States should ensure that workers' rights of people of African descent, including those relating to fair and equal wages, are protected, by increasing the effectiveness of legislation that prohibits all discriminatory practices in employment and the labour market that affect people of African descent, including through the implementation of special measures to promote the employment of people of African descent in public administration, as well as in private companies, including affirmative action policies such as quota systems.

- Women's access to health services in many countries is not autonomous, affordable and effective, elements which are essential for States to respect, protect and fulfil women's and girls' rights to life, health, privacy, equality and human dignity. A major barrier is lack of affordability as a result of exclusion from insurance for treatments specifically needed by women and girls or exclusion of groups of women such as migrants. Non-affordability severely discriminates against women living in poverty. Barriers also include restrictive legislative requirements, biased and stigmatized provision of services and conscientious objection to providing services.

- However, the Special Rapporteur is convinced that the human right to education for migrants, refugees and asylum-seekers should not be contentious. Nevertheless, this right is sometimes disputed. The dispute centres upon the nature of the right itself. Despite being an “enabling right”, the right to education has become a de facto derivative right; just as, for instance, the right to development, economic security and the right to life per se are subordinated to the primary rights of private property and the profit rate. This situation highlights the two conflicting (and irreconcilable) legal regimes for education: on the one hand, international human rights law defines education as a human right, while on the other hand, international trade law views education as a service, i.e. a commodity. The latter regime offers little scope for advancing mechanisms for realizing the objectives of a human rights responsive education system.

- [Regarding the legal and normative framework, the Special Rapporteur is of the view that:] • As the International Conference on Population and Development (1994) identified migration as a consequence of significant global economic transformations, the Special Rapporteur is particularly concerned by the fact that half of the world’s out-of-school children — 39 million — live in conflict-affected areas. Moreover, as 80 per cent of all refugees are hosted by countries of the developing world, which figure shows that a disproportionate burden is carried by those least able to afford it, increased international cooperation and sharing of responsibility is required, as called for in the International Covenant of Economic, Social and Cultural Rights and the Dakar Framework for Action adopted by the United Nations Educational, Scientific and Cultural Organization (UNESCO) in 2000. As underdevelopment is a “principal root cause” of migration, helping Governments to realize the right to development becomes imperative.

- Basic protections are critical to an effective right to freedom of expression, accountability and democratic governance. Individual cases of disproportionate treatment and retaliation against sources and whistle-blowers have been in the public eye over recent years, relating to intelligence agencies, asylum programmes, public health, environmental protection, corruption in the business and financial sectors, international organizations and many other domains. The Special Rapporteur has avoided mentioning specific cases in the present report. Moving forward, the principles identified in the present report will be applied in communications with Governments and international organizations on specific cases. - The right of everyone to the enjoyment of the highest attainable standard of health encompasses access to medical services and the underlying determinants of health, such as water, sanitation, non-discrimination and equality. As access to medicines is an integral and fundamental part of the right to health, Governments and the international community as a whole have a responsibility to provide access to medicines for all. Yet massive inequalities remain in access to medicines around the world, as up to 2 billion people (or one third of the world's population) lack access to essential medicines. Most of them live in low- and middle-income countries, where the needs of persons living in poverty, women, children and undocumented migrants, as well as other marginalized and vulnerable groups who are often discriminated against in terms of access to medicines, are ignored or underestimated.

- Migrants, however, have a number of rights in their country of destination that must be recognized and respected by public authorities and private individuals. Regardless of their immigration status, all migrants must be afforded essential levels of protection with regard to their access to adequate housing and living conditions. Accordingly, States are under the obligation to adopt all necessary measures to progressively ensure the realization of the right of non-citizens under their jurisdiction to adequate housing and to protect them from discriminatory, unfair and degrading treatment. It is worth recalling that, as part of their core obligations and with immediate effect, Governments should ensure access to basic shelter and housing to all migrants in their territory. To fulfil this obligation, the Special Rapporteur provides a number of recommendations.

- States should elaborate and adopt a national housing strategy that establishes the objectives and available resources, time frame and responsibilities for the development of appropriate housing conditions that include the needs of migrants. In addition, States should ensure that laws, strategies and plans of action are implemented in such a way as to address discrimination by public and private actors, in particular with regard to the right to adequate housing, and take account of the situation of documented and undocumented migrants. State policies should include special measures and incentives to change the attitudes of public and private actors towards migrants. States should frequently review the regulations governing housing allocation in the public and private spheres and adopt effective inspection and enforcement mechanisms.
