2, para. 22). In Colombia, the Representative received allegations that internally displaced persons registering for State assistance were often expected to attribute their displacement to insurgents (see A/HRC/4/38/Add.3, para. 31). In other contexts, humanitarian assistance is subject to conditions that are equally motivated by political aims but are not related to the characteristics of the populations in need. This was the case when, following the August 2008 conflict in the Tskhinvali Region/South Ossetia, no United Nations humanitarian actors had access to the area because the parties to the conflict sought to underline their respective claims to the territory by blocking the humanitarian access routes allowed by the respective opposing side.

- This mandate has been specifically tasked with addressing situations of internal displacement caused by natural disasters. It is an issue which the mandate has already done significant work on, most notably, in the form of the revised Operational Guidelines on the Protection of Persons in Situations of Natural Disasters, which have recently been adopted by the Inter-Agency Standing Committee (A/HRC/16/43/Add.5) and a thematic report on the protection of internally displaced persons in situations of natural disasters submitted to the Human Rights Council in 2009 (A/HRC/10/13/Add.1). At least 36 million people were displaced by sudden-onset natural disasters in 2008, including over 20 million displaced by climate-related, sudden-onset disasters, according to a report by OCHA and the Internal Displacement Monitoring Centre. This does not include slow-onset disasters such as drought and sea-level rise, which will also trigger important displacements. By contrast, 4.6 million people were newly internally displaced during that year by conflict and violence. As a further aspect of its work on internal displacement, this mandate will seek to address more specifically the human rights implications and dimensions of climate-induced internal displacement.

- Moreover, experiences of crisis, conflict and displacement often challenge existing notions of gender. While uprooted, many women take on new roles as leaders and breadwinners, which they sustain after displacement by, for example, developing new businesses and promoting peaceful coexistence at the grassroots level. However, many women struggle to preserve these advances upon return or resettlement, as they are often pressured to revert to traditional gender roles. Such changed gender roles can lead to increased incidents of domestic violence, particularly when men return to their families and communities and are not able to resume their traditional roles as breadwinners and head of the family. Hence, the importance of actively engaging men in order to achieve equitable humanitarian assistance and enhancing IDW participation and protection. Additionally, displaced and returnee women may be disadvantaged with regard to housing rights, be unable to gain security of tenure, and are often marginalized in the negotiation of land claims. Those with disabilities may also face particular obstacles to accessing durable solutions, including extreme marginalization in decision-making processes, lack of appropriate transportation and inadequate services and pervasive discrimination in return and resettlement communities.

- For more than 20 years, the mandate holders have consistently addressed urban displacement and its consequences and called for durable solutions during numerous country visits, including to Colombia (A/HRC/4/38/Add.3), Côte d'Ivoire (A/HRC/ 23/44/Add.1), East Timor (E/CN.4/2000/83/Add.3), Kenya (A/HRC/19/54/Add.2), Somalia (A/HRC/13/21/Add.2), the Sudan (A/HRC/23/44/Add.2) and, more recently, Haiti (report to be submitted to the Human Rights Council at its twenty-ninth session, in June 2015). They have also undertaken considerable work through law and policy support in Afghanistan, Kenya, Somalia and Yemen, considering the specific aspects of urban displacement, on particular matters such as eviction or relocation, notably in the context of climate change and slow-onset disasters that prompt movements of people to urban locations in search of livelihoods, security and safety (see A/66/285, para. 30). In previous thematic reports on a more systematized response to internally displaced persons outside camps (A/HRC/19/54) and the role of humanitarian and development actors in achieving durable solutions for internally displaced persons through peacebuilding in the aftermath of conflict (A/68/225), the Special Rapporteur has also considered other aspects further developed herein.

- In some cases, such as in Colombia, there are hundreds of associations of internally displaced persons, representing various communities of origin, women's groups or indigenous groups, among others. The Government has set up a consultative process with those associations that reaches out to such groups. The Government of Georgia has also engaged in widespread consultations with internally displaced persons (see A/HRC/26/33/Add.1). While not flawless, such processes represent a meaningful effort by Governments to consult internally displaced persons. Consultations can affect the attitude of the Government towards such persons, as was the case in Afghanistan. For example, until 2013, the authorities had not considered internally displaced persons to be permanent citizens of Herat, but, following the consultations, the political elites of the city now acknowledge the permanent settlement of those persons in the city. In a major breakthrough, the Government is now considering upgrading and regularizing the Maslakh settlement. Measures aimed at achieving durable solutions for internally displaced persons can therefore yield positive results when internally displaced persons are treated not as objects, but as active participants in the search for, and implementation of, durable solutions.

- The municipal authorities of Kabul and the Government are working with the Japan International Cooperation Agency to develop an urbanization plan for the building of new housing units over the coming eight years. The expected benefits include strengthened municipal capacity to manage urban development and deliver services; improved institutional coordination and monitoring of key urban indicators; increased access to basic services for urban households; phased regularization of tenure for 50 per cent of households living in informal settlements; upgraded public services and facilities, including new urban area development; increased availability of affordable shelters, including an increase of 50 per cent in the number of housing units and of 30 per cent in the area of serviced land on the market, coupled with access to affordable finance; and an improved urban environment with green areas and open spaces. It is to be noted, however, that, while internally displaced persons are expected to benefit from the initiative, the plan has been criticized for ignoring the informal settlements in which many live. Furthermore, it may be difficult to relocate internally displaced persons and other groups living in informal settlements en masse.

- Despite attempts to mainstream attention to gender, age and other elements of diversity, room remains for stronger links between gender and generation-sensitive analyses and interventions in support of IDPs. This is especially the case for adolescent girls, young and older IDW. The ageing of the global population points towards the need to integrate gender and generation-sensitive approaches to internal displacement more systematically, given the growing proportion of elderly displaced women, including widows, with particular capacities and protection and assistance concerns. These concerns may be particularly pronounced when older IDW take on the role of caregivers to children whose parents have died or moved elsewhere. Similarly, displaced girls are burdened with heavy household responsibilities, including domestic chores, such as fetching water and firewood and caring for younger siblings. This often results in young girls missing out on schooling and exposes them to increased protection risks. There is also a need for more concerted attention to the particular risks and challenges faced by IDW and girls with disabilities, including ensuring full access to and inclusion in humanitarian programmes and recognizing their skills and capacities.

- While donors play a critical role in financing and promoting durable solutions initiatives to resolve displacement, short-term funding cycles and stovepiped funding streams have also complicated cooperation between humanitarian, development and peacebuilding actors. In this context, what might be termed "donor champions" can lead the way in identifying flexible funding arrangements, incentivizing cooperation, applying diplomatic measures to help to overcome obstacles and ensuring that peacebuilding and development actors, including development banks, deal with displacement more systematically and concertedly. Improving donor practice requires engaging not only the branches of donor agencies dealing with humanitarian crises and multilateral agencies, but also those focused on bilateral agreements. The argument for incorporating internally displaced persons into development plans is often made, but rarely acted upon; donors can play a key role in breaking this trend by developing specific measures or procedures designed to actively encourage or require, depending on the context, the integration of displacement and durable solutions into these plans and bilateral cooperation agreements.

- In some situations, such as the Philippines, employment rates are in fact higher amongst IDW men, in part due to the fact that women benefit from greater freedom of movement because they are not seen as a threat by warring parties. IDW taking on new employment opportunities can result in increased tensions, particularly within families and between generations, as notions of pride, status and dignity are perceived to be challenged. These women may face increased pressure and strain, particularly if men do not shift roles to take on more domestic work. However, new livelihood opportunities can strengthen the confidence, leadership skills and influence of IDW. To maximize these benefits, the skills and resources of IDW should be fully recognized and more systematically supported. This entails rectifying the "pervasive biases", which, as the Secretary-General has highlighted, result in resources for initiatives such as post-conflict livelihoods programmes being directed "overwhelmingly towards men". Livelihood programmes for IDW should further be designed to be safe and sustainable, and protect women against unintended protection consequences, including elevated risks of SGBV.

- Despite the unprecedented global displacement figures, much internal displacement goes unacknowledged, unrecorded and is not responded to by Governments and the international community. Hundreds of thousands of those who are entitled to protection and assistance as internally displaced persons under international standards are left to fend for themselves. A protection gap exists for many internally displaced persons globally who are the victims of causes of displacement that include generalized and criminal violence, discrimination and other human rights violations, development projects and business activities, or other neglected factors. These factors result in internally displaced persons who are uniquely vulnerable, outside of camps or other support and assistance settings, hosted by local communities and families, and frequently "invisible" and impoverished in urban settings. Failure by Governments to identify them as internally displaced persons leaves many unable to access assistance and support. Denial or neglect of the problem of internal displacement often means that, at the national level, no protection or support mechanisms exist.

- In 2006, however, the Guiding Principles would assume a new legal stature in the context of Africa, when member States of the International Conference on the Great Lakes Region established a legal framework for the formal legal adoption and implementation of the Guiding Principles. As part of the Conference process, 11 States of the Great Lakes region of Africa adopted in 2006 a binding Pact on Security, Stability and Development in the Great Lakes Region, with 10 separate protocols, including two which recognize the importance of the Guiding Principles on Internal Displacement, namely the Protocol on the Protection and Assistance to Internally Displaced Persons and the Protocol on the Property Rights of Returning Persons. The Protocol on Internally Displaced Persons, which entered into force in June 2008, obliges member States of the International Conference on the Great Lakes Region to enact national legislation to domesticate the Guiding Principles fully and to provide a legal framework for their implementation within national legal systems (art. 6.3) and to ensure the effective participation of internally displaced persons in developing such legislation (art. 6.5).

- The Protocol on Internally Displaced Persons served as an impetus for the African Union to draft the African Union Convention for the Protection and Assistance of Internally Displaced Persons in Africa (the Kampala Convention). A watershed in international law for the protection of internally displaced persons, the Kampala Convention was adopted by the African Union at its first ever Special Summit on Refugees, Returnees and Internally Displaced Persons, held in Kampala in October 2009. Developed over a five-year period, a process to which this mandate contributed at the request of the African Union, the Kampala Convention incorporates the Guiding Principles and sets out obligations for States parties, the African Union and humanitarian agencies in relation to all phases of displacement.

- During his recent country visit to Kenya in September 2011, the Special Rapporteur found that of an estimated 664,000 IDPs resulting from the 2007/2008 post-election violence in the country, over 300,000 had dispersed into the wider population (many in towns and cities) and neither been registered nor assisted by the State. Many displaced in previous cycles of displacement (e.g.1990s) in Kenya were also unassisted. While it is generally presumed that these IDPs found their own solution through host families and friends, the Special Rapporteur remains concerned that many of these IDPs, a large part of whom had already been poor, had seen their situation further deteriorate and could be living in urban slums or on the street. In this regard, the Special Rapporteur received reports of a significant increase in street children, many of whom were believed to be IDPs, in a number of large towns and cities since the 2007/2008 post- election violence.

- Tensions may also arise due to perceptions by host communities that their own needs are being neglected or that IDPs are receiving preferential treatment. A recent study in two urban neighbourhoods in Bogota, Colombia, found tensions between host communities and IDPs, due largely to IDPs being regarded as receiving preferential treatment in a context of widespread urban poverty. In Guinea, host communities struggling to rebuild after attacks on their community, became increasingly vulnerable as they shared meagre resources with IDPs. While some of these challenges can also arise in the context of IDP camps, IDPs who live within the community will be especially affected given their level of dependency on informal community support. In this respect, a greater focus on assisting host communities in tandem with IDP assistance in order to prevent tensions, inequalities or the increasing vulnerability of hosts is a challenge for both development and humanitarian actors.

- Efforts to address displacement as a development concern have sometimes been stymied by debates over whether it is appropriate to target internally displaced persons and/or to undertake area-wide efforts that include internally displaced persons but do not target them specifically. Assessments conducted by UNDP in Georgia and the World Bank in Afghanistan, for example, have determined that internally displaced persons do face particular development needs relating to issues such as housing and tenure security. Meeting such needs in a targeted manner, while integrating internally displaced persons into broader development and peacebuilding plans, is conducive to achieving development goals and consistent with an approach based on human rights. Internally displaced persons also face a number of other particular challenges requiring specific and targeted measures, such as with regard to the issuance or replacement of personal documents, compensation for or restitution of property, family reunification and assistance in ensuring access to public services, among others. Ensuring that such targeted measures are in place, and that development and peacebuilding programmes, in addition to broader programmes such as those relating to poverty reduction and land reform, include internally displaced persons and support durable solutions, can make significant contributions to reducing fragility and poverty. In addition, ensuring that the needs of host or receiving communities are also factored into durable solutions strategies is important for the viability of programmes and to reduce possible community tensions. As questions of State fragility are integrated into mainstream development debates, including in the context of the negotiation of the post-2015 development agenda, it is essential that the concerns facing internally displaced persons and refugees be appropriately and equitably integrated.

- An integrated analysis of these tools underscores the need for the development of durable solutions strategies to become a routine element of international responses to crises involving displacement. The development and implementation of these strategies should cut across sectors and be participatory, involving a wide range of international agencies, national and local authorities, non-governmental organizations and representatives of returnee, internally displaced and displacement-affected communities. Durable solutions strategies should deal equitably with the rights and specific needs of displacement-affected communities and be localized in order to ensure that they are appropriately inclusive and maximize the capacities and coping strategies of displaced persons. An approach based on human rights underscores that durable solutions strategies must respect the rights to freedom of movement and choice of residence. Such an approach also brings into focus concerns that must be addressed in order to achieve development goals in displacement-affected communities, such as ensuring equal and non-discriminatory access to education, health services, livelihoods, land, property rights and equality before the law. Transitional justice, peacebuilding, reconciliation, rule of law and security reform and land reform efforts are also highly relevant to durable solutions to displacement, underlining the need to include considerations of internally displaced persons and the participation of displacement-affected communities in these processes.

- Despite these developments, in many cases responses to internal displacement still do not adequately address the concerns of women, who account for some 50 per cent of IDPs. As IDPs, women experience the various human rights challenges characteristic of displacement situations generally, and which often place IDPs at greater risk than most other affected populations. These frequently include: loss of livelihoods and key documentation, and lack of effective access to a number of important rights and services. Existing patterns of discrimination prevalent in many of these contexts are exacerbated during conflict and contribute to violations of women's rights to housing, land and property. IDW also often experience human rights challenges due to interlinked forms of discrimination based on gender, and intersection of gender with other factors such as age, group affiliation (e.g. membership in minority groups), disability, civil status, socioeconomic status and displacement itself. Particular groups or categories of IDW can therefore be especially at risk, while the particular risks encountered by IDW vary depending on the displacement context (e.g. emergency situations, protracted displacement situations, camp settings, etc.). The Council expressed "particular concern at the grave problems faced by many displaced women and children, including violence and abuse, sexual and labour exploitation, trafficking in persons, forced recruitment and abduction" (resolution 14/6). Other major human rights concerns include inequitable access to assistance, education, training and livelihoods; poor reproductive health care; and exclusion from decision-making processes.

- Modest - and not yet entrenched - advances have been achieved in integrating women into assistance distribution systems, and implementing fuel strategies to reduce displaced women's exposure to violence when they collect firewood. Limited gains in upholding housing, land and property rights of IDW have been achieved in some instances through measures such as the provision of legal aid to returnee women. Likewise, the participation of IDW in decision-making processes has increased in some countries, including through the development of strong associations of IDW, for example in Colombia and the Philippines. In 2011, UNHCR convened its second global dialogue with women and engaged IDW in this process for the first time. Despite persistent constraints, some progress has been made in collecting disaggregated data in conflict and post-conflict situations, including through the establishment of JIPS, which collects data disaggregated by age, sex and location, as well as other indicators such as the provision of protection of and assistance to IDW, their housing, land and property rights.

- The challenges posed by unequal and discriminatory access to education, health services or employment are protection risks regularly faced by internally displaced persons in urban areas and may sometimes be compounded by the lack of individual documentation. The loss or lack of documentation in urban contexts can further exacerbate the already-dire situation of internally displaced persons, given that, without identification, it is generally impossible to sign a lease, seek formal employment or even gain legitimate access to a mobile telephone or the Internet. In some countries, such as Côte d'Ivoire, internally displaced persons are put at risk of statelessness. - Pastoralism in Africa is characterized by a high reliance on livestock as a source of economic and social well-being, and various types of strategic mobility to secure access to water and grazing resources in areas with a high degree of rainfall variability. Pastoralism is found in all regions of Africa, where, in some regions, it is the dominant livelihood. In 2010, pastoral areas were known to occupy some 40 per cent of African land mass. Contrary to assumptions and despite their tradition as nomads, pastoralists do suffer from arbitrary displacement. Displacement of pastoralists is closely linked to the loss of livestock and of access to markets. All causes of internal displacement identified in the Convention can be causes of forcible internal displacement for pastoralists.

- The Convention has made important advances in articulating the right to be protected from arbitrary displacement by elaborating a number of acts that may cause it. While international human rights law does not clearly spell out the right not to be arbitrarily displaced, some components of this right are to be found in the right to freedom of movement and residence, the right to privacy, the right to choose one's own residence and the right to adequate housing. The prohibition of arbitrary displacement has also been addressed to an extent in international humanitarian law. Article 49 of the Fourth Geneva Convention, relative to the protection of civilians in time of international armed conflict, prohibits "individual or mass forcible transfers" as a grave breach of international humanitarian law. This prohibition was later extended to non-international armed conflicts when the second additional Protocol to the Geneva Conventions. State practice establishes these rules as norms of customary international humanitarian law applicable in both international and non-international armed conflicts.

- In addition, a campaign was launched regarding the rights of internally displaced persons to land tenure in Boosaaso. Consequently, landlords entered into an agreement with local authorities and representatives of various displaced groups, which opened the door to upgrading the settlement and included simple principles preventing ad hoc evictions. The campaign mobilized local authorities and traditional/religious leaders to define what would no longer be acceptable in the community. It focused on the positive contribution of internally displaced persons to the local economy and the impact on the host community of unhygienic conditions and heightened fire risks.

- Even before Nigeria ratified the Kampala Convention in April 2012, the Nigerian authorities were taking steps to better coordinate their response to internal displacement. In 2003, a committee was established to draft a national policy on internally displaced persons to define the role and responsibilities of State agencies and of civil society organizations. The draft policy was presented to the Government in 2011, and was subsequently revised and reviewed by multiple stakeholders. - Those States with a history of displacement due to disaster or with histories of internal conflict should be proactive and have displacement preparedness measures in place. Where the occurrence of disaster is cyclical, adequate preparedness and mitigation measures must be explored to prepare for potential displacement flows. The Cancun Adaptation Framework, adopted by the Conference of the Parties to the United Nations Framework Convention on Climate Change, held in Cancun, Mexico, in 2010, invites Parties "to strengthen and, where necessary, establish and/or designate national-level institutional arrangements, with a view to enhancing work on the full range of adaptation actions, from planning to implementation". These include displacement-related adaptation measures. During his visit to South Sudan, the Special Rapporteur called on the authorities to explore and implement effective disaster risk reduction and mitigation measures, especially in areas prone to repeated disaster (A/HRC/26/33/Add.3).

In cases of large-scale displacement, the capacity of existing health-care services is often inadequate to respond to the psychological and physical health-care needs of IDPs. In urban settings, the challenges are also acute and include lack of capacity of health-care services, and challenges relating to documentation and possible discrimination. The costs of services and medicines frequently put adequate health care out of the reach of IDPs.

- The challenges facing IDPs have long been recognized internationally. In 1998, Kofi Annan, then United Nations Secretary-General, noted that internal displacement had emerged as one of the great human tragedies of our times and that internally displaced people were among the most vulnerable of the human family. - A durable solution cannot be said to have been achieved if internally displaced persons cannot enjoy physical safety and security and cannot benefit from the effective protection of national and local authorities, including protection from the threats that triggered the initial displacement or that may cause renewed displacement. - Mechanisms to replace lost or other documents should be established at the earliest opportunity. The lack of documentation can be a major barrier to registration, free movement or the ability to access benefits and other assistance. Mechanisms should be accessible and affordable to all internally displaced persons, regardless of their displacement situation. The establishment of local or mobile documentation services may be required. During his follow-up visit to Côte d'Ivoire, the Special Rapporteur called for the rapid implementation of the law on the registration of births and deaths, which provides for free-of-charge registration. This law is crucial as many children, most of them internally displaced persons, were not registered in the period following the last national elections. In addition, some 80,000-120,000 civil records were destroyed during the crisis.

- In December 2012, the African Union Convention for the Protection and Assistance of Internally Displaced Persons (the Kampala Convention) entered into force. The first legally binding instrument specifically for IDPs, it sets obligations for States in their responses to internal displacement and aims to "establish a legal framework for preventing internal displacement, and protecting and assisting internally displaced persons in Africa". So far, 24 African Union member States have ratified and a further 37 have signed the Convention. - [Putting the most vulnerable people first was a major Summit theme, with the objective of leaving no one behind, which was one of five key responsibilities identified in line with the 2030 Agenda. - The potential of the Global Cluster on Early Recovery to help internally displaced persons move beyond aid dependency has yet to be fulfilled. The early recovery and livelihood sector is consistently neglected and underfunded. A Brookings Institution report found that, in three countries studied with protracted displacement, namely, Somalia, Colombia, and the Democratic Republic of the Congo, the early recovery cluster was not active, despite obvious opportunities for early recovery programmes. - To prevent and improve responses to internal displacement, it is imperative to have comprehensive and reliable information upon which to base both humanitarian and development interventions. This includes baseline data from which to make informed decisions, measure progress, create data tracking and monitoring mechanisms, and comprehensive trends analysis. Reliable data and evidence are a precondition for good policy and programming and are vital for strengthening coordination and collaboration between different actors. Many States lack accurate information about the number, profile and needs of internally displaced persons. Globally, the available figures on displacement do not reveal the full picture. As IDMC points out, current global estimates indicate only the scale of displacement caused by conflict and yearly estimates of disaster-induced displacement. Serious gaps exist in data on those displaced by disasters. Slow-onset disasters, development projects and generalized violence constitute significant data blind spots.

- While displacement due to development is commonly associated with major projects, such as dams, numerous activities cause displacement annually, including mining and extractive industries, logging, pipelines, national parks and conservation projects, port or military installations, sports projects and events, industrial plants and urbanization and infrastructure projects. Small-scale development projects can be just as damaging as larger-scale projects and are often harder to identify and monitor. While some projects meet international standards of consultation prior to displacement and compensation, resettlement and rehabilitation when displacement takes place, many fail to do so. Those affected are often poor, belong to marginalized or indigenous groups and lack political representation or an equal voice in decision-making.

- This is not often the case; compensation is often pitiful and unable to sustain livelihoods and the responsibility to ensure that development-induced displacement leads to a durable solution by relocation or settlement elsewhere in the country is avoided. Development-induced displacement and resettlement processes have resulted in landlessness, joblessness, homelessness, marginalization, food insecurity, increased morbidity and mortality, loss of access to common property and ancestral lands and social disintegration, and have a cumulative impact seen in massive impoverishment and even death.

- While there is general agreement on the need to engage and involve development actors in displacement responses at an earlier stage, this must be informed by data and analysis to best identify where, when and how development actors should intervene to best effect. Improving "development-relevant" data and analysis on displacement will help to justify or trigger a more "displacement-sensitive" development approach in affected countries. While it remains difficult to generate an analysis that serves the information needs of all actors and to reach agreement on evidence-based priorities for response through genuinely collaborative efforts, this has been achieved in several contexts including integrating displacement issues into national development plans. A recent profiling exercise in Mogadishu, supported by JIPS, is a good example of this.

- National responses to internal displacement are often not integrated into national action or development plans. They are often ad hoc and conducted without clear time frames or long-term strategies or budgets in place. Attention may wane over time, resources may diminish and initial plans are revised or go unimplemented. In some cases displacement becomes protracted and transitional solutions become permanent. The political will and programme momentum may dissipate or disappear leaving internally displaced persons abandoned. Maintaining attention and resources through to the completion of durable solutions would benefit greatly from the establishment of national action plans under the framework of the Summit goal to reduce internal displacement by 2030.

- All countries, particularly those in which there has been a history of violence, ethnic, religious or political tensions or other factors leading to population movements, should remain vigilant to the possibility of forced or arbitrary internal displacement due to general violence, even in the absence of armed conflict, and ensure that they respond appropriately and according to international standards to prevent and respond to such internal displacement. In this regard, social and statistical research should be undertaken to reveal the causes, extent and dynamics of displacement and to determine the profiles of victims. Following this, information campaigns should be considered to inform persons who may have been forcibly or arbitrarily displaced about their rights as internally displaced persons and protection and assistance measures available to them.

- In some situations, internal displacement disproportionately affects certain communities that, due to their characteristics, geographical location, poverty, discrimination or other unique circumstances, make them particularly vulnerable to internal displacement. Such groups may include indigenous peoples and ethnic, religious or other minorities, who are frequently numerically few relative to majority communities, among the poorest, and who may experience different forms of marginalization and commonly lack representation in political or other State bodies. In some cases they may face long-standing discrimination and violence targeted against them. Such population groups are often overrepresented in internally displaced person populations.

- These and other factors may make certain marginalized communities vulnerable to violent displacement in situations of conflict and intercommunity or interfaith tensions or result in their being poorly equipped to resist efforts to displace them from their lands due to development or business activities. Greater research and data is required globally to reveal the full impact of displacement on such communities, as well as regional trends, patterns and dynamics of displacement. In particular, this makes it necessary to disaggregate data not only by sex and age but also by diversity categories, such as ethnicity and religion, that should be determined by contextual realities. Such information, fully adhering to international standards of data protection and use, would help to predict and prevent displacement targeted against certain communities and contribute to much needed displacement risk assessment and early warning mechanisms.

- The Special Rapporteur is concerned that his engagement with internally displaced persons in numerous country situations reveals a general lack of meaningful consultation with them; they lack a voice and, when they speak or claim their rights, they are not heard. Such persons frequently stated that they are poorly consulted, rarely visited by officials or provided with adequate information about the options available to them or plans being formulated for their shelter, locations or time frames for their return or resettlement. Internally displaced persons frequently stated that they lacked opportunities to participate in decisions affecting them. Consultation and participation is a right of those persons and is essential to ensuring that solutions for them are appropriate, informed, acceptable to communities and sustainable.

- In the Syrian Arab Republic and Iraq, visited by the Special Rapporteur in May 2015, the targeting of Christians, Yazidi and other smaller ethnic and religious communities by the so-called ISIL has been evident and well documented. They have experienced targeted violence and displacement on the basis of their belonging to certain ethnic or religious groups. In some cases, internal displacement may have been arbitrary, amounting to ethnic cleansing, crimes against humanity or atrocity crimes, and has included the cultural destruction of monuments and places of worship with the objective of permanently removing communities from those regions. Equally, in numerous other regions, discrimination against certain groups in society may reach such levels that it results in hate-based crimes and internal displacement that does not take place in a context of armed conflict.
