- States should prioritize social protection policies to ensure the well-being of children and adolescents with disabilities and their families; to enable them to realize their full potential through inclusive and adequate services and support measures (especially in the education and health sectors); and to combat poverty. In effect, families with children with disabilities are disproportionately more likely to fall below the poverty line, as disability in childhood is often the catalyst for poverty owing to disability-related extra costs, family break-ups and unemployment following the onset of disability. Poverty, in turn, remains the main cause of malnutrition, school dropout, abandonment and institutionalization of children with disabilities. States should adopt inclusive and barrier-free social protection systems as they can have a life-changing impact on children and adolescents with disabilities.

- [The Special Rapporteur will be guided by the following overarching considerations in all aspects of her work:] Inclusiveness. The Special Rapporteur will work in an inclusive manner, aiming to ensure that the needs and concerns of persons with all different kinds of impairment are taken into equal consideration and that her work is age-sensitive, paying special attention to children, adolescents and older persons with disabilities. She will be attentive to the specific situation of persons with disabilities who may be subject to multiple or aggravated forms of discrimination on the basis of race, colour, sex, language, religion, political or other opinion, national, ethnic, indigenous or social origin, property, birth, age or other status, and the multiple layers of barriers that these intersections may create. She will also work across social and economic groups and layers and do her utmost to ensure that no one is left behind in her deliberations.

- International cooperation can play a crucial role in the implementation of support systems. Donor countries and international organizations should consider increasing funding for the design and development of sustainable national support systems and securing the necessary funds to implement development aid inclusive of the support arrangements required by persons with disabilities. For example, when funding national education systems, donors should take into account the obligation to provide support to children and adolescents with disabilities within the general education system to facilitate their effective education.

- School-related gender-based violence takes different forms, with girls in some countries violently targeted for attending school, while in other countries, they are subject in school to sexual violence or harassment, including by teachers. Such violence results in trauma, stigmatization and sometimes pregnancy, and severely curtails girls' educational opportunities. In many States, sexual intercourse with a minor is considered rape, as minors are not capable of consent, but only 32 out of 100 States have specific provisions on sexual harassment at schools. Examples of good practices by some States include introducing confidential school reporting mechanisms, capacity-building for police, child-friendly courts, a public register of sexual offenders and barring sexual offenders from teaching.

- Many girls are exposed to a wide variety of practices which are harmful to their health and well-being, such as female genital mutilation, discrimination in food allocation resulting in malnutrition and discrimination in access to professional health care. Furthermore, early marriage and adolescent pregnancy have a long-lasting impact on girls' physical integrity and mental health. Pregnancy and childbirth are together the second leading cause of death among 15- to 19-year-old girls globally, putting them at the highest risk of dying or suffering serious lifelong injuries as a result of pregnancy. For example, up to 65 per cent of women with obstetric fistula, which is a severely disabling condition and often results in social exclusion, develop this condition as adolescents.

- Overmedicalization may result in reduced access to or affordability of services needed by women and a barrier to developing adequate alternative services which can be competently provided by nurses, midwives or auxiliary nurses, either at clinics or at home. Such "task shifting", particularly in places where there are few qualified doctors, would make services more accessible. Similarly, restricting authorization for the use of contraceptives to a medical practitioner is a barrier to access. Allowing pharmacists to provide contraceptives, including emergency contraceptives, over the counter is essential for effective availability, especially for economically disadvantaged women or adolescent girls.

- A growing number of States worldwide have confirmed their commitment to comprehensive sexuality education as an essential priority for achieving national development, health and education goals. In its resolution 70/137, the General Assembly called upon all States to develop and implement educational programmes and teaching materials, as well as teacher education and training programmes for both formal and non-formal education, including comprehensive evidence-based education on human sexuality, based on full and accurate information, for all adolescents and youth; to modify the social and cultural patterns of conduct of men and women of all ages; to eliminate prejudices; and to promote and build decision-making, communication and risk reduction skills for the development of respectful relationships based on gender equality and human rights.

- However much we try to avoid it, we are always sexually informed, by action or by omission, at school, in the family, through the media, etc. Thus deciding not to offer sexual education at teaching centres is opting for an omissive form of sexual education, that leaves girls, boys and adolescents on their own as regards the type of knowledge and messages, generally negative, that they receive on sexuality. When sexual education is not explicitly provided, in practice education follows the so-called hidden curriculum, with its potential load of prejudices and inaccuracies over which there can be no social or family criticism or control.

- United Nations treaty bodies have viewed the lack of access to sexual and reproductive education as a barrier to compliance with the State's obligation to guarantee the rights to life, health, non-discrimination, education and information. For example, the Human Rights Committee has urged the removal of barriers to access by adolescents to information about safer sex practices, such as condom use. The Committees have also identified sexual education as a means of guaranteeing the right to health as it helps to reduce the maternal mortality, abortion and adolescent pregnancy rates and the prevalence of HIV/AIDS.

- States are required to provide comprehensive sexual education to their people, especially children and adolescents, in compliance with the standards of availability, accessibility, acceptability and adaptability established by the Committee on Economic, Social and Cultural Rights as regards the right to education. This is a State obligation of due diligence since, under international law, States must show that they have taken all the measures of a preventive nature that are necessary to fulfil their obligations to guarantee the right to health, life, non-discrimination, education and information by eliminating barriers preventing access to sexual and reproductive health and by providing in schools and other educational facilities comprehensive education for sexuality giving precise, objective and unbiased information. The Declaration "Preventing through education", signed by the Ministers of Health and Education of Latin America and the Caribbean in 2008, is a good example of recognition of States' obligation of due diligence in this regard.

- According to the International Bureau of Education, HIV/AIDS is a mandatory subject in primary education in 10 of the 18 countries in sub-Saharan Africa. However, in many African countries, adolescents have no access to information on sexuality. On the basis of a number of studies carried out in the region, it is estimated that almost half of the people who have received sexual education received no information on topics considered to be of key importance (contraception, pregnancy and pregnancy prevention, sexually transmitted diseases and the right to say no to sex). In the vast majority of cases, sexual education is provided through lectures; only in a few cases are more effective tools, such as interactive or group activities, used.

- Violence against women is another pandemic that affects the whole of humanity. It is estimated that at least one in three women throughout the world has been beaten, subjected to sexual violence or abused in some way in the course of her life. Consequently, the Special Rapporteur considers that the empowerment of women, of which sexual education forms an essential part, is a powerful defence against violation of the human rights of girls and adolescent women. In addition, men who receive appropriate sex education acquire values of solidarity, justice and respect for the integrity of others and are therefore less likely to resort to sexual or gender-based violence.

- Although fathers and mothers are free to choose the type of education that their sons and daughters will have, this authority may never run counter to the rights of children and adolescents, in accordance with the primacy of the principle of the best interests of the child. Particularly in the case of sexual education, people have the right to receive high-quality scientific information that is unprejudiced and age-appropriate, so as to foster full development and prevent possible physical and psychological abuse.

- The Convention of the Rights of the Child establishes, in article 28 (b), that States shall "encourage the development of different forms of secondary education, including general and vocational education". The Committee on the Rights of the Child has stressed the importance of providing vocational training at the end of compulsory education at the age of 12. It has also underlined the need to ensure the availability of vocational training opportunities for all children and adolescents on an equal basis for boys and girls, with priority given to children from vulnerable groups and children who dropped out of (primary or secondary) school. The Committee has put focus on those children who "left school without certificates, enabling them to acquire competencies and skills in order to enhance their work opportunities".

- Second, the focus on pregnant and lactating women and infants in some recent nutrition initiatives, while understandable, should not lessen the need to address the nutritional needs of others, including children, women who are not pregnant or lactating, adolescents and older persons. The right to adequate food, which includes adequate nutrition, is a universal right guaranteed to all. This pleads in favour of broad-based national strategies for the realization of the right to food that address the full range of factors causing malnutrition, rather than narrowly focused initiatives that address the specific needs of a child's development between conception and the second birthday.

- Courts may contribute to strengthening benefits into legal entitlements. Following the filing of the public interest litigation Petition (Civil) No. 196/2001, People's Union for Civil Liberties v. Union of India and Others (PUCL), the Supreme Court of India derived from the right to life mentioned in article 21 of the Constitution a series of requirements articulating how various social programmes should be expanded and implemented in order to ensure that the population is guaranteed a basic nutritional floor. This is to this date the most spectacular case of a court protecting the right to food. The Court prohibited the withdrawal of the benefits provided under existing schemes, including feeding programmes for infants, pregnant and nursing mothers and adolescent girls; midday school meal programmes; pensions for the aged; and a cash-for-work programme for the able-bodied, thus converting such benefits into legal entitlements. Moreover, the Court expanded on and strengthened existing schemes, to ensure that they provide effective protection against hunger. For instance, it ordered that school meals be locally produced and be cooked and hot, whereas in the past children were fed with dry snacks or grain, and that preference be given, in the hiring of cooks, to Dalit women; it raised the level of old-age pensions; and, consistent with the idea that the schemes implement a constitutional right, it ordered their universalization, significantly expanding the number of beneficiaries. To supervise the implementation of its orders, the Court also established two independent Commissioners to monitor the implementation of programmes fulfilling the right to food throughout the country.

- Advertisements influence people's food preferences and habits. Recognizing that children are especially exposed to aggressive marketing and promotion strategies by food and beverage companies, some States prohibit media advertising to children for certain "restricted" food and drink products. In Chile, for example, where children form more than 20 per cent of the audience, mandatory regulations restrict advertising to children under 14, while Taiwan Province of China bans the advertising of restricted foods on channels dedicated to children, levying fines for violations of its regulations. Brazil imposes strict regulations, prohibiting any "abusive publicity" and strategies that appeal directly to children and adolescents. In practice, however, there seem to be many difficulties in implementing such restrictions.

- Furthermore, girls and adolescent women induced by tradition or forced into child marriage and adolescent pregnancy, suffer the consequences of a high work burden and deprivation of their child rights, including their right to adequate nutrition and education. They are required to perform heavy amounts of domestic work, and are responsible for raising children while still children themselves. Adolescent pregnancy is a typical outcome of child marriage and complications during pregnancy and childbirth are the second cause of death for 15-19 year-old girls globally.

- The reasons behind the failure to women's access to adequate food can arguably be linked to two structural disconnects which exist at the crossroads between Women's Rights and the Right to Food. The first disconnect refers to the failure in international law to fully endow women with their right to food. In the Universal Declaration on Human Rights (UDHR) and the ICESCR, the right to food is accorded to himself and his family. Although the ICESCR General Comment 12 and other documents have underscored the non-discriminatory intention of the right to food, the archaic language of patriarchy taints the UDHR and treaty language. Concurrently the economic and social rights of the ICESCR are generally reviewed in CEDAW, but not the right to food, which is indirectly touched upon only through a call for rural women. In CEDAW, as in the Convention of the Rights of Child (CRC), food access and adequacy for adult women and teenage girls are addressed only on behalf of pregnant and breastfeeding females .

- In other cases, intermediary liability is imposed through privacy and data protection laws. For example, a court in Italy convicted three Google executives for violating the Italian data protection code after a video depicting cruelty to a disabled teenager was posted by a user on the Google video service. Even though the video was taken down within hours of notification by Italian law enforcers, the judge found the Google executives guilty. The Government of China requires ISPs and web platforms to conduct surveillance on their users, and they are also held directly responsible for content posted by users. Companies that fail to comply with this obligation risk losing their business licences. Holding intermediaries liable for the content disseminated or created by their users severely undermines the enjoyment of the right to freedom of opinion and expression, because it leads to self-protective and over-broad private censorship, often without transparency and the due process of the law.

- There is no reference in article 13 to the child's evolving capacities, nor is a minimum age or a certain degree of maturity for the exercise of the right to freedom of expression fixed. In this sense, freedom of expression has been regarded as having a developmental aspect, since its aim is to enable children to develop their minds and themselves in society with others and grow into citizens participating in public life. Children's freedom of expression does not - and cannot - start when children become capable of expressing their views autonomously or become teenagers; they cannot be expected to develop as autonomous beings and participants in society at the magical age of 18 years without having had the opportunity beforehand.

- The effects of limits on children's right to freedom of expression spill out of the school gates into public life. Children, just as adults, may be subject to excessive violence or arbitrary detention for expressing political views. For example, the Committee on the Rights of the Child recently highlighted such violations to the Syrian Arab Republic in relation to the arrest and incommunicado detention of a group of children between 8 and 15 years of age accused of painting anti-government graffiti on a school wall in the southern town of Dara'a (see CRC/C/SYR/CO/3-4, para. 46). It also expressed its concern to Belarus about the detention of adolescents during demonstrations held in the context of presidential elections in December 2010 (see CRC/C/BLR/CO/3-4, para. 35).

- Empowering children must include training parents and professionals who work with children to support them in using the Internet, keeping in mind their evolving capacities. A positive way to introduce online safety and information beneficial to the development of children is through school curricula, including by involving children in the development of school policies on information and communications technologies. Non-governmental organizations and public communications such as radio messages can provide similar support to children who are not in school. Some examples of child safety initiatives are SaferNet Brasil, the Slovak Safer Internet Centre and Manos por la Niñez y Adolescencia (Hands for Children and Adolescents) in the Bolivarian Republic of Venezuela.

- Article 20 (2) provides for restrictions with respect to hateful advocacy that amounts to incitement to hostility, discrimination or violence; it does not permit restrictions merely on the basis of "incompatibility" with a particular faith's values, nor does it (or article 19) permit restrictions that amount to blasphemy as such. Nonetheless, Maldives enacted a law in 2016 that criminalizes speech not expressed in accordance with social norms, national security and Islam. Singapore noted that a teenager was convicted under national legislation "for posting a video containing remarks against Christianity with deliberate intent to wound the religious feelings of Christians". While "wounding religious feelings" may involve real emotional costs, such charges have no basis under international human rights law and limit without justification the sharing of information and ideas pertaining to religion and belief.

- Some laws limit the type of associations that individuals or groups can join or form. The Committee on the Rights of the Child has noted with concern that in Costa Rica, the Children and Adolescents Code denied adolescents the right to form or join political associations, yet they may form community development associations in which they may actively participate (CRC/C/CRI/CO/4, para. 37). In Turkey, children over the age of 15 may form associations and from the age of 12 may join those associations, but they must be 19 in order to form an organizational committee for outdoor meetings (CRC/C/TUR/CO/2-3, para. 38). The justification for explicitly excluding those groups from forming associations that engage in certain activities is unclear.
