- The Special Rapporteur also remains concerned by the failure of public authorities to protect Roma from violent attacks. That includes the lack of systematic intervention and condemnation by public figures when political and public discourse perpetuates racist and extreme views about Roma, and the failure of law enforcement authorities to protect Roma from the perpetrators of crimes against them. For example, a violent police crackdown on a Roma community in Slovakia in 2013 was condemned by a number of special procedures mandate holders, the United Nations High Commissioner for Human Rights, and the country's Ombudswoman. Nevertheless, the Minister of the Interior of Slovakia publically labelled the Roma victims of that intervention as criminals, and investigation into the police misconduct has been slow, with no charges brought against the police to date. Such failures by authorities to protect Roma adequately and to distance themselves from all manifestations of anti-Gypsyism not only promote a climate of distrust, dissuading Roma from reporting violent crimes against them to authorities, but also create an atmosphere of impunity and may encourage further acts of violence against Roma.

- The Special Rapporteur thus believes it is necessary to reflect on the lessons learned, both globally and in particular from the European experience, to understand better why existing approaches have not managed to bring about structural change. Although she recognizes that every Roma community is unique, and there is no blanket approach that will accommodate every community, she believes that drawing some general lessons from real examples may be helpful for all regions looking forward.

In Europe, Roma still experience heightened levels of disadvantage and marginalization. Outside Europe, the Special Rapporteur regrets that very little has been done to acknowledge the disadvantage experienced by Roma and few policies have been developed to address those concerns.

- In the United States, in 2013, the Federal Bureau of Investigation (FBI), Uniform Crime Reporting Program, recorded almost 6,000 hate crimes incidents: 48.5 per cent were racially motivated (66 per cent anti-Black, 21 per cent anti-White, 5 per cent anti-Asian, 4 per cent anti-American Indian or Alaska Native); 17.4 per cent were motivated by religious bias (59 per cent anti-Semitic, 14 per cent anti-Islamic, 6 per cent anti-Catholic); and 11.1 per cent stemmed from ethnicity bias (53 per cent anti-Hispanic or Latino biased).

- Social media is a fertile ground for radical and terrorist groups to spread hateful messages. ISIL uses online platforms, including Twitter, Facebook, Instagram and Youtube, to deliver updates on their actions as well as to reach out to potential donors and recruits, including posting videos and graphic material. The misuse of social media by ISIL has been described by the United Nations High Commissioner for Human Rights as "the product of a perverse and lethal marriage of a new form of nihilism with the digital age".

The Press Council in Bosnia-Herzegovina monitors the application of the Press Code and the investigation of complaints. In 2014, in the context of the general elections campaign, it launched the campaign "STOP! Hate Speech!".

- Some initiatives seek to involve ISPs in combating online hate speech, by advocating the implementation of reporting mechanisms for illegal material posted on their services, identifying hateful content that violates the terms of service or code of conduct of the ISPs and requesting the ISPs concerned to remove it. The Anti-Defamation League (ADL) has been actively involved in combating online hate speech through close collaboration with ISPs as well as law enforcement agencies, and providing training resources and educational materials on hate crimes.

Having local "eyes and ears" to report potential incidents offers valuable, community-based, early warning potential, although it remains reliant on a rapid response by law enforcement bodies to alerts if it is to be effective.

- While extreme nationalist, racist, xenophobic or radical elements may exist in any country, States which fully implement minority rights protections and legal, judicial and institutional safeguards are better placed to ensure that any illegal actions and incitement to acts of violence are prohibited and prosecuted according to the law. Hate-motivated activities are curtailed by legal prohibition and appropriate penalties and through a general societal rejection of them. The threat of prosecution and appropriate penalties is a major deterrent and preventative tool.

- The Government of Colombia consulted with Roma communities in the context of drafting national development plans for the period 2014 to 2018 and committed to implementing strategies to increase Roma visibility, improve their quality of life and provide for improved access to their social, economic and cultural and political rights. In Argentina, a local Roma NGO has been successful in initiating dialogues between civil society and the State, which has proved to be key in promoting the visibility of Roma culture.

- Despite those clearly defined international standards, Roma remain underrepresented or not represented in the public administrations, institutions and political parties of many States within Europe. - The term "Roma" refers to heterogeneous groups, the members of which live in various countries under different social, economic, cultural and other conditions. The term Roma thus does not denote a specific group but rather refers to the multifaceted Roma universe, which is comprised of groups and subgroups that overlap but are united by common historical roots, linguistic communalities and a shared experience of discrimination in relation to majority groups. "Roma" is therefore a multidimensional term that corresponds to the multiple and fluid nature of Roma identity.

- The Umati project in Kenya emerged out of concern that mobile and digital technologies had played a catalyzing role in the 2007-2008 post-election violence in the country. The project seeks to better understand the use of dangerous speech in Kenyan online space, by monitoring blogs, forums, online newspapers, Facebook and Twitter. From October 2012 to November 2013, over 7,000 incidents of hate speech in English and local languages were identified. They were shared with other Kenyan organizations responsible for countering hate speech.

- In Nepal, in the agricultural sector, Haliyas ("ones who plough") are labourers effectively caught in a debt bondage system. They plough the land, a task considered dirty. They are often forced to take out loans from landowners to cover personal expenses and are charged exorbitant rates of interest, making their debts extremely difficult to pay back and effectively trapping them in a never-ending cycle of submission. According to civil society reports, despite criminalization by the Government in 2010, the practice still persists and there is currently no legislation in place for the rehabilitation of Haliyas.

- In Japan, feudal society stratification during the Tokunaga regime (1603-1867) placed two groups at the bottom of the system, referring to them as the senmin (humble people): the eta (extreme filth) and hinin (non-human). Although the Emancipation Edict was promulgated in 1871 to include the senmin in mainstream society, the Burakumin, as their descendants are now known, continue to be considered as an outcast group, subjected to prejudice and discrimination, including in employment, education and marriage, and physically segregated in Buraku districts. Official figures estimate the total Buraku population to be 1.2 million; however, unofficial figures place the number at almost 3 million.

- The Council of Europe has launched an awareness-raising campaign entitled "Dosta!", which emphasizes the value of Roma for societies through an interactive website, on television, in school projects and training for the media and teachers. It also awards a prize to local authorities that have taken steps to uphold and protect the rights of Roma. The Government of Latvia informed the Special Rapporteur that, in order to implement the "Dosta!" campaign, its Ministry of Culture, together with the Latvian Centre for Human Rights, would organize an event entitled "Latvian Roma - between past and future" in April 2015 in Riga, aimed at eliminating negative stereotypes about Roma and promoting intercultural dialogue.

- The Special Rapporteur also includes disasters in her report, whether natural or man-made (see section H below). Defined as calamitous events that seriously disrupt the functioning of a community or society, disasters cause human, material and economic or environmental losses that exceed the community's or society's ability to cope using its own resources. These can be a result of spontaneous natural hazards, such as hurricanes, tsunamis, earthquakes, volcanic eruptions, and wildfires, or be a result of more frequent slow-onset and mega disasters such as recurring droughts or floods. Disasters can result in the devastation of communities, loss of lives, leading to displacement, or migration, and can also lead to more complex emergencies such as loss of livelihoods, famine, housing crises and medical pandemics, which can also lead to mass displacement.

- There is a need for integrated approaches that combine measures in different policy areas, strengthen political will at the national and local levels in particular and build mutual trust and an openness to learn from past mistakes. Inclusion programmes should not be limited to material improvements; they should also contribute to the empowerment of both urban and rural Roma communities, strengthen dedicated institutional attention to Roma rights and encourage Roma leadership in order to break the vicious cycle of discrimination and marginalization. Such programmes should ensure that Roma groups most at risk of discrimination and/or social and economic exclusion are also targeted and empowered.

- The marginalization experienced by Roma is often interconnected with disadvantage in the area of economic and social rights, often stemming from, or leading to, further impediments in civil and political rights and vice versa. However, the Special Rapporteur has observed a tendency of Roma programmes to focus on short-term, issue-specific projects that fail to adopt an integrated approach that addresses multisectoral disadvantage. Many measures and instruments focus exclusively on one policy area and are delivered through uncoordinated projects with insufficient connection to other, interconnected policies and funds. For example, housing programmes that tackle issues of adequacy, including ghettoization and segregation, that are not linked to employment opportunities will have little prospect for long-term sustainability. Comprehensive solutions should take account of intersecting discrimination that Roma face and ensure that programmes are developed in genuine consultation with affected communities.

- The Special Rapporteur further notes that the lack of accurate data on Roma populations has important consequences and directly impacts the ability to develop policies and programmes that comprehensively address the issues faced by Roma groups. Disaggregated data allows inequalities to be revealed objectively and demonstrated statistically, and provides clear markers by which progress towards targets can be monitored and evaluated. The lack of accurate data in turn contributes to a lack of evidence-based programmes building on clear indicators. Indeed, a recent European Union report acknowledged the impact of the lack of disaggregated data for Roma programming.

However, even within the European Union, where significant funds are dedicated to addressing Roma disadvantage, challenges remain. Firstly, within the European Union, not all of the available funds for Roma are being spent or efficiently invested and the level of expenditure on this issue, especially by new member States, is very small. This results in many cases in funds being directed towards short-term projects that are incapable of achieving any long-term, sustainable impact, therefore reducing their positive impact on Roma communities.

- The National Institute to Combat Discrimination, Xenophobia and Racism (Instituto Nacional contra la Discriminación, la Xenofobia y el Racismo - INADI) of the Government of Argentina coordinates the "Discrimination Map" project in collaboration with several universities. In 2013, the situation of the Roma was specifically addressed and Roma were found to be among the most discriminated groups in Argentina. One priority of INADI is establishing a dialogue with the Roma community in order to better understand their needs and challenges. INADI also sponsored a book on Roma history, legends and traditions and the documentary film "Roma - Gelem, Gelem" in 2015 with the goal of introducing a shift at the cultural level to combat racism against Roma.

- Although not all European States officially recognize 2 August as the International Day of Commemoration in Memory of the Victims of the Holocaust, the Special Rapporteur is pleased that the European Parliament has recently adopted a resolution on recognition of the memorial day of the Roma genocide during the Second World War and that that many States are moving in that direction. In order to better recognize the victims of the Roma genocide and to improve understanding of the situation of the Roma in Sweden, in 2014 the Government published a white paper highlighting abuses and rights violations of Roma throughout the twentieth century and showing the negative stereotyping and discrimination they continue to face.

- Nevertheless, across the regions, negative stereotypes of Roma persist, describing them as criminal, unworthy, unclean or aggressive. The Special Rapporteur has explained how hate speech, including negative stereotyping of Roma, is widespread in the media, including social media, and in public political discourse, and how Roma rarely have access to media or other means necessary to challenge those perceptions. Hate speech is not only a denigration of Roma identity, but impacts negatively on Roma community members' sense of inclusion in the national psyche. The Special Rapporteur therefore understands a key aspect of pillar 2 to include addressing hate speech through systematic intervention and condemnation.

- Studies reveal that poor reporting by the media on features such as ethnicity and religion involves, inter alia, labelling, selected use of data, generalizing incidents, negative stereotyping, giving one side of a story, use of derogatory words, mixing facts and views, absence of fact checking, and mismatching of the content of the text and headlines, images and sound. Lack of knowledge about ethnic and religious issues by media reporters, absence of in-house training, poor financial situation of media outlets, heavy workload and scarce time to prepare reports were highlighted as obstacles to good, unprejudiced reporting.

- In the Central African Republic, hate speech has been recognized as having played a role in inflaming and fuelling violence and has been described by United Nations officials as a possible precursor to serious human rights violations, including potential genocide. In March 2014, the United Nations Special Adviser on the Prevention of Genocide alerted the media that Muslims were being "deliberately and systematically targeted by the anti-Balaka" in attacks referred to as "cleansing operations". He referred to reports of hate speech by anti-Balaka (Christian armed groups) on public media referring to Muslims as "rotten potatoes" and public justification of their actions.

- The protection and promotion of Roma identity means that States have the obligation not only to protect Roma from forced assimilation, but must adopt positive measures that promote the distinctive characteristics of Roma culture, including language, history and tradition. That should be achieved through financial and technical assistance to preserve the Romani language, art, poetry, dance, music and traditions, including their promotion through the media. Roma history and the cultural contribution of Roma must also be recognized and taught in school curricula. In that regard, Roma must be given opportunities for self-interpretation and self-representation.

- The present report should be seen as complementary to the work undertaken by many other United Nations mechanisms. That includes the previous work carried out under the mandate of the Special Rapporteur on minority issues, in the form of thematic reports, country reports, communications and press releases. It also includes the work of other special procedures mandate holders, including the Special Rapporteur on contemporary forms of racism, racial discrimination, xenophobia and related intolerance, who has reported on the causes and consequences of racism against Roma (see, for example, A/HRC/17/40, paras. 5-25, and A/HRC/26/50) and regularly addresses challenges facing Roma in country reports (see, for example, A/HRC/23/56/Add.2, A/HRC/20/33/Add.1, and A/HRC/7/19/Add.2), the Special Rapporteur on the human right to safe drinking water and sanitation, who made important recommendations regarding Roma in her report on stigma (A/HRC/21/42) and in relevant country reports (see, for example, A/HRC/18/33/Add.2) and the Special Rapporteur on adequate housing as a component of the right to an adequate standard of living, and on the right to non-discrimination in this context (see, for example A/HRC/16/42/Add.2, paras. 51-56, and A/HRC/25/54/Add.2, paras. 69-71 and 74-75), among others. She also notes the role the United Nations treaty bodies have played in highlighting discrimination against Roma, particularly the Committee on the Elimination of Racial Discrimination in its general comment No. 27 (2000) on discrimination against Roma. Roma have also featured prominently in the universal periodic review of States before the Human Rights Council. The Special Rapporteur refers to her recently published review of minority issues in the first cycle of the universal periodic review, which highlighted that over 25 per cent of all minority rights recommendations in the review referred to the situation of Roma. Despite that important work, the Special Rapporteur nevertheless believes that the full capacity of the United Nation is not yet being used by Roma rights advocates. The United Nations should be seen as a core Roma rights partner whose work can complement other mechanisms. She hopes that the present report will contribute to such an approach.

- In Turkey, data indicates that the Roma population ranges from 500,000 to 5 million. In Ukraine, 47,600 persons identified themselves as Roma, according to 2001 census data, yet the Council of Europe estimates there are between 120,000 and 400,000 Ukrainian Roma. In Belarus, the 2009 census indicated a population of 7,316 Roma, but the Government recognizes that that number does not necessarily reflect the true figure, which ranges between 50,000 and 60,000. The 2010 census in the Russian Federation estimated that there was a population of 205,007 Russian Roma, although Council of Europe data suggest a larger population of between 450,000 and 1.2 million.

- In the post-9/11 era, Islam and Muslims have been subject to stigmatization and hostility in Western media. Certain media outlets have identified Islam with terrorism, which, according to the Special Rapporteur on contemporary forms of racism, racial discrimination, xenophobia and related intolerance, is a major driver of resurgent Islamophobia around the world (E/CN.4/2006/17). Despite many civil society organizations delivering pro-Muslim discourses after the September 11 attacks, anti-Islamic fringe organizations have exploited mass media to spread messages of fear and anger. The former Independent Expert on minority issues noted in a report (A/HRC/13/23/Add.2) that members of Muslim and Arab communities in Canada stated that negative stereotypes had been reinforced since September 2001, including in the mass media, resulting in their reluctance to engage in public debate or raise their concerns.

- It is difficult to talk about upholding the values of democracy and equality if certain groups are completely excluded from participating in or shaping that democracy in practice. If marginalized communities lack access to public platforms and communication channels, they have no possibilities to influence public opinion or to seek and obtain justice. Roma communities struggle to respond to hate speech in mass media from far-right groups and political parties, since Roma are almost completely excluded from mainstream media platforms. Where communities are regarded as inferior in any society, their voices will also be treated as inferior, regardless of how loudly they shout and how valid their concerns.

- The Special Rapporteur on the human right to safe drinking water and sanitation, Catarina de Albuquerque, focused her 2012 report to the Council (A/HRC/21/42) on stigmatization in the realization of the rights to water and sanitation. The report examines different manifestations of stigma in the context of the human rights to water and sanitation and explores recommendations for policymaking and solutions to prevent and respond to human rights violations resulting from stigma. The Special Rapporteur found that stigma pushes people to the margins of society and results in the rejection, avoidance and marginalization of certain groups. Access to water and sanitation for many Roma communities is notoriously precarious. Similarly, the report highlights that Dalit habitations are often systematically excluded from service provision.

Communities in Bulgaria, visited by the mandate holder in 2011, described paying more for energy from private providers and being unable to afford energy bills owing to lack of employment and low incomes. - Addressing inequality is an overarching goal that, if it is achieved, will inevitably bring with it benefits for disadvantaged minority groups across a wide range of other areas that the post-2015 development agenda consultations are addressing. The rationale behind such an inequalities-based approach is strong, however it must be driven at a global and donor level to overcome barriers of discrimination, power-dynamics, and lack of political will that are often evident at the national level. In the Synthesis Report of the Global Thematic Public Consultation on the Post-2015 Development Agenda focusing on inequalities, it is stated that "there is considerable evidence that inequalities in one structural domain increase the likelihood of inequalities in others. In the event of opportunity for improvements in one domain, the chances of progress are often undermined or rendered inaccessible by simultaneous intersecting disadvantage in another. These intersecting and mutually reinforcing inequalities are often rooted in historical relationships, and continue to be reproduced through discrimination in social, economic, environmental and political domains."

- Rohingya Muslims in Rakhine State, Myanmar, face discrimination, exclusion and denial of citizenship. Violence between Rohingya and Buddhists in 2012 left hundreds, mostly Rohingya, dead and over 150,000 displaced. The Special Rapporteur on the situation of human rights in Myanmar visited in 2014 and stated that community-based, political and religious groups had been conducting, with impunity, well-organized and coordinated campaigns of incitement to discrimination, hostility and violence against Rohingya and other Muslim minorities (A/HRC/25/64, para. 21). He noted the propagation of an agenda to rid Rakhine State of the estimated one million Rohingyas who lived there and concluded that the pattern of widespread and systematic human rights violations in Rakhine State might constitute crimes against humanity (A/HRC/25/64, paras. 45 and 51).

- Some States demand the declaration of religious affiliation on identity cards and other official documentation. The enjoyment of rights may then be precariously conditional on ascription to a closed list of particular religions or be utilized to ensure the impossibility of conversion and the denial of the existence of any other beliefs. Refusal to abide by such requirements may result in the denial of a number of basic rights: from the registration of births, marriages and deaths; school and university entrance; obtaining passports, driving licences, bank accounts and property; access to health provisions; and so on. The restrictions amount to violations that destroy the very foundations of minority rights. Compelling people to identify religion or belief on official documents undermines the explicit assertion developed by the United Nations Human Rights Committee that no one can be compelled to reveal his thoughts or adherence to a religion or belief.

- The Government of Brazil has established institutional attention to Afro-Brazilians in recognition of discrimination and the disproportionate socioeconomic disadvantage of Afro-descendants, including through its ministry dedicated to promoting policies for racial equality, the Secretaria de Políticas de Promoção da Igualdade Racial (SEPPIR). A statute of racial equality (law 12.288), adopted in 2009, reinforces State obligations to guarantee equal opportunities to Afro-Brazilians. Affirmative action projects combat structural inequalities, in particular in respect of access to education, health and employment.

- The National Cohesion and Integration Commission of Kenya was created in 2008, following ethnically based election violence, to "facilitate and promote equality of opportunity, good relations, harmony and peaceful coexistence between persons of different ethnic and racial backgrounds". It advises the Government, and its activities address discrimination on ethnic grounds and seek to promote respect for religious, cultural and linguistic diversity. The Ethnic Relations Commission of Guyana was created following ethnic violence between Indian and Afro-Guyanese communities to monitor and improve ethnic relations and observe political activities. It held cross-country, multi-stakeholder forums prior to 2006 elections, recognizing that elections had become an ethnic and political flashpoint.

- The Centre for Research on Inequality, Human Security and Ethnicity at Oxford University has undertaken detailed quantitative and qualitative research into conflict and horizontal inequalities (inequalities between ethnic, religious or linguistic communities) in 8 countries in three regions, and statistical desk research in 55 countries. The Centre concluded that in the top 5 per cent of countries with the greatest socio-economic inequalities, the risk of conflict is tripled when compared with the average. The risk of conflict increases again if socio-economic inequalities are combined with inequality in access to political decision-making, and inequality in cultural status adds a further risk factor.

- Preventive diplomacy can be most effective when tensions first arise between a Government and a minority, and they are relatively susceptible to third party engagement. Envoys may work discreetly, as the situation is not yet in the glare of national or international media. Parties may be willing to calmly present their concerns, and to explore possible solutions. When a situation develops from these initial tensions to actual incidences of violence, positions begin to harden and resistance to compromise grows. It becomes more difficult for leaders to make compromises as the depth of feeling and emotion among their constituencies increases.

- As an illustrative example, in the late 1990s the High Commissioner monitored the situation in the former Yugoslav Republic of Macedonia and became very concerned about grievances of the ethnic Albanian population, particularly with respect to access to Albanian-language university-level education and other language rights, as well as the right to run their own media outlets and political participation. He issued an early warning within OSCE and also took a project-oriented approach to easing tensions around the contentious language issue. The High Commissioner persuaded the Government to adopt a new language law permitting private universities to offer instruction in languages other than Macedonian. He then raised the funds to establish a new university that would offer instruction in Albanian.

- When violent conflict does occur in diverse societies, applying a minority rights-based approach to consultations regarding peace agreements will require that all communities affected by the conflict, including those that are not active parties to it, be able to participate in the settlement process. That approach should counteract a tendency common in many conflict situations, whereby Governments, and to a certain extent the international community, focus predominately on addressing the demands of communities that are linked to armed movements, which may result in peace agreements that guarantee rights for some communities at the expense of others. That outcome both rewards the use of violence and violates the rights of those not associated with armed movements.

- A prime example is the constitutional arrangement derived from the General Framework Agreement for Peace in Bosnia and Herzegovina and the Annexes thereto (Dayton Peace Agreement) (A/50/790). According to the Constitution of Bosnia and Herzegovina, membership in the House of Peoples and the Presidency are reserved solely to those who identify as belonging to one of the "constituent peoples". That provision has been found by the European Court of Human Rights to violate international legal protections against discrimination on racial or ethnic grounds, and specifically the rights of persons belonging to ethnic groups other than the Bosniacs, Serbs or Croats. Sustainable peace is highly dependent on the participation of all population groups in peace negotiations and resulting State institutional arrangements.

- The Special Rapporteur calls upon States to review their respective domestic legislation to ensure that it is fully in line with the Declaration on the Rights of Persons Belonging to National or Ethnic, Religious and Linguistic Minorities. She recalls the four pillars of minority rights protection that should be reflected in those laws: (a) the protection of a minority's survival by combating violence against its members and preventing genocide; (b) the protection and promotion of the cultural identity of minority groups, and their right to enjoy their collective identity and to reject forced assimilation; (c) the guarantee of the rights to non-discrimination and equality, including ending structural or systemic discrimination and the promotion of affirmative action, when required; (d) the right to effective participation of minorities in public life and in decisions that affect them. The Special Rapporteur wishes to stress that merely having non-discrimination clauses, according to which all members of the society are to be treated equally, without the aforementioned additional guarantees have often proven insufficient for effective protection of disadvantaged minorities.

- The Secretary-General has laid out a three-pillar strategy for the implementation of the responsibility to protect (see A/63/677), drawn from paragraphs 138 and 139 of the 2005 World Summit Outcome. The first pillar emphasizes the primary responsibility of States to protect their populations by preventing genocide, war crimes, ethnic cleansing and crimes against humanity (atrocity crimes). The second highlights the commitment of the international community to assist States to meet their obligations and to provide necessary support and capacity-building measures when a State is unable to meet its obligation to protect populations. Under the third pillar, the international community must use appropriate diplomatic, humanitarian and other means to protect populations from these crimes but must be prepared to take additional collective action to protect populations, in accordance with the Charter of the United Nations. The three pillars are not sequential and each pillar is of equal importance. They are also mutually reinforcing: while appointing a special envoy to a country to monitor a deteriorating situation is a response on its own, it is also a preventative tool as it might help to stop the violence from escalating.

- The Special Rapporteur observes that there are often underlying attitudes that contribute to the lack of focus on empowerment of Roma communities and organizations. They can be outright discriminatory attitudes, such as when decision-making authorities adopt the paternalistic attitude that they are better equipped to make decisions on behalf of Roma. However, there are also more subtle forms of bias, including the tendency to focus on Roma as passive victims of discrimination, which may have the effect of perpetuating erroneous assumptions about their inability to contribute to society. This in turn hampers the shift from a perception of Roma as primarily passive victims of discrimination to an acknowledgment of their role as active agents of transformation who can participate in policy decisions that affect them. The Special Rapporteur notes that effective, meaningful participation must be a transformative process that becomes an inclusive experience, facilitating Roma involvement, empowerment and active citizenship. Such a participatory approach must also guarantee that those whose voices are rarely heard are empowered, including Roma women and young people.

Women belonging to minority groups often struggle within their communities to advocate for their rights, which can be set aside as a result of the prioritization of the general concerns of the group. Barriers to the empowerment of some minority women, including lack of social or economic contact, networks or minority women's support groups, and scarcity of female minority role models have an important impact on the enjoyment by minority women and girls of their human rights. Minority women may hesitate to voice their gender-specific grievances even within their groups, let alone outside them. Minority women's rights could also benefit from increased attention by the broader movement for women's rights. In turn, the women's rights movement would also benefit from the specific experiences of minority women in their overall struggle for equality.

- Owing to multiple and intersecting forms of discrimination, specific challenges face minority women and girls affected by humanitarian crises. According to the General Recommendation on women in conflict prevention, conflict and post-conflict situations of the Committee for the Elimination of Discrimination against Women (see CEDAW/C/GC/30, para. 36), during and after conflict specific groups of women, including, inter alia, internally displaced and refugee women, women of diverse caste, ethnic, national or religious identities, or of other minorities, are at a particular risk of violence, especially sexual violence. These groups of women "are often attacked as symbolic representatives of their community". The Committee has further noted that stateless women and girls face heightened risk of abuse during conflict, owing to, among other factors, their minority status (ibid, para. 60). Minority women may be particularly at risk of sexual and gender-based violence and other forms of violence, including slavery and trafficking. The Special Rapporteur was deeply troubled and saddened when she listened to the testimonies of Yezidi women in Iraq of sexual and gender-based violence committed against them by Daesh, which acts must be fully investigated and their perpetrators prosecuted.

- The Special Rapporteur dedicated the first Forum on Minority Issues under her leadership, the fourth session, to the topic "Guaranteeing the rights of minority women". The Forum participants recognized that it was particularly important that the voices and views of minority women be heard and that they be consulted and have the opportunity to participate fully in all aspects of life, both within their communities and in the wider society. Barriers to the empowerment of some minority women, including lack of social or economic contacts, networks or minority women's support groups, and scarcity of female minority role models had an important impact on the enjoyment by minority women and girls of their human rights. The Forum considered specific thematic areas in detail, for example, the access of minority women and girls to education; their ability to take part effectively in economic life and to have access to labour markets; and issues relating to their participation in social, cultural and political life. It recommended that Governments should seek and encourage opportunities for women's participation and work together with minority communities as well as minority and women's rights organizations to develop and implement programmes to sensitize minority women about their rights, and men about minority women's rights. - During her tenure, the Special Rapporteur has promoted the work of and the recommendations emanating from the Forum on Minority Issues in other forums. As a regional follow-up activity to the Forum, she travelled to Banjul in April 2013 to attend the fifty-third ordinary session of the African Commission on Human and Peoples' Rights where, among other activities, she organized a public side event with the participation of Commissioner Soyata Maïga, who served as Chair of the fifth session of the Forum. That event provided an opportunity to brief the participants about the mandate and the Forum, and to share information related to minorities with different African human rights mechanisms. In November 2015, the Special Rapporteur organized a side event during the eighth session of the Forum to consider, inter alia, ways to improve the structure and working methods of the Forum, to share best practices on how to better mainstream its recommendations and to discuss how United Nations mechanisms, in particular the Forum, could remain relevant for and accessible to minorities on the ground. In October 2016, on the occasion of the presentation of her report to the General Assembly, she convened a consultative session in New York that served as an opportunity to discuss the draft recommendations of the Forum ahead of its ninth session as well as to raise awareness of the work of the Forum outside Geneva and engage relevant stakeholders in New York.

She has guided a total of six sessions of the Forum on the following themes: "Guaranteeing the rights of minority women" (2011), "Implementing the United Nations declaration on minority rights: identifying positive practices and opportunities" (2012), "Guaranteeing the rights of religious minorities" (2013), "Preventing and addressing violence and atrocity crimes targeted against minorities" (2014), "Minorities in the criminal justice system" (2015) and "Minorities in situations of humanitarian crises" (2016). Since 2013, the Special Rapporteur has devoted her annual thematic report to the General Assembly to the same topic as the Forum session, as a means to contribute to and inform the discussions within the Forum. The Special Rapporteur notes that the themes she selected for the annual sessions focused on areas that had emerged as particularly concerning or problematic for minorities and where they believed that minority rights should be better applied and mainstreamed. - The Special Rapporteur is concerned that in some regions and in several countries, minority rights protection is not seen to be important, or even relevant, owing to deliberate denial or lack of understanding of its legitimacy. There is a need for stronger awareness-raising on what the entire minority rights protection regime entails, that it also includes wide-ranging issues around religious and linguistic identity, and that the effective promotion and protection of the rights of minorities contribute to the political and social stability of States and, therefore, are always timely and important. It is essential to understand that majority-minority relations should be assessed not only from a national perspective but also specifically in the context of smaller territorial and local levels, where the dynamics and dimensions of identity, ethnicity, religion, language and access to power and resources are frequently more important and play a greater role in the daily lives of individuals and communities. The notions of "majority" and "minority" may be interchangeable and depend on the particular context, as a group that constitutes a dominant majority nationally or regionally may be numerically inferior and non-dominant in another region. Therefore, minority rights standards must also be applied to those groups constituting de facto minorities in the localities where they live.

- The United Nations in general should advocate more strongly for minority rights protection at both national and regional levels, to seek to ensure that States strengthen their legal, policy and institutional frameworks and that regional anti-discrimination and minority rights standards and mechanisms are put in place for the protection and promotion of minority rights, respectively. Equally, the Organization should consider strengthening existing mechanisms and platforms for minorities within the United Nations system, including the Forum on Minority Issues. It would be important for the United Nations network on racial discrimination and the protection of minorities to regularly update the Human Rights Council about its work. Furthermore, the establishment of a committee to monitor the implementation of the Convention on the Prevention and Punishment of the Crime of Genocide is long overdue and would assist Member States in complying with the Convention. It would also be crucial to appoint a high-level official on minority issues within the Secretariat as well to establish senior positions within United Nations departments and agencies to look into issues of minority rights protection, diversity management and safeguarding pluralistic societies. The designation of minority focal points in all United Nations field offices would be another great step forward.

- In her report, the Special Rapporteur emphasized that for minorities, language was a central element and expression of their identity and of key importance in the preservation of group identity. Language was often particularly important to non-dominant communities seeking to maintain their distinct group and cultural identity, sometimes under conditions of marginalization, exclusion and discrimination. Minority language rights and language use were frequently a source of tensions, both between and within States. Proponents of linguistic rights had sometimes been associated with secessionist movements or had been seen as a threat to the integrity or unity of a State. The Special Rapporteur pointed out that it was often only when minorities asserted their rights to identity and language that discrimination or persecution started. Fulfilling the rights of minorities, including their language rights, was an essential means to prevent tensions from emerging and was a key element of good governance and conflict prevention. If not appropriately addressed at an early stage, such tensions had led to protracted conflicts and deepening of divisions between linguistic groups. Where conflicts had ceased or peacebuilding initiatives were under way, it was essential that all groups in society should play a full role in discussions, negotiations and decision-making processes.

- In India, manual scavenging constitutes a caste-designated occupation that is mainly imposed upon Dalits, particularly Dalit women, who represent 95 per cent of manual scavengers. Despite the passing of the Prohibition of Employment as Manual Scavengers and their Rehabilitation Act in 2013, the practice reportedly persists, institutionalized through State practice, with local governments and municipalities employing manual scavengers.

Article 9 of the 1961 Convention stipulates that "A Contracting State may not deprive any person or group of persons of their nationality on racial, ethnic, religious or political grounds".

- Access to education continues to be a major obstacle for all Roma. The Government of Argentina has recognized the high levels of illiteracy and school dropout of Roma children. In Brazil, official data on literacy and/or school attendance of Roma children are lacking, but civil society organizations reported that very few Roma children living in camps have ever been to school, and estimate that 90 per cent of the Roma living in camps in Curitiba city are illiterate. Prejudice has also been identified as an obstacle for accessing public schools in Brazil, where Roma children are reportedly not given the chance to enrol on the pretext of a lack of space. A representative of the United Nations Children's Fund (UNICEF) has emphasized that teachers' biased attitudes towards Lyuli children in Central Asia may result in violence at school. The illiteracy rate among Iraqi Roma is very high and many Roma children there are forced to take on irregular jobs or resort to begging. In Lebanon, 68 per cent of school-aged children reportedly do not attend school because of significant obstacles such as discrimination, legal and economic barriers, leading to street labour becoming a significant trend among Dom children.

- In the context of her global study, she also wishes to draw attention to incidents of negative stereotyping of Roma outside Europe. For example, in Argentina, a now discontinued television series, Soy Gitano, focused on so-called "Gypsy crime". Although the Roma community in Argentina denounced the soap opera to the National Institute to Combat Discrimination, Xenophobia and Racism, the complaint was dismissed on the grounds that the series was fictional. A similar complaint was filed before the Canadian Broadcast Standards Council following a show which contained strong discriminatory statements towards Roma refugees in Canada. As a result of the complaint, the network removed the video from their web page and issued an apology. The misrepresentation of Roma in the media in Turkey was exemplified by a popular television series, Cennet Mahallesi, which presented highly stereotypical depictions of Roma. In the United States of America, a reality television programme entitled My Big Fat American Gypsy Wedding, a spin-off of a show of the same name in the United Kingdom of Great Britain and Northern Ireland, continues to be broadcast today. Both versions have been criticized for their stereotypical approach and for misrepresenting Roma culture.

- In 2012, the Council of Europe launched the "No hate speech movement", a campaign directed towards youth with the objective of combating online hate speech in all its forms. The campaign is part of the project "Young People Combating Hate Speech Online, 2012-2014", which aims to equip young people with competences to recognize and act against hate speech, racism and discrimination in their online expression.
